    In Canada, supreme court appointments are not seen as such high stake events as the separation between the legal and political alliances are strong. Prime minister Steven Harper actually appointed 7 of 9 sitting judges at one point. The court still repeatedly sided against his government on key decisions.

      To me, as a German, I have no idea how you can have legal appointees, that are at the same time political. It's almost as if this system was designed to be able to be overturned by people wanting to overturn it. As long as you have righteous people, it's all right, but as soon as you have people like trump... It's almost you didn't learn anything from 1931 Germany and how Hitler rose to power. How he erroded the government and turned a democracy into a dictatorship.
      There is a very good reason why you should separate the legislative, executive and judikative.

      That would be because the four courts/judges/DAs persecuting Trump are the very embodiment of illegal lawfare. If Trump could be persecuted for his official acts in office, so can Biden, and Obama, and the Clintons, and every other living former President and Cabinet member.
      But fear not: impeachment is still the prescribed Constitutional remedy for official malfeasance. But even that is vulnerable to politics, as Hamilton, Madison, and Jay observed in "The Federalist Papers" -- "Impeachment is an inherently POLITICAL act. It cannot be any other way." The check on political malfeasance in matters of impeachment rests with the constituents of our Congress critters, for better or for worse.

      So nothing is stopping him to just don't accept the results of an election. He could send alternative electors, put pressure on state officials etc. With this new power he might even use the military or arrest/kill his opponents since this is an official act as the president.

    “No man above law” now you should begin to see that a form of democracy is NOT a democracy! There isn’t a democratic country in the world only political systems that call themselves democracies. People must be requested to have a far greater direct say in how they want to enhance and live in a democracy.

    It is ridiculous that the judges on the highest court are appointed politically. The system needs to be changed. There is no ideal way of appointing the top court. In Britain, the highest court members are voted into position by fellow Judges.

    As an Australian, the more I hear about archaic US democracy, the more I am thankful of both the Westminster system and compulsory voting. As a newer democracy, we are absolutely blessed. It's still not perfect, but it's a massive improvement on what we see in the US. What a vulnerable mess.

      1) if the 4 dissenting Judges refused to sit the SCOTUS would not have had a quorum so couldn't over-rule the previous decision. Duh. Cream of the crop.
      2) Let's see the SCOTUS rule that taking bribes is a duty of the President. Can't see it, myself. Trump should have been arrested for soliciting bribes and be in jail for offending while on bail.
      3) If Trump gets in, immunity's not going to make any difference. He already said he would ignore the Constitution. He doesn't operate by law.

      This is how things have been for more than 200 years in the us… also the us isn’t the only country with executive immunity. Also the scope of immunity is not as broad as made out to be. The dissents own arguments wouldn’t be immune under the test setup by the majority. The dissent is a really bad strawman of said test.

I do not know the far reaching ramifications of this ruling, but I have a strong feeling we may have the largest voter turnout ever for a presidential election. We cannot be a silent witness to the attack on the democracy of our great country.

    JP This is a very difficult day in America. I need to tell you nobody really understands this ruling. It's so vague it's stunning. My ex-wife has argued cases before the Pennsylvanis Supreme court, and I have been on the phone all day with at least a dozen of my friends who are all lawyers or involved in various roles within government. We can't figure this out. It seems like Biden could just arrest Trump and ship him off to Guantanamo Bay............I am almost wondering if he should..............

    "Democratic backsliding"? I haven't read the judgment yet but compare:
    The *_royal prerogative_* is a body of customary authority, privilege, and immunity recognized in common law (and sometimes in civil law jurisdictions possessing a monarchy) as belonging to the sovereign, and which have become widely vested in the government.

    I personally don't agree with these, particularly in foreign affairs, but:
    "Duty" Doesn't cover bribery. Doesn't cover deliberate or reckless assault in violation of the law. (eg police). etc.

    BTW, it seems SCOTUS reasoned from a premise of full immunity, chipping away while still preserving a broadest possible interpretation, instead of a premise where everyone is accountable under the law, but then carving out a niche of immunity for presidential official acts that are not undertaken with criminal intent or expectation of personal benefit.
    Also strange that under this ruling, one cannot question the motivation behind any official act nor use any fact arising from them.

