    I remember reading about case like this once. The biological parents didn’t want the baby because it was premature and would be too much work so the surrogate, who had bonded with the child, took it in instead.
    Flash forward a year and half where the child was a perfectly healthy, happy baby and then suddenly the biological parents ‘changed their minds’ and wanted the kid after all!
    They claimed it shared their DNA so it was theirs! It was basically like the surrogate had done the hard work of caring for it when it was ill and now they could have the baby when it was healthy!
    I remember being so mad reading it but then being so freaking happy because the surrogate won the court case or something and kept the child!

      usually in that case everyone needs and should sign some paperwork. i would not trust anyone over their at-time emotion and decision anymore. the bio parents should sign something that proved they gave up their child's custody, correct?

      @@pascalemayne9518 Il y’a des parents qui ont des raisons médicales valides pour ne pas porter leur propre bébé. Sans l’aide d’une mère porteuse, ils ne pourront jamais avoir leur “propre” enfant. C’est une bonne chose pourvu que le contrat soit bien écrit pour le bien de tous les partis impliqués.
      C’est en effet une honte de rejeter son propre sang juste parce que le bébé est prématuré.

      I was 7 and a half weeks premature but I'm fine plus despite premature babies are meant to be shorter I ended up at 6'2 so uhhh... yeah no issues

      I was 3 months premature, I was tiny and had serious health problems, but that was 27 years ago. I'm perfectly fine now.

      Abusive contracts should not be legal at all... And a contract that puts selfish parentig desires over the dignity and walfare of a newborn is abusive and beyond... I see it as borderline to preverse.

    Not equipped to deal with a premature baby??! Babies arent toys that never get sick, if they wanted a child, they probably know a child comes with being sick sometimes, you can't just stop being a child's parent because they need your care more than usual. Wow, those parents are not parents at all.

      Shit like this in real life makes me mad. Like when parents put their kids up for adoption just because they get born with complications. People shouldn't even consider becoming parents if they wouldn't be able to take care of a child with poor health, "special needs" or a disability. Like, even if a kid is born healthy, an accident or illness can occur at any moment. Suddenly their kid's vision could go away, they could get brain damage from trauma, cancer, perhaps psychological problems. And still, shit like this actually happens. It's so pathetic.

      I will say though, some people with special needs shouldn't have children. For the sake of the children. I've seen kids who struggle because their home life is so chaotic. Children should be considered a gift, not a right.

    As a Brit this is so shocking. It's illegal here in the UK to pay for someone to be a surrogate for you and I think this is why.

      It is also illegal in Australia and Canada. Probably elsewhere too but those are the ones I know of.
      I'm sure that that is why, but I don't see why anyone would put themselves through that without money... unless possibly for a sister or someone you love.

      It's not illegal to be a surrogate for someone in the UK, when you do midwifery at school the prepare you for births with surrogate mommas. However in the UK there are laws protecting the mother and baby that have to be put in place. I have no idea why the American laws allow this kind of thing to happen, its crazy
      EDIT: just thought I'd add, you don't necessarily "pay" someone to be a surrogate. It's more like the bio parents give the mother money for the pregnancy costs so medications, maternity clothes etc. and I think the surrogate gets some money for carrying the child but the surrogate has to be psychologically assessed beforehand and it all has to be arranged through lawyers etc.

    I was born 6 weeks premature, small and with under-developed lungs, very similar to the baby in this clip. I am now 15, about 5'11" and I sing and play the flute which are both activities that need good lung capacity. Just because a baby is small, doesn't mean they can't grow to do big things. I know its just a show, but this is a message I want to share.

    How is it adoption if the child is genetically born of them? The child in no way is the surrogate's responsibility. If people like this actually exist, they really didn't deserve that child.

      @@AR-jz4os it is also the case in my country,in fact on the birth cetificate it is the surrogates mothers name as the mother the bio mom must adopt the child.there was a big case this year where the bio mom challenged these laws as the egg was her own she just could not carry the child to term so they opted for surrogacy only for the Hospital to refuse to allow the bio mom from taking the child even though the surrogate was already on board,the police were involved and she was almost charged with kidnapping.The case is still in court but the child was released to the father. It needs further evaluation some argue it is almost punishing to the woman for not being able to carry her own child,a very complicated issue!

      My friend was actually told that if she won't have her child now(17y) that she won't be able later on
      Thankfully she had an awesome boyfriend he's her husband now (20y) and they have a little girl
      I'm so happy for them and feel so sorry at the se time...couse I now they'll never be able have another and the only other option is adoption
      So I kind of don't get those two who abandoned their baby

      We will all be custom build androids very soon. Humans made hybrids because our fragile bodies won't survive what the technology expects of us. Smarter, prettier... It will be better place. Give it another 100 years.
      I don't like the idea of a custom baby either. Still - we wouldn't be here if not millions of our species would have decided to have children based on superficial genetics and character traits, enslaved by biological needs. Can you blame someone for behaving like an animal that wants the best offspring? I am not so high an' mighty. Call me cold hearted but every child that is being aborted is a choice someone makes and every single one of them is at it's core to serve interests of the animal we all carry inside us.
      And the world doesn't care about any of us. Alone we are worthless. Just a small number on the big globe.

