I managed to get hold of an agent, He had me mail my documents to him, and that same week I had my first month's pay in the bank. Unbelievable!

Oh holy cow!!! I didnt know it was 100% I would receive from the ex. You're right he couldnt put no SS in the decree BUT he is trying hard to outlive me. He ducked out after court, left the state, judge ordered him to pay alimony, he didn't. Moved to a state that doesn't force alimony payments. So he is 77, I am 71. He has had triple bypass, has emphysema and COPD and still hanging in there. SS told me I could call every couple months to see I qualify yet, hidden message when they say no you're not eligible for any extra right now (close enough) thats the heads up he is still kicking. They also told me that I would have like back pay since I have no way of knowing except theough them. But I'm not sure how long they said back pay would be available. But Ed you have helped me considerably since I found you here and I appreciate you so much.
You don't need to wait till he's dead. You can collect 50% while he's still living. It'll automatically be 100% after he's passed. He'll never know if you are collecting. His benefit will not be touched.
Please talk about the card that is being advertised for seniors. That claim is up to $3,000. To use for food, pay bills, etc. Please tell seniors its a scam!
I Will be filing for my husband’s SSA, how does Social Security calculate your spousal benefits? I remember something about your husband has to draw double , Are the benefits anything over double is what you would get an addition? or is it I get Half of what he draws. I don’t know why they make this so confusing but it is. Also, I’m not sure how long I’ve been eligible to draw my husband’s SSA but my question is would I be able to apply for backpay? I started collecting SS at 62, I’m now in my 70’s. I get $802 and my husband retired at full retirement age . He gets $2291.00. Question is , if my husband should pass , what percentage of his check would I get. We were both wondering how this would work. My husband is fine! Just curious !! 😂
My understanding is that you are entitled to a spousal "top off" NOW of +/- $300 to bring yours up to half of his present benefit. Upon your husband's death you would be entitled to the equivalent of his benefit (100%).

When I filed for my social security benefits I was 62 . Been receiving SSI instead I’ve been receiving this for 18 months now. I keep hearing you say check your earnings over and over and over. I did last night and by this woman at the SSA putting me on SSI instead of my benefit earnings I’ve been shorted over 14,000 $$. Now I’ve read that by taking them early I’m 0:230:23 going to be penalized for this for the rest of my life . Exceptions , exceptions, exceptions. Now what do I do ? Re file . Every single time I have called the SSA I have been MIs informed and now it has cost me $$. Not to mention it has affected every part of my life for the last 18 months. My earnings clearly show what I should be getting every month. I want answers. I believe this is what is wrong with the whole system giving out wrong information to everyone leads to all the questions you get . I can’t believe what I have read tonight. I’ve worked all my life and they gave me a state based welfare program check that doesn’t even come close . Now what???
I filed for my my benefits at 62 then when my husband file a few months later i didn't even have to file for my husbands benefits the SS office actually contacted me to ask if i wanted to file on my husbands benefits i said yes. Turns out i only got an extra $3 or $4 dollars off of his i told the guy i would try not to spend that extra money. 🤣🤣

