youtube not only prefers the claimant in user-to-user copyright disputes, but they hand out "golden hammer" privileges to big companies for them to abuse, such as the ability to file takedowns without having to define what copyrighted material was being used, and taking down tons and tons of videos in one big sweep, making it exceptionally tedious to dispute.
i used to make mods for Nintendo games, and Nintendo themselves abused their golden hammer to illegally take down my innocuous mod videos. it was not a copyright dispute, they just didn't want people to mod their Switch, so they abused the copyright takedown system to censor and silence me as they saw fit. this was back in december 2020, and i have not talked about modern Nintendo games on my channel since then out of protest.

I never wanted to follow him during those times tho bc he was mainly doing ACNH mods and I hadn't a switch so I wanted to avoid anything related to the game in order to be totally "fresh" when I play it (Spoiler it wasn't worth it bc the game is boring LOL)

I’ve always liked the idea of boycotting TH-cam until all our answers are met but it would be nigh impossible as there are just so many children constantly giving TH-cam ad revenue and a doubt the brainrot channels and companies that benefit off of this would be willing to join so unless I could start a yt channel that got me beast levels of popularity (unlikely) I don’t think much will change for now

Not only do most creators use YT (for fair reason, it pays fine even if most of that money is gone due to 'copyright' and demonitization bs). Why would they switch to a diff site and get paid waaaaay less? Why would I go to a different site if all the people I watch are here?
It's just a frustrating example of why we NEED competition. As much as I hate Kick, the existence of it put a bit of a fire under Twitch since it actually gained traction. Similar to YT streaming for a while. Competition forces companies to actually improve. YT has no competition, thus there's no rush to fix their dogshit copyright, bot comments and demonetization issues. Issues that even their biggest earners deal with daily.
It's why they spent a good while tryna make an adblock disabler yet somehow have no solution for spam comments that say the most vile shit under nearly every video.

EDIT: Not a rant, just giving my overall point of view and educated pointers due to my experience as a software developer. It may sound negative, but nothing says it is impossible, just... incredibly difficult to pull it off
The issue is making a competitor. The major hurdle with this kind of services is storage and bandwidth. TH-cam has A. LOT. of data. A. LOT. of videos per day, which demands a astronomical amount of server power to even handle, let alone stream to users at a reasonable time frame.
This, costs money. A lot of money.
And then, to make this money, you have three options:
1. Monetize the entire thing with ads, which... congratulations, you're back to TH-cam
2. Make the entire platform paid(look at FloatPlane, Nebula and others. Works but... it wont get to the same level as TH-cam while being paywalled)
3. Set-up donations and HOPE you can ever make enough through donations to even keep the servers running, let alone cover development and maintenance costs
And on top of that, you fall on the same cycle as being a competitor in most spaces nowadays. You need content.
You need to attract people to make content in your platform, but people who make content won't come to your platform because there is no users, but users won't come to your platform because there is no content.
It becomes a Chicken & Egg situation, and it is extremely hard to break out from it.
Not to mention that, to bring the proper content creators, they'll need some sort of revenue to be able to keep doing their things, so not only do you have the costs of the servers, but you also need to figure out a way to come up with some sort of system that allows for content creators to receive some sort of revenue.
And whenever 'earning revenue' becomes a thing, there comes the opportunists and literal scammers, making obvious low effort farming content to try and extract as much revenue as possible. Which, in turns, becomes a whole cat and mouse thing to figure out whenever someone is one of those opportunists trying to break the system, or someone who's just starting out (false negatives are bad, but false positives are way worse).
Not to mention that, from the moment money is involved in any way, copyright laws applies, and the copyright system is broken. TH-cam has it worse because, well, we're almost daily interacting with it, so it becomes extremely obvious. Even if TH-cam tried to set their foot down and try to 'fix the copyright claim system', they are forced to abide by this system.
The only 'somewhat viable' system that I saw that could be a proper competitor is PeerTube(joinpeertube.org/), a peer-to-peer distributed video sharing software built on top of ActivityPub.
Yet, it has major issues. Compared to TH-cam:
- The decentralized nature of it makes it more difficult;
- It is less accessible overall;
- Due to the decentralized and distributed nature of it... you end up having not-so-appropriate content on the platform;
- Once again, the chicken and the egg problem: Lack of content makes adoption difficult;
Goodness gracious this system is rough 😅 It sucks that you had to go through all of this, and I'm glad someone's making awareness about it. I hope they can fix this copyright fraud stuff in the future :/

