Ballerina Judge Fires at Defense After Daughter of Murder Victim is Called Out For Speaking to Media

- Eva Benefield, the daughter of slain father Doug Benefield, was called up to the stand on Thursday morning after she was found talking to the media about the trial when she was allegedly under subpoena. Defense attorney Neil Taylor asked for Benefield to retrieve her phone after he found social media posts of her talking about the trial on TikTok. The judge fired back saying that it was a waste of time, and the state believed it was a violation of privacy.

In September 2020, Ashley Benefield ran to a neighbor's house in Lakewood Ranch, Florida, and stated she had just shot her husband. Douglas Benefield had several gunshot wounds to his leg, arm, and chest area. Ashley Benefield claims she shot him in self-defense after months of alleged abuse. She was arrested and charged with second-degree murder. Ashley Benefield made bail and has been living with family and her daughter since the crime.

A person who “doesn’t do social media” should not be asking the witness about social media.
I just watched her TikTok and her posts have NOTHING to do with the case. She's doing a "fit check" and mentions the trial is starting; second video mentions how nerve wracking it is to testify on live TV; and finally, she says she finished testifying and then talks about the necklace she's been wearing to court! When you're the survivor of a crime, this is ridiculous! She did NOT mention any testimony, witnesses, the jury or even about the specific crime! This is a defense ploy!

She was told not to post anything related to this court case. She disobeyed the court order.
Ummm… she also went straight out of court and talked to reporters after she was specifically told not to talk to anyone about anything pertaining to court. No matter who she is she shouldn’t get a pass for that.

@@roseann5562 the main reason to not speak about it would be to protect identities of important factors in the case, from jury to witnesses, and they decided that not talking about the case AT ALL with anybody is the best way to avoid accidentally or purposefully exposing information that should not be giving to anyone at all. That is mainly to protect witnesses and jury from being intimidated or assaulted/murdered.
As a witness she’s not allowed to watch or read or talk about anything to do with the case until such time as the Jury is released from their duties.

She didn’t state anything about what she testified in court. Even with reporters, she stated her own personal feelings. Her posts also have no relevance whatsoever to what is being discussed in the case that can’t be accessed by public knowledge.
Judge basically said not to talk to anybody about the case, which she didn’t. What did she do wrong?

Ashley is a cold blooded murderer. There was no event of altercation between her and Doug. It is amazing that neighbors did not hear any screaming or argument minutes before the shooting.

She answered all questions forthrightly, looked directly at the people asking her questions, realized she had misinterpreted a question about witnesses in the context of the judges order and corrected her answer, then stood up and calmly walked off the witness stand. I think her parents would be proud of how she’s conducting herself.

Agreed! Hearing the mischaracterization of her father hurt her. She’s not allowed to talk abt her family, to her family. And just many of her generation, she needed an outlet. She’s been in a lot of emotions from her mother’s passing and now with the accusations against her dad. It’s hard to process that especially if you have no one to talk to in a different state.

The defense attorney was trying to get the girl to tell what she posted. That's not how this works, he should be doing his due diligence instead of wasting court time fishing for information

Thats not at all what she admitted to. She said that she posted THAT she testified....that, by itself, does not break the judges order in any way
It was 100% a fishing expedition and intimidation tactic, any halfway ethical lawyer would have reviewed all her posts before initiating this complete farce. You don't get to make assumptions that then have to be disproven, that's not how the burden of proof works _at all._
