Dear ********* City Council,
I write to make this formal request to the council to consider using its discretionary power under Section 13 (a) of the Local Government Finance Act 1992 to discharge my council tax liability obligation which is outstanding due to a variety of justifiable and conscionable reasons.
This request is made because, it is clear that the liability is in all probability never going to be paid. The amount demanded is liable to force me to live on an income below the government poverty threshold (The UK government, the European Union and many other countries use 60 percent of median household income as the poverty ‘threshold’).
I accept it, is the authority’s discretion alone to exercise this privilege under the above-mentioned law, but I make this request to you in writing as my very last resort to resolve this longstanding issue and it is my utmost hope that we can come to this arrangement mutually and agreeable to all concerned.
Your personal bit here…Over the last 3 years;….my personal circumstances, illness, bereavement, loss of job, dependency on medication, partner left me, single parent, blah blah, blah…
As a section 13 application has been made prior to an award of a liability order then you should not continue with an application as you do not know how much council tax is now outstanding. Any liability order made at this juncture would be quashed.
I am unable to attend in person to ensure the hearing is adjourned; due to ****** commitments. There are no financial means test for the previous LO’s therefore they cannot be enforced; there is none for this year either and there is case law and legislation to support that.
It would be a breach of my human rights and my children if you were to attempt to jail me for a civil matter. There is case law and legislation to support that also.

Your personal bit here…With the coronavirus pandemic causing me to lose hours, shifts and being laid off during this time has exacerbate my already precarious financial situations. I am already living from paycheque to paycheque. I don’t have an emergency fund, I am struggling to make ends meet during these uncertain times blah bblah…

Ask them where it states LGFA 1992 that payment of council tax is mandatory and why they are sending out a statement of account as "billing agents" instead of a bill?

He doesn’t need to as he’s read the act. If you haven’t, or don’t understand it you can contact them yourself of simply go to the government website which clearly shows the obligations, duties and powers the billing authority has on the subject of council tax.

Hi Andy, I take it you are in rented accommodation for them to zero your arrears, otherwise they would have gone for putting a charging order on your property. The best way to be is self employed in rented accommodation.

@Richard Fox Yes you still pay Ctax in rented property, but you have no property for them to take off you, so more chance of getting debt after some time wiped, zeroed.

Hi mate I’ve just received a letter from my council about council tax debt from 2010-2016 and 2016-2019. I don’t want them to add a attachment of earnings on my pay. I’ve offered £20 monthly on 2016-2019 debt. Both debts have liability orders. Does this mean they can chase me for debt even after 6 years

They can chase you indefinitely as long as a liability order has been obtained.
