    I cannot imagine how utterly hopeless Maya and her family must feel. The system has continually failed them, and failed them in an unbelievably overt manner. This judge is yet another example of this… 🤦‍♂️

      The plaintiff's attorney hasn't presented anything yet to show negligence on the part of the hospital. It's all in what the court order states. The hospital had to comply with court orders.

      Nay, the plaintiff seems to want to flood the court with video, 1thousands of documents, and not following procedures. He is an ambulance chaser.

      Watching the judge rule in favor of the plaintiff in one of the preliminary motions…looks to me like he rules in their favor when they are right; i.e., he’s not biased. He is just reacting to their propensity for being less organized, more “flaky,” and generally wasting too much time. (I’m watching the whole trial, in chronological order-AFTER the verdict. Maybe that affects my perception?)

      @@Shooshie130 I am also watching this in order after the verdict and I 100% believe the judge is on the hospital’s side. If you pay attention to each episode and tally up both sides, he sustains almost EVERY objection the hospital has and overrules almost all of Maya’s lawyers. There were plenty I seen that were absolutely relevant that he let be objected because he sides with the hospital. I fully believe he only allows Maya’s lawyers some leeway so it don’t look too obvious that he isnt being fair but it has been noticeable since day 1.

    I have really been trying to not feel this way… BUT I’ve watched this trial in its entirety and the judge seemingly makes efforts to be rude to plaintiffs side.

      Blatantly rude and biased. I am blown away by how disdainful he is toward the plaintiffs counsel and how he rules 100% of the time for the defense.

      I’m hesitant to say flat out biased because he has indeed sustained some objections for the plaintiffs and overruled some from the defense but it’s his attitude towards the plaintiffs side that is so blatant. He does not display that rudeness towards the defense. That’s the way it is. Sad to see it.

    Does anyone else notice the judge? I'm concerned. He seems to almost get annoyed with the familys lawyer, and is making their case harder than it should be. That poor girl. The hospital failed her and now the JUDGE and judicial system. I'm praying for Maya and their family, may they receive punative, pain, and suffering and more.

    It's just crazy to me that JH billed the Kowalski's insurance for CRPS from the beginning of her stay, yet they denied that she had CRPS in order to accuse the mother of CA. Now, the hospital is saying that they had nothing to do with it. They blame CPS and the Kowalskis, or the doctor who was contracted, yet take no responsibility for their own actions - like billing the insurance company for a condition they denied she had. Their culpability just seems so obvious, to me.

      I would not be surprised if the insurance company goes after JHACH now for compensation. THey didn't previously because there probably wasn't proof enough. Now that the billing has been proven fraudulent, they have a WAY better chance of getting their money back.@@jackielove2737

      Yes, I posted that same thing about this judge not seeing these comments. Very biased and this hospital is terrible in that they do not treat the child as an individual. When you work with children, you do show compassion and treat medically. To treat a young child the way that they did is scary and causes emotional issues for that child.

    had an open mind going into this and still do. I never saw the documentary and both sides are making legitimate arguments. I am flabbergasted at this judge whom CLEARLY is biased to the defense. He is the worst judge I have ever seen! He actually seems contemptuous to the prosecution at times. He needs reported and if the prosecution loses they need to send the videos with their appeal as I don't think they are getting a fair trial at all.

      Judge silenced Maya prior when she wanted to speak. Wouldn’t let this trial go ahead. May I suggest you watch the documentary. Then you will see the role the courts namely Judge Howarth and this judge behaved. This is not prosecution as this is ligation for punitive damages.
      This is not a criminal trial sadly, if it was Sally Smith and Judge Howarth would be trial on for murder.

    my story is nearly exactly like maya’s. i have crps, went to the same exact hospital just a year or 2 later than her, and still had to fight really hard to get them to prescribe me ketamine to get me out of my quadriplegic state. thank god they didn’t seperate me from my family (likely bc they were already battling maya’s family) but i heard them talk negatively about me and my family. they also told me it was all in my head, and told me to get up and walk while i was paralyzed in a wheelchair, bc they didn’t believe me. i had to fight to get my meds. i then saw dr. hanna like maya and he saved my life. maya’s situation saved my families lives, but i wish none of her family had to go thru that. i thank maya so much for raising awareness about crps and for fighting so so bravely for the justice they deserve.

