They are just the same concepts. As im sure you know each states exam is private. They don't give out the test questions. They do however give a list of concepts that will be on the exam and thats part of how we derive our study materials. Hi! I have a question about question 51. I’m in NC and I was taught that, if a party is found to be incompetent, that makes any contract voidable at the option of the incompetent party, not void. Is this not the case?
Hi Mary, the whole "void vs voidable" debate can be complicated. Many times with these exam questions "it depends." In this instance the question states her client was previously ruled as incompetent. So therefore the contract is void. Remember in order for a contract to be void: it must lack one or more elements; meaning it has no legal force or effect. Since it lacks the element of "sound mind" it is void. I am sure exactly the specific law in NC, whether or not if the incompetent party has an option or not. However either way, in this specific question it would be labeled as void. Doing a quick google search I found this from the ncsu, it says: "if the party with diminished mental capacity cannot act in a reasonable manner regarding the contract and if the other party knew of the defect, then that contract is void." projects.ncsu.edu/project/are306/lecturenotes/Unit6NContracts.pdf

While the real estate exam questions are not exactly the same you’ll see on the exam(as copying questions verbatim is illegal), we do, however, use the concepts and laws associated with the questions typically on the real estate exam.
They are practice real estate exam questions. They cover all the concepts you need to know for the real estate exam. While they are not word for word carbon copies, they are the same or similar concepts.
Right now we offer state specific stuff for fifteen different states. The national portion stuff we offer is for all fifty states though. That's the national portion, so check that out!
Wow! Question 54 - can you sue the previous owner if that deed restriction damages the house -ie sentimental tree falls on it! Can you be sued by previous owner if lightning destroys their deed restriction - or vandels burn their Confederate symbol???
Not sure about that question. You probably would have to consult a lawyer to determine whether or not you could sue. You might have some legal grounds, but we're not lawyers here so we cannot give legal advice, haha.
My big quandary with the answer for question #41 is isn't family status protected under the fair housing act? Wouldn't being non-widowed (or widowed) be considered a family status under that law?
A couple things. First as I mentioned in the video its specific to the 1968 act, not any state specific amendments, or updated versions, the test will often do that to try and trick you. Bring up old laws, or federal ones, that may contradict your state specific, which makes it super important to learn both the federal and your state specific laws. With that being say the with the 1968 act people can look for roommates as the same sex. The fact that she is looking for another widowed is protected by the "Mrs. Murphy exemption". "Mrs. Murphy" is a hypothetical elderly widow who converted part of her home into apartments to supplement her limited income. The exemption says that if a dwelling has four or fewer rental units and the owner lives in one of the units, it is exempt from the FHA. In this scenario, Mrs. Murphy can be selective. So she can select a widow. I should have mentioned that more in the video, I will definitively do that next time. Thanks for asking! Hope that explains it better.
Practice questions are good but it would be much more effective if the guy had a better grasp of the llegal vocab in order to offer an explanation as to why an alternative oftently chosen but incorrect answer is incorrect. He is purely reading from the explanation

I wanted to take this practice test online but they don’t have my state to choose from or does it matter. New Jersey
