    Attorney, nag semento po kasi sila ng daan dito samin.
    Isinagad po sa mismong muhon namin.
    Ang problema po, gagawa sila ng drainage tapos kukuha sila dito sa loob ng lupa namin.
    Sabi nila yung muhon daw ay wala sa tamang pwesto.
    Pero 35 years na po yung muhon doon.

    Hello atty, very interesting ang mga topics nyo Salamat po sa napaka clear po ng mga explanation nyo. . Mayroon po akong question regarding sa property na iisa lang po ang title pero dalawa po ang may Ari. Ang lupa po ay awarded ng PNR sa mga magulang namin, pero dahil sa katandaan na nila hindi na nila kayang bayaran ang outstanding balance na dapat bayaran sa PNR.I binigay po sa aming dalawang mag kapatid ang lupa kaya dalawa kaming nagbayad sa PNR thru home owner’s association. Pero dahil nailigay ang pangalan sa kapatid ko noong natapos na ang pagbabayad ngayon gusto na po namin hatiin, puwede ko bang gamitin ang waive of right na ginawa ng kapatid ko? Nakalagay po sa waive if right na half of that property ay sa akin. Signed ito ng aking kapatid, ng aking father, naka pirma din ako at Naka notarized po ito. Ano po ba ang best na dapat gawin? Ano po ang pagkakaiba ng extra judicial settlement, deeds of donation at deeds of sale. Attorney alin po ba sa tatlong ito kami puwedeng gawin just to separate the title between m
    And my sister. Sana po masa got po Ito para po maging malinaw po sa amin.

    Kapag barangay road naman atty nagwidening sila ng kalsada sa baryo at naputol ang punong kahoy sa gilid ng kalsada kasi masasakopan ng brgy road widening. May grounds ba ang brgy officials na idemanda sila kasi pinutol nila ang punong kahoy sa gilid ng kalsada?

    Ang binili naming lupa may title ngunit ang original pong issuance nito ay ang DENR dahil ang original owners po ay hindi nabayaran ang arrears sa tax (agricultural ang classification along seashore) kung Kaya ay na auction ng Municipality and one of the heirs paid the arrears with corresponding Waiver of rights of the owners.
    Ngayon gusto gamıtin ng Municipality as Barangay road in our Barangay that has an existing road as right of way para ma madadaanan lng ang mga tao in our Barangay…
    Now my question is gustong gawing Barangay road ng Municipality namin ang portion ng lupa na binili namin Magkano po ang posibleng ebayad sa amin ng government?

    Attorney, you emphasized that the road widening in this particular instance is that one pushed by the national government what if the riad widening in a certain locality is caused by virtue of a sangguniang bayan/lalawigan duly approved by the mayor/governor, will the measure of just compensation to judicially titled land still apply?

      The local government is also vested with the power of eminent domain to expropriate private property for PUBLIC USE ,PURPOSE and GENERAL WELFARE, subject to just compensation. Take note that:
      When eminent domain is exercised by the LGU, the amount to be paid for the expropriated property shall be determined by the proper court, based on the fair market value at the time of taking the property. The LGU concerned may immediately take possession of the property upon the filing of the expropriation proceedings and upon making a deposit with the proper court of at least 15 percent of the fair market value of your property based on the current tax declaration of the property to be expropriated, provided that the same is for the purpose or welfare of the general public.

    Ask ko lang po Atty. If intitled ba kami na huminge ng just compensation sakaling gamitin ang lot sa pag tayo ng mga poste sa mga private businesses. Gaya ng DITO at SMART.
    Basta na lang kasi sila ng tirik ng mga poste nila sa property ko. Nasa tabi kasi ng highway ang property ko. Tama ba yung ginagawa nila nag basta na lang nag tirik doon na walang pahintulot sa amin bilang may ari? Ano dapat ko gawin sa mga poste nila? Sinamantala kasi nila na wala kami nung tinirik nila ang mga yun.

      Kung ang nasbing lupa ay classified as alienable and disposable land of public domain, ay nagkaroon na tax declaration certificate na nakapangalan na sa declared owner na naka saad sa tax declaration certififate, ay maari na kayong mag apply sa pagpapatitulo nito. Upang mapadali at less gastos, sa pagpapatitulo ay mag apply kayo sa PENRO-DENR for the issuance of Free Patent. Mag ka subdivision and lot plan survey din kayo sa geodetic engineer, with approved technical description galing sa LMB-DENR. Mga karagdagang dokomento na maaring kakailanganin sa inyong application:
      1.Affidavit of Land Ownership & Possession
      2. Affidavit of Adjoining Lot Owners
      3. Barangay Certificate of Land Ownership
      4. Where applicable: Settlement of estate/partition or Affidavit of Self-Adjudication as Sole Heir
      5. Where applicable: Proof payment of BIR taxes(Estate tax, documentary stamp tax, penalty/interest charges and certificate authorizing registration(eCAR)

      Kung HINDI maituturing na real estate developer or engaged in real estate business ang may-ari na nag bebenta ng lupa na pinag subdivide into several lots at maituturing na isolated transactions lamang at hindi HABITUAL ng may-ari ang pag benta nito ay maaring hindi kailangan pang kumuha ng license to sell sa Department of Human Settlement and urban Development. Ang sukat ng lote na binibenta ay angkop sa paggagamitan ng buyer. May karapatan ang buyer bilang siyang magbabayad ng lote kung anong area ang gusto ninyang bilhin.

    relative po namin ang nagsasaka and meron kaming sharing sa harvest ..
    Hindi po sinabi sa amin ng relative namin na na- convert na as barangay road yung portion ng lot .. ano pwede kong gawin?

