    HOA's infuriate me. My brother had a house in the country. Eventually they began building next to him. He has a nice house but nowhere near what they were building. He also had a lot of land. A development was put up next to his house and about 9 properties backyards were connected to my brothers field. HOA president came over when I was visiting trying to get him to mow his grazing field for his two horses. They also tried to force him to sign a document for him to become apart of the HOA. Almost all of the neighbors were ass hats. So one day, my brother asked me to help him put up a fence along that side. We installed a 7 foot high cedar wood fence along that portion of the property. We installed the face on our side and painted the other side the brightest orange and pink we could find and put up all sorts of gawdy things all over it along the entire run. The hilarity that ensued was pure enjoyment. Everything from the cops being called, to threatening letters, to even a court summons. Of course they all failed because it was private property that built before the HOA was formed. It really got fun when I helped him do a controlled burn on that part of the field. They called the fire department which worked out because they used it as a training day for them on how to handle brush fires.

      When I bought my house, I told the realtor that I dont even want HOA houses listed which cut our options down 1/4. I live in the country now. Will be awhile before they come this way.

      you should have put up flood lights facing out on top on the fence hooked up to generators and a train horn just to piss then off with lots of light and noise maybe drive back there and do donuts or put some speakers up and blast the audio from gay porn. lol

      Tell your brother he needs to start raising hogs in that area next to the fence or the easier way is hire a hog farmer to deliver and spread hog manure all over that corner of the pasture. That ought to get the hoa freaking out. Think about it " your Honor I was simply improving my pasture by spreading fertilizer on the land. Try and find a judge that will agree with the hoa, I'll bet his Honor will have a hard time not laughing.

    Had a friend buy a nice 20 acre lot that bordered with an HOA. He hadn't moved into his house a full week before they knocked at his door. They thrust a paper at him where the previous owner had agreed to abide by their strictures and he had agreed that he would add to the deed any future owners would sign the HOA.
    He told them to get fucked, slammed the door in their face and called his lawyer. After double checking deed there was nothing about this so, he went on about his business. Wasn't long before the threatening letters started and before long, it went to court. He won, including his legal fees. He then built a dirt track on the HOA side so he and his buddies could race motorcycles and ATVs and party hearty every weekend.

    I had a cop refuse to allow an HOA to have my motorcycle towed (NO MOTORCYCLES ALLOWED) because the HOA rules do not apply to public roads. He told the tow truck operator it would be considered theft if he took the motorcycle.

      If it's a gated community, those are private roads. If public roads, the officer was right. However, your HOA can fine you if you are breaking their rules.

      +John Thomas No, gated communities maintain their own roads and they are not owned by the state or county. They are privately owned roads. Otherwise, a gate wouldn't be allowed.

    I once bought a house in Edmonton Alberta that had something similar to HOA. I was given a similar agreement document. I looked it over, said I don't agree and never signed it. There was one or two times I received a letter complaining about something with a fine attached. I justs returned it to them with a letter threatening harassment charges against them. And that was the end of that. I don't have to live by rules I never agreed to.

    I drove team with an owner operator friend of my mine and we had a trailer full (48 footer) to deliver to a house in a private run development. The customer was the first house sold in the entire development and three asshats showed up when we parked in front of the house which was finished and told us we had to remove the truck from the property and use a small 1 ton van to deliver the furniture. a bulldozer from the contractor attempted to pass the 18 but the asshatts were blocking the road with their pickups. Bulldozer asked them to move their trucks and they told him to sit and rotate. Next thing we knew the dozer started forward gathered all three pickups pushed them past the 18 then raised his blade and drove over all three trucks with the Cat D-11R. Ya shoulda seen those idiots freak out. They lost in court when the contractor pointed out to the judge that he had inserted a paragraph to move any vehicle out of his equipments way. Judge read that part of the contract looked at the three idiots and said if you don't know what your signing don't try to sue when you have no legal standing. Then they found out two months later the first home buyer never signed the form to join the hoa. The hoa hadn't registered with the county so he doesn't have to join.

      nope they wont, i used to fly my drone over various HOA board members houses when i was living in an HOA neighborhood (i wasn't part of it but they tried everything in their power to throw me away). rules dont apply to them, everyone else will get violations and legal threats, but i have seen how trashy they really are... back yards are full of violations like multiple sheds, play toys left out for WEEKS unused, and garbage in backyard bin untouched for months...

