    Runkle, just so you know, the feed skipped over the defense's argument about the late disclosure issue literally in it's entirety.
    It unpaused where the defense rested and the state gets to respond with argument.
    Sadly, TH-cam live still does this on occasion for some reason, just jumps up to real time with little indication except a stutter and what gave it away for me was the stutter + Baldwin just took off his glasses and suddenly those glasses were on him as if time had jumped, and it jumped substantially.
    You did notice something off but didn't realise this specifically happened.
    Just wanted to let you know (if you even do read these comments) so you are aware of that during upcoming live trial (assuming you're gonna be behind on 1.25x or normal speed as much as you can, to skip breaks etc) and so you don't miss these parts. This has happened to Emily D Baker as well, it's unfortunate.
    I had to watch this part from the feed itself because it was very interesting and really wanted to hear your thoughts & insights, as a lawyer, on those arguments etc.
    In any case, as usual, thanks for the coverage & your breakdowns, really enjoy them, very entertaining!

    Something I really want to know about is how relevant the on-set power dynamics matter for legal liability. And accounting for his producer role touches on that but doesn’t quite get to the scope of what I think needs to be addressed.
    Because Baldwin had *massive* power on that set, for a lot of reasons. The fact that he was able to misbehave and ignore safety rules without consequences, and the reason he was able to order around the crew and all that, was because of the unique position he had wrt the project.
    It was HIS project. He co-wrote it, he was the lead, he was a big part of the potential commercial success of the film, and therefore directly a reason for at least a decent portion of the financing the film received. He had so, so much clout on that set, and treating him as ‘just an actor’ is a really, really inaccurate picture of the dynamic his actions actually occurred in.
    I think what im trying to ask is that because of his combination of circumstances, he was both in a position of power and essentially uncheckable on-set, and is that a viable legal argument, and if so how, and if not, why not and what is possible.
    Also, personal opinion, the nepotism baby/entitlement narratives about Gutierrez reed were unfair, and are much more accurate applied to Baldwin.

    Im at replay and 2,5 hours only, but damn even Kari made me crazy in last trial and is so condecending, but she has so good arguments, is passionate and also NOT A single kinda, sorta, whatifanys! Thank god!! 😂 I think I just have Lally PTSD because after Hannah trial I was like, I cant wait for Balwins lawyers to go after Morissay. Now Im like wuhuu, go Kari and thanks for not being boring at all!!! 😄

      Same, I think I would definitely find her tone annoying if I was the judge/defense and I *do* find it annoying when I disagree with her, but as an outside observer I really enjoy the snark when I'm in agreement 😂 and I can always appreciate the passion behind the snark

    An audio compressor is a filter that automatically increases low audio and limits loud audio, its perfect for bringing up low volume voice without clipping the audio.
    OBS has it in the audio filter menu, I assume stream labs has something similar.

      Unfortunately, one of the most common complaints many streamers have with Streamyard is the software’s automated audio processing that gives the streamer very little insight into what their audience is hearing. From what various streamers have said, Streamyard does some sort of post processing which involves attempting to automatically level the volume from multiple sources while simultaneously not giving the streamer an option to hear what their audience is hearing. Based on reading chat of various streamers when these audio issues arise, OBS gives more control to the streamer, more buttons to manage but the ability to have control

    I think it is very important that Baldwin was producer. He was using this to intimidate other crew members and as producer he cannot argue "i am just dumb, good looking actor, I just do what others tell me on the set". And I bet they will try to shift blame on Halls, because of his production role... they will try to argue out of both sides of their mouth... I bet we will have some lengthy sidebar about opening the door to this.
    And as a producer he should have been aware of previous misfires on the set, which should make him act even more cautious with the guns.
    And as a producer he had more motive to rush things, actors usually do not care about timing, it is up to producers to make sure that filming doesnt take any longer than needed.
    The transcripts from the sidebars will be soooo interesting

      Baldwin was not charged as a producer or actor, but as the guy who shot someone. As such, he was certainly aware of the prior safety incidents on set and that the crew walked out the day before.

    at 1:34 talking about vicarious liability - Baldwin is lucky he did not do the shooting in Australia as - In Australia, company directors can be held criminally liable for the negligence of their employees under certain circumstances, which would have included himself and Hannah, and it seems reckless enough to warrant that charge

    Very supportive of the argument that Baldwin as the producer and actor failed the safeties to expediate shooting. Also he's the investor as another reason to cut corners to save money cause it's his payout as well he's protecting.

