    I went to court yesterday as i got a section 13a granted over 2 and a half YEARS ago! The council did nothing in this time. Then they popped up threatening court again!
    I turned up. Waited. Case got adjourned. Twice.
    Me suitably miffed.
    Went yesterday and i brought up the electronic signature with no name next to it. I was instantly told its a non starter as its legal now. However... only if its recognisable as a person. It wasn't traceable.
    So they took me to court even though they hadn't followed up on the section 13a for 2.5 years!
    They said they " they'd tried calling twice..no answer.
    And sent an email"
    i never saw...and that was their only attempt! I asked why they didn't write a letter, as they know where I live! No reply.....funny that!
    So the court was to see IF a liability order is valid, NOT how much! Boy, they have section 13a to remember..
    They have made an enemy now. They will get get less than nothing ....my income was from a ltd company that made a loss for 2 years due to the pandemic. No gov help for company directors.
    Only a LOAN a year in...i am paying that back now....
    Section 13a is great. Write to them and request it written off.
    Remember its not pauper prison any more, you dont have to pay them if it makes you financially insecure..

      Mr Echelon: well done! my council had asked me to pay a specific amount with another arrear which I was paying alongside the regular levy, but recently, when I logged on to my council tax account, which I've never done, I realized that a small amount of this CT I'd paid was registered monthly into my CT account with them, when I inquired this, I was fooled around to call this and that number and no one was ready to give me a straight answer. Then, the worst since the money didn't add up, one of them with an eccentric brain would decide to send me a bill requesting unpaid CT, how do I fight this? And now, they've erased the account as I got to direct them to it some days ago.

      I asked Dover Council to grant me Section 13A and they replied and said I am not eligible because I no longer live in Dover.
      Have you also moved away from the original address that you own them council tax?

      I will continue to find other ways to fight this.

    Good Vid although there is a golden nugget to all this.
    The local government act 1888 section 79/2 clearly states :
    "All duties and liabilities of the inhabitants of a county shall become and be duties and liabilities of the council of such county."
    That's right, the council settle ALL accounts, not YOU.
    You are not the fictitious "legal person" to whom such notices & letters are addressed, you are a Man / Woman under God.
    Furthermore, on letters/notices, legally, ALL text that appears inside a 'box' is not a part of the letter, so can be disregarded. Read that letter again with this in mind.
    Realise your authority over all commercial entities, as a living man / woman under God.
    Go from there.

    Section 13A (1c) of the Local Government Finance Act 1992 allows local authorities to, in exceptional circumstances, reduce the Council Tax liability for a charge payer. Statutory exemptions and discounts must first have been exhausted.

    CAN YOU IMAGINE IF THE PEOPLE STUCK TOGETHER AS THEY DID WITH THE TV LICENSING?
    THE SUCCESS WOULD BE WONDERFUL FOR REUNITING THE SOLIDARITY OF PEOPLE.

      @@DebbieLeighDriver I am, but how exactly would that work? I cannot see how your idea will work. Power, water, services all take ingenuity and effort. And cost money. We've had state owned utilities. And now we have privatised suppliers. And why shouldn't people of pensionable age pay for their utilities? There are already systems in place to assist people suffering hardship.

    In 1989, the council tax (formerly poll tax) in Westminster was£35. That means, according to inflation, that it should now be about £87 ayear. It is now somewhere between 800 and 900 a year. WHERE'S THE MONEY GOING? The council appears to have the cash to buy buildings such as supermarket buildings and them renting them out to supermarkets.

    Since 2003 there has been no prescribed form for a liabilty order. The court do not hold a copy and neither do some councils. Allthough the best thing everyone could do is attend court and stifle the courts clog them up

    This is good advice, apart from the fact that all taxation is voluntary, so you will be writing off a none debt and agreeing to continue to pay a tax that is not actually enforceable once you question the actual legislation that is in written format indicating a law that is in place to say all populations have to by the law of the governance "pay taxations". there is not one law, statute bill or act currently stating that the taxation system in place now is anything but by voluntary consent........the governor of the IRS even stated this very fact in 2014 at a senate hearing declaring that all taxations were by voluntary consent....And all councils are for-profit companies and will be listed as such on Dun & Bradstreet, this in itself is illegal as the populations are being taxed by companies for profit who are collecting on behalf of a UK government corporation also a company for profit......so in effect you are funding a criminal enterprise and in doing so are committing a crime.........what a carry on.

