- The plaintiff claims the defendant got into a car crash, ran into a fence, and knocked it over. The fence fell on the plaintiff’s parked car, destroying it, so the plaintiff is suing for the damages. The defendant alleges his gas pedal got stuck in place, and he’s just lucky to be alive. The defendant believes the plaintiff is an opportunist trying to rip him off.

The defendant was the first intelligent one I've seen on the show. He knew the case was going his way so when the judge asked him if he wanted to say anything he wisely said NO. People usually want to keep talking instead of letting the judge win the case for them.

@@kyoto32001 i dont believe the plaintiff's car had any damage because he was able to sell it for over 2 grand shortly after the incident . nobody is gonna pay him over 2 grand for a banged up car . i dont think the plaintiff proved his car was damaged by the defendant . questionable verdict at best . and if he paid 1500 for that car then i guarantee it has mechanical problems that the poor sucker who bought it from him for over 2 grand is now stuck with .

He should've taken the 2K for a car he spent 1,500 for. He does sound like the typical dealer, they play by a different rule book.
Naw he sold the car for $2,100 and got another $2,300. But yea I guess you're right he could've taken the insurance money and still sold car. But more than likely if he took the money from the insurance they would've taken his car
When you settle with the insurance company, they then own the vehicle. He would have only ended up with the 2k. So this was a smart move on his end.

Insurance companies don't use blue book values. I was in a wreck in my 2013 focus. Insurance companies research using what car is worth and how much those cars are selling for in your area. Insurance paid me 8500 and blue book value was 3900.

The show actually pays the award. All the defendants on this show technically end up on the winning end also. Especially if they actually owed the debt. They get paid to appear and don't pay a cent towards any award/judgement.

Florida is a "No fault state" I'm not even sure how he was even able to sue the defendant personally. I guess it pays to go to a TV judge because in real life his case would have got thrown out because that's what insurance is for.
PIP is for medical coverage. & even with that if it exceeds the amount you’re covered by, you can still sue the other driver. No fault does not eliminate personal lawsuits for car damage. & arbitration, which tv shows are, utilize the law from which the parties come from. So FL law was used. The case on its face would’ve been heard had they chosen to be heard in FL.
Production gets all of their cases from people who filed actual cases though.

I'm a mechanic and as all mechanics know, even if you have a severe brake fluid leak, if you step on the brake pedal as hard as you can the vehicle will stop. Brakes don't go from working one block to not working at all the next block. It's unreal how many people use the excuse I stepped on the brake and nothing happened. 99.9 percent of people who say that are liars.

Claims are settle for retail value not private party. Judge is incorrect . If the dealer was able to go through his own ins , he then would be paid a wholesale value .

Im a little confused on why the judge didnt just award him the $100 and make him go back to insurance conpany for the $2,200? That they originally offered now the defendant has to come out of pocket for the $2200 that his insurance was willing to pay, that's why you pay for insurance so you dont have to come out of pocket, I understand it may be to late for him to get anything from insurance company but I think that would be on him, maybe he should of accepted the $2,200 and sued defendant for additional damages I understand that when you take money from an insurance company you sign something saying you're settling but that's just saying you're settling with the insurance company and that you're not going to sue to try to get more money from them it doesn't say that you can't go after the person responsible for the wreck.