    The lawyer said ask many questions. Only one qurestion I would need to ask: "Is the neighborhood ruled by a HOA?" If the answer is, "yes," then I say, "I'm not interested in the property'" and walk away...

    Not sure how you can tell people they can't park on a public street, so they signed something, So what. it's a public street, it can't be binding. Secondly, anyone visiting a house and parking in the pubic street, didn't sign anything. So they aren't bound by some dumb HOA rule!!!
    Really, should never live in a HOA.

      JB Dragon it’s a gated community. Not a public street. The community is responsible for all maintenance of the roads. It does suck though. Especially with those short driveways.

    Why somebody with a detached home would want an HOA is beyond me. Townhouse/condo yeah, due to the common walls, but SF homes? No way.

    "The road is county property." When the homeowners purchased their homes they were required to sign a contract agreeing that they would keep their cars off of that street. But that only applies to the people who signed that contract. Apparently, anyone can park there except for the people who actually live there.

    Sorry, but no. HOA rules do not cover public streets, at least in California. Anybody with a legally registered, road legal vehicle can park on public streets unless there is a legal no parking sign. These have to be issued on a case by case basis. Lots of little Hitlers set parking restrictions on public streets for fun and profit, so this is specifically illegal. An HOA can't forbid the use of public streets because they don't own them.

      If you agree to the terms set forth by the HOA, then you must abide by the terms. You can't sign the contract and then bitch about it. Those that signed the contract are bound by it, those that did not are not bound by it.

      Real estate and community development law is outside my area of expertise, but I have to seriously question whether an HOA can prohibit a homeowner from parking on a public street. I don't see how the HOA has any authority over that. Contract or not, the HOA doesn't have unlimited jurisdiction.
      This is even more true in this case, where the parking rules restrict vehicles to garages, driveways, and "designated areas". It doesn't actually prohibit parking on the streets. It may be true the public street isn't a "designated area", but that's because it's not an "area" at all! That is, a city street is not part of the community area that is owned by the HOA. So the parking restriction as written in the rules doesn't even apply (assuming there was any legal theory under which it otherwise even _could_ apply -- that is, assuming the HOA could somehow exert authority over city land).

      Often you cannot obtain a home in a neighborhood with an HoA without automatically agreeing to the HoA. And in places like newer cities, having an HoA is almost inescapable so not everyone really has the choice

      It seems non HOA homes and rural homes have no problem selling quickly.

I live in a city that has grown substantially in the last decade and there has been a massive increase in new home construction and any construction that is anywhere close to the city is HoA bound. If your “choice” is to either live in an HoA or commute 2 or more hours every day then that’s not exactly a reasonable option.

    I’ve asked this a million times, why even live under HOA? How do they get away with such bullshit? There’s thousands of videos and hundreds of thousands of stories about corrupt, unfair, tyrannical, shady, petty HOA experiences. Yet no politician, lawmaker, lawyer, judge, department or agency has stepped in to address how these associations screw so many people and their families.

    HOA's are easy to deal with. You know where they live. You know where they shop. You know who they are.
    There are a few thing you need to get right:
    1. that must have been your house the fire truck was going to.
    2. Was that your pet zip tied to the front gate?
    3. Was that your van stolen at the market the other day? They burned it!!!!!
    4. I see you had new windows installed. What someone shot them out? Well that window truck did park in the street so you need to write yourself a ticket for that.
    5. Call the head of the HOA every now and then and just ask. (I was outside and smelled smoke. Is your house ok.)

    Here's a hint. The HOA agreement is between the home owner and the HOA. There is absolutely nothing the HOA can do about any citizen, regardless of where they live, parking in front of any house as long as it's parked legally. In other words, if I'm driving down the road and for whatever reason I decide to park my car legally and then walk to my house 10 miles away, the HOA can do nothing about it.

      a1scooter You are very very wrong. If the HOA owns the road and in a lot of HOAs they do, when you come back to find your car towed so sorry Charlie. Most HOAs also have gates and they have signs on those gates warning you this is private property and illegally parked vehicles will be towed.

      Read Fred's reply again. He did clarify that not all HOAs have roads owned by the county. So, the strategy of parking in front of a board member's house is not a fool-proof solution.

