Fiscal EJ I have a queston about the gun shot to the person from the other person. Ex. X pointed his gun to Y then, X fired his gun to Y, X he missed to shot because mabilis nakailag si Y meaning hindi nya natamaan si Y Q. what case applyed to X it's attepmted murder or homicide murder?

Or let's say X fired the weapon but missed however Y died of heart attack because he was stressed? Or what if without using weapon, X kills Y with his fists shouting I'll kill you and X is a trained/professional martial artist? Will taht be taking advantage of one's strength thus proving intent to kill?

Hindi po ibig sabihin na dahil baril ang ginamit sa pagpatay eh murder na kaagad. Ang paggamit ng baril ay nangangahulugan lang na may "inten to kill" ang offender. Hindi po qualifying circumstance ng murder ang use of a gun. Nasa article 248 po ang enumeration ng mga qualifying circumstance. Pag wala po ni isang qualifying circumstance, homicide lang po ang magiging krimen.

Posible po. The element of intent to kill is present, qualified by the qualifying circumstance of "by means of motor vehicles".
