    My dad has a close friend in Fort Myers who’s HOA pulled this stunt. The guy has a $100k loaded out Denali 2500 truck and got letter from his HOA. He Started parking the truck at my dad’s property and then bought the ugliest beater of a car he could find. Now he drives the beater to my dad’s when he wants to use the truck. I’m sure the HOA loves looking at his beat up 97 caprice classic.

      My son and his wife bought a 1/2 million dollar house (against my advice) sans an HOA. As a result they have a neighbor who has a huge storage container in his front yard. Another neighbor has a 20+ foot boat and trailer parked on the street. My crappy neighborhood has no such things because we do have an HOA.

    I just resigned from being president of my HOA. Trying to change dumb, restrictive rules like this one was such a waste of time. Any time a change was mentioned at a meeting people would throw a literal tantrum with no awareness of reality or truth, pounding the tables and screaming over nonsense ams gibberish... The whole HOA thing is a bad idea because the majority of people are staggeringly idiotic.

      Why did you guys sign onto the HOA rules? Do like others said, buy where there's no HOA. I did that. Can park whatever wherever, etc. Within 15 years, the hood became a dump, and my house was worth half of what I owed on it.

I’m currently looking to sell my place and I’d like to stay in the same city… but unfortunately, as soon as I exclude HOAs from the search parameters, the listings drop from 1,853 homes to 404 homes. THAT’s why people have no choice but to join a community with an HOA. 45% of Florida homes are in an HOA, and the numbers where I live are clearly even worse. Given how competitive the market is in Florida right now-especially where I am-people have to take what they get or be homeless. 404 properties is not a lot when you live in one of the fastest growing cities in the country. That’s a lot of people vying for very few homes to go around.
      As for me… I’ve had enough and I’m leaving Florida because I simply can’t find what I want/need unless I keep caving to HOAs. I really can’t do it anymore. I knew they’d be a problem when I first moved here, but I simply didn’t have a choice given where I needed to be. 8 years passed without a problem and now my entire community is in an uproar. Trying to move has made it clear that HOAs are the norm here and they have too much control; they’re not going anywhere anytime soon. We aren’t given enough choice in some cities-because the cities themselves prioritize HOAs over everything else. It’s cheaper for the city when communities are privatized.

      Because some people want to live in a nice community where a 23 year old can't buy a house and park 6 cars there with 2 of them broken down and tires deflated. Then he decides to paint his house 4 different colors after the siding and gutters start falling off. Then has his buddies over who park on the street while they all get hammered at the community pool. There is a place for HOAs and people can choose not to live in one if they don't like the rules there.

      The problem is states and municipalities are passing on their job to HOAs (or the management companies to that make $$$$ sending emails and fining people and doing not much else), so they mandate that HOAs must be in place to build new subdivisions

      Imagine some developer wants to build a new sprawling neighborhood and add more streets to plow, more public spaces to maintain, etc. Unfortunately, towns generally don't have slush funds sitting around to cover the possibility that there may be 'more town' to take care of in 6 months so they enact rules requiring new subdivisions to setup HOAs to directly tax the residents of those areas through Fees, and to cover their own maintenance with those funds. In some areas, it's almost impossible to find housing that ISN'T in an HOA for this reason.
      I had a buddy who eventually moved from his recently build neighborhood.. not because of an HOA.. but because every house in the subdivision got hit with a special tax assessment to cover the cost of all the infrastructure required by the neighborhood.
      Sure, he got a newish McMansion in the boonies for maybe $500K (10-15 years ago).. but that neighborhood required major infrastructure projects when it was built.. new sewers, water lines, power, data, etc. The Town they fell inside of decided the best way to fund that was by borrowing money that those residents had to pay off through a special property tax assessment. I think he was paying about 5% of the value of his house in property taxes every year.. and after accepting that for a while, he just moved on.

      ​@realflaman you don't even habe to be in an HOA. In San Antonio, they enact similar regulations to an HOA. I was fined for working on my own truck in my own driveway BEHIND a prvicay fence. And I'm not dropping the trans or the motor or anything, just minor work and I was an actual certified mechanic, but it was my personal vehicle, not someone else's. I never paid a penny and kept fighting it until it came to go to court snd they dropped it before the date. They KNOW they aren't legally allowed but people will just pay the fine and comply, to avoid court or any retaliation. And most people do, so they get to do it ALOT

      What difference does that make?? When you buy a house within an HOA, you are given a copy of the rules to READ and sign. If you don't agree with the rules, don't live there. It's as simple as that. Don't sign saying that you'll abide by the rules, then cry about it later. Play stupid games, win stupid prizes.