Not even private playlists are safe, I got my very first playlist deleted for some reason because there was "content inappropriate to children???". I couldn't check the playlist to delete the potentially bad stuff in the playlist. I had the bad idea to ask them to give me back my playlist before the end of the 30 days delay and they just removed my playlist completely

I think more websites should get in the habit of letting you pick a license to go with your work, like how github asks you to choose a license when creating a repo. That way, there's always a record of usage rights.
I love how the TH-cam Twitter account said that they kick out companies and bad actors that abuse the copyright system. So why is UMG and WMG still allowed on the site, they've been abusing demonetization tools FOR YEARS. God it's so frustrating they've been doing this for ages and they're such weak people for not taking a stance and protecting their creators.

@@theedgydoormat1283 The problem is it's straight up illegal for UMG and WMG to do this and TH-cam allows them to do it. There really needs to be something done because fair use is there for a reason. They say they can't mediate yet they give the corporations all the power to strike down and take revenue. There's no tools for creators to use, TH-cam could do a lot that wouldn't even hurt their bottom line. A lot of it is complacency, they should be protecting their most important stakeholders that make them free content.

Copyright on TH-cam is honestly ass, idiots just steal songs and call it their own, someone copyrighted the Mario paint music at one point even though they don't own it whatsoever and its JUST the Mario paint music with NOTHING else added to it.
They did add something to it. they added some other random song they either made or stole for like about 2 minutes or something and then they relooped the mario paint song

If I remember correctly even the video game Company Bungie had trouble with youtube's copyright system when they had it's own situation.
Yep, someone was impersonating them and trying to hide as one of the people being struck. Ironically he kept sharing his plans to the group. I can’t exactly remember if Bungie either encouraged TH-cam to change its system or tried suing TH-cam on it, on top of suing the guy abusing it.

Considering people make their livelihood off this site, there should be more than enough cause to sue TH-cam over wrongful misallocation of payment funds or whatever. There has to be some kind of basis for which to force TH-cam to rework this system considering how easy it is for people who don't even own a song to take away your revenue even if you're following fair use for the song in the first place.
Like, the level of gross negligence at play is astounding, and it makes me mad every time I see a creator I love watching has to deal with it.
If you're not a TH-cam creator, you can't even contact TH-cam at all anymore, either. I tried to reach out about a comment of mine being wrongfully reported, and they've just removed all options to call in or chat with any support members.

Fair use is primarily for purposes of commentary, that's why reaction videos can be a thing, but using someone else's work in your own is a different story entirely. You are not allowed to use copyrighted material because that would mean copying the material and redistributing it while you don't hold any rights to do so

It doesn't matter if you think it's not nice or if that's a poor decision, that's your opinion. The fact of the matter is that the copyright holder has every right to decide what happens to their copyrighted work and so should be asked permission first, otherwise you're risking situations like this. Until you have explicit permission to use someone else's copyrighted material you do not have permission to use it period

just a reminder that tracked music posted/downloaded from the mod archive is permitted for remix, transformations, and other things.
you can't copyright a track that's on the mod archive, otherwise it'd go against their terms and they can take it off of the site.
this whole shbang is just greediness on one side, and i bet 'Getimi' never even researched where the song originated from, or what it was made on, since the speed up is low quality and not even done using tracker software.
Tracked music uploaded to The Mod Archive can actually have copyright protection, however it can be redistributed and played freely if I remember correctly. Usually the artist, if registered, states which license (Creative Commons) applies to the song. Sadly, the two Eek! song files in The Mod Archive seem to be re-uploaded or ripped from somewhere on the Internet. This still requires that whoever wants to use it in some ways (like in a game soundtrack or commercial things) get in contact with the author to ask for permission to use.
It's still just horrible to copyright claim a song you don't own nor didn't add something to make it distinct enough without permission.

Its sucks now. Content creators want to use real music in their videos and TH-cam throws the copyright claim saying the music they're using are copyrighted, so people have to resort to free music for their videos, but nearly every video I see on TH-cam uses the same free music that TH-cam provides because its the only way to not get their video have a copyright claim and the worse annoying part is that TH-cam free music now uses AI generated music.
What A World We Sadly live In Now. This Is Why I Miss TH-cam In The Early 2010's And Even Before That. Back When Life Was More Simpler And Everything Was Fine. Nowadays Though. It is Not.