      So now Dover Council has written back to me after much delay and told me I am not entitled to Section 13A since I don't live in that property (the property I own them council tax) anymore.
      They asked me to contact Enforcement Agency Dukes because recovery action is to be continued.
      So, this is what I am going to do, I will still live in my apartment but I won't open my front door to the bailiffs. Apparently every bailiff is given a deadline to recover debts, and I found out it's usually 3 months.
      Let me know what you guys think.

      @@johnnyc5765 Make sure to keep doors locked as they are allowed through unlocked doors and it’s an offence to obstruct them (I.e try and kick them out).

      @@johnnyc5765 No - Reg 20 of the taking control of goods act.
      Don’t forget though the council can use a liability order which means if they fail to collect payment via balliffs, they can make a deduction from earnings or benefits. If the amount owed is over £1k they can do a charging order against your property if you own it (add an extra debt to it) and if the amount owed is over £5k they can petition for bankruptcy.
      In England as a last resort, and if it’s willingfully refusing to pay the council can apply for a prison term.

    You should state the 'section' of which Act this relates to rather than just the 'section'. Every Act of parliament probably has a 'section 13' or '13 A'. People can then read the actual legislation on the gov website

    Out of interest, by not paying council tax how exactly do you propose society fulfils essential services such as Social Care, Policing, Fire, Ambulance, emptying bins, etc?

      Council tax doesn’t cover these things . It is put into a national pot where government redistribute it as they see fit . Ukraine amongst others get the majority of it lately I understand . MP’s pension pots get it too . We are being “had” .

    Hi, I wrote to the council about section 13a and they totally ignored it. In return I received a court summons 3 months later. I wrote back asking why they didnt reply to my letter and sent a copy to them. I also sent a copy to the court saying they didnt respond to my letter. I sent both by recorded delivery, so I know they got it.

      @@LofiWurld I ended up with a baliff at the house. I wrote to the council leader and eventually someone from the council tax dept wrote back and confirmed they called off the baliffs but i had to pay it on installments.

      Ive had Bailiff letters all my adult life, an them knocking at the door.. I just don't answer or put a camera in thier face... they don't like that an will pissoff.. ✌️

    I Andy, just seen this 13A information. Does a draft letter exist please and where can it be found please?

      I am the person liable for council tax. My council tax account number is [999999999].
      I write to apply for a discretionary reduction in the amount of council tax under section 13(A)(1)(c) of the Local Government Finance Act 1992 that I owe for the following tax years: [2020/21 and 2021/22].

    I have done this but they responded with a letter with links to apply for help which I’m not entitled to. Also they are saying section 13A is only applicable for certain circumstances. I’m not sure if I should be responding now or not. I drafted an email and left it in drafts saying…I’ve sought legal advice and I’m not liable to pay something I have never contracted to pay…(I’ve worded it better but this is in brief). What next??? 🙃

      If you go down the Freeman “ no contract” woo route you will get nowhere, except courts and bailiffs. Section 13A is relief due to reasons of financial hardship. If paying CT means you can’t afford to eat, pay your rent & heating bills etc then provide evidence to the Section 13A officer at your Council. Send letter by recorded delivery, keep copies of everything.

    All of these things on the internet are complete bull. All you end up doing is delaying it, getting sent to court and having to pay more in fines. None of these people have any proof of these things working, and normally don't try them themselves.
    If you are struggling to pay ANY bill, the best thing is to contact the people, explain the situation and get an arrangement in to pay in place.
    Whenever you see these sort of things about it not being your legal name, not having a wet signature, not being a legal bill etc.., ask them for solid proof they have challenged this and it has been written off

      I agree with most of what you say but this video is correct, unlike all the other FOTL, wet ink signature, Maritime Law woo. Every Council does have a Section 13A officer and they do have discretion to reduce or write off council tax liability. It is not a “loophole” but it is there to help people with genuine need. If you’re paying a Sky subscription, have a 52” plasma screen tv and are off on hols abroad, but are being chased for CT arrears then you aren’t in financial hardship, you’re just making bad choices!