If I want to park a torn up 86' f150 in my driveway with missing body parts and a dented tailgate, that only starts with a jump box and lose parts as I drive away... That's my problem.       State is going to have a very hard time getting older HOA neighborhoods to comply with this new law. There is a contract signed between the homeowner and the HOA. It's signed the moment they close on the house. The HOA says, no trucks in the driveway. Deep down, trucks not fitting into garages is because today's trucks are too big and too long with large cabs and beds.

      HOA is. there to protect property values! MOVE. I see neighborhoods w/ 4 or more trucks parked in front of a house with their company signs on the trucks and trailers. A neighborhood isn't storage for your company vehicles and/OR beat up rusted vehicles. You must be ok w/ a neighbor w/ 5 trucks and their trailers w/ equipment parked in front of your house! and crewmen coming and going at all times of the day!

    😂, that’s why when I was looking for a home…I told my realtor to TAKE OFF EVERY HOME THAT WAS IN A HOA run setting. I’m not going to be told what I can and can’t do on my own property. No drama and peace of mind is more important to me.

      I bought my current house partly because there was no HOA. Some organization came along later to try to enact an HOA. That went nowhere.
      When I was a 9yo kid my dad tried to form an HOA. He was into controlling other people. It wouldn’t have affected me. But thankfully for the residents there it went nowhere. My dad was a weasel.

    My HOA sucks too. At the meetings they always say they have over $400,000 in reserves, yet they want to hike the HOA fees so they'll have money "just in case". They pay a security company $28,000 a year to have a guy who barely speaks English walk around 3 days a week from 1pm-9pm, and hand out violation notices for cars being parked incorrectly or not having their parking pass hanging from the rear view mirror. He gave me one for that because my mirror fell off the windshield and I placed the tag on the dash so he can easily read it when he made his rounds. But because it wasn't hanging on the mirror, I got a warning. He's not here to police the property for the residents, he's here to police the residents for the property. Any crime that happens will happen after 9pm so it's pointless to even pay $28,000 a year for 24 hours a week of "security".

My HOA board focuses on stupid crap like painting lines in the parking lots and hiring exterminators because someone saw a couple of Rat Snakes. The property has wooded areas on three sides. You're never going to get rid of the wildlife. What really sucks for me is, I have to share the water bill with the other 15 units in my building because the units aren't metered individually. So I'm paying for water being used by units that have 2-6 people living in them. As soon as I find a house that fits my needs, I'm listing my condo for sale.

    My Parents home owners association had the rule about not parking boats, RVs, campers, commercial vehicles, or pickups in the driveway. The bylaws had no mention about parking in the street, the city and county both allowed parking in the street. So my dad parked his pick up in the street. They threw a fit. If the road was owned and maintained by the association they have a right to prevent parking on the street but since the roads and drainage was maintained by the County there was nothing they could do about it. After a couple of months they broke down and allowed pickups to be parked in the driveway.

    I do have to say, the oversized van has no business parking in a private drive as it would be unsightly. But pick up trucks, if kept presentable like the ones in this video should definitely be allowed to be parked in their driveways. Additionally, if an HOA, as in this case, does not allow residents to park their pick up trucks in their own driveway. That HOA should be made responsible for providing a reasonably distanced secure parking area for those vehicles and provide it to the residents free of charge. An HOA collects enough monthly to make that happen. No special assessments allowed for maintaining that parking facility. It is fully the HOA’s financial responsibility.

      “No kids playing” is pretty close to a reality in some. I’ve heard of HOAs that don’t allow, basketball hoops, trampolines, and any sort of above ground pool.🤦‍♂️
      Some other notable ones:
      -Can’t work on a vehicle in your driveway.
      -Can’t leave garage door open
      - have to have garbage cans placed out of view
      - garbage cans must be brought back from the street by a certain time
      The list goes on and on