Most of the time it’s not even used for copyright, it’s used for either people trying to submit false claims to take down videos that hurt their feelings, even though it’s under fair use, or just people that want to make money, no in between.

Usually with disputes like this, leeches don't ever respond and let them expire because they know if THEY escalate the situation, they can potentially be found out by youtube itself. 30 days is still way too long to allow for that, especially when users have like 7 days to respond to takedown requests.
Malicious actors however will wait til 2 days remain in a dispute, then remove the claim and re-issue it, starting a completely new cycle cause it's a new claim.

When this happened with pizza tower. almost everyone in the community knew something was off since materia publishing handles the music like undertale, but no this was not a underale yellow situation, in fact the song that got took your revenue was called endless summer it was just the lap 2 song and it keeps getting repuloaded.
To start changing the system in our favor, it’ll take some major overhauls. Regardless, it’s work that has to be at least discussed.
Safe Harbor, multimedia law, automatic copyright bots, and system abuse are some of things that _need_ to be more well-known.

I once had my twitch stream muted because of a remix someone did of an Animal Crossing track, but I wasn't playing the remix. I was playing the original, but it got claimed as if it were the remix.
i heard the same thing happened to aria math from Minecraft, some guy made a weird remix of it and copyright claimed any videos using any little bit of the ORIGINAL song
Yeah, it sucks, another example of things like this was when a guy literally just stole the song "monkeys" from Mario Paint and claimed as his own

People using the loophole of "Sites can't see other sites" is bullsh*t. They're still involved, therefore still just as responsible.
Any time I stream with the Minecraft OST playing in the background, I get claimed (multiple times) by a random person like "Latin Author Perf", someone who CLEARLY does not own the rights to the Minecraft soundtrack. Doesn't stop TH-cam from just handing all of the ad revenue I would have made off to some scammer who doesn't even own the tracks. The copyright system is so rife with abuse and fraud any time anyone gets a copyright claim people rightfully immediately assume it's fraudulent, and most of the time they are. Getting the video back up means you have to send your personal information to some random guy that just SAYS they own something in your video they clearly do not. To have TH-cam come in and fix anything means you have to either go to court or make a huge fuss on twitter until they are forced to respond. This system is bad for both TH-cam and its creators largely because of their inability to support the community and recognize obviously frivolous copyright claims
Precisely the problem with the concept of an absolute “free market” system; if anyone can make any claim or do anything they wish involving monetised matter, literally anyone could get away with anything involving monetised matter, including falsely claiming trademark, creating a monopoly, etc.
Without a foundation, a building would come collapse. Such is the case in other matters as well, t’would seem.

Trademarks would very likely cease to exist under an "absolute 'free market' system". IP law exists principally to restrict competition in favor of a select few rights holders. A lack of IP law would probably topple down giants like Disney and Comcast due to their heavy reliance on exclusive rights to creations. Out of the ashes would likely just be smaller creators. In this case, the protectionist system of TH-cam backfired and the content creator failed to get the protection. If anything, our current system is the counterproductive one.
Well, looking on the bright side, you got 16 extra minutes of content because of this nightmare!

god i absolutely hate youtube's copyright system. they really need to get human reviewers to even look at this stuff cus you were only on the tip of the iceberg. a year ago I have had all of my videos, streams etc. FALSELY taken down off of youtube through their copyright system and had my channel terminated about 3 times. everything was my own content and it should have been under the protection of fair use, but it happened anyways. when I went to go for a dispute I had no idea that they would send MY HOME ADDRESS, FULL LEGAL NAME, AND PHONE NUMBER TO THE CLAIMENT (found that shit out the hard way when all of my information was put onto twitter for a certain amount of time and was receiving spam calls from both the claiment and whoever else agreed to blow up my phone) and whats worse is that they immediately denied the disputes and it was a back and forth battle between having my channel or not. six years of work man... straight down the drain in 2 seconds to the vile piece of trash that took it upon themselves to fuck with me. youtube for the love of god PLEASE ACTUALLY FIX YOUR COPYRIGHT SYSTEM

The fact that we can get banned for copyright infringement but companies and fraudsters get ZERO REPERCUSSIONS for false claims, that's the biggest problem.
This is entirely non-apropos but your voice fits your character and is very cute. More apropos, I am deeply sorry that all this happened to you (and Surasshu and everyone else getting hit with this, for that matter). This platform is a mess, and copyright law as a system is a nightmare.