    Just been to magistrates court about me refusing to pay council tax
    Mentioned the capitalised name the wrongful summons n liability from the council tax office not the court
    Asked the magistrates were they under their oath
    They said they were
    Mentioned the 1888 local government act section 782 saying no councils and government bodies could act as courts and judicial bodies
    Magistrates told me they gave c tax authority to issue summons for payment of c tax
    Please advise

    Where I live they go to Court and are granted the power to seek repayment in the form of an attachment of earnings order . I lost £250 in November and £250 in my December wage this way- ouch ! So that has left me short for Xmas and my council tax for the past 2 months aagh! And so the cycle continues … I end up paying late , they go to court or ‘court’ and get a AOE order ( which I’d rather than a bailiff on my doorstep when I have kids ) it’s been like this for the last 3 yrs since my husband had an accident at work that left him disabled and unable to work but because I work we aren’t entities to a discount on our council tax .

      @@markp6982 I think it must be legal through some loophole as they keep doing it - but what I find pretty unethical is the way that when I tell them ‘you are forcing me into financial hardship when you take so much of my wage and expect me
      To pay council tax and have enough for my rent and other bills plus stuff like
      Xmas ‘ they don’t care - now that seems pretty dodgy to me that they knowingly perpetuate the cycle
      Of debt for ppl .I believe it’s so they can keep adding their charges on top

      @@LxUxNxA If you are domestic I don't think they can charge you. Maybe read regs/laws which are offers to contract requiring a wet ink signature. You are being defrauded imo. Bills etc will be sent to MR JOHN FRED DOE which is not English. Its American Sign Language. They have never billed you as John Fred Doe. Maybe tell them no company called JOHN FRED DOE is trading at your address.

      What do you mean? The property is taxed and the people who are liable to pay are named on the bill. Usually the occupier and if there is not one then it's the owner.

      @@blackiesun One of the reasons you can not living in a caravan all year is because the council would not be able to make you pay council tax, s while they can claim "Its the property thats taxed and the people in it that need to pay it" its a load of bollocks. At the time they could not get away with yet another tax on the people so they just called it a property tax instead to get around it.
      They say we are free but we can not do anything without the governement getting its pound of flesh.

      @@datruthhurts28x More often than not the court summons are generated by the council, there pretty crafty with them.
      Assuming this is for non payment have you had any communication with them at all?
      You need to Section 13 the council also I would send a seperate letter / email asking for more time to pay and that you have served a section 13, are you on benefits? if not could you get any help that way?

      @@AndyTheGabbyCabby Andy I cannot see how they can win in their phony courts because all letters including reminders are not recorded, which equals no contact & no contract. So in these jump up courts my AWNSER is where is proof of contact and even contract with this corporation. These corporation's including the water section just send out bills with no record of contact or contract, if any company sends bills out there has too be proof of contract & contact and the best response is I do not understand or consent, by contacting the council with this 13A angle enters you into a contract with them & it's done on a yearly bases so if you payed last year does not mean you are contracted too this year's bill ?

    Hi lve just paid 2014 2015 2016 2017 2018 2019 2020 plus 2023 iv been paying for 10yrs they are saying l still owe them 500 pounds plus my normal c tax am now 67 yrs old on the 3 july they have put courts costs on loads of times can l claim anythink back of them the stress this has put me through ive been ill for yrs now

      How did you get on? It's happening to me now but luckily I live in an apartment so I just keep my door and windows shut to prevent the bailiffs from getting in.
      I still don't know how to come around with to pay or not to pay them yet.

    There’s no need to do that because we aren’t obliged to pay council tax in the first place so don’t waste your time writing to them for a reduction just stop paying it and tell them to prove your obligation to pay it which they can’t

    I can't afford to pay I'm behind I can't even afford to pay water to as I'm on benefits and do part time work it's not likely I'll be able to keep up payments. I don't even feel I should pay any council tax. If your on benefits you shouldn't have to pay it the rates are a joke. Electricity gas food all going though the roof petrol it's going to be a bad storm people are at breaking point. I can see why single men in their 40s are killing themselves.

