There's a big difference between a cop who can emotionally handle the job, and is probably just following bad practices as told to him by his superiors, and a cop who can't keep his emotions/biases in check. @@quintessenceSL I know people who train these dogs. They come out of training and are ruined within weeks. They go from being rewarded for a proper search, whether or not they find something. Then once on the force, if they don’t alert, they’re stuffed into the back of the vehicle rudely. Whereas a false positive is rewarded. How long does it take for the dog to learn that alerting is the way to go. A friend of mine had her car torn apart because she had a female dog in heat in the vehicle that got the sniffer dog very excited.
Dogs shouldn't be used in law enforcement. When an Officer is running after someone, he understands that he's foot chasing a suspect. A dog's instinct doesn't discern between a suspect and prey. If the "suspect" is too hard to catch, the dog could instinctively switch to an easier target, like an innocent kid or an old lady. This happens too often with dogs that are rewarded for hurting people as part of their training. Municipal governments are reckless and barbaric.

I grew up helping my parents train dogs like this and they stopped selling dogs to police dept's.due to crap like this, along with the dogs tend to get abused or neglected and treated like equipment to some cops - Cops have a very high rate of anger management and family abuse issues, I think they have a hard time turning off the 'abuse the civillian' switch when they get home and just beat the wife and kid and pets to make the time go by before they can get back out there.

I've had to know the law better than court appointed attorneys because none of them would fight for me or somebody else that I knew so yeah that's how it is unfortunately. And yes you can get arrested even for the police lying and then you'll have to fight your way through that with terrible terrible attorneys I even had a paid for attorney that was just awful didn't care about the law and clearly was working with a prosecutor and they were all hand and hand working together against me which is absolutely despicable especially when it costs thousands of dollars and the corner pointed attorneys just didn't care and you know if a court appointed attorney doesn't do their job you can get the case overturned but when it's criminal you really don't want to go through all that because it's scary and it's just awful what police and prosecutors do to regular people especially when they're lying.
Journalists need to look into law enforcement academies. I suspect some are much worse than others. How much time does each spend on teaching law, and how much on target practice? Why don’t LEs shoot fleeing vehicle TIRES instead of drivers’ heads? Especially when they’re standing right next to the vehicle. There’s no excuse.
During a court case a judge simultaneously said to the defendant "ignorance of the law is no excuse" and that it is not the job of the police to know that the law only that the officer has to believe there is a law in place you have violated. Until we end qualified immunity and get the right to sue police directly this abuse will never end.

ATA I’m so happy to have you review a k9 search. I was a K9 LEO for 6 years with the US Army and specialized in all of the legal aspects and court precedent of k9 in the US. You definitely covered a ton of the content surrounding this content. I know you don’t comment on details that are option based and focus on facts, I would like to add that in my 6 years of experience where I worked with all layers of k9 (USSS, DHS, DOD, FBI, State, Local, ATF, & TSA) and in my experience, local k9 are some of the most undisciplined and guys out there. Handlers like this gentleman has obviously let his weight go, and hovered over his dog to stay focused on the vehicle, and in my professional opinion is likely to have undertrained an effective dog. Most local and state k9 have false positive rates somewhere around 50% or above, meaning if they were to search 10 blank areas that have never been exposed to narcotics, they would have 5 false alerts. And on the opposing side they miss quite often because they never train with street obtained narcotics. These handlers tend to be unsupervised. I urge people to challenge their LE k9 if ever going to court and request the dogs records because it will expose this if they are doing any at all. The DOD has some of the strictest k9 standards in my opinion. I felt as though we were the best of the best. Marines were maybe better than army dogs, depending on the individuals but nevertheless DOD had it right.
Excellent post . A canine sniff is like a coin flip. There needs to be a database on each dog and false alerts. Undisciplined handlers is an understatement. I’ve seen a cop call for a dog. The dog circled the car 5 times never alerted. The handler gets angry and keeps making the dog circle the car. Still doesn’t alert. The cop THEN calls in another dog. The second dog alerts after the second time around. Guess which dog the cops went with.
@@ianbattles7290they used to be a well known speed trap. 18:07 I guess they have graduated to civil forfeiture as it brings in more money. Hated the otherwise great area because of it. You had to drive 10 mph below the speed limit, watch for sudden changes in signage that was obscured and be going the new speed as you passed the sign. I dont speed but enough of my friends and people on the roads got tickets for not going from 55 mph to 45 in 2 seconds.