    Oh Jonathan, of all people, I would have thought you would have actually read the Majority Opinion before commenting. The liberal justice you trumpeted is having a hysterical come apart based on one person and her distain for him. The majority had to look at and make a ruling that is timeless. No where in the opinion does it say Trump was immune from prosecution. It just says, and this is my paraphrasing, that the presidents, official acts, meaning those responsibilities delegated to the president and executive branch are immune from prosecution. Sending a seal team to murder political rivals is not an official act. In fact, the US law forbids taking out the leader of another country. The whole ruling was an outline to be used by lower courts to instruct them to look at what charges against Trump were official acts and what are not official acts. Even you would agree it would not be a good idea to be able to hamstring leaders of nations to make decisions when they will always live in fear of the other party gaining control. Please stop trumpeting the far left and do what you do very well in your other endeavors, read it yourself and draw your own conclusions. I am sure you will agree exaggerating and fear mongering will eventually be counter-productive, as both the Republican and Democratic parties are now beginning to see. This is resulting in both sides moving further and further to the fringes leaving most people in the US having to make the decision of the lesser of two evils rather than the best candidate or party. In this case you are not helping by being irresponsible and using a dissenting opinion as fact without knowledge of the actual opinion, that is irresponsible.

    This Ruling may well be the "Dred Scott Decision" of our time and Chief Judge Roberts may share the same fate as Chief Judge Roger B. Taney and his Court in the late 1850's and early 1860's in Civil War America.

    250 years of precedence upheld.... supreme court judges choose when to retire, or stay in til they pass.... those judges, well 2 of 3, choose to retire under Trump... yet last weeks decision on Jan 6 wasnt just partisan... Bidens appointee voted against the charges 350 people are facing... as far as abortion, the US Constitution specifically lays out the role of the federal government, Taxes, immigration, military, establishing nations capitol, patents, border, protecting trade and seas.... everything else is supposed to be a state by state law... each state how the people of their state vote.. states were supposed to be a conglomerate of sovereign entities held together by a constitution, minimal federal government to protect those states and their rights... dems had 50 years to pass a law and did nothing.. the same with this other stuff, 250 years of precedence, same as Bushs illegal war, Clintons illegal war, every president has broke the law, every president since the 70s has broken the classified document law according to NARA, none have been charged or tried, well except Trump.... the whole reason this case went to the supreme court, bc hes been treated differently than every previous president

      Well said. The only thing that is a danger to democracy in the US is lawfare presently being used by the Democrats. Biden's television appearance firmly confirms that the Democrats are totally involved in the use of lawfare as he plainly stated that he wanted President Trump to be tried before the election day by his Dept of Justice (DOJ) rather than let the American voters decide. Its rich and a lot of hypocrisy to say the Supreme Court is trying to make Trump a king, when the truth be told, Biden has executed more Executive Orders than the last 4 Presidents combined. Talk about trying to be a king he should go look into a mirror as the "king has no cloths" as evident by his statements

    Just to be clear the US is **NOT** a democracy it is a constitutional republic. This is actually a rather important distinction and while it may seem semantic its a foundational concept. This decision is hardly surprising at all and anyone who actually understands the constitution and takes a textual approach to its interpretation would have seen this coming from lightyears away. The separation of power and even more so the balancing and checking of ambitions was of utmost importance to the founders. There needed to be some separation between the executive and judicial to keep the judicial apolitical in the sense of separating it from political fighting over the executive. The solution was to grant the executive branch sweeping immunity from the judicial branches powers and to give the executive the pardon power. The counter balance to this was given to the legislative instead. Trump can be impeached and convicted by the legislative branch. That is where the counterbalance lies not with the courts. I don't know if you've read through the full decision rather then just the dissents but I think you should. The concept of no man above the law isn't actually a thing in the constitution rather that all citizens are equally granted right and treated under the law. The government itself and its officers/branches are treated differently then the common man.
    Just to be clear this covers Biden and Obama too both have done things that they would have been tried for if not for this decision.

