Kirsten Kluyts Murder I 'The trial has not started but the accused is already implicating himself'

- The bail application of 21-year-old murder and rape accused Bafana Mahungela continues in the Alexandra Magistrate's Court in Johannesburg.
Mahungela was arrested for the murder of 34-year-old Johannesburg teacher Kirsten Kluyts in October. Her body was discovered in a ditch at George Lea Park in Sandton.
The state has presented pictures that were taken from the scene of the crime that show Mahungela following Kluyts the morning her body was discovered.
Mahungela told the court that the only crime he is guilty of is that of stealing Kluyts' clothing.
For an analysis on this, we are now joined by Senior Legal Analyst and member of the Legal Practice Council of South Africa Advocate Romeo Nthambeleni.

I don't understand why you see a woman who is brutally killed,you take her clothes?how?why?was it the first time you do it?what was so atrective about her clothes?why?
I have been asking myself this question. I have not seen an accused put on a stand for his/her bail. This is crazy.
And the boy mentioned that he knew what it means to be a black man seen with a white female corpse.
And this guy has just been digging his own grave.
There are two approaches to bail application. One can use affidavits and not take the stand. One can also make his application viva voce (orally), where the accused takes the stand. On both approaches they don't deal with the merits of the case
Sometimes your client insist on being put in the witness stand, but they end up implicating themselves.
Yes, the accused has implicated himself by his evidence under oath ... The admissions he had made is admissible evidence to charge & convict him of theft, complicity after the fact & obstruction of justice ... It also placed him on the crime scene, & can be used as contibutory evidence in charges of robbery, murder, & possibly rape / sexual assault ...
Wow! And all this happens in the presence of his lawyer, who against best practice and common sense put him in a witness box.I am sure people will be beating a path to this great defence lawyer's door. So sad that the poor has to put up with the dregs of society.

However rape is ruled out. My question what could the motive be? Her phone was not taken. And when you see a deceased person your first instinct is to call for help? Let alone touch and undress and toss your own clothes. Why the camera didn't pick up anybody else given the head trauma.

I have done first aid course. Now, if I see someone lying down conscious, noe i will think twice before i assist or check if they are alive. If I do, I will be charged or accused, if I don't, the person is might die.
So it's now going to be difficult for us to assist
Dont steal the deceased clothes simple as that
Do your first aid , if the person is deceased go report to authorities. DONT take their clothes off and wear them and dump the clothes you are wearing and then wait for the cctv camera to expose you Like what Bafana did

"When They See Us" is basically happening to Bafana. Even if he had not taken her clothes after discovering that the teacher has died, but called the police, they would still make him a prime suspect and sentence him.

Doesnt matter whether he is a student or not anyone can commit a crime ,everyone is capable of such, if he was smart as u say ,a smart person wouldn't rob a dead body of its belongings,they wouldn't keep quite but notify authorities

it can only happen that accused is in box during bail application when you have an accused person who is arrogant & thinks they know the law& can lie their way out of the crime as he always does... most probably this is not the first time the accused is before a court.

i am certain that the Analyst had never appeared in court. The worst analysis ever from an advocate. I am sure that He is not from a Bar. In a Schedule 6 application it is wise to do a vivo voce evidence so that you can challenge the strength of the states case.
Agreed with the comment below mentioned, the defence must not control the court, that's why this Bafana is so stubborn. Anyway the verdict is coming in few days, he know what happened...very senseless. To undress a dead person, that happen only in mortuaries, not where u find a person dead u undress her/him. I differ with the common view. I think this was genius by the defence. In as much as the accused might have implicated himself on lesser charges I.e theft, his viva voce evidence was not not rebutted by the state on the main charges.

Why should he be freed? A crime has been committed and he is found to be involved. I still maintain he is just the trigger man. The husband or bf needs to be questioned. I feel like the lover is the mastermind behind the murder.

I think there is more to this than what we are made to believe, do u remember the Pistorius case, Dewani case and the famous USA case of Chris Watts, nothing can be ruled out but I think there is foul play here, again the post motem says 1 of the causes of death is blunt head trauma so based on his inability to think I think the weapon used to strike the head would hve been found with the clothes….the defence lawyer is playing its aces close to the chest and they are showing that yes the boy took clothes but who killed Mrs Kirsten Kuytes?
