Great video! I am glad I have stumbled upon it. For the past 6 years, I have been under direct consumer services here in Texas. I work with two clients (mother and son). Basically, a company pays me my checks although the mom and son are technically my bosses. One of them is under PAS and the other STARRPLUS. Starting a company has always been an idea. I believe the company paying me is basically the middle man? If I started my own home care agency, would I be like that company (the middle man)? My clients have told me to go for it and they would still remain my clients.

Your situation is called Consumer Directed Services. Yes the company paying you is just the middle man. Yes you can open your own PAS Agency and keep them as clients. But there is an overhead cost for it, licensing and billing, etc. let’s talk.

Yes absolutely! You can always change the address later if you move or when you’re ready to get an office. It’s only $30/30 days notice to change your agency address.

You’re welcome! DADS is now HHS. HCSSA is the license you’d be getting, when you apply to HHS. Once you’re licensed you may get credentialed for Medicaid, if that’s what you meant. Outstanding student loans are not an issue for l licensing.

Does the administrator have to be any of the things the alternate admin has to be as far as RN, Dr., Social worker. ?
The requirements for both positions are the same. The minimum requirement is a high school diploma/equivalent and at least 1 year of hands on exp caring for a person with functional disabilities.
If you’re asking if the Admin has to have a “higher” qualification than the Alternate- no.
My question is I was signed up with MHMR Tarrant county that put me through to this hhs agency to work for as a caregiver for my son and to get paid. Can I get the provider's license and still get paid to be my son's care giver
I know that’s a possibility in PAS for adults. I am actually unclear about how that works for MHMR/IDD. But I believe it falls under “self directed care”.

No. You’d have to pay a fee, and meet the additional staffing requirements but you’d just add a category. Should be

No you don’t. The state licensing department doesn’t care about those things. So you have time to set them up.

Can a PAS Home Care Agency operate the business from a home office when just starting out? This is for a small business in a small community.
Yes you can! You can remain in your home office as long as it’s feasible for your agency. If you decide to move you just have to notify the state with a 30 day notice and pay a $30 fee

The owner and administrators must have a social security number. Otherwise, residency is not a factor.

If I start with PAS and then added skilled nursing down the road, would this make the process more complicated and be added stress? Would the fees cheaper or more expensive?
To add another category to an existing license is less than $100. If you want to do both eventually I recommend doing 1 at a time, because you must sign up a client in each category within 6 months of licensure. There’s a much bigger investment in starting skilled home health as well.
Do you know if this is the same for renewals? The same process
Not quite. For renewal, HHS will pre-populate a renewal application for you about 90 days before your license expires. (It will be about 30% incorrect for some reason) and you’ll need to correct and complete the application with required documents, and pay and submit for your renewal 45 days before license expiration.
Can the agency owner be the alternate administrator?

Does the alternate administrator need the experience as well.
Yes. The qualifications for administrator and alternate are the same.
I'm an RN in Texas with a Compact license, do I have to get Fingerprints for my Application?
No you don’t. With the info you put in the TULIP application they’ll run your background.

I have a major criminal record when I was young but charged as a adult. However I have since change my life and work in the field in Alaska under a variance. Does Texas has a variance process that you go through for individuals who had a barring crime.
I am not aware of any such variance program, however there is a time limit on many of the convictions barring employment, of 5 years or 10 years. But some convictions do not have such limits. I recently received my License and Medicaid approval in Texas. Where can I find legitimate forms and documents for my agency, caregivers and any other assessments that we must have for audits and records?

The application requests the social security number for the owner(s). And Driver’s License if you have it, this is what they use to check backgrounds. So regardless of citizenship, if you have SSN, you should be good to go.

Please clarify CDS. If you have at least 1 year experience as a CNA, you qualify to become an administrator for PAS. Does this help?

@@tonyajohnson9949 I believe the best route to provide CDS is to get a PAS license so that you can serve as many people as possible. If you’re not a licensed agency, you’re legally not permitted to provide care outside your own caregiving time, in other words you can’t hire a caregiver and place them with a client.

Yes. But the process is taking less then 3 months, and once you receive your license, you have 6 months to sign up a client and submit for survey readiness. You must have a physical address to use for the application.

In home care there is no “licensed administrator” the agency becomes licensed and designates an administrator and alternate admin.

To get your license you’ll need the initial 8 (out of 24) Administrative CEs for you and your alternate administrator. And you’ll both need to take the 1-2-3 modules on the HHS website.
