When Copying gets morally sketchy | Art + chat

  • What distinction is there between copying and stealing? The difference might seem obvious, but there are nuances that can put us in a moral gray zone when it comes to copying from our favorite artists. In the end it comes down to your personal ethical compass. If your work is inspired by someone else, say so. If you directly copied or even traced someone else’s drawing, it’s only ethical to clearly credit the person who created the original drawing/artwork or at least state that you are not using your original art. What are your thoughts?

    I always feel so terrible when I copy someone else's work. It really feels dishonest to me. I don't display it or use it in any way for personal profit, but I do use others' work to inspire my own pieces that I'll use to decorate my home or embellish a birthday card, or just see if I can do it, then tuck it away in a book with many others. I recently joined your channel and LOVE watching your videos. The way you speak and share in your videos makes me feel like you're sitting right next to me and we're creating together. Thank you for putting the amazing in your work, and yourself!

    1) I stumbled across your channel about a week ago and your drawings have ignited my creative spirit. After not picking up a drawing implement for years, I went out and bought a small notebook and a couple of decent ink pens. And I’m copying lots of elements of your drawings! But I’m NOT posting them anywhere, lol! Your techniques and instruction are simply infectious. The fact that so many of us are following you is testament to that. Thank you for making me feel like a real artist. I wish you could have heard what my husband said when he saw my sketchbook!
    2)There is a special ring in hell for those who appropriate others work and talent for their own glory.

    I totally agree, one painting i did someone's sister inlaw took inspiration and did a similar yet different take on it, you could clearly see the similarities in it but it was different enough to be her own which was the most amazing feeling especially because at that point i didnt think my artwork was very good. I was actually very shocked they thought it was that good that they wanted to do something similar!
    But if it was copied exactly the same it would have been a different feeling and is the same reason i share videos to hopefully inspire someone to see that one thing they can apply to their own unique creations 🙏💖

    I love your artwork. It is beautiful and I love the messages that come with it. I am very sorry that people can be so awful as to steal your work. I thank you for sharing your work and helping people like me draw and doodle with the knowledge you impart. Most people love to draw and doodle and if you can do this with some knowledge and be happy with what you have done that's a blessing and a very positive experience. I thank artists like you every day who put themselves out there so we can learn from your teachings.

    I, also, have been doing my own version of what is now called Zentangle since 1956.
    I find your designs quite inspiring and appreciate your honesty. You’re right. Recognizing and giving credit for inspiration has never hurt an artist. It only adds credit and trust to their own art. Thank you for such a good explanation. Vickie / STL MO U. S. A.

      Oh! I also write down the artist, date, etc on my inspired pieces. Plus thoughts of ways to color or what other materials go try a design/ pattern that might !Lol really cool. Mostly for future reference and to show who I learned from. The right thing to do.. Many artists in the past obviously borrowed from each other. And you are right, it IS a form of flattery!! But to blatantly take someone else's content without permission and call your own in order to profit off it is wrong! Ok sorry for the babble lol! I've tried "copying" many many other doodly art styles before, and my attempts always looked horrible to the point where I thought I was doomed. But I tried those fanned leaves from Aug 7th the other day, and they looked good. My brother even glanced at it and said "huh, I didn't know you could draw" and I've shown him lots of things I've drawn before... So thank you! Proper use of social media is sharing other creators as intended. Stealing content and claiming it as one’s own is just theft. Same goes for copying other art in the process of learning techniques and skills, but the line is crossed if someone sells the copy as their own original art. Your work is lovely and greatly appreciated.

    I can not thank you enough for your, art, wonderful instruction, the calm I feel when listening, watching and learning from you and the art you are so willing to share. Because of multiple issues with my spine, I have had to give up the many artistic persuits I have found great joy and pride. The litany of those pursuits as well as those I found suscess in, mainly painting florals in watercolor ( I love painting and drawing leaves) I can no longer enjoy due to the limitations of my back and neck.
    I found your wonder art, I love shading and just doodling. I always have pencils and ink pens and have a collection of drawings pinned up on the walls of my art room. I carry a small art journal with me now all the time. Yours lit up my mind and I thought "could I do this"? Well yes I can, not with the gentle flowing of ink to paper you display. But when I do copy and practice your work dispite the fact that they are nowhere as beautiful as yours, I always feel like Im stealing a portion of you. Thank you so much for not only knowing what I do is ok with you, but learning a new skill from you and honing my own. Copying has been a part of how we learn to make art for as long as people have made art. Sitting in museum galleries sketching from the collection was, historically, an important part of any artist's education and training. Unfortunately, that historical practice has fallen by the wayside.

