Exactly… she said 10 cops are killed each year. A quick google showed 86 citizens were killed in interactions that started as traffic stops. Cops are cowards.
@@justing7490 Exactly what I was thinking. I'm pretty sure it's been objectively and factually disproven that traffic stops are so dangerous when compared with other jobs. That old trope just won't die.
They make them dangerous with the concept of "Investigating". If they wrote a ticket before approaching, then approach and give the ticket to the driver it would take all the "danger" of prying into someone's business out of the equation
If they were really 'public protectors', absolutely not. But there's no such thing as a 'public protector'. If the public wants protecting, there's the Second Amendment, they can start protecting themselves.
Prosecutor "traffic stops are inherently dangerous, 2,000 officers are assaulted and 10 are killed each year". According to the University of Illinois, over 1 million people are assaulted or "use of force" by the police each year, and 1117 people were killed by police from a traffic stop". The Prosecutor is using the "2,000 officers was assaulted" number, which is skewed, you can see from this case, the victim was also charged with "resisting arrest", which counts as an "assault" on am officer when we can clearly see who is the one being assaulted.
@@asmodeus1274 How many arrests are there with no charge other than resisting? Too many. What exactly are you resisting when there is no charge, other than for the resisting?
@@Vicious_Delicious I have seen vids on dirty cops and their arrest record involves a lot of these resisting only cases. There should be a sweeping investigation across the board to see just how rampant the problem is. The idea of these police just throwing people in jail and "letting the courts sort it out" is nonsense and a waste of resources.
I keep saying this. Cities shouldn’t have to pay judgements. This payment should be paid from the police pension fund. That will ensure that good cops hold bad cop’s accountable.
@user-et3in7qj6z, You are 100% correct. When their unions and pension fund start shelling out for their stupidity instead of the taxpayers , this crap might stop, With these tyrants having no accountability , they couldn't care less.
There should probably be a clause in that which extracts from the upper management proportional to the time in service/training, and number of offenses… meaning the management should share in the cost, if they’re supporting the bad behavior.
There should also be some form of positive reinforcement points system bonus for merited service… because if I know I was doing something stupid when I was pulled over, and the officer communicates the issue professionally & respectfully, expressing concern for all involved… that deserves a positive feedback, made easy to provide. Even if the officer gives me a citation and hints at how I can have the citation tabled unless I commit another similar infraction within 2 years… that is actually serving the community.
I agree some sort of accountability needs the be had, but going after the pension fund is not the way. Yes there are bad cops out there. But there are also good ones. And those good ones would suffer. This is called collective punishment and is a prohibited act. “International law posits that no person may be punished for acts that he or she did not commit. It ensures that the collective punishment of a group of persons for a crime committed by an individual is forbidden...This is one of the fundamental guarantees established by the Geneva Conventions and their protocols. This guarantee is applicable not only to protected persons but to all individuals, no matter what their status, or to what category of persons they belong...”
Traffic stops are only inherently dangerous because a thin skinned road pirate with a gun and a chip on their shoulder is willing to unalive you over perceived disrespect.
Her own numbers prove it. How many officers was it, 10 per year? And how many stops are made each year? 10 is a statistical nothing, but she says every encounter is dangerous for the officer. Absurd! It's dangerous for the public.
@@garyrolen8764- Yes, how many INNOCENT civilians are MURDERED by police every year???? I'd actually like to know that. That cop should NOT BE A COP. Their violence wasn't even close to reasonable.

I'm over seeing this comment.... Did you not watch the video and see that the police lost their QI ... There are 5 states that don't have QI and what has it done for those states!!?? ABSOLUTELY NOTHING!!!!! They won't get rid of it in other states because it's there for their safety for ACCIDENTS
Wow. The cop said "I'm going to hurt you if you don't get out." Not I'm going to pull you out, or you'll be put on the ground, I'm going to hurt you. That right there speaks volumes. This is a clear case of arrest for "contempt of cop." Disgusting.
It's pretty disgusting that prosecutors are usually in tight with cops. The DAs office in Scottsdale should've charged Koller with assault (for stating we was gonna hurt Andy) and also battery (for following through) if they had any decent principles.
More critically to this case, it establishes that the reason was not due to an alleged perceived threat, making the claim of a threat based on a "reach" a "hindsight argument" thus not applicable to the objective reasonableness standard.
You got it twisted, the state _is_ the gang. The police are just the armed domestic occupying force keeping your tax dollars flowing into the gang's pockets.
The male lawyer was 100% right. When the citizen had his hands up, when the cop opened the door, he was showing absolutely not threat!! Hands were in plain sight. There was no reason to use that force against the citizen!!
This whole argument in court just pisses me off! It’s not the argument to be having. The video shows the cop wanted someone to lick his boots and bow down to him and when they didn’t immediately do it he wanted to whoop his ass. Plain and obvious that’s it.
They've done it since Joe Arpaio was still Sheriff and they'll continue to act this way until they face actual punitive damages for each instance of rights violations.