Ed Isn’t the lack of a cap on earnings for Medicare proof that doing so with Social Security would make sense?!! Would love to hear your assessment of ratcheting back the age to begin Medicare in 5 year increments, so 60 in 2030, 55 in 2035 and so on, getting in premiums from younger healthier people, and hopefully preventing chronic illnesses like Diabetes or finding Cancer in earlier stages when it’s still possible to cure. Is there anyone who would be willing to go with you or, if you're on the phone with the SSA, is there someone who could be there with you and you could put it on speaker? I don't know the laws in your State but in mine, I'm the only one who has to be aware I'm recording the conversation. You could ask the SSA for permission to do this.
Assuming that you are an adult, contact your county's Adult Protective Services and explain about your brain injury. They generally will have a booklet or list of non-profit agencies and individuals who may be able to assist and advocate for you with Social Security. As an adult person with special needs, there are likely agencies in your area who can help.
I just turned 65- I applied for medicare and was told I should apply for spouse SS benefits as I didn’t have enough work credits on my own. My husband is on early retirement due to disability. After crunching the numbers i decided to apply for SS. During my application my interviewer commented that my husband had a workman’s comp claim. He did, but was closed in 2008. He never got financial payments only covered his medical cost for work injury. Interviewer said he could see no payments had been made in years and didn’t think it would be a problem. But it has been. My benefits were severely docked. When i found out and the reason we provided the paperwork proving claim was closed and no payments of any kind had happened since 2008. The super visor at my local SS office resubmitted my application but now almost 6 weeks and counting i have heard nothing. I went back to SS office and was given the run around. I don’t know if I need to wait longer- or file an appeal or what I should do now. Thank you for your advice, this has caused a lot of stress.
Any person who was married for ten or more years and NOT remarried,and has the marriage certificate and official divorce decree, can apply to collect as an independently entitled spouse. The former spouse has to make at least double the Social Security benefit as you are making, to claim on theirs. We are required to file for our own record first, and then we would receive the Difference to make our benefit Equal to Half of the Ex-Spouse’s. When the former Spouse passes away, we could collect their entire amount as a Survival benefit.
Does a collecting spouse's 100% disabled veteran status change any social security rules? side note: Months before medicare kicked in at 65, I got a letter from social security/medicare with a prepaid return envelope. It was a welcome to medicare kind of letter.. confirming my address for the card and it gave me the option to decline part B, without any qualifying other insurance questions.

And because of that you might want to wait to let your own grow until you are 70, because each year after your full retirement age that you wait increases your benefit by 8%, so you will receive 24% more at 70, while receiving the survivor benefits in the meantime.
What happens when you are already collecting social security check and you suddenly inherit, say, 1 million from a relative. It's a one time deal. Does that change what you collect from social security the following year?

You don’t get delayed credit on his benefits (because you are taking the benefits not only on time but early, lol). However, your own benefits are growing and it’s possible that at some point-either when you are 70 or before-your benefit might overtake his; you should definitely ask SS!

I just read that spousal benefits for survivors , has changed if you claim your deceased spouse benefits you can no longer allow your credits to grow until you are 70 to maximize . You can no longer switch over to your benefits at 70, that was just changed, is this correct?
@@MyGovExpert I googled it, as of 2024 a long standing rule allowing individuals to switch between their own benefits to maximize their payout has officially ended for most people , except those who were 70 years old on January 1, 2024., which means most couples can no longer use the strategy where the higher earner claims spousal benefits at full retirement age and then switches to their own benefits at 70 to maximize their benefits.
Can I Not take Ex Spousal Benefits? If I do, I’ll have to pay for Part B Medicare and my rent will go up!! For my own situation, I’m better off keeping my monthly income low. I have PASSIVE INCOME THAT DOESN’T count towards either…. I need to keep my monthly check below $1,500.

You should definitely talk with SS because you could have been collecting on her record since you were 60, so if you haven’t filed yet you should ask them to run the numbers on her survivor benefits vs your own benefit. I’m going to take my deceased spouse’s survivor benefits in January-when I turn 60-and wait to take my own when I turn 70 because they will grow between now and then.
Some math. Hopefully someone can help. If I am getting $1300 ss , and my exhusband will collect if he retires at 65 $2800, how much will my ex husband benefit be for me??? $200 ???
Half of $2,800 = $1,400, but if you filed before your full retirement age then not only is his benefit reduced (due to filing at 65 rather than 67), but your benefit will also be (further) reduced so you might not be eligible for anything from his record.

When I was 55 I went out on SS disability. When I went to SS when I was 62 asked about ex spouse benefits . They compared his benefits to mine when I was 55 and he was 54. He didn’t make 2x more than me at that time. Now being 65 him now 64 will they look at my benefits I got at 55 to his now 64 years. He probably will have 2x more at this time. My husband applied for his ss ad they gave him less than quoted , he ask why and they said he gets pension from the government, which he does not . He gets pension from another union , not government at all , he has sent all the info necessary but still have been waiting for 5 months for his readjusted amount . Ill never understand any of it. I became disabled July of 2021 at age 56 and qualified for SSDI. My late husband passed of a heart attack age 59 Jan 2021. We made similar lifetime amounts, both Vets but 1 term. I was told my income would not increase until he would have been 67 and it will be $20? Sounds like a slap, he'd be horrified. My step daughter arranged for her mother(whom she hates) to go to a retirement home in Canada and told me her mother was able to keep her Canadian gov't pension as well as ex wife benefit from my husband. The tax on social security is based on your adjusted gross income. If you’re single and your AGI is under $25k it’s not taxed. If your AGI is between 25k and $34k up to 50% of your SS benefits can be subject to tax, and if your AGI is above $34k up to 85% of your income can be subject to tax.

