The legal terms are "derivative work" and "parody." Derivative generally means it borrowed for the purpose of recycling for a profit, parody means it used the content for the purposes of commentary and typically not for profit. Fine line and the courts almost always side with the corporation. Not that it ever gets to court. They don't issue takedown notices to take someone to court - they do it to let them know that any legal action would completely bankrupt the smaller company so they'd better comply regardless of whether they're legally in the right.

But when it copys the style in hopes people would mistake it for the original, but don't give any unique content itself, usually not even doing the things the original does that well, it's a rip-off. If they try to make you believe they are the original, they are a rip-off. If they do anything they can to make sure people know it is a different game, it ususally is not.
It was very shaky legal ground to begin with on that one. All assets used may of been similar but were original to its creator. Nintendo had a lot of power in those days.

More than that, it set legal precedent which established that gameplay can't be copyrighted, which was a pretty significant sea change in the legal landscape. OwGash what did they expect. They used a copyrighted name, copyrighted pre-existing Pokémon, and just added tons of new lackluster mons as well as an awkward story.
I know this is 3 weeks old, but I can come in knowing a touch on copyright. When it comes to Intellectual Property, you have to be very aggressive to protect it. Especially if its worth as much as the Mario IP is. If you allow "Non-profit" games to rise, you start to lose your rights to the IP and those who do eventually want to profit off it will find loopholes. So in Nintendo's case, its an All or lose it situation. No company wants to lose a multi-million dollar IP. Pokemon Uranium knew what they were doing. By using "Pokemon" in the name, they were found out a lot quicker. If they had used a completely different name, they mightve been able to get away with it, but they used a well known IP to gain viewers, players, supporters and the like. So in the end, Nintendo just did what they do. They protected their property.
i have a few really awesome rom-hacks. on the super nintendo there is zelda parallel worlds, zelda goddess of wisdom, and zelda ancient stone tablets. theyre fan made games, and oddly enough it seems nintendo supports them. im assuming as long as they get the biggest cuts of the sales.
Fan games and rom hacks are different. Japanese copyright laws state that fangames are basically theft but rom hacks are fair a lot of the time because they use the existing content of the original creator, and just edit it. So things like Mario and Zelda rom hacks tend to be fair game.

I came across them by pure dumb luck, so I really don't know much of anything about them other than what I've been told by game shops.
The other 2 are actual ROM hacks, the only reason they're not taken down is that there isn't anything illegal about ROM hacks as the guy stated above. No ROM hacks are approved by Nintendo, they just can't do anything about them. Same could be said for the Ancient Stone Tablets, considering the hack wasn't made by Nintendo, just people who wanted to play the Japanese exclusive.

Well because in a legal sense there is no difference between a rip-off and a fan project. There is obviously a difference in intend but legally there isn't. So if they would allow high profile fan projects then other companies could start calling their ownership of Mario's IP into question. Nintendo could endorse some games like Sega has done but they are hesitant of acknowledging projects done using their IP's that they had no control over. I do see Nintendo changing this though. As programming software becomes easier and easier to work with and the amount of internet users continues to increase the Nintendo fan projects will only continue to increase in quantity and quality. Nintendo can only keep ignoring them for so long.

They also shut down a cool pokemon game that they have the developers permission to make, called "Pokemon adventure" it was an online multiplayer game, where you roleplayed as pokemon. 3 months later they were slapped witb a cease and desist when they heard about the concept. They revoked their agreement and took down the game.

The legal terms are "derivative work" and "parody." Derivative generally means it borrowed for the purpose of recycling for a profit, parody means it used the content for the purposes of commentary and typically not for profit. Fine line and the courts almost always side with the corporation. Not that it ever gets to court. They don't issue takedown notices to take someone to court - they do it to let them know that any legal action would completely bankrupt the smaller company so they'd better comply regardless of whether they're legally in the right.

You left out the biggest Mario ripoff Pandamar on the Power Joy, which was a different name for the Power Player Super Joy III, a console filled with a ton off ripoff games that came out in the early 2000s. Nintendo took legal action against the makers of the console and the FBI arrested a guy for selling them at a mall, 4 chinesee guys, and confiscated 60,000 consoles. that perfectly fits the description "Super Mario Rip Offs That Got What They Deserved".

But when it copys the style in hopes people would mistake it for the original, but don't give any unique content itself, usually not even doing the things the original does that well, it's a rip-off.
If they try to make you believe they are the original, they are a rip-off. If they do anything they can to make sure people know it is a different game, it ususally is not.

It was very shaky legal ground to begin with on that one. All assets used may of been similar but were original to its creator. Nintendo had a lot of power in those days.

OwGash what did they expect. They used a copyrighted name, copyrighted pre-existing Pokémon, and just added tons of new lackluster mons as well as an awkward story.
I know this is 3 weeks old, but I can come in knowing a touch on copyright. When it comes to Intellectual Property, you have to be very aggressive to protect it. Especially if its worth as much as the Mario IP is. If you allow "Non-profit" games to rise, you start to lose your rights to the IP and those who do eventually want to profit off it will find loopholes. So in Nintendo's case, its an All or lose it situation. No company wants to lose a multi-million dollar IP.
Pokemon Uranium knew what they were doing. By using "Pokemon" in the name, they were found out a lot quicker. If they had used a completely different name, they mightve been able to get away with it, but they used a well known IP to gain viewers, players, supporters and the like. So in the end, Nintendo just did what they do. They protected their property.
i have a few really awesome rom-hacks. on the super nintendo there is zelda parallel worlds, zelda goddess of wisdom, and zelda ancient stone tablets. theyre fan made games, and oddly enough it seems nintendo supports them. im assuming as long as they get the biggest cuts of the sales.
Fan games and rom hacks are different. Japanese copyright laws state that fangames are basically theft but rom hacks are fair a lot of the time because they use the existing content of the original creator, and just edit it. So things like Mario and Zelda rom hacks tend to be fair game.
The Ancient Stone Tablets was originally made by Nintendo for the Japanese exclusive online thing for the SNES.
Bradley sinodhinos I had no idea. I just thought all 3 were fan made rom hacks. Were the others Nintendo, or were they actually rom hacks? Or could they have been roms that were approved by Nintendo? I came across them by pure dumb luck, so I really don't know much of anything about them other than what I've been told by game shops.
The other 2 are actual ROM hacks, the only reason they're not taken down is that there isn't anything illegal about ROM hacks as the guy stated above. No ROM hacks are approved by Nintendo, they just can't do anything about them. Same could be said for the Ancient Stone Tablets, considering the hack wasn't made by Nintendo, just people who wanted to play the Japanese exclusive.

Well because in a legal sense there is no difference between a rip-off and a fan project. There is obviously a difference in intend but legally there isn't. So if they would allow high profile fan projects then other companies could start calling their ownership of Mario's IP into question. Nintendo could endorse some games like Sega has done but they are hesitant of acknowledging projects done using their IP's that they had no control over.
I do see Nintendo changing this though. As programming software becomes easier and easier to work with and the amount of internet users continues to increase the Nintendo fan projects will only continue to increase in quantity and quality. Nintendo can only keep ignoring them for so long.

They also shut down a cool pokemon game that they have the developers permission to make, called "Pokemon adventure" it was an online multiplayer game, where you roleplayed as pokemon. 3 months later they were slapped witb a cease and desist when they heard about the concept.