    Theres no way this is a real scenario.
    "Our clients are desperate to have children." If they pulled out so easily, they're not that desperate. The surrogate mother is the one who was actually desperate, not them. This is just gross.

      Actually it’s pretty common, especially amongst the “pro-life” community, if the baby isn’t a “perfect” (healthy, no defects etc) the surrogate parents won’t want it. It’s horrifying but that’s also why there’s so many kids in the adoption system

      Christian Aquilina The surrogate agrees and is willing to go through with it. It’s not like the people who are in need of a surrogate is getting one just because, it’s because they cant. Maybe infertile or a gay couple. They’re being paid, sure, and most of the time people don’t become surrogates just for the money but to help out others.

What does worry me is the poaaible systemic abuse that could result from putting a price on such things, with all the terms and conditions which could screw over the surrogate.

      This is basically human trafficking. The social worker lady even mentioned it. They are just doing in a "legal" but illegal way because they are preying on vulnerable and desperate women to follow through what the company and their clients want. If it doesnt fit their standards then they dont get rewarded. Human trafficking is not always about being "forced".

      The point is this:
      (Warning, morale won't be needed after this point) if you buy a race horse but you get a slightly sick horse instead:
      How do most people react? If it comes from your own stable the situation is obviously different. It is your flesh and blood but without the emotional connection of seeing your horses all the time - you wouldn't buy a lame horse when you payed for a healthy one.
      Life is unfair and heartless. Sadly we humans have a tendency to be like that. This is why we rule this earth and sometimes even each other.

    I am not familiar with American contract law but it shouldn't be possible to "pull out" of a contract that was basically fulfilled.
    The risk of the baby being unhealthy should only be put on the surrogate If she willingly did things to harm the baby (for example taking drugs, drinking) That would classify as a violation of the contract and only then the Buyers should be able to terminate the contract....

    This just makes me sick to my stomach. My brother had a surrogate in the US(we are Canadian). He wanted a baby so badly that he would take whatever came out. My nephew was born full term, and the surrogate was amazing and very well compensated. My brother is an amazing Dad who loves his son more than anything. We were fortunate. He is a beautiful, healthy, 7 1/2 year old and is the love of his Daddy’s life. I wish all surrogacy agreements would end this way.

      unfortunately surrogacy companies under this capitalistic system prey on women of poor backgrounds or even poor countries with no protection for the surrogate whatsoever. Surrogacy in general is not unethical IMHO, but of course the moment it becomes a business, the moment abusive practices become profitable.

    My best friend was born 2 months early. Her lungs were also underdeveloped, and she's deaf in one of her ears because her ear drum did not develop. It's 13 years after she was born and she's healthy as ever. If her mom can do it I'm sure this child's parents can raise her.

    This is absolutely horrific! The surrogacy company in this situation does NOT protect the person who is carrying the baby. This is a direct violation of human rights. The clients are completely in the wrong as well with unrealistic expectations. First of all she's already given birth twice there's no guarantee she would make it to term even if she had no previous pregnancies and no way to predict complications. I hate how the representative from the surrogate agency is treating the surrogate AND the fetus as OBJECTS. That their lives don't matter unless they hit a certain criteria. Also that she doesn't hold the clients accountable that their flesh and blood is alive and well, yet they just pull away from the agreement like their BABY is not good enough.

      Suspected placental abruption, pre-eclampsia and HELLP syndrome would all culminate to cause the blood stained amniotic fluid. The retractors, however, were used incredibly brutally!!!

      it's bloody because the placenta had seperated from the uterus (explain in the beginning) which cause excessive bleeding which is why it looks different and more bloody, but it's also a TV show to more blood=more drama

    The biological parents and surrogate CHOSE to have this baby, regardless of the consequences. They only cared for themselves. I understand that the surrogate mother doesn’t want to keep it but she would’ve known the high risk of the biological parents not wanting to keep it. She was too desperate that she put herself, her children and this baby at risk. This baby is unwanted by both its biological parents and the woman who carried her. How would that feel ? Shame on all of you

    Is this is really how the system works? If so, what load of nonesense, change this stupid system!! I was premature with a cleft palet born 7 weeks early, thank the Lord I have loving parents.

    Edit: and then really bloody depressed when he tried to give the baby to the woman and she refused.

    I feel like no parent would really be that cold and cruel to just abandon their baby - the agent probably lied to them or exaggerated the baby’s condition so that she could profit off of it.

    Some people just do not deserve to be parents. If you want a child that badly then nothing and I mean absolutely NOTHING would put you off! Physical health, appearance, race, mental health, age, gender, nothing should make the blindest bit of difference because last time I checked parental love is completely UNCONDITIONAL!
