    In the instances where you're charging each individually when more than one is committing different crimes / distinct acts of the same crime simultaneously (the polyjuice, for example), they would have entered into a criminal conspiracy so all would be charged for all crimes in furtherance of said conspiracy, whether or not they were directly responsible for the individual counts. So for instance, each of the Golden Trio would be charged with 6 counts of ID theft via polyjuice: 2 counts each from the Slytherin common room, 3 each from the Ministry of Magic, and 1 each from the bank.

    During the year Ron used Imperio on the Goblin, the unforgivable curses were legalized and there for he gets out scotch free. I'd argue that using the time turner is a fraud, because no student is meant to have them. The accusation goes for McGonagall too since she was to give Hermione the time turner. Good thing you are judging only by the movies, in book 4 she can be found guilty in:
    1.Kidnapping. 2.Torture and starvation. 3.Blackmail in threats. All of these were done against Rita Skeeter.

    I would count Harry using Sectumsempra on Malfoy as self defense, considering Malfoy cast the first spell (in the books he tried to cast Crucio) so Harry was really just defending himself, like with Quirell.

    Don't know which legislation we're going by, as some of the punishments provided here differ from the Swedish legal system, but there are some additions that would at least exist in my country:
    - 4:50 Attacking a member of the court during a trial would not be regular assault, but violence against a public servant (+2 years) and gross interference in a judicial matter (up to 8 years)
    - 6:10 I would argue breaking and entering over trespassing.
    - 7:15 Should be considered child endangerment.
    - 24:04 I wouldn't call Dumbledore's Army an illegal business, as it is in no way commercial. However, it could be considered unlawful military activity (2 years) if not armed threat against the legal order (6-10 years).
    - 27:40 Again, violence against a public servant (+2 years) and gross interference in a judicial matter (up to 8 years).
    - Besides aiding in the escape of a criminal, Harry and Hermione are also guilty of protecting a criminal due to knowing of Sirius' whereabouts without reporting him.

    For Harry: Accidental magic like the vanishing glass and inflating Marge doesn’t count. That said: Marge provoked Harry, just like Dudley and Vernon also provoked him into pointing a wand at them. (Doesn’t excuse what Harry did, but it’s not like they were innocent)
    Also: the Imperio on the Goblins wouldn’t necessarily be a Life Sentence. The books say using an unforgivable on a Human is a life sentence. Goblins aren’t human. Might be a bit of a problematic law, but technically Harry didn’t break that law on those cases with how it’s explained. I’m pretty sure they say multiple times that it’s using them on a human is when it’s illegal.

    You know it would be interesting to see how some of these charges would stick in magical court. I do imagine that Dumbledore would’ve probably dismissed like some of the detentions and such although they did serve detention a few times so that’s something that you probably should’ve kept in mind, I would say that since a lot of this happened on school grounds, I mean, you know again that would be up to Dumbledore whether that punishment or not sticks. As for all the others, I think they deserve a full pardon because they were trying to save the world. As for Malfoy however I do think he deserves a lesser punishment and I do think that putting him in therapy and rehabilitating him would make a lot of sense.

      True, but who would be charged, Ron or McGonagall? If a teacher orders a twelve year old student to make an experiment which involves animal cruelty and the student does it, who will be charged, the teacher the student or both? I would intuitively only charge the teacher, but I am not sure.

      Harry seeked Malfoy out. We hear him calling Malfoy out and arriving. “I know what you did Malfoy. You hexed her didn’t you?”Draco began casting spells as Harry went closer to him.
      Would X be able to claim “Self Defense”if they arrive with the intent of confronting Y?
      I think Draco can also make the claim of Self Defense.

      @@kendraroth1276 If someone who is armed, but has not threatened to use his weapon or pointed it at you blocks your way and accuses you of a crime is it self defense if you draw a weapon, aim for the head and start shooting without warning? By the laws in my country (Germany) Malfoy at the very least would have to tell Harry to stay back or fire a warning shot otherwise he couldn't claim self defense. Is it possible by British laws to try to kill someone who apporoaches you angrily without warning and claim self defense?

