      Bakit Wala naman binigay ang goverment na bayad sa mga kapit bahay namin nag road widening sila . Yung sa bahay namin hindi pa nag road widening masisira yung old house namin . Paano po yan?

    Atty thank you for the information. Dito sa probinsya almost five years na natapos ang road widening (high way)pero wala naman information ang may ari kung babayaran siya ng gobyerno.

      Na fixer yan sila, contractor ang nag lakad niyan, sa bayaran di makukuha ng mayari ang buong bayad 60/40 ang hatian niyan

    Good day po Atty. 🙂 Sana maexplain din po na ang mga titles na under the provision of CA 141 (Homested Patent, Free Patent, etc.) na entitled ang government na gamitin ang 60 meter strip of ROW sa isang titled lot without just compensation unless kung may First Taking na ang lupa. Baka po kasi mag assume ang lahat na may lupa entitled sila sa just compensation. Ang nice po ng video nyo 😊 Thank you 😊

    If a portion of the lot has been purchased by the government this will have a change in the surveyed lot plan. Who will pay for the new lot plan as this might be expensive than the portion of the land purchased by the government due to a road widening project. This is specially true if the land hasn't been titled and the owner wanted to title the land after purchase. Thanks and keep safe.

    In our case po, dati ay maliit pa ang road but when government widened it last 2018, 1,700 sqm po ang nakain at di po nasabihan aag may-ari at di nabayaran. Pero napaluwagan na kalsada. Kahit noong maliit pa road, di rin nabayaran. Bayad po realty tax.

    Para sa Akin kung Legal kang nagmamay ari ng LUPA na aabutin ng Road widening Dapat lang Bayaran.. Pero kung squater ka lang sa lugar na yun eh dapat i relocate ka na lang at walaa kang dapat asahan na kabayaran dahil sa Govyerno yung tinitirhan mo .. puwede kung irelocate ka na lang sa isang lugar na matatawag na pag aari mo nang ayon sa Govyerno.. pero mukhang malabo kasi makakapal ang pagmumukha ng nasa Housing Authority lugar na mapunta sa tamang tao eh.. sa kanilang mga angkan napupunta .. na alam naman ng lahat kung bakit garapalan ang kaululan ng ibang.. marami nga pag nasilip na sa Govyerno eh pilit kinukuha ng mga Politiko papabakuran tapos babayaran ng tax declareration tapos kanila na yun pag sapit oh pag lpipas ng Taon.. kaya ang para sa ibang tao eh Ninanakaw mismo ng mga naka upo sa Govyerno.. na sana eh Mapansin ni MARCOS.. run after them

    Nice explanation. Ito ang problema. Ang project ay tapos na, pero ang bayad ng right of way ay wala pa naiibyad kahit isang centimo, paano at puwede pa ba makuha? Encroachment area ay about 60 sq. m. may habol pa ba kami? Nasa AH 435 ang location nito Batangas-Quezo National highway.

Ano po pde gawin kc yung lupa namin kapatip namin nagfarm dahil kami naga skol sa mnla at nagtatrabaho din ung ibang kpatid sa malayo bali nagkahiwalay hiwalay kmi at ang naiwan sa lugar namin ung nakakatandang kapatid. Ang history ng lupa namin naaward sa tatay namin since cla naglinis ng area public land 1960's tapos inaplayan ng isang tao ung nilinis nla ngaun nagpetisyon ung mga tao at nanalo cla at naaward sa knla 5hectares each. Ngaun noong nawala na magulang namin mga kapatid ko nagfarm dahil sa gulo noon nagkahiwalay at ang natira ang eldest namin cla nagfarm ngaun nagkaroon naman bgo peogram ung Dar paresurvey ang area ngaun ang inilagay na name as posesyoner ung husband ng kapatid namin ibininta ung ibang portion ngaun may natira isinanla ng kapatid sa tiya namin at nagkaroon ng resurvey ulit ang ang inilagay na name sa isang portion na isinanla name ng kapatid ko as awardess or owner. Namatay na rin ang kapatid ko at ako na lng natira na bunso ngaun ayaw esurender ng anak ng kapatid ko sa akin dahil cla na may ari dahil c nanay nila ang awardees. Ngaun nang pumunta ako assesor office sa province nami ang nakalagay sa tax declearation ang owner is tatay namin ngaun sa ilalin naka endicate doon na for cancellation sa name ng tatay ko as original owner ngaun ang nakalagay na sa area name is name ng bayaw ko year 2018-19 sa declearation ito. Atty. Ang tanong ko po miron ba ako habol na econtest sa DAR na lahat magkapatid wala kmi perma na sa knla eaaward ung lupa during sa OLT program ng gobyerno na wala kmi perma? Miron ba kmi laban kung econtest namin sa Dar kasama ng iba ko na pamangkin? Kasi sa amin na magkapatid ako na lng natira na buhay. Sana matulungan mo kmo kung ang dapat gawin. SALAMAT PO😊