They ask you to exit the vehicle for "officer safety", yet when there's multiple armed agents outside my car telling me to get out, i can't say no for "citizen safety". If you score too high on the entrance exam ... then you just failed the entrance exam. They only accept candidates who score an equivalent of a "C" grade. They argued that more intelligent officers might get confused and/or "think too much" ... instead of blindly following orders. . So, think of how dumb the "average person" is and realise that the smartest cop is as smart as that "average person" (at best) ... Now think about how "smart" the average cop must be.
The part that always bothers me is just how many resources they’ll use for a single detainee - An entire precinct on a traffic stop. I feel for the man bc I have been stopped under questionable circumstances myself.
They can literally just say you weren't wearing a seatbelt and then everything they do after is all justified according to the supreme court. Even if you were wearing it they can say "oh i thought he wasnt" and theyll say they acted in good faith. Then you better have an interior camera that can prove you had it on, but still the traffic stop is "reasonable" because of "good faith".

It's cool to see AtA looking at the exclusionary rule. I wrote a 10 page research paper on the history of the exclusionary rule for a college credit class in high school and I think it was some of the best work I've done. It's satisfying to know exactly what supreme court cases are going to be brought up before the episode starts.

New law: everytime as officer uses the "...if you have nothing to hide, you have nothing to worry about...", their person, personal car(s), and residence should be subjected to canine search by a dog that "We The People" certify.

The Cumberland police force believe they are big bad drug busters and will pull over anyone with out of state tags or even in state tags if the address comes back from being an hour or more out of their area. Just look deeper into the department, they’ve had tons of complaints.

Here's a police/security secret: K9 handlers put more weight on the *person's reaction* to the dog more than the actual results of the dog's sniff. Handlers know they can make the dog alert when there is nothing and dogs may not alert when something is present. But if the suspect shows signs when the dog shows up (like dialated pupils, sudden shallow breathing, and other signs of nervousness/fear/adrenaline) handlers just force the dog to alert and use that as justification to search further. School police, concert/festival security, city/state police, and even Homeland Security (TSA, immigration, border patrol, etc) all take advantage of visual cues you give them to single you out for increased screening.
100% profiled. The cops probably stalked him for awhile, hence why their police dog unit, was standing right. Black guy, braids, maybe the car had rims... out of state tags... The cops 100% assumed he was a drug runner. The "traffic violation" had nothing to do with why they pulled him over. Also, the one guy did say "when the dog alerts", not "if"....
The only reason that dog did, not 😉 😉, hit on the car is because the sergeant said, " When the dog hits on the car." He knew it would look bad when it did and they found nothing. It will just bring more attention to how vague and the possible abuse to circumvent the 4th amendment those supposed dog sniffs and alerts are.

Apparently there has to be some legitimate officer safety reason. But it wasn't the main topic of the video and he didn't expand on it. I'd like to see a video expanding on when cops can make you exit the car.
All he has to do is say "Due to my years of experience, I noticed some furtive movements that allowed me to ascertain that he was carrying some kind of implement which could of hurt me or my fellow officers, so I asked the subject to exit the vehicle" (they always talk like that, think it makes em sound professional or something) and then it's reasonable. The court is on their side, not yours.

I live in MD and can corroborate your statement. It’s even worse in these small rural communities. The small town cops and sheriffs run the towns and hassle the public and abuse their authority regularly. Just drive around Carroll County, the Sheriff department has turned the county into a police state. I hate driving through that county.