    You will not find a court who will actually find the things Sotomayor listed to fall under the constitutionally official conduct. Ontop of that the congress will in a heartbeat impeach and convict him for those things she listed.

It may be a reflection on human nature, that such devices should be necessary to control the abuses of government. But what is government itself, but the greatest of all reflections on human nature?       "Trump can be impeached and convicted by the legislative branch. That is where the counterbalance lies not with the courts".
      That is flawed. An outgoing President can escape impeachment due to lack of remaining available time. If Congress is predominantly of the President's party, the voting is skewed politically rather than legally, and the matter is legal.
      When impeachment was brought against Trump, a significant number of his party gave "he is leaving anyway" as the reason to not support impeachment.
      Yes, US scores very lowly in world tables for democracy, 30th and 39th I believe in two studies. It looks like it will cross from "flawed democracy rating" to joining the autocracies in the course of time.

Although the Constitution gives members of Congress absolute immunity under the speech and debate clause, nowhere does it even mention anything even approaching Presidential immunity. Must have just been an oversight, right? No, the Court is just making stuff up to protect their guy.

      The point is that virtually no analysts outside of the fox News Republican maga world agreed that this was a sensible ruling. If you read the dissenting opinions, it is seriously legally problematic.

    The President has the power of appointments, but the real power over the courts rests with the U.S. House of Representatives, under Article III, Sec. 1 of our U.S. Constitution. Specifically, the House holds considerable power over lesser courts, such as the ones persecuting Trump, up to and including de-funding the courts and proscribing their jurisdiction in situations of judicial or District Attorney overreach. This is the Constitution's primary check-and-balance mechanism holding courts accountable to the rule of law. And that is a set of functions I believe the House MUST exercise, because the four cases against Trump this year are ridiculous excesses: lawfare and rogue judges and DAs at their worst, in effect turning our cherished American court system into a thing that's appallingly reminiscent of Stalin's court system under his KGB director, Lavrentiy Beria, who infamously asserted: "Show me the man; I'll show you the crime."
    Simply put: these four courts (Atlanta, DC, and NYC) MUST be reined in by Congress. This subversion of the rule of law in our courts is as grave a threat to the foundation of our American Republic as the rampant mail-in ballot fraud in our 2020 election.
    And it's noteworthy that Snopes just last week FINALLY admitted that Trump did NOT "call for the overthrow of the USA" at his Capitol rally speech. He said repeatedly: PEACEFULLY AND PATRIOTICALLY make your concerns heard -- language straight out of the 1st Amendment to our U.S. Constitution as a fundamental right, to "peacefully petition the government for redress of grievances."

What Democrats, these corrupt Soros-funded judges and DAs and their hack allies in the media are doing is the EXACT THING they falsely accuse Trump of doing! It's sickening!

    Although you make very good Ukraine presentations, your thoughts and opinion on the Supreme Court ruling regarding immunity are just absurd and really quite ignorant. The example you gave that Trump can order an assassination of a opposition leader and this would be legal as it would be a "official" act is just plain foolishness at best and really quite ignorant. This would not be considered an official act and implying that it would be is squarely a thought from "never never land". In actuality, this protects all Presidents against frivolous and political retributions as this ruling actually protects Biden from lawsuits arising from liability from letting illegal immigrants into the country, liabilities arising from illegal immigrants having murdered US citizens, ordering the bombing of a food center in Afghanistan killing 8 innocent inhabitants, and on and on. Chief Justice John Roberts explicitly and clearly stated that the president "is not above the law" and immunity is only a factor when it involves an "official act". An official act is an action that is prescribed by law. US law does not prescribe that you can kill your political opponent as you evidently believe or some such other James Bond fiction.

Read the transcripts of his speech as he states "I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard." There nothing about go and riot. Second, the police officer was not killed by rioters. The police officer Brian Sicknick, died after suffering two strokes the day after he responded to an attack on the U.S. Capitol. You need to get your facts straight as your thoughts are based on incorrect information.
