@@erikkalivingston I believe any state allows you to refuse a sobriety test. It's your constitutional right to not self increment. If you're volunteering to do such test your technical self incrementing
@@erikkalivingstonI’ve lived all across the USA and it’s been the same thing everywhere you can refuse the FST’s and the portable breath test they give on the roadside is inadmissible in court BUT you can be taken in to do the official test at the station or the equivalent test site. Thats the one if you refuse you get basically a dui anyway. So they could have arrested him on suspicion anyway but would have to have him perform the “data master” breath test or a blood test. These dudes though were jackasses and idiots.
🤨 it's Texas and they were a mixed couple and the cops were showing them...🤷! That's how that is refusing.
It was absolutely no right or wrong thing that this couple could have done everything was going to be wrong and they were going to be violated as soon as the cop saw them together. You can look at the judges rulings and realize that's business as usual in Texas. Don't get me wrong You have rights in other states and in Texas... Right up until a cop decides to violate them.
@erikkalivingston field sobriety tests are consensual and are administered solely for collecting evidence, there is no passing the test. You cannot however decline chemical testing without legal consequences

@@montebrodie4086that’s what they said tho
Yeah not how that works. You can only sue a judge when they act outside their job as a judge. Basically when the judicial branch stops being the judicial branch and tries to be the executive or the legislative branch. That’s the only time you can sue them. It bothers me that a plea deal was offered when they clearly had a convincing case to a jury. You can clearly hear the officer say “ you can be free to go at any time,” then arrested, tasered, and beat the guy. What jury wouldn’t convict these officers?!?
Prosecutors always offer plea deals. Those cops probably didn’t have a criminal record. That’s why the prosecutor offered that plea trial diversion program. Once they completed the program then their charges automatically gets dismissed. I’m glad they can never work as cops in Texas again though

You CANNOT be arrested for refusing a field test, and he NEVER REFUSED.
As much as it infuriates me, police absolutely will arrest you for refusing a Field Sobriety test or a Portable Breath test AND you may get a mandatory license suspension depending on the state.
Does this mean you should do either? Never do them. It will all come down to what they can prove in court, and without those tests there is usually little definitve evidence. Always refuse, but understand you will be going to jail.
@@hashbrown4781 That is mostly incorrect. I have not checked all 50 states, but I have yet to see a state where you can be arrested for refusing the so-called field sobriety tests.
Breathalyzer is a different matter. You should NOT refuse the breathalyzer, since there the consequences are usually a suspended license at a minimum.
@@XJWill1 You're correct. The law doesn't say you can be arrested for refusing the tests. HOWEVER, you can be arrested for suspicion of DUI, which is what you get arrested for by refusing. See the difference? It's a bit of a catch 22 as they were probably going to arrest you anyway and the tests are designed to give them more evidence. So, just take the ride and NOT do the tests.
@@XJWill1 it doesn't matter. If they pulled you over for DUI. even if you blow 0.00 they will more than likely still arrest you. They will take you down and do a different breath test and then a blood test.