    I am a writer. On several occasions I have had people blatantly steal what I have written and claim it as their own in public and even in published works. They didn't even have the sense to hide it! I have had people take credit for my artwork and photography as well. Obviously, artists inspire others. Why bother doing anything if it isn't inspirational? There is a big difference between being inspired to try something and replicating something with your own name on it. You can't let it make you bitter or stingy though. Give what you have gladly. Creating is risky business! You have a great attitude about it all. :)

    so sorry that you had to go through that.. my son is an digital artist and gets commissions and that is how he makes his living. some body stole his images and even went so far to put his own name on the images and tried to pass them off as his own art. however.. my sons work is quite recognized and people started messaging him to tell him what this person had done. what a mess trying to get that all straightened out legally. it made him so upset.. and of course it would. I enjoy your videos so much.. you have been such an inspiration and are the reason i have delved into doing zentangling. i have learned so much in the last week.. you make it look so simple. i did indeed do one of your tutorials... and shared my result on my facebook page. it was different than yours, because i dont follow instructions well.. lol.. , and i told everyone that it was inspired by a video tutorial on youtube, however did not name you . ( im old and had forgotten your name to be honest as you were just one of many zentangle videos i had watched before settling on one to learn from ) i will go back and change that though, to make sure that my friends know who to look for on youtube. you do awesome work and i am so glad there are people like you that are there to help people who are new to this kind of art to find their focus. Only a couple of weeks since i discovered this zentangling and i am currently participating in the Inktober 2023 and loving it... that is because of you. thank you. :)

I also do my best to share the inspiration behind my work, mostly because I just want others to be inspired like I was.

      i also forgot to mention that i do not sell my artwork, but keep it in a file along with my colored pencil, pastel and watercolor projects. i used to do a lot of pet portraits back in the day, and made some nice pocket change, but took a 35 year hiatus from drawing while i raised kids and worked full time. now that i have retired, i find i have more time to find that creative side of myself again. i have branched into a bunch of interests to find one that really grabs me..sadly the talent that used to flow so easily for me has got rusty ( like my joints and eyesight have..lol. ) so it takes a bit more practice to relearn what i used to know without trying. 3 dimensional is a real challenge for me now. and i want to learn the weaving and knots patterns so i can do celtic crosses and so on. you have a wonderful day. :) @@betsi_jae

In the near future I may have the opportunity to display artwork that incorporates your "techniques" at my church or other local venues (but never online). If so, I would want to give you credit in some way, if that is appropriate, possibly in a little backstory note about my inspiration or creative process. @Miss Betsi Something that's morally wrong can be just as bad as stealing. The people who copy your art down to the circle (you draw circles 😊) may not be getting financial gain but they are still getting visual gains. People are thinking that picture belongs to the thieves advertising it which could hurt you down the line. What if people are looking at the thieves as the originator and come after you as the thief? Don't apologize for feeling however you feel. I can appreciate you giving thought to what's going on despite your feelings about it. Emotions aren't logical so it's good to go over things logically. Just as there's a thin line between love and hate, there is a thin line between admiration and thievery. Thank you for sharing. I think the problem is that if someone saves your video on TH-cam it can save it as public in the account that saves it. I didn’t even know I had a channel until I found out that I had 13 followers! I think that TH-cam shares stuff that folks have saved for their own use not knowing that it was saved as public in their account. I know their are people that do steal content but some times they don’t know their saved videos are being posted by the TH-cam algorithm. Just a thought.

    I sale cards, I use stamps, I don’t copy what I see with the stamps or reproduce someone card. I make it my own and put my touch on it I can’t even make the same card twice and I have a lot of cards. When doing pattern drawings even if you copy someone’s drawing it can maybe look like it but it will never be it because it’s done with a different hand. So I do see we’re your coming from and understand also to make something your own from something you see has to be changed 80% and that makes it yours. So if your going to change something just do it 100% and then it’s inspired by you and a credit to you would be nice.

