  • The family of Maya Kowalski, the subject of Netflix’s “Take Care of Maya,” allege that a report of child abuse from Johns Hopkins All Children’s Hospital led to Beata Kowalski taking her own life. The Kowalski’s are suing doctors, the Department of Children and Families, and Johns Hopkins All Children’s Hospital for $200 million dollars in connection to Beata’s death. According to court documents, the child abuse case against Beata was pushed forward after Maya’s physician confirmed her condition, complex regional pain syndrome, was not the fault of her parents. During the time Beata was separated from Maya, she took her own life.

      Is this the documents the plaintiff was asking for for proof about the evaluations? The plaintiffs have the one from 2019 I think, and that back dated back to 2015?

      Let's see JHH 53 Lawsuits since 2012 The original court order never said Maya's mother wasn't allowed supervised visitations? This Judge wants them all out of his court room. Oh my goodness gracious JHH is certainly in hot water and it's a Children's hospital ? Please let that sink in for a few minutes 😢 oh my goodness gracious. 😢

We got a blessing there’s no problems we’re doing great we’ve always done great you are to the jury. We’ve always done great and it’s insane that they had someone why they knew he was lying up there and they tried to say the heart foundation. I’m so sick of their lies. Slide to the Austrian gotten caught so many times these questions are not good for the defense and why should a juror be punished and kicked off the jury because of a question that was asked because they dared to ask a question which they’re supposed to be able to do so.

    When hunter said I buried this a long time ago. shows how decietful the defence is. Also the review they cannot seem to find of beedy. They 100% have that i think just hurts their case. Its shady lawyering. I'm glad they got caught out. Makes you wonder what else hasn't been turned over??
    Judge Carrol is great for pushing them to give more information. The lady lawyer keeps talking over him and whitney. Very unprofessional. She sat there trying to Gaslight him the whole time.
    Also the call from beedy to beata is the exact same voice as on the call with maya and her mum. i hope they play both tapes to them side by side. The lady that said was her voice is commiting perjury and its clear as day.

      mountains out of molehills. It was buried from his brain, ie recollection. I have read that the finding was sealed. Bedy performance evaluations are the last gasp of the plantiffs. She wasn't a nurse and did not provide medical care.

    Federal inspectors identified widespread problems and declared the hospital had put patients in “immediate jeopardy” of harm. The hospital signed a binding 12-month agreement with the government to avoid being cut off from public funding. Patient safety.... Jhatch widespread systemic and agrecious issues 😢

      Johns Hopkins Hospitals are world reknown. Why did family take her there so often? Hospitals in Sarasota and Tampa closer to their home in Venice.

    I believe that any parent would have been overwhelmed and stressed out from their child being kept away for an indefinite time. And not even a hug allowed by court. SAD. .she was in my opinion giving up and loosing her child and the hospital started the downward spiral of her action ,making her feel insignificant and etc..as a mother

    3:16 The newspaper started an investigation because of reports of so many babies dying following heart surgery. This got the attention of the federal agency that reimburses the hospital for medicaid/medicare. They investigated and determined there were hospital wide issues resulting in the IJ grade. The hospital did not self report . The report is public, the hospital surely has it and the newspaper published it.

      Did you try googling the address of the JH Heart and Vascular Institute and the JH All Children's Hospital? They are not in the same location, do not have the same doctors, nurses, and other staff. One has nothing to do with the other except owned by the same company.

      Not entirely accurate. The newspaper published the follow up report, as the witness testified to yesterday. Yesterday's witness has never seen the original report with the IJ finding as the hospital has it sealed, which he also testified to yesterday. On top of that, Hunter hammered the witness several times on cross yesterday that he had never seen the report, which Hunter would know as he knows that the report had been sealed. The judge then ordered that the original report and everything even remotely related to it be turned over the plaintiff.

      I agree. However, he has been dealing with this case for years. Once it reaches the appeals court he is done or so he hopes. He will be retired by the time it comes back around.

      Trials have time limits and lawyers have to be wise about how they use it. Judges have other cases to tend too, can’t have trials last months.

    No matter how the jury votes, this case will be appealed higher up by the loosing party, it probably will be another 5 years before anyone sees any money or it gets another jury or gets further appealed. The cilvil lawsuit system is absolutely insane.

      That’s the saddest part. When it’s all said and done, Maya’s family will need all the money they get to cover these legal fees and the impact on them will be worth every penny. But sometimes someone Hass to really speak up and I think Anderson said at the beginning that he was aware this is the only way to get their attention. If an entity only cares about money, then money will get their attention. The Kowalski see more motivated by the injustice than financial gain.

