      Alimony is paid by women too but dowry is ONLY paid by the women side. That's why dowry is illegal and alimony isn't.

      Women take care of the children. If she were a working women, then it would have been a different matter. She sacrificed a possible career to take care of the household ; it is not possible for her to enter the job market so late. On top of that, she has to take care of the children. They are his children too btw.
      If you want equal shares, don't marry a woman without a career. Take equal part in household activities and in the life of your children. Don't make handwavy statement without logic.

      The judge expects the man to pay 50k and don't assume that he doesn't want to see his kids. The court doesn't allow him to. Which is wrong.
      The actual story is this women is given the right to demand even when he doesn't have money which is sad. And as parents both should look after the child but instead she demands 1 crore . And the reality is court supports the women and doesn't care about the man's side of view. Or what the kid wants. Only women women women.

      ​@@manishrai6845 We don't whether the 1 Cr is lump sum or monthly installments. From her statements about daughter's marriage, it would appear to be a one time payment. If it is a one-time payment, 1cr is very little.
      As for 40k per month, 1) do you know how much a proper education cost today? You can just barely manage in 40k 2) Why should she "manage" in 40k? If she were a career woman, then it would be a different matter. But she is not, and she sacrificed the prime days of her life to take care of the household. Doesn't she deserve financial recuperance for her service and time, given that it is too late for her to start a career now?
      You don't know that the court doesn't allow him to visit his children.
      The courts give her the right to demand alimony (I am going to consider this as just alimony and go into child support payment). She has a right to demand alimony for the work she did for the past 14 or more years, and because she is too late to enter the job market now. Again as she said, she herself would have to take up the cost of her daughter's wedding, so she is including that in the alimony too. I don't see anything unreasonable if it is a one time payment and because the ex-husband is sufficiently rich (her lawyer has documents to prove).
      You just saw the court consider the man's view just now. What is the fuss?
      As a side note, if you people don't want to pay alimony then don't force your wives to sacrifice their careers. I know you'll argue feminism, yada yada, we never force, but in reality? Look at the female workforce statistic of India. Women sacrifice their career because they don't receive enough support from their husbands in taking care of the children. And then there are the snide, passive-aggressive comments about "what's the need? I am doing na!" , "you are neglecting the children", etc.

      More like Hindu law, it doesn’t provide for pre nup, as it regards marriage to be a sacrament and not contract in a broader sense.
      However, other personal laws do provide it.

So, if the concept of divorce can be inserted into Hindu marriages (and rightly so, because no one should be forced to stay in a marriage against there will), then the concepts of pre nups should also be inserted which safe guards the rights of both parties involved before they get into the marriage.

    I just had my divorce...in my 4 years of court journey, the more I tried to negotiate the more I lost. Finally, I gave a huge chunk of money just to get rid of it. Neither we had children neither she was unemployed. I have seen hundreds of innocent men, who just broke inside in these years..one day...one day..I will fight for this !! One day

      Beware if you are not married a prostitute cost hardly 1% compared to a marriage. A disgruntled wife can drag your whole family into court making sure that you end up loosing money, parents, jobs and property, while a prostitute just cost a bit or fraction of what you endure into marriage even if a prostitute blackmail you then it is you who will suffer not your whole family.

Here women are treated as things, their skin colour, height everything is checked including childbearing acceptable age till 30 years in an arranged marriage. After 30 years most women are considered useless for marriage in middle and lower-middle-class families. This is India, not America my friend.

    Divorce is only available to wives, it is never available to Husbands.
    After divorce, the wife doesn't have any responsibilities towards the husband, she is free.
    But Husband is not free, he has to bear the expenses of the ex-wife just like when he was married.

      If a wife was not earning when she got married, she should be given money, cause if she spends let's say 10 years as a house wife, it would be difficult for her to get a job or establish a high level career.
      However if she has been working before and throughout the marriage, the she shouldn't be paid alimony.