      I think the videos of his behaviour on set should have come in as that was him creating the environment that allowed the incident to happen.

    I do think there is an argument with Baldwin's role as a Producer makes him responsible to be more aware of the safety issues and concerns that were being violated than a simple actor. If he was simply an actor, there's an argument that they may not be know of problems on a greater level and couldn't have behaved with the precaution that knowledge may give. To bring this up however, you have to touch on the responsibilities of a producer and what they should have known.
    Innately it is a messy web in that Baldwin is an actor and a producer. I don't think you can treat his entire scope as -purely- an actor, I do agree however that it isn't the failings as a producer that matters in this case, that would be the civil, but there is some point of the deeper knowledge he had and ignored.

    About the very end re: disclosure of documents - what we've used in California for 30+ years when we are refusing disclosure on some basis, we provide a log (often called a "privilege log"). All documents are numbered. Any document not disclosed or redacted is listed on the log by number/to-from/date AND basis for redaction or nondisclosure. Game playing is NO BUENO.

      I honestly don’t think Morrisey was doing much wrong and she knew Bowles could have been objecting etc., so she wanted to let it play out and not over control until necessary! Just my two cents.

    At first I? was thinking Runkle was being harsh towards the older prosecutor's argument style, however after hearing her make several arguments, I now get it, she does the condescending thing every time. It makes me want to argue against her, even if I agree.

    I'm super excited for Runkle's live streaming, but I really really hope he keeps up the shorter form recaps. I'm not as interested in or have time for every case, especially this one. I have REALLY valued Runkle's recaps to zero in on the most important/impactful parts of the trial day.

    5:42:35 - Not quite. She's allowing the letter for impeachement purposes, where the people who signed it are concerned. The only extent to which she said it cannot be used for impeachment, is that the letter cannot be used to impeach someone testifying about how "everyone knew the set was unsafe" if that someone didn't sign the letter saying otherwise.

    US Army Pamphlet 385-63 specifies SDZ for blanks at 5m. This is considerably more conservative than 'a high probability of injury' but is rather the more convenient 'everyone gets to go home without injury' one appropriate for safety. It is distinctly further than the 2-3 feet that these complacent fools think eliminates all risk. There can be grit or dirt in the barrel from 'acting'. There can be a fragment broken from the crimp of the blank and/or wadding. There is the propellant gas which has a substantial pressure, velocity and temperature, and which often contains solid residues which can cause burns.
    There is of course also permanent hearing damage from unprotected discharges - unavoidable in some self defence environments (though blanks would be inappropriate there) but a risk of harm when on a movie set where the producer/actor has a duty of care.
    Safety is everyone's responsibility.

      It can imply a responsibility over the entire production and everything that happens to the lay person and the prosecution wants that. Judge made the right call to exclude imo. I still think Alec was negligent, but this is a scum prosecution team.

      Arguments:
      1. He knowingly hired an incompetent armorer because she was cheap.
      2. He always got his way because he was the real boss, including
      a. Using full load blanks when not required.
      b. Always wanting a real gun even for rehearsals.
      c. Ignoring safety protocols with impunity.

    I would agree with the producer argument, as a producer you are in a position of power and in the end responsible for things that happen or do not happen on set, even working at one of the major US broadcasters, I as an individual producer was personally liable about any safety that happens on set, you are responsible to voice any concerns and seek to resolve those issues, even if you are not responsible directly for things such as lights, or cameras, or props. As someone in a managing position you are still responsible for the safety of those employed in the crew. Sets are hierarchical for a reason, so anyone who wants to work in the industry long term, will respect and follow those in roles of responsibility.