      Shapiro really screwed up! Last night I went back and listened to witness Anderson’s direct and cross, then listened to the rebuttal with Dr. Cochran from yesterday, then read the public reports and news articles - now todays stern directive from the judge - the hospital knows they’re toast. So many lies concerning the reports.

    The Judge should be commended as this has been in mitigation for years before it ever went to trial. The Defendants could have settled it there, so I am sure the Plaintiffs saw it as just a slap on the wrist and decided taking it to trial was best. This is IMHO

      This same judge is the one who delayed the trial. He's been assigned to the case for years. It was delayed for perfectly appropriate legal reasons. There was nothing nefarious against the family happening on those delays, which this judge oversaw with the same competency he's mostly handling this trial.

      @@bees5461 That's right. He is trying his best to prevent the verdict being overturned on appeal. I do believe no matter what it will be tied up in court for years to come. There will be a verdict next week but there won't be an end.

The defense has already taken two "appellate proffers" which means if the plaintiff gets a verdict in their favor those proffers go along with all the trial testimony for the appellate court to consider. Those had to do with defense being cut off at the knees, preventing them to present the evidence of WHY the MBP suspicion was perfectly reasonable for them to have. They were not allowed to present that to the jury, which they believe could make a difference in their case. Will be interesting to see what happens.

      @@bees5461not true according to lawyer you know on YT… he said if attorneys are good, both sides should always do proffers for appellate reasons because the verdict is unknown so to be the best attorney to your client, proffers on both sides should always always be done

      Hospitals always settle, even if they are in the right, they always settle. It was the family that would not take the settlement and wanted their day in court. This isn’t even about money for either side, this is about a hospital’s reputation that has probably gone downhill since the trial started and a family that wants justice for how Maya was treated by incompetent hospital staff. Yes, money will help with Maya’s condition going forward and that would just be icing on the cake.

    If none of this had ever happen. What do you think Maya life would be like today. How many more comas could she survived before there was permanent damage? How much more drugs, valium, ect before she became so hooked it would be a life long battle.     From watching this entire time and not seeing the biased documentary, I believe that this hospital was going to be here no matter what the outcome. If the hospital gave her the treatment and died in the hospital they would have been sued. Not doing what Beata demanded is now getting them sued.

Jh are being sued for saving maya, it’s highly probable they would have been sued if maya died after admission due to some type of complication in treatment and they would have been sued if she died after being discharged back into the hands of Dr Kirkpatrick. No matter which way you spin it, it was always going to end up in court. Hospitals absolutely get it wrong but whilst not perfect, I think they got it right with maya. There’s alot going on with the kowalski family that makes this different to your typical malpractice/medical negligence case and I think that’s why there is strong reactions from both sides. It an interesting case and whilst Team JH, I feel the jury may award some type of damages but not in the range they are seeking.

    I’m not 💯 but I believe the Joint Commission reports are available to the public. I tried to find them but I’ve only ever used CMS so I didn’t have any luck. I hope the judge will consider CMS reports because it will tell you if that hospital met the requirements for Medicare/Medicaid funding.
    Also, the defense is acting childish. I’ve never seen so much snark from one side in my life. They are always there to point out that ‘it depends on the how long the plaintiffs cross will take”. Which is funny because they are the ones holding back so much evidence. They have the ability to show the claim JHACH sent to Aetna with the DRG that would prove they did bill for CRPS. Their Executive Director for the Rev Cycle they brought to testify even makes a comment to reviewing the info. And yet they try to pull out Aetna’s data, which is only for Aetna to approve for continuing the stay. Since Maya was in-house for over 30 days, this becomes an interim bill. JHACH will bill Aetna every 30 days and, depending on Aetna’s policy, they will pay portions until discharge. But the real bill from JHACH will come at discharge and the billing department will need to determine what Aetna still owes.

      @@chiccavaquita I work in hospital administration, and specialize in billing, coding, and payer contracts. Part of my team’s job is to make sure the bill is calculated correctly and the payer (Aetna in this instance) paid it correctly. Plus I’ve built in the same EHR they use.

My guess is the defense probably think that juror’s body language, questions etc. indicates heavily that they are for the Plaintiff, so they want to get rid of them. Unless they have been doing something they are not supposed to, I doubt the judge will dismiss that person and will deny the motion.

