I found it odd how HAL never had a reasoning for him not being in the games (except his rare mass attack cameo)
But my two guesses would be that:
1: HAL already had plans on another character having a role like his (Bandana Dee probably)
2: He doesn't fit the aesthetic of the Kirby games and HAL didn't want to give him a new look
(Also no its not due to him originating from the anime and licensing issues or whatever, since HAL and Nintendo made their own animation teams for the show)

The fact that DeeDeeDee might be correct is hilarious indeed, as the Kirby species was hinted in the game as something that can become a world ending entity if feed with enough malice / negative energy.