@@ianbattles7290 because cops aren't interested in upholding the law. as a concept, police protect capital. practically, police districts secure revenue for the city via fines. on a personal level, cops may have a retributive interest in enforcing the law as they understand it (read: poorly). but at NO level is policing interested in upholding law.
My biggest concern with "dog sniff" is they do not keep track of when they do a dog sniff, if the K9 "hits" or doesn't "hit" and how many times when the K9 does hit and they search and found nothing. This is all information that should be recorded and tracked.
The entire argument that a dog sniff isn't a violation is garbage. I feel that unless there is probable cause having a dog sniff for shit, which I might add, has a far higher failure rate than a successful one, governments shouldn't be able o have a dog sniff. The fact that there is a higher failure rate than a success rate should be considered by the supreme court. But they have to have some authority over us.
Dogs do have incredibly sensitive noses, I'm completely sure they are more than capable of detecting just about anything in a car, from drugs, to money, to weapons, you name it, and I would absolutely support using dogs for searches, just as soon as you get that dog on the stand and he can testify about what he smelled/found. Until then, it's just a "that was easy" button for getting around the 4th amendment.
It should be pointed out also, that several courts over the last two years have questioned the validity of using drug sniffing dogs at all, given that they can be commanded to alert even when drugs aren't present as a means of generating a reason to search a vehicle. Given that several cases have arisen as of late where this has happened and in at least one of them the arresting officer was fired and arrested himself for planting drugs after a dog sniff search "alerted" to drugs being present, it's highly likely that courts currently would be far more reluctant to rely upon the assertion the dog alerting was a valid basis to search a vehicle.

The k9 officer was the most professional police man ever, he was calm, listing, and not at all threatening to the driver. We need more officers like that man. The other officers including Mr Jonny bravo needs to go back to school instead of worrying about his ego.

An old coworker left to go to police academy, I ran into him later after he joined at the county sheriff's office. He told me he hated it, he said all they do is drive around profiling people. He told me he wasn't going to stay. That was 10 years ago and he's still there. He drank the cool aid.

To be fair US vs Harris, 568 U.S. 237 (2013) Was the reliability of drug dogs and it found they had about 50/50 accuracy out of 10 stops they alerted 5 times when no drugs were present. This is mostly due to positive reinforcement of praise when they do find something so the dog is eager to please his handler.
He doesn’t have a lawsuit. He gave them consent. He was claiming he got his rights violated at the same time he was telling them he can let the dog in the back.

There's an intersection near me with a mall on the left side that requires people make two left turns at lights to get into. There is one small "No U-Turn" sign at the intersection. 3 cops hang out there (1 K9 unit) and pull over cars that make a U-Turn and immediately do a drug sniff of every car they pull over. I know it's technically legal, but it definitely doesn't feel in the spirit of the law / freedom.
He said once the dog alerts not if the dog alerts on camera . That seems like he was admitting he assumed an alert. I always ask people to confess to having drugs when my dog does not alert for training purposes. I wonder how often that works.

There's a big difference between a cop who can emotionally handle the job, and is probably just following bad practices as told to him by his superiors, and a cop who can't keep his emotions/biases in check. The former can be mostly fixed with better superiors and some retraining.

I know people who train these dogs. They come out of training and are ruined within weeks.
They go from being rewarded for a proper search, whether or not they find something. Then once on the force, if they don’t alert, they’re stuffed into the back of the vehicle rudely. Whereas a false positive is rewarded. How long does it take for the dog to learn that alerting is the way to go.
A friend of mine had her car torn apart because she had a female dog in heat in the vehicle that got the sniffer dog very excited.

Dogs shouldn't be used in law enforcement. When an Officer is running after someone, he understands that he's foot chasing a suspect. A dog's instinct doesn't discern between a suspect and prey. If the "suspect" is too hard to catch, the dog could instinctively switch to an easier target, like an innocent kid or an old lady. This happens too often with dogs that are rewarded for hurting people as part of their training. Municipal governments are reckless and barbaric.

