      Hey LackLuster, the 5th Circuit Court of Appeals determined that there was no violation of a constitutional right as to Solis’ Fourth Amendment excessive force claim. In a universe without qualified immunity the court would still have granted the defendants’ motion for summary judgment.
      The court also decided that the right Solis’ alleged was not clearly established at the time of the alleged conduct.
      It was over when the court found that there was no constitutional violation.
      {In sum, even viewing the facts in the light most favorable to Solis, we cannot say that the officers violated her constitutional right to be free from excessive force. Accordingly, we conclude that the district court erred in denying the officers' motion for summary judgment.}

      The excessive force claim was the only claim that was before the 5th Circuit.

      Yup it’s legal but there is a reason they have 2 officers, you can put one down easily but the other will be there to put you down even if you are justified and the officer that gunned you down will be justified even if his parter was violating your rights.     I am 75 and I have watched the police get dumber and dumber and more violent over my lifetime. They don't know the laws they enforce and don't care about the rights of citizens. This is heartbreaking and disgusting.

      In reality they were like this all along, we just didn't have bodycams and CCTV to see it all happening. There's that famous case from 1945 where a bunch of GI's went home from WW2, back to their town, and declared war on the cops because of their despicable behaviour. It led to the GI's laying siege to the police station.
      The job of being a police officer attracts a certain type of person. Ask yourself why the Nazis and Soviets heavily recruited from the police force for their death camp / gulag guards and various other mass murder brigades.

      And in turn, this is why police are never held accountable. They are corrupt from top to bottom. The fact that a judge can watch this video and not only throw out the case, but force the victim to pay the court costs makes me want to throw up.

      Also in Texas field sobriety tests are not mandatory. There are no penalties for refusing to submit to a roadside sobriety test but they immediately arrested him for "refusing" to perform one.

      @@Strideo1 field sobriety test are done right before they arrest you, just so they can gather more evidence. If you're ever requested to perform one, they already decided on arresting you for DUI/Public Intoxication. In this case they never even asked him, nor did they tell him he was performing a field sobriety test before giving him the instructions. They should be punished for not informing him of what was being done, as by not telling someone that they are performing a voluntary test, it could lead to the person thinking the request are actually lawful orders that they cannot refuse, thereby removing their ability to consent. these test are designed to be failed by even sober individuals, don't consent to them.

      You may not like this reply, but they don't have to give you field sobriety or PBT before arresting you. They can arrest you simply under suspicion of DUI. They only do them to "gather evidence". Just take the ride and get a chemical done. Arguing, resisting or any of that just makes it worse, because 9 times out of 10, when a LEO "asks" you to take the tests, you may as well already be in cuffs, because you're taking the ride.

    She was cold sober and at her home. Still, they assaulted her, arrested her and then _stole the car and held it for ransom._ Wrong on SO many levels.       Prosecutors always offer plea deals. Those cops probably didn’t have a criminal record. That’s why the prosecutor offered that plea trial diversion program. Once they completed the program then their charges automatically gets dismissed. I’m glad they can never work as cops in Texas again though

      As much as it infuriates me, police absolutely will arrest you for refusing a Field Sobriety test or a Portable Breath test AND you may get a mandatory license suspension depending on the state.
      Does this mean you should do either? Never do them. It will all come down to what they can prove in court, and without those tests there is usually little definitve evidence. Always refuse, but understand you will be going to jail.

      Breathalyzer is a different matter. You should NOT refuse the breathalyzer, since there the consequences are usually a suspended license at a minimum.

See the difference? It's a bit of a catch 22 as they were probably going to arrest you anyway and the tests are designed to give them more evidence. So, just take the ride and NOT do the tests.

They will take you down and do a different breath test and then a blood test.       I refused to leave the vehicle one night in a snowstorm. That rookie tried every way he knew. My buddy who was driving had picked me up because I was drinking. I opened the pass window a slit and handed him my license. He kept asking me to get out and talk etc. Finally he went back to the cruiser and checked me out. He came back up to the window and asked me to step out and get my license. I told him to just have them mail it to me. He asked me why I would get out. I told him that it's freezing outside and I was not going to jail for PI. My buddy and the training officer were on the edge of busting out laughing. We didn't even get a warning, my buddy had picked the car up so we could fix what it needed to get tagged and inspected. That TO was a decent cop.

    Ask the Cop where his house is... When he asks why tell him you want to know because you may move there after you sue him or maybe just rent it out.

    You can tell how much they relish in the power by how condescending they are the entire time. Talking down to people is an obvious sign of ill-intent. These cops are unbelievable. Please don't talk to them. let the good ones have to deal with the consequences of the bad ones. Maybe the good ones will prove they are good ones and put a stop to it.... lol.
    "If only it were that easy, sir. That I could just take your word for it...." But has no problem just making up the facts in his own head... smh. it's just eggregious. They aren't even trying that hard to hide their corruption. Not just twists her arm, reels back and wrenches as if she's been told multiple times, but cops prefer the no communication method, where they just pounce and arrest anyone with as much brutal force to withstand anyone rightfully resisting being jumped out of nowhere by "trusted" officials, with no warning or command (not to mention the complete absence of reason).