I’ve even heard of some HOA’s that demand homeowners leave their garage door open at all times. Sick, just sick.     HOAs aren't necessarily out of control but there are exceptions. Despite The Meadows attempt to shield themselves under Kaufman, it wouldn't hold up in court.
    1. HOAs may pass rules and regulations that do not conflict with federal, state, and local laws and ordinances
    2. HOAs may, in certains cases, make rules that have greater restriction, i.e. the city allows lawn mowing between 7 am - sunset, an HOA may pass a restriction of 8 am - 5 pm
    3. HOAs must comply with all federal, state, and local laws. A private community is not exempt. In this case, the HOA officers may have received incorrect guidance. Should residents file a suit against the HOA, they would likely prevail and could recover damages for themselves and the HOA if it is determined the elected / appointed officers failed in their fiduciary duty. While unlikely, they could be charged criminally.
    4. The news report stated that the HOA has entered resident's properties to affix letters, warning, and towing of vehicles. This is illegal, regardless of any C&R or bylaw. Unless a vehicle is derelict, it rarely can be removed. HOAs may fine, in accordance with federal, state, local, and HOA regulations but may not enter the property. This HOA should cease and desist entering any property for such reason; certified mail has a purpose.
    The takeaway is that the HOA officers likely need training. HOA boards are a community of volunteers and often seek advice from property management companies. Sadly, many property managers are under trained, overworked, and can be bonused on up sales (mailers, notices, legal counsel, fines, etc.).

      When I was looking for my current house. The realtor was peddling a particular house that apparently had an HOA comprised of a board of one guy and his wife. It was crazy. Basically you didn’t own anything on the outside of your house. You had to sign an agreement that would give this couple total control of the outside of your house and your property. I can’t believe anyone would buy a house in that neighborhood. But I guess people did.

    I live in an HOA community in the Tampa area and have no issues. I guess it depends on where you live. This situation in this video is crazy. Hopefully they can get this resolved or move.       They just explained to you why you can't. The HOA contract does not contain Kaufman language “as amended from time to time”, so the law does not apply retroactively to HOAs that don't have that language in them. Therefore the HOA is not violating the law so you have no basis to sue.

      According to the video because the statue does not include "Kaufmann Language" it does not have to comply with laws made after the HOA documents are drafted. Essentially they can apply old laws and ignore new laws.
      Given this why would any agreement include Kaufmann language, it seems advantageous to not have it so you can act outside the law if you want to.
      The HOA have found a legal way to defy the new law. Presumably a case will need to be brought against them to force them to change the statute to comply with the new law.

    First reasonable thing I ever heard an HOA enforcing.
    Commercial vehicles as a rule have no reason to stay overnight at residential streets. No reasonable person would want to buy a bus, 18-wheeler or a truck and expect others to pay for it, change legislation or widen streets for their entitlement. It's not reasonable and because you live in a society and not on your private island, you should be reasonable and if necessary have legislation tell unreasonable people what is reasonable.
    Notice that he could actually enlarge his garage, but he doesn't want to, he thinks that others should finance for his unreasonable decisions and risky investments.

    I'm not a fan of HOAs but I don't understand why people buy in one then complain about the rules. There are plenty of non HOA communities in FL.

    We have the same situation here in Delray Beach.
    That Kaufman language...
    They not just do keep the rules what we had, but made it even more restricted.
    According to the HOA attorney, if someone challenges it, he will lose the case.

      Because the homeowner signed a contract saying they won't between 10 pm and 5 am. I would like the homeowners to tell us why they would agree to such nonsense in the first place.

    When I first moved into my HOA townhouse, my Dad visited soon after from out of state. Living in a rural area, he was clueless on the ways if city life . The poor man parked his truck with real estate signage behind my garage. The signage would have resulted in a fine because they actually expect you to read the CCRs when you buy a home. His truck was towed.

    If I own a house, I ll park whatever vehicle I own on my property. No HOA will ever tell me what vehicle I can park on my property.

    So funny, we lived there for a year. The first morning after the move, our moving van already had a warning sticker attached to the window. Our president came back from her summer house one day and started moving people trash cans around, into their condos, so funny! She was pissed the bins were sitting in the parking lot 😂

    I was an HOA president. Residents insisted on no advertising on vehicles. One woman had a company car with a tel.# on it. They warned her and threatened to fine her. I argued that they needed to take off any window stickers advertising the universities they had attended. They impeached me. I couldn't be happier. I sold the place and moved to a better community. Before I did, I reported them for hurricane cutting the palm trees. Big fines were issued by the county. "Let's move to Florida and make rules" Vicious and cruel small minded people.

    I live in an HOA and am 100% ok with pickups/work trucks in the driveway. It's all of the pickups and sometimes very large work trucks/vans that park on the street in front of my house that anger me. They block the line of sight and it's difficult to see oncoming cars when backing out of my driveway. My HOA management company is useless, and never hands out fines anyway.
