At worst, those Pals that look too similar to some Pokemon might be removed. Then again, that option is less likely considering most(if not all) of the creature design are original enough.

I agree! I've gotten fatigue from playing Pokemon games. They're all the same with little things added in each rendition. PalWorld took good things from many games and then made it their own. Yeah, so what if a game has a chine when entering a new area, a lot of games do. Or text popping up on screen. Or games that have a climbing mechanic. Only reason why people compare to Pokemon I feel is because you're using a ball shaped object to capture a cartoony looking creature... 🤷

Nintendo have plenty of lawyers and we've seen them acting against people in less than 24h, so if they had ANY to go on and knowing this game development on their own Country, wouldn't Nintendo had taken measures years ago or even make a move with Steam to block the sale of it........ What i'm sayin is that the statement is a paragraph full of nothing, or in another words a "ok ok stop spamming us with crying, we will pretend we will do something" so those pety people will stop and some already celebrate victory of a lawsuit that doesnt exist and won't because unless Japan has some damn odd law, outside of it they have 0 chance to win in special on NA/EU.

One thing Nintendo has never had to contend with is Threats of Violence if someone were to send them an encrypted email threatening to Shoot Up there offices if they tried to sue there only hope would be to get the (supposed) bigger guns of the FBI which typically won’t conduct a lot of effort as Nintendo is a Japanese business.

What got me absolutely laughing the other day is how these very toxic individuals were yelling how they not only stole from Pokèmon company, but from Fakemon artists.
Despite the absurdity of expecting a company to just magically know the millions of internet fan made creatures and creations. Yet what is so sad but funny is one the Fakemon they screamed PalWorld stole... the artist investigated and found out the very similar looking pal, & found out when looking at the first trailer that had presented this pal; hangyu. It predated her creation by a year. So she mentioned it was just a coincidence, and similar ideas came out.
But these people will try to weaponize anything they can, even if it means lying to get their opinions made fact.

I have been playing Pokemon since the Gold and Silver edition and in all my years I have seen many games similar to Pokemon (Nexomon for example). For me, Palworld has nothing striking, because I see it as just another survival game whose only interesting thing is the Pals. Being basically Pokemon with Guns (I don't like shooters or any game that has similar mechanics) but, honestly... I feel like the whole scandal was unnecessary.
Furthermore, Palworld appeals to a completely different audience than Pokemon.

    • @NeverMeltIce
      @NeverMeltIce 5 หลายเดือนก่อน

@@therealdrogane I wouldn’t say “extremely biased”, it seemed relatively balanced to me.
The legal expert and Pokémon fan seemed to make a balanced argument, in that some designs will be more easily to prove a direct derivation of licensed works.
Note the term ‘licensed work’, which is slightly different to ‘copyright permission.’
If Nintendo et al will seek compensation, that may perhaps settle with PalWorld on a license agreement- which would see Nintendo et al will receive a small share of revenue derived from PalWorld and its future works and sales that feature characters that are of ‘most similar in appearance.’
This may actually be a cheaper option for PalWorld as a settlement out of Court - vs if they went to court and risk of paying even more money in compensation as well as Court fees and legal dues etc.
Depends too on which Nations they file lawsuits in.
If they were to take legal Action through the Law Courts of my country, Australia, they could actually go for a Libel Suit (defamation against a corporation and/or brand) on grounds that PalWorld’s characters have damaged the reputation of Pokémon’s family-friendly ratings and a proportion of its proprietary characters.
Australia’s Defamation and Libel common law has recently been widely-opened in terms of its ‘greyness’ and ambiguity over the years, - which means that recent precedent has made it easier for plaintiffs to be successful in their civil cases relating to any ‘damages to their brand reputation’.
So what I’m saying is that it’s easier to win a defamation/libel lawsuit in Australia than a copyright infringement lawsuit - on grounds that recent court rulings have resulted in more ambiguity in terms of ‘what can be claimed as defamation’ and ‘how the damages are calculated’; many more factors can be applied nowadays.

It’s like walking a tightrope when it comes to copyright law and the video game industry as a whole.
If PalWorld is successful in dodging a lawsuit, it would likely give ‘carte blanch’ for other video games to use AI’s capacity as a blender of past design works.
Defensive strategies such as used for: ‘irony’, ‘comedy’, ‘only 10% of original’, or ‘educational’ purposes would likely fail given that the mode of operation used to produce the game was intended solely as a ‘commercially available video game’.
It is not a TH-cam video, it is not a lecture presentation, it is not a discussion forum, and it is not a comedic act, and it uses over 10% of each alleged more-obviously copied material such as the Eevee looking one.
One thing Nintendo et al’s Lawyers can do is to hire an Independent Research firm to conduct independent surveys on asking random people: ‘which video game does each character belong to?’.
They would use a random but evenly distributed mix of official Pokemon designs, designs from other games, and PalWorld designs. Eg. 5 Official Pokemon designs, 5 designs from other games, and 5 designs from PalWorld.

In regard to Anubis, yes Nintendo et al don’t own it but they do own the elements of the design that go above and beyond any ordinary past portrayal of Anubis.
Also, while I doubt this to be the case, we still don’t know if Nintendo had made an arrangement with the Government of Egypt 🇪🇬 and its accredited research institutions to pay to use the base design of Anubis - given its rich cultural heritage and preservation of image.

Don’t forget the term ‘Pal’ being used in conjunction with the overall context of these character designs & their resemblance to Pokémon.
We have a plethora of instances where Ash Ketchum used the term ‘Pal’ when referring to his Pokémon such as ‘Pikachu’ in the English anime and manga.
We also have ‘PalPark’ and ‘PokéPal’ used within the franchise too - both used well-before the conception of PalWorld.

Monster Hunter uses the term Palico and they capture monsters should Pokémon go after them too?

@@zzirSnipzz1 oh my goodness. Well I guess that’s my fault for living in Australia 🇦🇺. I do not know as much about it in the USA 🇺🇸 legal system or Japanese legal system and their respective legislation.
In Australia, when it comes to copyright infringement claims it’s all about ‘association’ and whether it is likely for a member of the public to confuse the two as being the same or directly related to each other as being co-owned by a parent company.
“On the balance of probabilities; is this claim so justified wherein random members of the general population within this jurisdiction would be able to see an apparent association between the two franchises or be able to confuse ‘PalWorld’ and its corresponding ‘box art’ as a Pokémon game title?”
Is PalPark a trademarked term? Yes.
Is there an association between a trainer and their Pokémon and the usage of the word ‘Pal’?
      Yes.
Has the word ‘Pal’ been used within the franchise to express the same sentiment as stated in the previous question?
      Yes.
Could you replicate this association using an independent survey?
      Yes.

good. Maybe they can get the game shut down. I doubt it though since bad companies such as the one that made Palworld get away with disgusting conducts. Palworld is an example of pure lazy and unethical game creation. Their blatant rip off of Pokemon is so obvious that people have to be blind to not see it. Palworld is on my hated game list. I refuse to buy and play it.

I admire your passion and dedication to Pokémon and respect your opinion, and whilst I don’t disagree some Pals look similar to Pokémon, they aren’t direct copies. You can’t copyright an art style, neither can you copyright a non specific artistic concept- which is what Pokémon characters are.
I am a die hard fan, but I can’t help but hope that Palworld makes The Pokémon Company look at the success that Palworld has had and maybe take a second look at where they may be going wrong and learn from it.
