      Exactly, my thoughts, he should make a compliant against the judge with the State. He clearly violated established case law on 1st Amendment protect speech. You can give a cop the bird and it shouldn't influence his verdict.

      They ALL belong in Federal Prison!! The officer should be fired. Charged under 18 USC 242 for deprivation of rights under color of law. He should lose qualified immunity and be put on the Brady list. The prosecutor should be charged with obstruction and abuse of office and be disbarred. The judge should also be charged with abuse of office as well as be disbarred and removed from the bench.

    The judge's long-winded account of his "findings" should serve as a blueprint for disbarment. He made it as convoluted as possible, ignored the defendant's first amendment rights, and then found him not guilty, all the while finding no culpability on the part of the officer. Embarrassingly shameful.

      Horribly long winded, yes. Sounds ai generated😂
      But it is correct, the doubt given by the dashcam is not conclusive, and neither is the cops radar or personal statement. With just this dash cam it would be hard to prove the cop is guilty, and that is not the case before the judge. It is wether the speeding was true or not. So he needs to take the middle ground and choose reasonable doubt. If it could be proven that the radar equipment said 35 and not 43, then the cop would be at fault. And then it would need to be proven it was not a mistake but malicious intent and the cop was aware that the actual speed in the radar was 35.
      Remember, the cop gets the same beyond reasonable doubt if he is charged.
      But if a helicopter was filming the car and it also showed him driving 43 (or another corroborating source), it would cast serious doubt on whether the dashcam was factual.
      The sad part is the slow court process. For simple cases it should be much quicker, and if its surpassed by the government, dismissed (because they have experience and knowledge and processes, it should be cookie cutter for them and not take a long time unless there is a good reason... Eg cop being on maternity leave / vacation)

      Everything is at the tax payer dime, except for the drawn out cost and time for the innocent defendant. Everyone else is on the state payroll, the judge, court bailiff, prosecutor, officer, stenographer. The defendant has to pay for his lawyer, take off multiple days due to the city moving the case multiple times due to their own errors. The fact it took 6 different days in front of the bench adds to the case load and justifies the need to hire more city lawyers and judges. It's a loop that the public pays for.

      Judge sees clear and incontrovertible evidence that an officer perjured himself in the judges court room, clear evidence of prosecutorial misconduct after the prosecutor went forward with charges after seeing incontrovertible evidence that the officer was lying and still the Judge decides to admonish the victim of this maleficence. The judge is part of the problem.

This innocent person was forced to appear 6 times on false charges. It would have been nice if the judge had admonished the two cops and the prosecutor for abusing the process. Instead this just made it a trifecta of police prosecutor and judge covering the bad acts of bad cops. Hope this innocent defendant punishes them in a civil suit for this illegal stop and abuse of process.

      Very true. In a year 100 cops die on duty. 60% of those are traffic accidents. 1100 civilians die from interactions with cops.
      Now those numbers are severely skewed. They don’t include how many are injured by cops. They don’t include the ones that die in police custody for lack of medical assistance. And they boost the police numbers by saying 35% are felonious. But that includes situations where they do a traffic stop & get hit by a drunk driver. Or where the cop is committing the felony.

    Judge's logic:
    Just because the video completely contradicts the officer's testimony and written statements, that still doesn't mean he's a liar. So what if the false incrimination was motivated by a citizen's free speech. The citizens should learn to know their place if they don't want to get pulled over and harassed with clearly false and fabricated charges.

    It hurts my brain to hear a “trained” judge say in one sentence that the defendant has no responsibility to prove himself innocent and then several sentences later say that the only reason he was ruling not guilty is because the defendant presented evidence that he was not guilty. This judge should turn in his own law license.

      The officer provided evidence in the form of the ticket and verbal testimony. No electronic evidence.
      So if the officer is a lying POS and you can't prove your innocence, you're found guilty.

That judge took the time to actually write all of this down and probably read it out a few times to be sure, and he STILL thought it was okay⁉️ That is a judge who shouldn’t be allowed to run fries as McDonalds, just how many innocent lives has he destroyed?       I went to court and the DA wanted me to take a charge for something I didn’t do. And it’s all on camera I said no way. Then they offered to take the charge and no jail time I still said no and made them drop the charges but not before going to court five times wasting my time

      Him exercising his freedom of speech right, by expressing his disdain for his government official....have EVERYTHING to do with the allegations against the citizen.     When you can prove an officer is lying in court, then they should be absolutely charged with perjury. We need to hold sworn officers to a higher standard, not a lower standard. This cop and this judge are reprehensible.

    If new cop lies as bad at start of his career it’s a warning of what he will become in future , cop judge and prosecutor are shameful and dishonourable,

      Bad habits are being taught. i ran into something like this when I reported a terroristic threat. FTO didn't want to teach a rookie female cop on filing the report and arresting the offender. Called for a SGT myself with watch command. He was lazy too. Called them out both, but told him to call the DA himself or ill call them myself. DA took the charge, and the rookie learned their job correctly.

      Well, there is hope he'll improve his lying as he gets promoted to sergeant, captain, chief so that by the time he becomes a prosecutor and a judge he is so adept that he isn't caught. Then, we can call him Congressman!

      The vast majority of judges are ex-prosecutors and they make rulings based on that bias. This judge is a cop in a black dress, How out of touch and ignorant of the Constitution do you have to be to not understand flipping off a cop is protected by the First Amendment?

    The comments the judge made about his "obscene gesture" was completely uncalled for and honestly, a betrayal to the robes he wears. He's someone that is supposed to remain impartial, but he rides the meat harder than the cops own union. That was wild.

    There should be action taken against the JUDGE who chose to admonish a citizen in court, for legally and properly using his First Amendment!!!!

    That he went to court 6 times is insane. The DA saying he didn't get the emails, and the clerk not doing their job is not a good look. We need to continue to support our 1st amendment auditors and local journalist, they expose bad public servants like these! ❤

    I actually hate this so-called judgement because the judge misrepresented the law enforcement officials retaliation and lack of evidentiary submission of the radar. Furthermore, the abusive behavior was constitutionally protected. Thus, it is once again a case of judges and prosecutors protecting the unconstitutional behavior of people honored to enforce our laws. This is shameful.

    I am more concerned with the judge's behavior in this case. 8 months to try a speeding ticket. It's not an OJ Simpson murder trial. How the permanently sewed his lips to the officers behind, placing that over the defendants' rights is a problem. It's like he was forcing himself to rule in favor of the defendant only because he had to. Disgusting.

    The judge ruling this case is so comically dense. Listening to him ramble on like he's trying to fill words in his essay was bad enough, but giving his opinion to the court on record afterwards is icing on the cake. His clear bias towards the police in this open and shut case should get his law license revoked.

      According to some New York language expert, it’s a sales tactic that puts a potential -victim- customer at cognitive ease and makes them more persuadable.
      So I’m betting the whole “call them boss” was in some training video the kid watched. I’m also betting that the language expert who came up with this couldn’t sell water in the Sahara Desert.