  • @Solitude11-11
    @Solitude11-11 ปีที่แล้ว

    Thank you for this, it really clarified some of the thoughts I’ve had floating around my head (they do that at lot 😂)
    Thinking about it, virtually every artist is inspired by, learns from, or is taught by, another artist. You very often see it being talked about even with the great masters throughout history. And techniques and tools are definitely learned.
    My grandmother taught me how to use oil paints. I used her technique for painting eg trees at first, but I never copied her subjects, I was inspired by different ones. I was hugely inspired by Aubrey Beardsley at one time, I used his technique a lot, but never actually copied his subject matter. I still have that inspiration many decades later. I think that’s why I like your art so much, there is something about it that feels similar.
    Of course years ago before social media people could get away with outright copying other people much more easily, as long as you weren’t exhibiting in a prestigious gallery you could copy a painting and sell it and no one was any the wiser, I’m sure that went on. Now everyone wants clout on social media and many don’t care whether the clicks and likes are actually for their own effort or just for reposting someone else’s. Which is sad, because they are kidding themselves, and somewhere deep down they know that.
    Out and out stealing for profit is a different thing, and that’s always happened, with everything. Many artists, particularly makers of sculptures and art dolls, are having their photos used by Chinese companies who scam people into parting with cash for something they never get, it’s a huge issue and all over the big selling sites.
    You are right about people taking inspiration making you happy, it really does. Teaching something to someone and seeing them succeed is the best 😊

    • @betsi_jae
      @betsi_jae  ปีที่แล้ว +1

      Wow! Yes, there are so many problems going on out there in the art world and there always have. It’s unfortunate that people’s gorgeous photos of their own work are being used in overseas marketplaces.
      I used to be a crochet teacher, so I started a presence online back in the day so I could share inspiration and patterns with my students. Even then, I would search google images for copies of my patterns and I would find them all over the place. I even found a blog where a woman claimed that she was using her own original pattern 😂. I laughed and moved on. What was there to do?

    • @Solitude11-11
      @Solitude11-11 ปีที่แล้ว

    thank you so much for the wonderful drawing you just did and for the inspirational conversation. Having never tried art of any kind until almost 3 years ago, I didn’t even think I could draw a stick figure. Then I found Zentangle and I am amazed at what I have created over the last three years, but I still am lacking in thinking up my own ideas to draw so to speak. I follow lots of videos and like you say they come out quite different than the original, but I always try to tag the creator because I couldn’t even think of claiming it as my own. Like others have said in the comments I read, if you ever see anything that I have done, and I’ve crossed any lines, please be sure to let me know, because it would be purely unintentional. Even after three years of drawing, I still rarely can just put pen to paper and draw first line and see where it goes. I am learning 😂, But at almost 77 years old, let’s hope I learn soon although my mother did live to be 102, so I may still be around for quite a few years. 🤪❤️

      @betsi_jae  11 หลายเดือนก่อน

      Not at all 😊. Truthfully there would really be no way of knowing if they arrived at the design on their own or by "copying" my work. All I know is that I spend hours and hours and hours on my work, so if someone plagiarized it, I would definitely know. By looking at the details and the quality of the strokes I can tell if it's my work or not. No one else would know, but I would know. I see lots of people using my tutorials on Instagram. Some even go on to sell some of their drawings. It actually doesn't bother me. It may look somewhat like my work, but not identical. My actual completed work looks even more refined that the doodles and drawings I make tutorials for, so in the end I'm not worried about it. Feel free to make some cool drawings and list them up on your etsy💕. I would just appreciate it if you don't just copy my drawings line by line, and sell only the works that are your own original compositions. 👍

    Miss Betsi better more accurate legal (and art world) terms to use are "Plagiarism" and "Copyright Infringement" not just stealing. Plagiarism and copyright infringement are defined very specifically in the US federal laws/acts: Copyright law, Visual Artist' Rights Act of 1990 and Intellectual Property Rights law. Someone doesn't have to intend to profit from plagiarizing another artists' work for it to be plagiarism and/or infringement...
    The #1 protection for all visual artists is to sign your finished work (including sketches/drafts) and put the copyright symbol after your name or initials. That informs anyone seeing your work that you not only signed it, also that you know your legal rights and are putting folks on notice that it's copyright protected.
    No, you do not have to register your work with the US Copyright office for the copyright of your work to be official or 100% protected/legal.
    Visual works of art no matter the size should always be signed on the front of the work. Not just the back no matter what a collector, curator, art agent or gallery owner says. Sign the front of your work! Even if you hide the signature in the work. And always add the copyright symbol even if you don't add the date (month/year). You can add the date on the back of the work...
    Visual art includes sculpture, paintings, drawings, prints, photography, collage, installations... Just sayin...