You were married more than 10 years, collected on your own SS benefits for a few years and now that he's passed, you'd get a widow's portion, even if he married after your divorce. Get your marriage certificate, his death certificate (which you can get online at the county records dept.) Call your local social security office, make an appointment, and bring them along. You'll also need to know his social security number.

I called social security to get info on collecting my own benefits vs what I get my deceased husband benefits .. to see if I can later get a built up amount of money from mine, and she didn't know anything about it. I filed in 2011 at age 62. I told SS rep I wanted to file on ex-husband's record and suspend my benefits until I reached either FRA or age 70. He said there was no such thing as suspending mine. Ive since been told he was wrong. If so, now at age 75, do I have any recourse to go back and get any money i lost by not switching from his to mine when i turned 70? You were not told wrong. You seem to be confusing survivor benefits w/ div. spouse benefits. They have different rules. When receiving div. spousal benefits SS requires you to take your own benefits first. You CANNOT suspend your benefits to take you ex spouse's benefits. Whoever told you otherwise was wrong.
@penelope5500 I was told that what you are describing became effective in 2016, but that when I filed in 2011, I could have suspended my benefits to let them accrue. I'm pretty sure Ed often mentions the 2016 change in his videos.
@@lk-ol2jt Ah, that is the old "file & suspend" strategy. From what I remember it was the currently married man (usually the man) who filed, then immediately suspended leaving his spouse open to spousal benefits. Whether that also applied to a divorced spouse I do not know.

Dr Ed has said that you don’t need your spouse/ex-spouse’s SSN because they can almost always find it as long as you have other information-date of birth, place of birth, etc..
Good info on exceptions, currently married since 2000 to my wife who gets $500 on SSI now at 73. She originally started collecting SSDI (reduced) when disabled in 2006 (age 55) because did not have full 40 credits. Because when married to her ex. for over 25 yrs. they filed as self- employed (fisherman Alaska), and all SS credits went to his account (ex. is deceased). SS office said she cannot collect on ex. SS account because she is remarried, and I am not collecting my benefits (currently 61 yrs old). She has to wait till I collect per SS office. How can she get SS credits reconciled between his account (ex.) and hers? Thanks

Any/all wives who have not remarried are eligible for up to 100% of his benefit-there is no split. However, if you filed before your full retirement age the same penalty might apply.
My spouse died and I was57 yes old they me I didn't get sick 9 mo.after he died so I applied for disability and approved now they said I wasn't in titled to his benefits until I'm 62
I took ss.at 62 I was lucklie before I got COVID was in hospital in bad shape for a while. Found out I had type 2 diabetes in there. Came home with oxygen for. A month. It really took a toll on my health. Can I get more money since I cannot work. Also can I ever get my full benefits. I was married for 21 years. Wife left. Married again now 18 years 3 more kids 14 16 18. My wife now is in early 50. If I pass. Can she get my SS.
The only thing you could do is apply for SSDI. You'll always have a reduction in benefits since you needed to take early retirement. Hope things are getting better for you now.

Hello, I’m 53. My husband was on SSDI and died 2 months ago. We have a 16 year old son who used to get Supplemental Income which was automatically switched to Survivors. Our son has Autism & I have compiled all documents since he was in Kindergarten. Can I apply him for disability? Can he get both Survivors & Disability? Is there anything that I can apply for? I am unable to work now (worked before, plan to collect mine at 67) coz our son is very low functioning & I am homeschooling him. He is enrolled in a homeschool program with included therapies. Im tuning 62 may 2025 i like to file for early retirement since i just make under the earnings limit of 23,400. I have about 2-3 years to get closer full pension. If ever my income goes over it wouldn't be more than 1,500 or less. I notice the early retirement limits increase 1,080 every year so i think ill be ok. I can always wd my application in case . New York State does not recognize common-law marriage for relationships established within its borders. This means that regardless of how long a couple lives together or whether they consider themselves married, they will not be considered legally married in New York without a marriage license and a formal ceremony. I would think she "cannot" claim spousal benefits. She would have to been legally married to you.
I'm a divorced disabled spouse. I'm on SSDI. My ex passed in 2018. We were married 15 years. I filed in 2024 for divorced spouse survivor benefits. I was just approved. My ex was also on SSDI when he passed. I received 50% . Am I entitled to 100%? His spouse passed before him. I'm the only one entitled to his benefits.