    I watched several trials, and with that said, the residing judges. However, I never felt such a dislike for a judge as for this judge on Maya's case. I can't pinpoint why that exactly is. Is the judge biased or just rude to the plaintiffs in general? I'm not sure, but I know for a fact that this judge provokes a strong antipathy in me!

      I have actually participated in several Trials, and I have never seen such an incompetent Lawyer. The Judge has had it with the Family’s lawyer, because he is unprepared and and is constantly revisiting issues that the Judge has already ruled on.

    It is disingenuous for John Hopkins to make a referral to the Department of Family Services, stay in contact with DFS, have them do the hospital 's bidding, and the wash their hands of Maya's treatment in the hospital. "It wasn't us. It was all Department of Family Services fault. We have clean hands." What a slick way to avoid liability. It appears all the hospital did for three months was provide OT and PT services and bill her insurance company over five hundred thousand dollars for a condition the hospital denied she had. This judge is extremely biased against Maya's team of attorneys. The hospital forced pictures under threat of never seeing her mother again. I guess that threat became a reality. They refused to allow her priest to pray with her. This is against the patient's bill of rights. We don't lose our religious freedom because we are hospitalized. I hope Maya gets every penny and more.

      Absolutely agree on your first point and it has been bothering me throughout the trial. Over and over Johns Hopkins tries to make themselves out as having their hands tied by the court, but the court wouldn't be involved if they didn't bring DCFS into the mix.

    I too have CRPS and she had the 3 of the top 5 drs!! Experts!! K has been used OVER 25 years + successfully with CRPS! It’s not well known or many treatment options. They did not confer with the experts but billed a half a million to the CRPS billing code! Negligent negligent negligent. Stop the bias of this judge! We support you Maya and family. Justice for the family

    What hasn’t really been addressed is the fact that the mother was polish, with a polish culture. They communicate differently. She also had to communicate in English, when her first language was polish. They are very “as a matter of fact” direct commutators. Her advocacy for Maya seemed aggressive to the doctors and the ones that removed Maya, due to her cultural differences. She seemed aggressive but she was just trying to communicate.

    I can’t imagine how Maya, her and father feel. I have watched every trial day. I hate to say I feel this judge has already , silently, sided with the hospital system and it makes me sick. He almost always sides with them. It’s sad. My respect for this judge is declining. Stay strong Maya and family.

      That’s their argument though, that yes they saw red flags and yes they started proceedings to separate the family and refused the previously prescribed care for Maya - but they’re justified in doing so because they’re following protocol. Their whole argument is that they did what they were meant to and what happened as a result is not blood on their hands - they were justified 😢

      The jury decides the case, not the judge. If judges had that much power in jury cases, Nikolas Cruz would have received the death penalty. That is his courtroom and he runs it as he sees fit. The plaintiff’s lawyer is not at all prepared and incompetent.

    I am disgusted by this Judge. Is he the one that ruled no Punitive damages? Was this not appealed to the Supreme Court? It seems like retaliation on this Judges part. He is a soo condescending. I want to shake him, and say be nice.

    The judge talks to the prosecution very differently then how he talks to the defense. I really think he needed to recuse himself after the hearing where he refused to let maya hug her mom, and refused to let her speak.

      I keep reading on comments about this hug situation. Did this judge oversee the DCFS compliant prior to Beata's death? Seems like he shouldn't be judging this case if his decision to keep Beata away from Maya may have contributed to Beata's decision to unalive herself. I mean, it's impossible to prove that, but him being that close to the case prior to Beata's death makes me feel like he wouldn't want the plaintiff to win b/c he would've been an active participant in her demise. They need an unrelated judge overseeing the case. IDK, maybe I'm speculating.