    The lady in this video should just spend the $500 on buying a POS cars from a wrecker and parking it in front of the HOA staff's houses.     The neighborhood next to mine has an HOA and they actually(with good reason) tried to get the local high school students to stop parking on their streets. Law enforcement told them they had no right. What you may not understand is that these kids have parking spaces available at the high school...but they park there so they can duck out and skip school. They take up the left and right of an entire street and it's crazy. School won't do anything about it either. It's about 25 vehicles. It makes coming home dangerous because you have kids walking home, and what is basically a narrow 1 lane road. But yeah..by law an HOA can't make rules for legal roads in the state of Texas

    i lived in a HOA once and they had to have been getting togeather and brainstorming about how to fuck with residents.
    i think HOA's are too powerfull and should not be able to levy fines

    Back in the day when I bought my home a co-worker told me NEVER buy a home with a HOA his brother lived in one of those communities. That was the best advice any one had told me when I was buying my home. I have pass on the wisdom a out not being a home with a HOA...lol

    That HOA is in violation of state law. They are not allowed to prohibit parking on county, city streets. ABSOLUTELY NOT ALLOWED. Only the city and country can prohibit parking on county streets. County streets are not owned by the HOA.

      What are you, an idiot? The HOA, it's true, can require you to abide by their rules but the one thing the HOA cannot do is lay claims of ownership over streets that are owned by the county or state. The only thing the HOA can do is regulate parking on property they own. If a street is owned by the county, the HOA cannot enforce their rules since they do not own the public streets.

      The only way that the HOA could enforce parking rules on county or city owned streets is if they go outside the HOA and get a parking ordnance from the city or county. Public streets are not owned by an HOA unless they actually own the property the streets rest on. HOAs only own the property lots and community areas of the HOA. If the streets and sidewalks are owned by the city of county, then the HOA cannot enforce their rules.

    Well, not happening anymore.
    Unfortunately, there's not a single new affordable neighborhood in or around Austin that's not an HOA. Just have to find the least intrusive of them

    Never move into an HOA neighborhood. My grandfather was ticketed because someone else pushed a dead golf cart through a stop sign. As in they were pushing the cart because the battery died, they went through a stop sign, and the HOA ticketed my grandfather whomwas in a different state at the time. They even took us to court when we refused to pay. They lost.

    HOA agreements and contracts are not legally binding when it comes to public or private property. They are only legally binding on HOA property. HOA are not permitted to regulate parking in public or private areas of which they do not own in any state.

      That’s nonsense my friend. If you sign a legitimate contract, you are legally bound by it. For example, if the HoA states you must mow the lawn every two weeks then you have willingly signed an agreement dictating what occurs on your private property.

    sad that you buy your home in the US and some fools limit you or tell you what you can do at your own home. where i'm from nobody can tell you what to do with your property unless you create a environmental or health hazard to the public then the government will step in. land of the free but yet your bonded by so many rules and regulations. i guess that's what makes america great.

    My parents live in a strict HOA community in FL and they allow parking on the street during the day and if you are having guests over. I think you just can't park overnight. Where do landscapers, plumbers, maintenance workers park while they are working?

      My neighburhood had an HOA that was really not a problem, but the residents voted the HOA out of existence before it became a problem. Remember, HOAs are collections of people and some people have big egos and an over developed sense of self importance and authority. As soon as they appear to start being abusive, get rid of them.

    In a part of Fayetteville New York, you can't park a Pick Up Truck in your own driveway! I live up above in another county, where there are no restrictions, as my house sits 2/10s mile off the road. In the Summertime, you can't even see my house. The code enforcement Officer covers 3 towns, and is overworked as it is. However, no HOA where I live.

      If it's a Public Street, I don't see how any HOA can override City owned streets. I'd give them the middle finger. If it's private Roads, that's a different matter.

    Yeah my hoa sent me a letter saying I had violations and would be fined . The kicker is they waited 2 years to send this letter . So when I call to ask questions the answer service picks up and no board member ever returns my calls. My guess is that they use the answering service to screen calls . The best part is the husband of the hoa member who sends the letters drives around the neighborhood 4 or 5 times a day doing what they property inspections . Busy bodies

    I would never own withing HOA boundary's.
    However if by some strange happening I ended up owning a property and had problems like so many seem to have I would take a hands on approach !