That from a person who is a district manager like Ed. Their full survival benefit. I can't under my husband now because he hasn't filed yet, he's 10 years younger than I.

I did last night and by this woman at the SSA putting me on SSI instead of my benefit earnings I’ve been shorted over 14,000 $$. Now I’ve read that by taking them early I’m 0:23 0:23 going to be penalized for this for the rest of my life . Exceptions , exceptions, exceptions. Now what do I do ? Re file . Every single time I have called the SSA I have been MIs informed and now it has cost me $$. Not to mention it has affected every part of my life for the last 18 months. My earnings clearly show what I should be getting every month. I want answers. I believe this is what is wrong with the whole system giving out wrong information to everyone leads to all the questions you get . I can’t believe what I have read tonight. I’ve worked all my life and they gave me a state based welfare program check that doesn’t even come close . Now what???
I filed for my my benefits at 62 then when my husband file a few months later i didn't even have to file for my husbands benefits the SS office actually contacted me to ask if i wanted to file on my husbands benefits i said yes.
Turns out i only got an extra $3 or $4 dollars off of his i told the guy i would try not to spend that extra money.

Ed Isn’t the lack of a cap on earnings for Medicare proof that doing so with Social Security would make sense?!! Would love to hear your assessment of ratcheting back the age to begin Medicare in 5 year increments, so 60 in 2030, 55 in 2035 and so on, getting in premiums from younger healthier people, and hopefully preventing chronic illnesses like Diabetes or finding Cancer in earlier stages when it’s still possible to cure.

Is there anyone who would be willing to go with you or, if you're on the phone with the SSA, is there someone who could be there with you and you could put it on speaker? I don't know the laws in your State but in mine, I'm the only one who has to be aware I'm recording the conversation. You could ask the SSA for permission to do this.
Assuming that you are an adult, contact your county's Adult Protective Services and explain about your brain injury. They generally will have a booklet or list of non-profit agencies and individuals who may be able to assist and advocate for you with Social Security. As an adult person with special needs, there are likely agencies in your area who can help.
I just turned 65- I applied for medicare and was told I should apply for spouse SS benefits as I didn’t have enough work credits on my own. My husband is on early retirement due to disability.
After crunching the numbers i decided to apply for SS. During my application my interviewer commented that my husband had a workman’s comp claim. He did, but was closed in 2008. He never got financial payments only covered his medical cost for work injury. Interviewer said he could see no payments had been made in years and didn’t think it would be a problem. But it has been. My benefits were severely docked. When i found out and the reason we provided the paperwork proving claim was closed and no payments of any kind had happened since 2008.
The super visor at my local SS office resubmitted my application but now almost 6 weeks and counting i have heard nothing. I went back to SS office and was given the run around.
I don’t know if I need to wait longer- or file an appeal or what I should do now.

We are required to file for our own record first, and then we would receive the Difference to make our benefit Equal to Half of the Ex-Spouse’s. When the former Spouse passes away, we could collect their entire amount as a Survival benefit.

You don’t get delayed credit on his benefits (because you are taking the benefits not only on time but early, lol). However, your own benefits are growing and it’s possible that at some point-either when you are 70 or before-your benefit might overtake his; you should definitely ask SS!

I just read that spousal benefits for survivors , has changed if you claim your deceased spouse benefits you can no longer allow your credits to grow until you are 70 to maximize . You can no longer switch over to your benefits at 70, that was just changed, is this correct?

@@MyGovExpert I googled it, as of 2024 a long standing rule allowing individuals to switch between their own benefits to maximize their payout has officially ended for most people , except those who were 70 years old on January 1, 2024., which means most couples can no longer use the strategy where the higher earner claims spousal benefits at full retirement age and then switches to their own benefits at 70 to maximize their benefits.