      If you are in financial hardship write to the Section 13A officer as advised, laying out your circumstances. Keep copies of the letters and send them recorded delivery so you have evidence they were sent.

      If you have, it will be the first genuine liability order I have ever heard of, because council tax summonses are dealt with in bulk and the genuine magistrates clerks will have no record. Try phoning them up and checking on your liability number, etc.
      The council staff simply hire the court, approx once a month and man it with their own staff. They will do their best to get a monetary agreement with you and, if you have a genuine arguement, they will break their necks to try and stop you actually speaking to the magistrate (always assuming he/she is a genuine magistrate).

    Can I have a template letter, please? As a single mum at home, they sent me a huge council tax bill when I moved to this new rented house in band E. I stopped UC 2 months after receiving it because of constant threats, intimidation, blackmails by JobCentre that I was forced to attend... I paid £800 council tax in 1 go and told them I stopped UC and now they are demanding all kind of proofs. I feel gutted that I gave them that money that could have gone to my rent instead. They had sent me a letter from court saying that I had a certain time left to pay the whole £1600 (£260/month). My council tax used to be £58 with help when I was in Tax credit.

    This is no great secret that council's are hiding, it is a discretionary hardship award that any council can make based on individual circumstances of those in financial hardship. It is covered under
    Local Government Finance Act 1992, Section 13A.

    Furthermore, if you have never replied to the council demands for thier tax you have not formed a contract... If they did have a contract they would be able to go through small claims court (it has to be small claims as council tax is a civil matter as the council is a corporation only) as the council don't have a contract they sell the none debt on to bailiff company to intimate and steel items which they have no legal authority to do and it is theft.
    If you have already started to make payments then use the benefit loophole.
    Then once the bill is paid , and council send new bill for new year, you return it "return to sender" with also written I decline your offer to contract. And keep doing so...do open the door to bailiff or any other enforcement officers and they are acting unlawfully.

      They cannot use the small claims court, here's why. Small claims courts and county courts deal with contract law, I.E where a contract exists between two bodies, in Council tax no such contract exists, because you haven't asked them to provide any services to you, furthermore they are packaging a range of services, (many of which you don't need) and are not asking you to pay for those services, moreover they are putting a gun to your head and saying, "pay up or else !". Hence the reason they use magistrates courts, and the process they use within those is not due procedure, they seem to think that someone who is struggling financially to meet their absurd demands for money, is somehow a criminal. I urge anyone struggling to meet their outrageous demands for money to research section 13A.

      I am currently in receipt of council tax reduction but I cannot pay the reduced amount OR I have applied for council tax reduction but I will not be able to pay the reduced bill if that is awarded OR I have been told I do not qualify for council tax reduction because [xxxxxxxxxxxxxxxxxxx].
      My reasons for applying for a discretionary reduction are as follows [see Reasons below]
      I attach an Income & Expenditure statement, showing that I have no surplus income to make payments to these council tax debts, and my latest two bank statements.

      I look forward to hearing from you within two months of the date of this letter.
      If you do not accept my application, I will be appealing to the Valuation Tribunal under section 16(1) of the Local Government Finance Act 1992.

      No, 13A does not apply in Northern Ireland since they pay domestic rates, not council tax

    It’s very costly for the council to recover debts not freely paid and they will attempt to avoid that cost if they can. Remember, after all , that it was the non payment costs that destroyed the poll tax system. Even debt collectors only buy the debt for pennies in the pound as I understand it.
    If they won’t cut their coat according to their cloth maybe it’s incumbent upon us to make them do so. Why should we work 5-6-7 days a week to provide for them when they unilaterally decide to only work 4 days a week?

    Council tax 60% towards pensions 30% to debt 10% maybe on local issues!!!! Also it's a demand not an invoice and they don't use proper magistrates court. It's all been one big con!!!!

      Go to Citizens Advice or another debt charity and get advice. Be completely honest with them about your circumstances. I’m afraid you are likely to end up in court though, with the possibility of being declared bankrupt (unless you can pay the outstanding amounts)
