Not Keeping a Customer In The Dark

  • The plaintiff hired the defendant to make custom shades, but she learned she was being overcharged and took her business elsewhere. Unfortunately, the plaintiff claims the defendant refused to return the deposit, so the plaintiff is suing. The defendant insists she did a ton of work designing the shades, measuring windows, and “running around like a chicken” for the plaintiff, so she deserves every penny from the deposit.

      Splitting it is not ok yes plaintiff made a mistake but letting her keep 950 for maybe at most 5-6 hours of talking is ridiculous and I don't know why any judge or person would find that reasonable or ok obviously the lady said her friend the neighbor usually gives people the information when getting her in touch with clients so to me I believe what happened is she jacked up her price so high so they both could get paid out of it and the neighbor being a friend probably makes people less likely to price match...... I have just been so happy lately that the peoples court is ending JM has been making bad judgement calls for a long time now

      Absolutely asinine! She said that she never used a contract in a proud bragging way…..that’s not something to brag about, that is a horrible business practice. I ran a very successful business for 18 years, when I started out at 21 years old with just walking dogs I had a contract and liability form even then…cover your ass people.

    • @wvrjl
      @wvrjl ปีที่แล้ว +1

      I would have given her $900 back, because the most responsibility lays with the person who writes the contract, or lack thereof. The business person should know better. However, any person with the tiniest amount common sense should know not to give a deposit towards something when you don't know the total price. My brother did that, and he's not rich, because he wanted something. I couldn't believe he was so stupid. He did have a major stroke, so that might be part of it, but he was never good with money..
      You NEVER agree to buy something / pay the deposit when you don't know the total amount you'll be paying. That also applies to anything where you're making a monthly or weekly payment, like a car. Do the math and figure out what the total amount is that you will be paying when you take all the interest into account. You should never buy a car without knowing that. In fact, I personally think it should be law (except governments WANT you to buy things).

    You CAN'T charge someone a consult fee, if they don't agree to it prior to the consult. I had a garage do that to me. For years, there was no consult fee, then all of a sudden there was, and they didn't tell me about the change prior to looking at the car. I freaked out on them, and did not end up paying that. It never ceases to amaze me how ignorant people are. Especially when we live in a time where everyone has a cell phone in their pocket or purse, so if you really want to educate yourself on a topic it's really not that hard. But seriously it should be common sense that whenever you're dealing with anyone on a business level, everything you're expecting to be done and the total price should be done in writing. If I had someone after the fact try to charge me a consulting fee I would absolutely laugh in their face. It blows my mind how many people just hand over money with no specific terms laid out then cry to a judge.

I literally laughed in his face and told him to piss off.. No one said anything about a charge for him to come out to give me estimate.. I called the number and I told the lady that this crazy ass joker was trying to charge me $80.. I told her i'm not paying shit because no one told me about the charge, I would of NEVER had him come out in the first place.. He literally sat out in front of my house for a 1 or 2.. But, I didn't give a rats ass.. It was his time he was wasting... Let people know up front if there is a charge don't wait until your done... Thats a damn scam!

    Maybe even the plaintiffs friend was getting a cut, she never told her about the consulting fee, defendant saw an opportunity to make a quick buck, over pricing all the materials.

    Defendant is a person that stabs people in the back . The neighbor had very poor judgment in recommending this person .
    If I was the judge , I would have returned all the money to the plaintiff , including the $250. The defendant didn’t do anything except show how greedy she is, and how stubborn she is in keeping money for doing nothing.
    Legally, if there was a contract, the defendant would be compensated for her damages . There is none.
    To say that she agreed to pay by a contract , is like saying the plaintiff gave the defendant a gift for nothing , which is certainly not the situation for deposits . The person is rather tricked and agree because of hastiness .

    Do window coverings really require running around like a chicken?

  • @synnove1046
    @synnove1046 ปีที่แล้ว +3

    People need to stop judging the plaintiff for choosing to use a paid consultant or for being willing to pay for higher priced window coverings. Those things are NOT THE POINT.
    What matters in this case is that the plaintiff paid for two things without having a contract first. She didn’t know about the consulting fee, and that is obviously true since the consultant is not even claiming to have informed her. It was unprofessional of the consultant to expect a friend to pass along the info about a fee and what the fee amount would be. But the plaintiff should have spoken up when she was told about the fee at the last minute:
    1.) To point out that it’s not fair to tell a customer about a fee AFTER the consultation takes place. 2.) To make it known that she (customer) is willing to pay for the rep’s time and advice, when given a choice.
    If I were in her shoes I would’ve been taken by surprise too and probably would have just paid it without arguing also. So I can relate to that reaction. I don’t think she had a big problem with the concept of paying for the consultation, I think it just bugged her to not be told about the fee in advance so that the choice would clearly be hers to make. She was already planning to buy window treatments that were not the cheapest available so I think she would have most likely been willing to pay a consultant for their time and advice, especially if she thought she would end up with window coverings that were higher end than average at a better price than the other higher end options.
    I am really amazed that she, or anyone, would pay a “deposit” on some work or product that hasn’t yet been defined at all! If I had been in her shoes it would be easy to say “No way am I signing anything and putting down any money on something that hasn’t even been described yet, and no price estimates have even been given.” That is just a horrible idea. She should have told the consultant to come up with an estimate and bring it over to the plaintiff’s house on another day in order to get the signature and the deposit. It’s one thing for a rep to assume that the customer should expect to pay a consultant for their time, especially if no product has been purchased yet. But to think that any person would hand over a deposit blindly with no product or price promised is just ridiculous! The plaintiff just made it worse by trying to apply the deposit to other window coverings, while making the same mistake repeatedly - not getting anything in writing and either believing the consultant’s claims that she could get her the best prices, or even just assuming that the prices would magically be lower than they actually were.
    I think Judge Milian came up with a pretty reasonable deal. On the one hand I think the consultant was unprofessional regarding paperwork/contacts. With 12 years of experience I think she knew that she couldn’t beat the competitor’s prices but kept stringing the plaintiff along to try to make a sale. So I think most of the responsibility for this mess is on the defendant. On the other hand, the plaintiff can’t just blindly trust every sales person who make a promise to get them a better deal. She let the rep just tell her what to do as though she was a child doing what her mom told her to do. I don’t think this was a very clear cut case so in a way the both lucked out.m by not having lost more money that the did.