    Relieved to see in the comments that I’m not the only one who thinks this judge is the worst. He’s rude and clearly biased. I would be surprised if plaintiff won this, not because of the case they presented but because of his clear bias. This is disappointing and frustrating 😢

      Thankfully he is not the one making that decision. It is the jury! They decide on damages\ $$$ etc. So, hopefully they see it the way most do online watching this case because this judge and defense team are disgusting!

    A case similar with another CRPSr with MALS a Houston hospital tried to do the same. Rare diseases and the systemic complications must be handled differently with experts consulted.

We fought to get our kids back for 3 years...just for year 4 the state to come back after they lost our appeal saying that they never had the right to take our child in the first place AND one of the things they accused us of doing the accusing hospital actually did. 🤯 🤬🥴 our child didn't have crps but another condition that was missed at birth and then at 5 weeks old taken due to symptoms of that condition. (Rickets and eds was the cause)

    Thing is not so complex as it seams.. if you going in details, focus is far away from point.
    And the fact is:
    》premature staff decision to include dcfs
    》evidently lack of knowledge about CRPS
    (Which is HUGE impact on Whole this situation)
    》 denied of diagnosis
    》invoices on half million dollars named on - treating CRPS.
    Its enough.

    I was surprised by the jury questions yesterday. The one with the gal from the church, "did the dark people tell you you couldn't pray with Maya?" And the other was asking the expert psych evaluater, "knowing what you know today would you still use the word warehoused when describing Maya's hospital stay? Both seem telling of what some of the jurors are thinking.

    The movie broke my heart, all the move was trying to do is getting her daughter help, I've taken Catamine drug before for my joint pain and it help for awhile, the side effects where awful, I pray the family wins.

    Based on the judges attitude this far I have held a firm belief that he is biased towards the hospital but after watching all of this and removing my own sensitivities I am inclined to believe he just has an attitude and shows his annoyance when he should not.

    Why wouldn't the hospital let her Priest pray with Maya. Most hospitals have pastors or allow religious leader in to comfort and pray with patients. The aunt wanted to give rosarie to Maya and wasn't allowed. I don't get that 😕

    I feel for this family however Maya’s mother is selfish. How is taking your life going to benefit your daughter and family? She made their lives worse by killing herself. I do believe the system and the hospital were evil but why kill yourself??? Now life is devastating for the kids and husband. The hospital needs to be held accountable for what they did but I do not believe they are responsible for her death.

He needs to recuse himself immediately!!! If this trial is over now & things didn’t go the way they clearly should have, then we need to fight for this family to have a fair trial!!!!

    Unfortunately, DCFS is to blame not the hospital. It’s apparent the referral was made in good faith. And they opted to drop the DCFS worker from the case, as a legal strategy.

Furthermore we’ve only scratched the surface of what their failed duty of care.They physically isolated her for 48 hours in darkness refusing to even toilet her as a “test” on whether she was faking,

      DCFS wouldn’t even have been involved if not for the hospital. The hospital didn’t listen to the parents or her prior doctors. They should have let them leave when they wanted to and none of this would have happened.

I don’t know if it was a scheduling issue with witnesses and they took advantage of that time and used it for this or if the judge decided they had a lot more to talk over that he didn’t want to have the jury sitting idle waiting etc. they seemed to have a lot to discuss and fight over with exhibits and wording of things. I think them meeting will make the trial run a little more smoothly with less side bars

      I can't decide. My understanding is that he denied the plaintiff's a trial initially, and they had to appeal it to sue the hospital. If that's true, another judge should be presiding over this trial.

      No, he did not. They won on 6th cirtcuit(?) appeals court. 100% should not be presiding over this trial.

    The Judge is completely biased for the defence! Its so obvious to all, a pity the Jury won't see the way he treats and speaks to the prosecution before they rule. The hospital did in effect "take the child away" before any court orders!! They were also negligent in providing the mental health services!
    I hope this family wins this, they deserve to and the hospital deserves being exposed! RIP Beata

    That hospital and their attorneys had to sign off on getting custody of Maya even through DCFS they had to help DCFS get chain of custody of that said child to keep her in the hospital
