I lost 3 highly educated and trained solid coworkers I looked up too that taught me a lot and even saved my father's life when I was away. I cried like a little girl. Almost certainly they 'should' but the reality is their cases would be so small individually, much harder to prove individually and result in much less coming back to the companies in question. So it isn't worth it for Facebook and Nike to pursue them. Remember some of them didn't even know where the money was actually coming from, she just basically said "send this invoice in and I'll get it paid then you give me x% back and we are both in profit." Not a moral or legal defence but it makes their situation a lot less clear cut.

TBF, $5mil for any corporate division of companies as big as Facebook & Nike isn't as impressive as it sounds...
Looking up the mean average annual household income for 2022: $105,555. $5 million goes into that 47 ways. So, sans any concern for equipment (at the very least they need some personal computers, access cards, money to create the internal DEI site, phones) the division can employ 47 people... which really isn't that much.
TBC: this is not a defense of DEI, I think it's a total damn grift that creates an absolutely toxic culture fed by utterly evil political views. But if we lay personal opinions aside & evaluate it in line with what we would expect from another, actually valid division at a company that size $5mil just isn't that much relatively.
It does add fuel to the fire that companies should not be investing in initiatives just because.

I truly believe ,over the years how selfish those with this view point really did not care about a black cause of equality, but about their own selfish desires. They were selling out to materialism. This story is the epitome of that con. Thank you for being one of the few individuals to highlight that the con has come back to correctly bite folks in the anus.
