A teacher saw my cell phone IN MY LOCKER, TEN minutes before school started and took my phone the day before I was leaving for vacation. I don't forgive her.
I was literally pressing the button to turn it off. I wasn't holding it, I was touching the phone while it sat on a shelf in the locker before the school day started.
Once got my phone taken away during school, dad had to get it afterwards. They told him that next time they would be holding it for the semester, he laughed and said "You can fucking try, I paid for that phone and you wont be keeping it."
Fun fact: there was a lawsuit regarding this exact issue stating that keeping the child's phone overnight left the child vulnerable and unable to contact anyone when an emergency occurred. Or something along those lines.
It’s worse than that. Even if there weren’t an emergency communication aspect, there are limitations to the guardian pro tem thing AND last I checked school is required so there is a coercive aspect to the signatures. Another AND, there are plenty of kids who are 18 senior year. Fun story, back in the 90s after I turned 18 senior year, I made a suggestive hat and wore it to school. An assistant principal took it and wanted one of my parents to collect it. I threatened him and he sent a cop to my house later that day. The cop noped out of there as soon as he found out I was 18, the assistant principal gave him everything needed for a theft arrest, and I started insisting I wanted a report and the assistant principal arrested for theft. Basically, “yes, officer, I did threaten him over the theft. He needs to be arrested, my property returned, and I dare you to arrest me. I’m sure we’ll have a splendid time in court.”

It's very unlikely that they need consent to take your phone, even by prying it out of your hands. The courts have frequently upheld teachers using reasonable force to keep a classroom in order, and taking a phone forcefully from you is within that Goldilocks zone of reason.
I am a teacher, we can take the phone. Now I would never take it by force. If you do not hand it over willingly, you leave my classroom, and we see where we go from there. @@allasar With respect, no, you can't take anything. It's a crime, legally speaking, for one I was not there to sign the school policy or witness it, but assuming I am a minor it won't matter much there, however. Policy of the school does not go over the law, same applies to HOA 'laws' which are more just regulations, police enforce laws, not regulations, take my device and I report it as stolen.
As a Norwegian I'm always astonished at how everything seems to be okay legally in the US so long as there is a contract. In Europe there are a loot of things that contracts can't legally regulate. For example, even if the contract made it sound like you theoretically sold your phone to the school so it's their property, if it's de facto your property (as in, in practice everyone recognizes it as your property) it IS your property. Contract or not
Maybe you should rephrase that. Do you know what a lease or mortgage is?
ปีที่แล้ว +2
We do have these contracts in Germany too, but they aren‘t binding because a minor simply isn‘t able to sign legally binding contracts. At most these contracts are binding for the parents but most schools don’t even have proper contracts. They also likely won‘t be valid in the US (not only that, school law both in Germany and the US is state‘s law, not federal law). However, school law usually has regulations put in place to allow for confiscating items under special occasions.
One time my teacher took my phone, set it on her desk and told me it was hers until the end of the day. She later left the room and I just picked up my phone off her desk and hid it in my bag.

Back when I was in school over a decade ago I saw a interaction of a teacher confiscating a students phone and refusing to return it at the end of the day. The student rightly pissed off was immediately scared and offered to stop arguing the point and behave should the teacher give the phone back after class. The deal was not taken. So the student admitted they don't need to play with the phone at school but they sure as hell need it to get home safely, because the threat of filming or calling the police was on the few things keeping her safe on the way home. Teacher flat out said not my problem and kept the phone. Later heard the student was followed and harassed all the way home without any way to call for help. When I was in school over a decade ago, they somewhat went by a "rest of class, then next time rest of day, then next time rest of week, then next time rest of semester, then next time rest of the school year." I'm a Millennial so we didn't have smart phones in school. Considering how many people needed to call for a ride home they should never allow phone confiscation. If you're caught screwing around on your phone, it goes in a basket on the teacher's desk that you're allowed to take it back from at the end of the class.

Stand therefore, having your loins girt about with truth, and having on the breastplate of righteousness; and your feet shod with the preparation of the gospel of peace; above all, taking the shield of faith, wherewith ye shall be able to quench all the fiery darts of the wicked. And take the helmet of salvation, and the sword of the Spirit, which is the word of God: praying always with all prayer and supplication in the Spirit, and watching thereunto with all perseverance and supplication for all saints. @The_Genius007 True. Nice catch.
Facts and I never consent to that
It's very unlikely that they need consent to take your phone, even by prying it out of your hands.
Never had it escalate to be honest, I teach and give respect. The rare occasion that a student is caught on his/her phone they hand them over. Rules are rules, and if you do not agree with them, there are other schools.
@@allasar With respect, no, you can't take anything. It's a crime, legally speaking, for one I was not there to sign the school policy or witness it, but assuming I am a minor it won't matter much there, however. Legally speaking, all you can do is request my device and I can tell you no, you can then remove me from the class and have me either sent home or to the office, the same dance will happen with the school admin, you have no legal right, I will say no.
We do have these contracts in Germany too, but they aren‘t binding because a minor simply isn‘t able to sign legally binding contracts. At most these contracts are binding for the parents but most schools don’t even have proper contracts. They also likely won‘t be valid in the US (not only that, school law both in Germany and the US is state‘s law, not federal law).
However, school law usually has regulations put in place to allow for confiscating items under special occasions.
In the US the school does have to return the phone if the legal owner requests it
If not they can be charged with theft since it isn't their property