I still remember that I made a video essay about Super Mario 64, and my usage of Dire Dire Docks got claimed by somebody who made a COVER of Dire Dire Docks, with the claim saying that “video uses the songs melody.” I disputed the claim and said that cover songs shouldn’t be able to claim ownership of the original, and that if I HAD to have a claim on this video that it at least should be from the original copyright holders. The claim went away after nobody responded to the dispute.
I have only just recently started to take TH-cam seriously, and I've already had to take down 13 videos due to fraudulent copyright claims on them (from songs that have been in the public domain for dozens of years or songs creators have publicly stated are free to use). It really feels like if TH-cam doesn't do anything about this, then the system is just going to cannibalize itself to death. This isn't sustainable for creators to try and make a living on, and it's super discouraging to try and make content for it.

This is the second time ive been hearing of how awful youtube copyright system is, and this one is a different pov. The first one, was about some dude getting doxxed because you have go hand over a ton of legal information, and the guy claiming him didnt even have anything to try copyrighting him for. And now, this video, shows how poorly the entire system is set up from an entirely different POV. Imagine having to hand over confidential information for something that doesnt make any sense and then you still have to wait a grueling amount of time just to see if they respond or not, hopefully youtube can recognize and fix this. Im glad you were able to get everything sorted out though.
Btw I saw a TH-camr by the name of Northflowo if I remember correctly, but anyways she had one of her videos get copyright claimed by someone with the name Christopher Larin which if anyone knows they were impersonating Christopher Larkin the creator of Hollow knights OST, but yeah TH-cam copyright system is broken af.
The crazy thing is that you can actually take public domain media and copyright it for yourself then copyright strike other people that use it. You can even sue the original person that created the media and made it free to use

I have literally had TWO of my accounts removed due to copyright, I really wish TH-cam had systems in place to help creators rather than fighting against us. ALSO heard nothing back about both of my disputes, genuinely so disappointing and discouraging.

Last I heard, People stop this abuse by making their own song, then if someone tries to copystrike a video, you also copystrike it. If a video has multiple claims? Nobody gets paid. That does include you, but if you really wanna be petty until its figured out, I heard that's how you do it.

I am making music myself, and my biggest fear is that someone steals my music. Making something creative for potentially months even, just for it to get stolen by some nerd so he could profit off it like a parasite is the most frightening thought to me. Its funny how companies like TH-cam, will basically allow such kind of theft to happen. But if someone asks directly about it, they always say "oh no no its not our issue and we cant do anything about it." Bro you literally gave a green light to this guy who stole someones work smh
From one side, it would be cool to achieve popularity, and be recognized. But when theres so many content thieves out there, ready to parasite from your work, i would rather want to have my own niche with few active engaged fans. Just so i can stay away from these thieves sight for longer.

This is the 2nd time I’ve watched content creators dreading over the system and it’s honestly enjoying to listen to their adventure (even if it’s having to wait 30 fluffing days which anyone can say is unreasonable) on how they took down some idiot who had no evidence to claiming something yet they say they do anyway

When I started streaming again, and then subsequently stopped streaming, I had a ton of my vods copyright claimed, one of which was from a ffxiv stream where I was just doing a dungeon. Apparently, they copyright claimed the dungeon soundtrack, saying it was some remix of a song. Every single dispute timed out.
one of the things you didn't mention but I think is really bad are ai-generated topic channels. they usually have a name that's just "___ beats" with the blank part filled in with a random word and ai generated pfps and thumbnails. the songs on the channel are just stolen. people like femtanyl and milkinthemicrowave have been copyright claimed over their own song and that's just the ones I know about. there is probably an underrated artist getting their art claimed by a "honey beats" right now and that's honestly sad and pretty telling about youtube

What is disgusting is that youtube requires you use their copyright system and adhere to their TOS for them to acknowledge your copyright. You shouldn't have to agree to youtube's TOS to have the legal rights aforded to you by the government's copyright system.
This allows youtube to grant your copyright (in their mind) to anyone you claims ownership as long as they agree to the youtube's tos and says they own the song.
I'm surprized no one hasn't sued youtube for copyright infringement for falsely attributing the song to a third party and granting them a portion of the revenue.