It's fkn common sense that this cop was triggered when the driver told him to lose his attitude. Then he went hands on just because he was mad. It's So fkn obvious!
This is almost entirely because of shitty training. This cop was trained to arrest people, so he is looking for people to arrest - instead of looking to protect and serve.
Why are the training officers never on trial AND the leadership that originally hired these tyrants?? Thought they went through testing both physical and psychological??
The attorney General claims having qualified immunity. But admitted that there was no case against me. And I was illegally held for 8 months in jail while my mother died on hospice care. I have no recourse
The fact that officers like this can even make it past the initial entrance exam, application process and their own peers, clearly illustrates how broken the system really is. And where the real problems are. The DA, the hiring process, and the legal protections for the criminals, also known as qualified immunity.
It's disgusting that the judges are talking about "Qualified Immunity" as if it's a written law when it's primary invented and used to let cops get away with murder.
Why do you all constantly do this? Tell us exactly how QI let's you get away with murder...not conjecture or speculation. Do you even know what QI is for?

Whatever way you look at it, Mr Dominquez was gonna get beaten up by this POS whatever he did and this pathetic lawyer is defending it. Lets hope she fights this hard for the cop who beats up a member of her family for no reason.
Actually, they do. Mimms gives them that right unfortunately. There was no reason at all for it other than that cop being a fkin psychopath with hurt feelings.
To be fair, as much as I strongly disagree with her arguments, an impartial justice system requires both parties in any case to have effective, passionate legal representation. She is simply doing the job she was hired to do. She may not even personally agree with her arguments but that's irrelevant -- her job is to try and defend her client to the best of her ability. Anything less than that could be found to be unethical or bad representation which can reflect badly on her. So always remember, even the most heinous criminals have a right to a passionate, effective legal counsel and depriving them of that turns it into a kangaroo court. Just look at the recent trials of the Americans held in Russia - he wasn't even allowed to make arguments. The prosecutor just reads their side into the record and it's accepted as fact, and bam, he's convicted. That is what happens when you disallow one side to have representation. Now, my personal opinion is that the cop is a garbage human being and deserves to be heavily punished for his actions here, and it sounds like these judges aren't buying her argument, but at least you can say the cops and city had effective counsel who tried their best to represent their client which is key part of a working justice system. The justice system in the US is already messed up, the last thing it needs is MORE actions to screw it up even worse.
No matter how many times the words, attitude, reach and tense are used, this was unconstitutional. How many civilians are hurt or killed in pull overs?

Oh no she definitely believes it until it happens to her one day. One day maybe when she’s had a little bit too much to drink and a rogue cop treats her the same way. Oh she’ll believe it then.
Why these judges are trash. Everything past the illegal stop is pure harassment. And their only supposed arguing point is the guy reaching? Last night checked reaching isn't unconstitutional. Would it be okay for a citizen to physically harm a police man or anyone for reaching? These people need to learn the cops orders isn't law. You don't tell me crime I drive away.

Petty from the first moment. The cops attorney’s tone becomes more and more desperate as she appeals to bias more and more loudly. It’s like she showed up thinking there’s no need for a persuasive argument. In my opinion, there was no “reach”. There’s a slowed down tape of a man flailing about while being attacked. The “reach” is a feeble CYA argument developed only after watching the tape. The officer showed no regard for reaching and every intention of having a confrontation.
Yes...that attorney lady was expecting easy summary judgement because most likely, that is what usually happens but this judge or panel of judges had their let's-be-honorable-today hats on. I also agree about using the "reach" like they did. Was the "reach" in the officer's report of the incident or was it something that was discovered and exploited after the fact?