You should definitely talk with SS because you could have been collecting on her record since you were 60, so if you haven’t filed yet you should ask them to run the numbers on her survivor benefits vs your own benefit. I’m going to take my deceased spouse’s survivor benefits in January-when I turn 60-and wait to take my own when I turn 70 because they will grow between now and then.

Half of $2,800 = $1,400, but if you filed before your full retirement age then not only is his benefit reduced (due to filing at 65 rather than 67), but your benefit will also be (further) reduced so you might not be eligible for anything from his record.

When I was 55 I went out on SS disability. When I went to SS when I was 62 asked about ex spouse benefits . They compared his benefits to mine when I was 55 and he was 54. My husband applied for his ss ad they gave him less than quoted , he ask why and they said he gets pension from the government, which he does not . He gets pension from another union , not government at all , he has sent all the info necessary but still have been waiting for 5 months for his readjusted amount . It depends on whether you have earned income and your filing status.
The tax on social security is based on your adjusted gross income. If you’re single and your AGI is under $25k it’s not taxed. If your AGI is between 25k and $34k up to 50% of your SS benefits can be subject to tax, and if your AGI is above $34k up to 85% of your income can be subject to tax.

You were married more than 10 years, collected on your own SS benefits for a few years and now that he's passed, you'd get a widow's portion, even if he married after your divorce. Get your marriage certificate, his death certificate (which you can get online at the county records dept.) Call your local social security office, make an appointment, and bring them along. You'll also need to know his social security number.

You were not told wrong. You seem to be confusing survivor benefits w/ div. spouse benefits. They have different rules. When receiving div. spousal benefits SS requires you to take your own benefits first. You CANNOT suspend your benefits to take you ex spouse's benefits. Whoever told you otherwise was wrong.
@penelope5500 I was told that what you are describing became effective in 2016, but that when I filed in 2011, I could have suspended my benefits to let them accrue. I'm pretty sure Ed often mentions the 2016 change in his videos.
@@lk-ol2jt Ah, that is the old "file & suspend" strategy. From what I remember it was the currently married man (usually the man) who filed, then immediately suspended leaving his spouse open to spousal benefits. Whether that also applied to a divorced spouse I do not know.

Dr Ed has said that you don’t need your spouse/ex-spouse’s SSN because they can almost always find it as long as you have other information-date of birth, place of birth, etc..
Good info on exceptions, currently married since 2000 to my wife who gets $500 on SSI now at 73. She originally started collecting SSDI (reduced) when disabled in 2006 (age 55) because did not have full 40 credits. Because when married to her ex. for over 25 yrs. they filed as self- employed (fisherman Alaska), and all SS credits went to his account (ex. is deceased). SS office said she cannot collect on ex. SS account because she is remarried, and I am not collecting my benefits (currently 61 yrs old). She has to wait till I collect per SS office. How can she get SS credits reconciled between his account (ex.) and hers? Thanks

Any/all wives who have not remarried are eligible for up to 100% of his benefit-there is no split. However, if you filed before your full retirement age the same penalty might apply.

The only thing you could do is apply for SSDI. You'll always have a reduction in benefits since you needed to take early retirement. Hope things are getting better for you now.

Hello, I’m 53. My husband was on SSDI and died 2 months ago. We have a 16 year old son who used to get Supplemental Income which was automatically switched to Survivors. Our son has Autism & I have compiled all documents since he was in Kindergarten. Can I apply him for disability? Can he get both Survivors & Disability? Is there anything that I can apply for? Im tuning 62 may 2025 i like to file for early retirement since i just make under the earnings limit of 23,400. I have about 2-3 years to get closer full pension. If ever my income goes over it wouldn't be more than 1,500 or less. I notice the early retirement limits increase 1,080 every year so i think ill be ok. I can always wd my application in case . New York State does not recognize common-law marriage for relationships established within its borders. This means that regardless of how long a couple lives together or whether they consider themselves married, they will not be considered legally married in New York without a marriage license and a formal ceremony. I would think she "cannot" claim spousal benefits. She would have to been legally married to you.

No, since you're an ex, you can only receive up to 50% survivor benefits.