    I'm at 2 hours, it feels like some missed opportunities on arguing the producer - I'd want to be establishing the point that he had control of the environment such that the armourer, first assistsnt director etc. were hampered in their roles; they could not treat baldwin as just another actor due to his inability or lack of desire to let others lead in their area of expertise. Thus, he cannot be treated by the jury as just an actor - it's more about the environment he perpetuated with this role that directly contributed to the death, not so much that he should have a wealth of knowledge as a producer

    Judge - “why are you writing documents and then not giving them to me or her?” Wtf? The aggression was so unnecessary. Prosecution wants to hand the judge emails to review and see they aren’t subject to disclosure and then judge immediately says do you have a copy for defense…Judge is doing better than she did in Hannah’s trial, but she still needs to check herself.

    Every time I look at the comments I feel the need to say that I really rather like Morrissey. I think she is effective, easy to understand, competent and easy to listen to. It makes me a bit sad how much flack she gets for her voice, in my opinion there’s nothing wrong with it.

    The prosecution should have been ready to argue the weight of baldwin as producer with his specific responsibilities where guns are concerned...furthermore baldwin is a seasoned actor in sets working with guns.its not his first rodeo.

    if he was the sole producer maybe he wasn't sole producer or even a actual producer he was a producer in name only ... its a way to pay lead actors more without having other actors saying well he's getting 10 million i should get 2 million ... but hes actually getting 2 million as a actor and 8 as a producer so they turn around and say well no he's getting 2 million so you'll get 400k its all a shell game

    Attorney Bowles was crap. Crap from interviews, during, and after trial.
    I am looking forward to sticking it to Attorney Morrissey. She was a bully during Hannah's trial, smug against Bowles.
    However, I do think Alec needs to do a little prison time.

      Have to disagree. She was not a bully in the slightest. She was a great lawyer and Bowles could have stopped her at any point had he been as well. This trial will differ as the defence has shown they’ve got just as much skill and push as her.

      @@amelia8357 A witness literally said yes when asked if Morrisey told them what to say, she constantly made comments in front of the jury that were absolutely inappropriate, doxed people, and even her tone were all reasons she is being accused of misconduct. When you have knowledge of what lawyers should and shouldn’t do, you see things differently. I think the jury got it right, but I don’t agree Morrisey prosecuted that case with any integrity.

    Maybe this is a stupid question: is there a difference between how you check a gun for blanks and how you check a gun for real ammunition?

      Not a stupid question but no there is not a difference - if you are checking for it to be unloaded it should be empty - ideally if you want to know there should be rounds there but need to know if they are dummies or blanks they should be visually marked i.e. no primer or crimped ends or each individually checked i.e. with a ball inside and rattling them

      In the gun live and blanks would look similar. If out of the gun you can see that a blank has a crimped end because the projectile has been removed. Blanks of course will make a bang because they still have gunpowder. Then there are dummies which have the gun powder removed, but still have the projectile at the end. They usually put bb's in dummies so you can tell by shaking them if they are dummies. You will see a dimple on the primer of a dummy which can be seen while in the gun.

    its surprising to me runkle doesn't think his role as a producer really matter much. Because I'm thinking to myself that if he was just a regular actor I probably don't think he did enough wrong to be given jail time

    This prosecution team is absolute garbage and I can’t stand Morrisey. I don’t like this judge either although she is doing better this time so far. The bs the prosecution got away with in Hannah’s trial is disgusting. Very impressed with the defense team.

    My issue with the producer theory is just that I grew up watching behind the scenes extras from Lord of the Rings and I'm keenly aware that a movie can have dozens of producers that all have wildly different roles. This can include people who work on the design side and are never on set, and people with money who aren't even on the same continent. Obviously Baldwin was on set, but that doesn't mean he had any producing related duties at that time. Does being a producer give him more authority? Sure, but does it make him actively in charge of how safety procedures are run, no--at least not necessarily.