When I was in school over a decade ago, they somewhat went by a "rest of class, then next time rest of day, then next time rest of week, then next time rest of semester, then next time rest of the school year." It was only enforced by the teachers' bias in how much they liked the kid or not. Some would walk by a kid's open backpack, see a phone sitting in it, and count it as the next step. He bashed a metal plate on another guys head once as well, this drug dealer used to get high on H and do heinous things to everyone. I hate snitches but in this case I potentially saved someone’s life.
Thanks, Mike. You really teach us every day.
The teacher really said 😂 😂 😈😈
That strict teacher
It’s all fun and games until the teacher disables your phone for a year
Still fun and games...namely "How many ways can you make someone scream?"
...Until they... WHAT?!
@@bruhidksomedumbshit yeah those dumbfucks just left evidence that they tried to access your phone without permission. Suing is an guaranteed money W
Yeh I knew this one bitch of a teacher at my old school who after taking a kids phone would proceed to type random numbers into the pass key to lock the kid out of the phone for a long period of time, I think if I remember correctly he wasn't able to get onto his phone for a bout 3 hours after school which caused him to be late for his soccer game after school
2001 illegal wire taps. No warrant on wire taps. 2016 Due process violation
This is why I didn’t sign the school handbooks.
@InuSakuraKage they didn’t sign anything either, I literally would just throw the shit out.
Also, you worded that very poorly. Just talk like a normal person, not a person trying to sound like what they think a lawyer sounds like. “Beyond the case of A year behind junior or senior basically an individual 18 years or older your signature is moot.” Not a lick of that sounds right in any capacity.
Just type slower maybe?
Its still crazy to me that we have to sign a policy like this to go to a place we're forced to go
Neither you nor your parents actually have to sign it (in most places, anyway). The school still has to let you attend if it's a public school (usually, depends on jurisdiction).
It is crazy
It's crazy that cell phones exist and you can send an email around the world in one second .
Be grateful for the help.. give your Mommy a hug today
@@yogijaya2897 lol wtf are you talking about, be greatful for what help lol
@@yogijaya2897 What does that have to do with policies??
Ain't gonna lie me and my teacher fighting before she gets my phone she reads people's messages out loud.
That's illegal
It's invasion of privacy to go through a students phone
Always put a passcode on it and turn the screen off before giving it to them
bro who has a school day that lasts only 5 periods??
I'm homeschooled mine lasts 4 at my co-op
He probably has zero period. One of my acquaintances had period zero to period 4, but only her senior year, and only second semester, after taking summer classes, the summer before the school year started.
me but we still have the same amount of school time because the start doesn’t count as a period
we have 5 periods in my school
I have 5 periods
I once had a teacher who got into an argument over a phone in first period. The teacher took the phone and said he’d give it back at the end of the day. He proceeded to input 0000 as the passcode, effectively locking the phone. He kept a close eye on the phone and continued to lock it out until the end of the school day. The student got their phone back at the end of the school day, but couldn’t use it for the rest of the day thereafter due to the lockout timer.
that’s fucked
It’s all fun and games until you secretly put a USB killer in his computer
And you could sue them for that
:p
@@thechargedfoxie456yt2 honestly I sided with the teacher, kid was a punk
@@ryanpohl2709 it's still illegal though
What if there were personal documents on the phone the kid needed that night? He could've ruined that kids life given the right circumstances
They are allowed to keep your phone until the end of the school day. But they cannot just take it away to their home for a whole year. You or your parents paid for that and that counts as stealing.
Fun Fact : there was a lawsuit Regarding this exact issue.
This kids is why you stuff your phone down your pants.
How to get expelled 101
@@deathmauler181you’re not gonna get expelled for having a phone in your pocket. How old are you, 12?
@@deathmauler181 bro you cant expelled, most they can do is give detention or in school suspension (which is just longer detention), they cant expel you for holding your own property to yourself, thats not how that works
@@mathmanchris666Probably 7. 12 year olds are wayy smarter than you think.
@@mathmanchris666he didn't say in his pocket 💀
Everyone parents look soo chill man
Glad went to school in germany. Taking the phone for longer than the school day is considered a crime here and the school would be in big trouble if they refuse.
We had a kid with a lawyer as father and well he changed our teachers mind when they thought its ok to keep the phone till a guardian comes.
The teacher nearly got fired for it too.
I remember being in elementary school and Pokémon cards had just come out and they were extremely popular. One day they called the whole school into assembly. While this was happening the principal had the teachers go thru all of the students backpacks and confiscate all of the Pokémon cards. They then brought them up on stage in the assembly room and shredded all of the cards in front of the whole school.
That’s illegal
@@The360MlgNoscoper correct.
That's property damage and all those parents could've sued the school
The school would've had to replace every single one of those cards
for my country its until the end of the school year 😔
If a teacher pulled that bs with my kid there would be one less teacher at the school. (In Minecraft)
When I was in high-school I had a teacher take my phone and they grabbed it out of my hand which in. California the way they grabbed it was considered assault. I slammed the teacher against the wall I got suspended pending investigation for expulsion I was back at school the next day
Please if you are in this predicament do not do what i did
*puts 50B alarms before getting taken*
Teacher takes my phone for longer than a day im chargin rent 💀
How to sue any teacher
Step 1: make them take your phone for a reasonable amount of time like 3 days.
Step 2: Have a routine that requires a phone to get home or an important place.
Step 3: have a parent to pick you up if they are called with your phone.
Step 4: you cant get a drive, so make a accident making you get a huge damage like someone who pushed you head first on a concrete ground.
Step 5 (if you are still alive): tell the teacher that you couldn't get home cause of the lack of phone.
Step 6: if executed correctly then the teacher should get sued and fired.
If you understood anithing you just read, then congrats, cause i bet you, you didn't understand a single word. :)
