July 1 నుంచి IPC, CrPC, Evidence Act స్థానంలో భారతీయ న్యాయ సంహిత, భారతీయ సాక్ష్య సంహిత, భారతీయ నాగరిక్ సురక్ష సంహిత అమలులోకి వచ్చాయి. ఈ సందర్భంగా మారిన చట్టాల మీద ఒక సిరీస్ చేస్తున్నాం. ఇది సిరీస్ లో మూడో వీడియో. ప్రజాస్వామ్యంలో ప్రజలు అనుకుంటే ఏమైనా సాధించేందుకు శక్తి కలిగి ఉంటారు. ప్రజలందరూ బ్రిటిష్యుర్లతో, సుల్తానులతో డచ్ వాళ్లతో ఫ్రెంచ్ వాళ్లతో అనేకమంది నల్ల దొరలతో ఇంకా ఎంతోమంది ఎంతోమందితో పోరాడి స్వాతంత్రం తెచ్చుకున్నారు. ప్రజలు ఏదైనా చేయాలనుకుంటే అవి చట్టాలైన ఇంకొకటైనా ఈ ప్రజలకు ఆలోచించే శక్తి ఉంది మార్చే శక్తి కూడా కలిగి ఉన్నారు. ఈ చట్టాలు నిజంగా ప్రజాస్వామ్యానికి సమస్యలు తీసుకొచ్చే విధంగా కనపడతా ఉన్నాయి కాబట్టి వాటిని రద్దు చేసి వాటి స్థానంలో పూర్వపు చట్టాల్ని కొనసాగిస్తే సరిపోతుంది. ప్రభుత్వం ఈ విషయం ఒప్పుకుంటే సరిపోతుంది లేకుంటే ప్రజాస్వామ్యాన్ని ఖూనీ చేయాలనుకుంటే ప్రజా ఉద్యమాలు ఎలాగూ ఉన్నాయి. ప్రజా వ్యతిరేక చట్టాలు ప్రజా వ్యతిరేకతతో వారు ఏమైనా చేయాలనుకుంటే వారి పాలన కావచ్చు పార్టీలు కావచ్చు ఈ స్థానంలో ఎవరన్నా ఎక్కువకాలం కొనసాగలేరు.
ఏది పర్మనెంట్ కాదు. ఇప్పుడు చేసిన చట్టాలు సామాన్య పౌరులకు ఇబ్బంది కలిగించే లాఉంటే ..మారి తీరాలి. రాజకీయ బందీలు అయిన పోలీసు వ్యవస్థకు విశిష్ట అధికారాలు ఇవ్వడం ..చాలా ఇబ్బందికరం.

It looks like Manusmriti is better than this BNS( Bharatiya Nyaya Samhita). These laws though may be good in a fair and just police system considering the succumbing nature of the Indian police system to the ruling governments this BNS can become a hand in tool to oppress all the opponents by the ruling governments. These new laws will deal a death blow to the human rights in India and will create police excesses and also increase the legal litigation by almost 30-40%. In the worst situations we may go back to the model of erstwhile brutal Nizam- Razakar rule in Telangana where police (Razakars) will work for the good of the rulers (Nizam)and the rich ( Zamindars/ Deshmukhs) and oppress the common citizens. Considering the role of political power and money in the police system can we expect something else? The latest example being the police playing mute spectators when the ruling party activists are attacking brutally the opposition party activists and their homes without any humanity. We can only imagine the plight of the common citizens in the future police system under the BNS. I think all the progressive states of India must reject the BNS until all the draconian features are removed from it and human rights, fairness and justice are upheld by the BNS. As Police is a state subject and criminal law a concurrent subject all those states which don't want the BNS in its current form must pass house resolutions opposing the BNS for now and the Old IPC be implemented as Status quo till all the necessary changes are done to the BNS in its present form or pass amendments to BNS in their own states. Also it is a shame that such important law is passed without any discussion and debate in the parliament with the opposition. Thus, it is time to reform the BNS through debate and discussion with the opposition to have a uniform criminal law all over India. If not it's time for legal battles too. Thank you.