      If the land owner is entitled to just compensation and under the Right of Way Act, and all the documents are complete and legal issues. Take note of the Implementing Rules and regulations assuming that the use and taking of the propperty is based on negotiated sale:
      Section 6.10 Deed of Absolute Sale and Payments
      As provided in Section 5(e) of the Act, the property owner and the IA shall execute a Deed of Absolute Sale after the property owner has submitted to the IA the Transfer Certificate of Title, Tax Declaration, Real Property Tax Certificate or Clearance (as issued by the Treasurer of the concerned LGU) and other documents necessary to transfer the title to the Republic of the Philippines. The IA shall cause the annotation of the Deed of Absolute Sale on the Transfer Certificate of Title.
      In case of sale of land with structures and other improvements, the Deed of Sale shall provide a stipulation allowing the IA or its authorized representatives to demolish and remove them. The Deed of Sale shall also include a stipulation on the right of the IA to immediately enter the property and implement the project.
      In case the sale pertains to structures and improvements only, as provided in Section 5(b) of the Act, the property owner and the IA shall execute an Agreement to Demolish and Remove Improvement (ADRI), provided that the former has submitted to the latter the necessary documents to establish proof of ownership of said structures and improvements, as mentioned in Section 6.8 of this IRR. Similarly, the IA shall remit to the LGU concerned the amount corresponding to any unpaid tax on such structures and improvements, subject to the deduction of this amount from the total negotiated price, provided that it is not more than the negotiated price.
      Upon the execution of a Deed of Sale, the IA shall pay the property owner: Fifty percent (50%) of the negotiated price of the affected land, exclusive of the payment of unpaid taxes remitted to the LGU concerned under Section 6.9 of this IRR; and
      Seventy percent (70%) of the negotiated price of the affected structures, improvements, crops and trees, exclusive of unpaid taxes remitted to the LGU concerned under Section 6.9 of this IRR. Where the property owner owns both the land and structures/improvements, as provided in Section 5(g) of the Act, the IA shall, at the periods stated below, pay the property owner the remaining fifty percent (50%) of the negotiated price of the affected land, and thirty percent (30%) of the affected structures, improvements, crops and trees, exclusive of unpaid taxes remitted to the LGU concerned under Section 6.9 of this IRR, provided that the land is already completely cleared of structures, improvements, crops and trees, as certified by the IA: At the time of the transfer of title in the name of the Republic of the Philippines, in cases where the land is wholly affected; and
      At the time of the annotation of a deed of sale on the title, in cases where the land is partially affected. Where the property owner owns only the land, as provided in Section 5(g) of the Act, the IA shall, at the periods stated below, pay the property owner the remaining fifty percent (50%) of the negotiated price of the affected land, exclusive of unpaid taxes remitted to the LGU concerned under Section 6.9 of this IRR: At the time of the transfer of title in the name of the Republic of the Philippines, in cases where the land is wholly affected; and
      At the time of the annotation of a deed of sale on the title, in cases where the land is partially affected. Where the property owner owns only the structures/improvements, as provided in Section 5(g) of the Act, the IA shall, at the periods stated below, pay the property owner the remaining thirty percent (30%) of the affected structures, improvements, crops and trees, exclusive of unpaid taxes remitted to the LGU concerned under Section 6.9 of this IRR, immediately after the IA has certified that the land is already completely cleared of structures, improvements, crops and trees. At the time of the transfer of title in the name of the Republic of the Philippines, in cases where the land is wholly affected; and
      At the time of the annotation of a deed of sale on the title, in cases where the land is partially affected. The IA shall ensure the faithful and prompt compliance with the above payment procedures and may revise or issue the necessary orders and directives to this effect.
      The IA shall pay the CGT to the BIR within thirty (30) days after (a) the release of the initial payments specified above or (b) the notarization of the Deed of Sale, whichever is earlier. The IA shall also pay the DST within five (5) days after the close of the month when the Deed of Sale is notarized."

      Maraming na tayong videos hinggil sa usaping Stewardship agreement. Kung hanggang sa kasalukuyan ang classification ng nasabing lupa ay forest/timberland pa rin, ay hindi ito maaring maging private ownership. Ang papel na pinanghahawakan ng steward ay nagbibigay lamang ng karapatan ng steward na mag tanim /sakahin at pangalagaan ang nasabing property for 25 years at renewable for another 25 years. Kung mayroong claimant mayroong tax declaration certificate at maaring kayo ay mayroon ding tax declaration, ay basahin ninyong mabuti, ang tax declaration certificate at ito ay hinggil sa bahay o mga improvement o crops lamanag at HINDI SA LUPA.
      Kung mayroong sumasaklaw sa inyong stewardship ay makipag ugnayan kayo sa DENR at mag file kayo ng Complaint or protest laban sa nasabing tao.

Babayaran lang kayo sa napinsalang bahay o crops na nasira dahil sa pag gamit ng pamahalaan ng inyong lupa na base lang sa replacement cost nito.
