    I have been asking myself this question. I have not seen an accused put on a stand for his/her bail. This is crazy.

      There are two approaches to bail application. One can use affidavits and not take the stand. One can also make his application viva voce (orally), where the accused takes the stand. On both approaches they don't deal with the merits of the case

    Yes, the accused has implicated himself by his evidence under oath ... The admissions he had made is admissible evidence to charge & convict him of theft, complicity after the fact & obstruction of justice ... It also placed him on the crime scene, & can be used as contibutory evidence in charges of robbery, murder, & possibly rape / sexual assault ...

      However rape is ruled out. My question what could the motive be? Her phone was not taken. And when you see a deceased person your first instinct is to call for help? Let alone touch and undress and toss your own clothes. Why the camera didn't pick up anybody else given the head trauma.

    it can only happen that accused is in box during bail application when you have an accused person who is arrogant & thinks they know the law& can lie their way out of the crime as he always does... most probably this is not the first time the accused is before a court.

    I have done first aid course. Now, if I see someone lying down conscious, noe i will think twice before i assist or check if they are alive. If I do, I will be charged or accused, if I don't, the person is might die.
    So it's now going to be difficult for us to assist

      Do your first aid , if the person is deceased go report to authorities. DONT take their clothes off and wear them and dump the clothes you are wearing and then wait for the cctv camera to expose you Like what Bafana did

    "When They See Us" is basically happening to Bafana. Even if he had not taken her clothes after discovering that the teacher has died, but called the police, they would still make him a prime suspect and sentence him.

    i am certain that the Analyst had never appeared in court. The worst analysis ever from an advocate. I am sure that He is not from a Bar. In a Schedule 6 application it is wise to do a vivo voce evidence so that you can challenge the strength of the states case.

    Agreed with the comment below mentioned, the defence must not control the court, that's why this Bafana is so stubborn. Anyway the verdict is coming in few days, he know what happened...very senseless. To undress a dead person, that happen only in mortuaries, not where u find a person dead u undress her/him. His going down in my own words. Is just shame with his going to loose his education process, what a waste of parents' money due to stupidity matter. May is coming not long.

    I differ with the common view. I think this was genius by the defence. In as much as the accused might have implicated himself on lesser charges I.e theft, his viva voce evidence was not not rebutted by the state on the main charges.

      I think there is more to this than what we are made to believe, do u remember the Pistorius case, Dewani case and the famous USA case of Chris Watts, nothing can be ruled out but I think there is foul play here, again the post motem says 1 of the causes of death is blunt head trauma so based on his inability to think I think the weapon used to strike the head would hve been found with the clothes….the defence lawyer is playing its aces close to the chest and they are showing that yes the boy took clothes but who killed Mrs Kirsten Kuytes?