      Of course! The matter of copyrights is a whole different beast. It's always a good idea to be aware of how all of that works and to stay informed of our rights. Unfortunately, despite anything we may do to protect ourselves against blatant infringement, it's often the case that without the money to pay a lawyer then we just aren't able to protect ourselves. I steered away from discussing those issues mostly because when it comes to copyright, every person's situation will differ. I'm not a legal advisor and I don't want to give people advice that may not apply to them 💚. I was mostly focusing on the ethical implications of regular folks like us copying from each other. 😊

      @betsi_jae Actually you don't need an attorney in most cases of "theft", copyright infringement and plagiarism... A simple cease and disest letter from the artist will usually do it. Whike you may not have wanted to get into the weeds, your viewers reading the comments will benefit from the info.
      I've been doing this professionally as an artist, instructor, curator... for 40 years, and it still amazes me how much artists refuse to research and apply this important business side of their creative craft/profession.
      Also, it's copyright ©️ law that protects us first. Ignoring it makes situations like yours common place and annoying.
      There are tons of FREE legal services with real/liscensed attorneys who specialize in "art" and copyright law for artists out there. For instance, TALA, Texas Accountants and Lawyers for the Arts is one. They offer regular free online and in person talks. They have free or very discounted fees based on income. Many large cities have organizations, free law clinics and services like this. So, if anything ever gets serious, we have affordable legal resources.
      Oftentimes, some lawyers will represent artists pro-bono, especially if only a letter needs to be written.
      I and other artists have traded artwork for legal services. 😉
      Mentioning copyright infringement, Artists Rights Act and Intellectual Property phrases is NOT giving legal advice. It's passing on general real information most artists are totally unaware of.
      As I said in my first comment, the term "theft" isn't always that straightforward, accurate or sufficient.

    Now watch one of those idiots copy-pasta from this video saying it's their own. If you're worried about them enough, you need to either put a big signature on something or watermark it. At least that makes it a bit more clear as to where it came from.

    • @betsi_jae
      @betsi_jae  ปีที่แล้ว

      I completely agree. I've unfortunately been ignoring the watermark thing on these videos, but on my Instagram content I always always include my name etc. I really wish I didn't have to do that, but it's part of the game.

    Good reason to stop using instagram. (I’ve never used it.) I only watch youtube for art tutorial content, political news information and comedic entertainment. I do not have my own channel. The rest of my ‘freetime’ is for creating my own art which I do not share on social media. I have no need to. People who scam artists out of creative content is very easy for them to do if you show the whole finished piece on your channel. I believe Annie Reiser, a professional botanical illustrator has a copyright statement at the beginning of her zentangling videos. Others who are Certified Zentangle Teachers also include this copyright statement. You might consider adding a statement like that.😊🙏

      You make a lot of excellent points. I have certainly considered adding a disclaimer but I feel like a disclaimer will put people off 🤔. I will continue to consider my options, and I will likely reach out to more experienced artists to find out more about how to protect myself and the work I do. Thank you for sharing your thoughts 💜💙💜

    For art when does copying become stealing is a subject that is not easy to define. There is a video here on TH-cam called How To Steal From An Artist Roy Lichtenstein on a channel called The Canvas which discusses this subject. I found it interesting but I do not agree with everything he says.

    I always and would always ask to recreate your pictures. And I also am sorry people have thieved your drawings. I don't have Instagram. But I would like to know if I could recreate this image or pattern you are creating now in this video. I'm not sure if I will post it but if I do I will tag you.

    Copy, or inspiration from someone else's work. I am inspired by others and have been known to re-do what I see in my own style.
    Bob Dylan and Santana are classic examples of plagiarists. Thieves. They are not copyists.

      Exactly! It’s cool to copy, to be inspired 🦋. Some people out there just don’t bother and they take what was created by others.

      Dear Betsy, I have just heard a very intressting and informative Podcast of Monet.
      When He started to study art He had to go into the museum and copy the pictures that hung there actually all students were busy copying.
      ( but He hated it because he wanted to paint his own style ). The reason why I am writing this is how did the pictures of All the copy painters look.
      So you see it is not new that artists copyed other artists.
      I hope I helfen a little but they did not have Instagram. Wait a little while when KI is going to start copying us.
      Have a nice weekend many greetings Christiane from Berlin Germany in the overheated City ;-)😉