Except the reach-around… she was all about the reach around. She must be a dong strap wearing kind of gal!
Some cops think knowing your rights. That is protected by the US constitution. Is having an attitude. And they're more than offended by it.
All.
attitude? They think it's a capital offence
@@rogeliobaeza9915 well said, good point
Yeah they literally hate it. They should be taught in schools.
The fact that this had to be argued to this extent is proof qualified immunity is garbage.
Security guard is trying to get to work.
Cop: "It's going to take you longer if you keep up the attitude." BLATANT VIOLATION OF RIGHTS UNDER BUTTHURT COLOR OF LAW.
For real
This cop has road rage, or some other paranoia issues.
LOUD AND NERVOUS FAST TALKING INDEED
Yes...that attorney lady was expecting easy summary judgement because most likely, that is what usually happens but this judge or panel of judges had their let's-be-honorable-today hats on. I also agree about using the "reach" like they did. Was the "reach" in the officer's report of the incident or was it something that was discovered and exploited after the fact?
Her voiced cracked when she was selling the reach.
She knew she was stretching
@@kevinbrand7992 She needs to try driving past a cop and flipping him off to see how reasonable the police are.
That's why we need a law passed that requires officers to give their sworn testimony/statement on a use of force incident BEFOFE seeing the video
If you are not 100% overjoyed about being pulled over then you have an attitude.
What would have happened if there was no video to prove the bad behaviour of this police officer?
10 officers each year vs 600 civilians killed by police each year during traffic stops.
“A good cop’s worse enemy is a bad cop.” Jason…Amagansett Press.
Funny how that works.
10 too many under a police state that is surviving to protect itself
If cops wore their seat belts, that would save more of their lives than anything else they do on these traffic stops
@@brockrock8898 10 too many or too few?
This cop instigated and escalated this stop right from the beginning and then opened the door, which is a 4th Amendment violation. The cop wouldn't back up so he could step out. I'll bet this cop has a use of force history.
Lookin for fight like most are and turn it around to an unlawful arrest the courts and prosecutors justify in most cases .
He makes me wonder what his history is with his family
This Officer is a danger to all working with Him!! Totally unhinged and untrustworthy
@@wingatebarraclough3553maybe that should be looked into
@@FreeUkraine69They are looking for fights with people they know can't fight back.
The officer escalated to punish the driver for his attitude. If attitude is a crime, the officer is guilty of it.
Legend has it that still to this very day, that officer is still yelling “stop resisting”
Imagine injuring someone to the point of causing your employer to pay 150,000 dollars, and you still keep your job? Who the f*ck?!?
Collateral damage. They train them to be like this.
laws need to change so that if you win a financial case against a cop you can personally prosicute that cop since the government wont.
@@McDinglefart_69 Exactly, they're trained to do exactly what he did, and the sheep are trained to feel sorry for them when they get deleted on the job.

None of the money comes from the police, it all just comes out of the taxpayer.
10 officers killed a year in traffic related incidence? that number is sooooo small compared to officer related shootings. how is that even a good argument
It isn't, but police are valued higher than peons like you or I by the programmed masses.
I thought I was the only person who thought that was too low of a number for the attorney to state that traffic stops are an inherent risk to officers.
YOU HIT THE NAIL ON THE HEAD THERE !!!
I was gonna say the same thing, thousands of more dangerous jobs then that
Yeah, in addition they sign up for danger.
Another man with a badge and a gun who shouldn't be a police officer. Hard to believe cops get away with criminal acts like those show in the vehicle.
The lawyer just can't believe her own BS
The attitude of a "REASONABLE OFFICER" sure isn't being displayed in this video. The attitude of a "TYPICAL OFFICER" these days IS being demonstrated totally.😢😢
Underrated comment.
Amen
Abolish qualified immunity and take settlements out of the police union pension fund! Guaranteed this will stop!
If I could give that comment a million likes, I would LEOs need to know the law , they are paid well to serve the public! Not harass and collect!!
Pension fund? No. Personal accountability first. Just like doctors, make them carry liability and malpractice insurance. And charge, fine and incarcerate as well when they break the law.
@@karactr8361 Might as well punish the police unions, they are the biggest armed gangs after all!
It’s really ashamed when a person has to scream help from ppl that supposed to help.
Wow it's not like I have seen this comment before
Instant escalation and disdain for the public. Notice the officer did not say if you don't get out of the car I will remove you, he said if you don't get out of the car I'M GOING TO HURT YOU.
Right as the cop had stepped into the floorboard of the car to deliberately prevent the man from exiting so he could beat him up.
@@joefudd one of those judges should have picked up on that. They should have asked the attorney for the police officer why did your client say he was going to hurt him before anything became physical?
Good point.
A illegal u-turn is not grounds for an arrest
