One thing is very clear that Judges know the importance of the case and they want 370 to remained abrogated.
They know that PM Modi will remove it by making a law in parliament even if judiciary goes against it and then these judges will be remembered as a blot in history books, so they too want 370 to remain abrogated.

370 is not squashed. It is still under enforcement. But only 1st clause of article is valid now and the remaining all the clauses are removed.

@@meermudee9210there's no qnswer for a fool for sure who is not ready to accept the fact that A 367 (4) introduced as per A 368 giving govt. the right to make changes in the constitution. As per clause 3 in A 370 govt. can revoke, before that as per A 358 state of emergency was declared in J&K looking at the unstable state govt. so the recommendation from the state is ruled out. Your Sibbal is unable to get this simple thing or he is trying to play smart by justifying his party's agenda which was wrongly taken in 1954.

During the Emergency, the Government Pleader ( he was Niren Dey, if I recall correctly) had argued before the SC that the parliament could give itself a new constitution by amending the current one, article for article and there were no fetters on the government. Now Sibal is singing a totally different tune.

The current case Kapil Sibal is arguing in the SC is very good for the country. However, most of the time, SC lawyers are keeping the Supreme Court
busy 24/7 with high-profile and NGO's cases. Meanwhile, lakhs of people are suffering for justice due to the years worth of pending cases.

The simple principle is, except the basic structure of the Constitution, everything else can be changed following the due process. It's futile to argue that provisions which were meant to be temporary are more sacrosanct than the basic structure. Some people are paid to talk nonsense. That's it. Everyone knows Article 370 is temporary. And the provision of Article 370 is also temporary, it goes away with Constituent Assembly.
As everyone know the role of Constituent Assembly is temporary and it automatically get dissolved. And the provision and conditions with Temporary institution like Constituent Assembly goes away.
And president can abrogate the article without recommendations...
Yes. 370,371 could be abrogated by president's order. It's as simple as that. 370 part of the constitution not unique to JK as Sibal wants to project and thus not even touchable as Sibal wants to project.