    Yung river easement sir matagal na di ginamit ng govt.ngayon gusto na nila gamitin mataas na mga niyog at fruit trees nagbunga na may rights po ba na magclaim ng bayad sa mga damage trees.almost 50 years na tinaniman po.

    About 15 years ago, 1000 sqm of my inherited property was offered by the government to buy for road project & my land was buldozed but I was not paid & the sale of 1000sqm did not go throu. I submitted all the requirements but the road project was abandoned by the previous administration.
    I cannot use my land and worst the land was damaged because the contructor hired by DPWH buldozed the land so deep, more or less as deep as 2-storey building. What shall I do. Help me please. I am so helpless.

    part of Our land was expropriated by then Transco on2008 but up to now our titles are with them and they did not subdivided the property what agency should we consult,? We want our titles back it's 15 years since they bought the property

    Atty Batu, Good day to you sir.
    I would like to know if the implementing agency (DPWH) have copies of the transactions between the "land owner". The land owner is in quotation because I am the land owner working abroad only to find out when I went back last year that they did a road widening thru my property without my consent. I would like to find out who authorized it.

    May mga lot owner na hindi pumayag na masali sa widening Kaya imbes 3 lanes kabilaan magiging 2 lanes na lang magkabila. Ang tanong, hindi ba sila(owner) pwede ma pwersahang e comply yung lupa na tatamaan sa widening?

    Paano gagawin Sir, nauna ng nakuha ng gobiyerno a piece of our land after a road widening program more than 30 years ago pa. Pwede pa ba iclaim ang corresponding payment nito? Another, kailangan bang magparenew ng title stating the exact area now of the land after nakuha ng gobiyerno ng a piece of it?

    May property Ang mother ko. Namatay napo siya. Binabayaran ko Ang land tax nito. Wala pa akung binabayaran na inheritance tax dapat naba akung multahan.

    Good evening po, 2nd time na po ito na magwidening ng national highway, pero hindi po binabayaran ng gobyerno ang mga apektadong mga lote. Location po maharlika highway bgy San Gabriel Pamplona Camarines Sur.
    Pwede nyo po ba kaming matulungan kung ano pwedeng gawin para mabayaran Ang mga resedente along the highway. Salamat po.

    Thank you for the informative video sir. I have a question, sa negotiated sale, is there a chance to "negotiate" or haggle sa figures/amount na lalabas sa offer to buy?
    And if the property owner disagrees sa figures na lumabas sa offer to buy at hindi pa nag lapse ang 30 days to agree or refuse, can the figures/amount in the offer to buy be changed by "negotiating" or haggling with the IA or Appraising Institution?

    Sir ano po ba ang dapat kong gawin nong nagkaroon ng kadastral survey yong lupa namin nasakop ng katabi naming c Pedro ayon sa land title nila tapos yong lupa naman na katabi naming si Jose nasakop naman sa land title na hawak namin ito ngayon dito kami nakapatayo ng bahay sa lupa na nasakop ne Pedro kasama ng mga pinsan ko at mga 30 yrs na ako dito ang lupa kasi na hawak ne Perdo may kaso nag kaso sila ng tunay ng may ari c Maria natalo c Maria RTC nag appeal c Maria sa Court of Appeal at nanalo c Maria tapos napunta sa supreme Court ang hanggang ngayon humingi ako ng tulong sa abogado nagpa gawa ako ng waiver sa tunay ng may ari na c Maria dahil nanalo sila sa CA at nagpirma naman si Maria ng waiver ngayon ano ba dapat uli kong gawin

Nagtatanong lang ako May nabili akong lupa at nasa likod ako binigyan ako ng right of way ngayon pinalinis ko at pinatabunan ko ng ilan load na truck at gumasta ako ng 45k ngayon yng nasa harap ay gusto nilang makipag right of way pa sa akin eh nasa harap naman sila ng kalsada ngayon ang sabi ko ok lang kng makikipaghati sila sa nagastos ko ayaw naman nila ano ang dapat kng gawin para malutas ang problema at walang gulo