      Also I was going by Hogwarts rules and laws. By Hogwarts rules and laws, Draco’s actions do indeed count as self defense. If you go deliberately seeking someone out to either confront them. spy on them or get them into trouble, they are allowed to attack.
      Examples include.
      1. Bertha when she was with Dumbledore and reported someone hexing her. Dumbledore’s response was to ask her why she was with the person in the first place.
      2. Snape during Sirius’s “trick”. Instead of Sirius being held accountable for nearly having Snape killed and using Remus as a weapon. The only one held accountable was Snape. “I heard about what happened the other day, you went wandering under the whomping willow and James Potter saved you from whatever’s down there”
      3. Hagrid was never held accountable for leaving Draco Malfoy and originally Neville alone to deal with Voldemort in the first book and threatened Draco with expulsion, since Draco wanted to inform the teachers and Dumbledore about Hagrid’s dragon and didn’t want to risk his life.
      4. Fred and George were never held accountable for what they did to Montague. Neither were Harry and Ron for what they did to Crabbe and Goyle during Chamber of Secrets or in Half Blood Prince.
      Also Draco wasn’t trying to kill Harry, he was trying to use a different spell.

      @@kendraroth1276 The spell Draco used was aimed at Harry's head and when it missed it caused the wall behind Harry to explode. This implies that if Harry hadn't ducked in time his head would have exploded which seems pretty life-threatening to me. That's why I think he tried to kill Harry or at least took the risk to kill. This is different from most of the examples you mentioned and I doubt this is allowed.
      I am also not sure whether the examples you mentioned really fit.
      1. We see what Dumbledore says to Bertha, but we don't see how the conversation ends. He could have asked her to completely understand what happened and we don't know whether the student who hexed her was punished or not.
      2. We know Dumbledore forbade Snape to tell that Lupin was a werewolf, but we don't know whether he was punished in any way. We also don't know whether Sirius was punished we know he wasn't expelled. 3. Draco got a detention because he was out of bed at night. Hagrid told him he would be expelled if he refused to do the detention. When McGonagall decided to give him detention at least in the books she didn't believe there was actually a dragon, she thought Harry had made up a story about a dragon to lure Malfoy out of bed and get him in trouble. After Draco and the others were given the detentions McGonagall apparantely decided being send in the forrest to find out who killed the unicorns was a fitting detention. Why she did this is beyond me.
      4. Montangue was not going after Fred and George, he was doing his duties as a member of the inquisitorial squad. Also Hermione says they will be in serious trouble, which implies they were not allowed to attack him. But by the time Montangue was found and had recovered enough to say what had happened to him Fred and George couldn't be punished according to the Hogwarts rules, because they were no longer at school. As for Harry and Ron attacking Crabbe and Goyle in Chamber of Secrets, nobody knew what they had done until they told Dumbledore months later and he basically said: "You saved Ginny, removed the threat from the Chamber and made sure Hogwarts is not closed, so I won't punish you, no matter how many rules you broke." which were clearly special circumstances.
      There is also an example that proves you are not allowed to attack students who go after you: In Chamber of Secrets Malfoy takes Riddles diary after it falls out of Harry's bag. Harry disarms him to get back the book and is punished. If you are not allowed to use a disarming spell which is pretty harmless to get back a book another student stole from you I seriously doubt you can just fire a potentially more dangerous spell at a student who shouts at you.

      @@patrickdematosribeiro1845 The wall didn’t explode when Draco was fighting. What are you talking about? There’s a sound and a light, but we don’t see much other than that. It’s no different than the spells Harry was casting. Whatever Draco’s intentions were, I doubt it was murder. If you read the books, Draco wasn’t using any spells that would have killed Harry. (Though he did try using an unforgivable.)
      All of my examples except for Bertha could have resulted in deaths.
      Voldemort and Quirrel easily could have chosen to murder Draco, Neville, Hermione and Harry. It’s only Draco Hagrid consistently left alone to deal with Quirrel/Voldemort. In the books, McGonagall herself was shown dragging Draco by the ear just because He was out at night telling her about the dragon.
      Werewolf Remus easily could have murdered Snape. It remains to be seen if Sirius was ever held accountable by anyone other than Snape.