Instead of trying to listen, they put blinders on and started accusing based on something that not a lot is known about because it is rare. 10 yrs ago they said this rare disorder was all psychological and now look.     The unethical defense has now been exposed by their attempt to cover up and withhold a damaging JCAHO and CMS report from an accreditation survey. A defense witness stated that the hospital had glowing surveys to the jury. The judge has now demanded all of the relevant documents be produced by Monday morning. Defense should be disciplined by the FL bar.

    Why didn’t Jack & Beata work with their family attorneys and plea to the DCF Judge to have Maya transferred to the Orlando outpatient CRPS program and put in the custody of Uncle Scott & wife or foster medical home? At least, this way Maya would be out of inpatient hospital. It was already recommended that the Orlando outpatient program was best care for her CRPS vs the program at JHACH had to offer.

Guess we will never know what the lawyer advised.

    The comment about being in hospital for 100 days is "not a big trigger" from male hospital lawyer..is ridiculous!! He obviously hasn't been in a hospital for that long. The family was treated wrong by the hospital and three days in a hospital is stressful without being treated like Kowalski's were ..in my opinion.

    It's interesting to see how much public consensus has changed over the course of this trial. There were a lot of Maya supporters in the beginning. Now since the defense has dropped some bombshells people's attitudes have changed.

    Sincerely hope a class action lawsuit is filed to address the negligence of the hospital, per the immediate jeopardy report, particularly regarding the cardiac unit. The families who lost children deserve the biggest payout. But $220,000,000 for one child whose well being was actually protected and maintained by the hospital just isn’t fair! Let’s think of the babies and their families in the cardiac unit who are the real victims here!

      I think you make a valid point. Corporations including hospitals should be held accountable for any ‘unreasonable’ and/or ‘foreseeable’ harm they cause as a result if their negligence. However, frivolous and vexatious claims brought on by the fact the defendant has the deepest pockets should be strongly defended. An infants loss of life is valued at a mere 2.5M, but the cost to save Mayas life will cost 220M. It will be a sad day for justice if the Plaintiff walks away with the 220M.

      If she had been allowed a hug she would've lived. To not be allowed a hug in front of the judge, court officers, lawyer, dcfs, ect., ect. Now that is a damned shame. A freaking hug, really? She I am sure was stressed to the ultimate with her daughter's illness, then finding out it's rare, then having to make the tough decisions to treat her based on the incredible pain she was in, then they take her child after she informs them of what has worked, then keep her completely away while asking husband about a divorce and allowing him to go see her, taking away the host while accusing mother, ( unfounded lies) of poisoning the host with ketamine, not allowing her to fully have freedom of religion, picking on her during phone calls, and then the hug. I am surprised based on my own experience with depression that was way less stressful than this, that she made it that far! Good Lord!

    Whatever the judgment is, it will be appealed. It's too complicated. Too much stuff to consider. Not even sure if the CMS reports will make a difference here in trial. More time would have to be granted to delve deep into this. But they don't have time for this. Both sides have decent chances of the verdict being overturned on appeal, so these reports the original report and the follow up report will be a factor on appeal.

    If the jury looks back at how the instructions to them are done, they will be shocked and dismayed at the pickiness of the wording is done. Most is done to "protect" the defendant for future losses they might incur regarding the verdict. The "score" for the hospital will be greatly affected either way the verdict goes. In the end, the Mother is still dead & the family will still have permanent emotional damage they will continue to live with. All this is IMHO 💙

      Another point of view is that after the Hospital took action Maya is still alive and healthy! She may be dead, addict or paralyzed from the amount of drugs and horrible treatments that Beata was exposing her! They both had/have mental issues

The question is whether the hospital act appropriately. The hospital has lied and have systematic issues. If the hospital does not recognize that and take corrective actions, there will be many more tragedies.

      I disagree, legal proceedings are full of legal language & law governing the place where the case is being presented. I would not expect either side to drop the ball in this procedure. This is it. Bring it home to the jury. The court wants a verdict. To me this is the most important part of the trial. The burden is always on the plantiff. The objective of this document is not to tell the juror what to think , it's to give them direction to reach their own conclusion. Where does one start & end with all this. It's the lawyers job to help the jury do that, so wording & words & clarity do that. So the better get it right. I don't think the verdict will.affect the status of the hospital. Public opinion has already been reached. I would expect that every juror will go through the steps of deliberating regardless if they have reached a person decision. It is their duty and the law is instructing them to be precise in the decision & conclusion process in coming to their verdict. With their note taking & jury questions I'm sure the jury will welcome the jury instructions. I live in Canada we never see cases like this. Besides we have Universal Health Care its non profit, funded by Canadians , & different laws. I've enjoyed watching the lawyers in this case, argue and present their case the judges rulings & the process of the rule of law.