      @@sum5687 Marriage is a contract in legal sense. This is not bf-gf nibha - nibhi.
      If you enter a contract in legal sense, you should know the terms of the contract, on what happens if it breaks, what's the relevant laws surrounding it. This husband is obviously educated, so he cannot claim innocence, that he didn't know he needs to pay money if he got a divorce.
      You can argue the law needs to be changed. But the Judge only interprets the existing law, he will make a decision based on existing law. This husband and every husband should therefore know before hand the risk of a marriage breaking. You cannot cry later that you don't know this.

      Ma'am I hope u realizeany of these men who have uneducated wives get involved with other women and abandon household family responsibilities. They have all the lies to tell the court. 1Cr is actually not enough to raise 2 daughters. Please see the Calculations in my main comment. And I can assure you, after settlement if the amount is not concretely set by court or if this lady trusts him and signs any wrong document, this man won't be seen anywhere again no matter what happens to the daughters.
      Even dowry is extremely prevalent in many areas even today. The lady is obviously not well educated to get a white collared job and leaving 2 teenaged daughters home alone in India is unthinkable.

      That is easy money and sex freedom for girls. Believe it or not our society is the main reason for that. There is no stigma at all for girls doing that type of divorce cheating, they get away by saying the husband is not potent to satisfy, just that is not enough reason for divorce so they start allegations like abuses, violence, torture, verbal vulgarity, drunkenness and many more so that they can get more money and sleep with a guy of her choice for life time.       @@pboy42 How do we know that judge ka cut nahin hai iss recovery mein? 1 Cr is not a small amount. The petitioner did not substantiate its claim of the defendant's income. He simply stated 83 shops, even if we consider 10K pm rent, defender's income would be a minimum 8.3 L per month. Abey tax kya tera baap dega. 8.3 LPM mein min 2.5 to income tax mein hi chala jayega.Then property tax, building upkeep etc. behenji se kotha khulwa kar dega kya? I am a woman too, but in all honesty if a man falls for the wrong sorts, there no justice for him in this country's legal system.

      when we sit in courts hearing the matters, similar scenes are portrayed by almost everyone, everyone portrays of being the most helpless in courts, but when u read the matter, the past orders, the facts and circumstances of the case, u realize something which was never visible in the act an human puts through before the court.
      Its all there in those papers, which by the video we dont get to know about. Even a rapist behaves like a cow in front of judges. Last winter maybe in jan, a so called lover in a delhi court has cried for 20 minutes straight, ppl felt sad seeing him like that, felt like the guy was tortured by the women he loved, but only after meeting the counsel in the later part of the day and having some small talks I was told the guy had threw acid on the lovers face in suspicion of her breaking up with him causing partial and full thickness burns🙂
      one video tells us nothing, u would be shocked if proper heinous crimes trial is shown, ppl can fool anyone after murdering butchering raping and what not. But the evidence and the story of the past tells the truth. The guy who murdered the girl shraddha and cut her into pieces in Delhi, I was told the guy talks like an intellectual, nobody would know about his acts by seeing the way he communicates and present his face, he's chilled about everything

    Interesting point to note.
    Demanding 1 crore means the lady has to deposit half the money (50 lakhs) in the court for further proceedings.
    Also, the 51 registered shops are not in the name of the husband instead her alive mother. Also, his adopted sister is also a share holder.
    So, is the husband liable to pay the alimony ? As, he is not earning anything.

      You are mistaken. Husband was asked to pay a deposit of Rs.50,00,000/. Husband inherited multiple shops in Fancy bazaar. Lower courts have already ordered him to pay 1 ,00,00,000/ as alimony.

      Regarding alimony, if the man is at fault, he should pay . But if he is not at fault, he should not. Moreover, if a woman is at fault, she should pay alimony to the male. Moreover, there should be efforts to find employment for the woman in the place of alimony if the man is innocent.
      That's how the rules should be.