During a court case a judge simultaneously said to the defendant "ignorance of the law is no excuse" and that it is not the job of the police to know that the law only that the officer has to believe there is a law in place you have violated. ATA I’m so happy to have you review a k9 search. I was a K9 LEO for 6 years with the US Army and specialized in all of the legal aspects and court precedent of k9 in the US. You definitely covered a ton of the content surrounding this content.
I know you don’t comment on details that are option based and focus on facts, I would like to add that in my 6 years of experience where I worked with all layers of k9 (USSS, DHS, DOD, FBI, State, Local, ATF, & TSA) and in my experience, local k9 are some of the most undisciplined and guys out there. Handlers like this gentleman has obviously let his weight go, and hovered over his dog to stay focused on the vehicle, and in my professional opinion is likely to have undertrained an effective dog. Most local and state k9 have false positive rates somewhere around 50% or above, meaning if they were to search 10 blank areas that have never been exposed to narcotics, they would have 5 false alerts. And on the opposing side they miss quite often because they never train with street obtained narcotics. These handlers tend to be unsupervised. I urge people to challenge their LE k9 if ever going to court and request the dogs records because it will expose this if they are doing any at all.
The DOD has some of the strictest k9 standards in my opinion. I felt as though we were the best of the best. Marines were maybe better than army dogs, depending on the individuals but nevertheless DOD had it right.

The dog circled the car 5 times never alerted. The handler gets angry and keeps making the dog circle the car. Still doesn’t alert. The cop THEN calls in another dog. The second dog alerts after the second time around. Guess which dog the cops went with.

I wrote a 10 page research paper on the history of the exclusionary rule for a college credit class in high school and I think it was some of the best work I've done. This is a normal occurrence in that particular area. The Cumberland police force believe they are big bad drug busters and will pull over anyone with out of state tags or even in state tags if the address comes back from being an hour or more out of their area. Just look deeper into the department, they’ve had tons of complaints.

Here's a police/security secret: K9 handlers put more weight on the *person's reaction* to the dog more than the actual results of the dog's sniff. Handlers know they can make the dog alert when there is nothing and dogs may not alert when something is present. But if the suspect shows signs when the dog shows up (like dialated pupils, sudden shallow breathing, and other signs of nervousness/fear/adrenaline) handlers just force the dog to alert and use that as justification to search further.
School police, concert/festival security, city/state police, and even Homeland Security (TSA, immigration, border patrol, etc) all take advantage of visual cues you give them to single you out for increased screening.

The Civil Rights Lawyer mentioned in a recent video that it's not the case that cops can order you out of the car as a matter of routine but many don't understand that. Apparently there has to be some legitimate officer safety reason. But it wasn't the main topic of the video and he didn't expand on it. I'd like to see a video expanding on when cops can make you exit the car.
All he has to do is say "Due to my years of experience, I noticed some furtive movements that allowed me to ascertain that he was carrying some kind of implement which could of hurt me or my fellow officers, so I asked the subject to exit the vehicle" (they always talk like that, think it makes em sound professional or something) and then it's reasonable. They need different training too. These police are trained to ignore the law and do what their superiors tell them to do. Why do you think they rarely get punished for violating the law like they do? Because you can’t punish someone for doing what you tell them to do. This is also why they hate being recorded by us. Because they know there is nothing they can do to stop a citizen from publishing their own video. But they can hide or delete body cam footage to cover their own wrongdoing.
@@ianbattles7290 because cops aren't interested in upholding the law. as a concept, police protect capital. practically, police districts secure revenue for the city via fines. on a personal level, cops may have a retributive interest in enforcing the law as they understand it (read: poorly). but at NO level is policing interested in upholding law.

My biggest concern with "dog sniff" is they do not keep track of when they do a dog sniff, if the K9 "hits" or doesn't "hit" and how many times when the K9 does hit and they search and found nothing. This is all information that should be recorded and tracked.

The entire argument that a dog sniff isn't a violation is garbage. I feel that unless there is probable cause having a dog sniff for shit, which I might add, has a far higher failure rate than a successful one, governments shouldn't be able o have a dog sniff. The fact that there is a higher failure rate than a success rate should be considered by the supreme court. But they have to have some authority over us.
My sentiment exactly. Worst of all, it comes from SCOTUS.
Dogs do have incredibly sensitive noses, I'm completely sure they are more than capable of detecting just about anything in a car, from drugs, to money, to weapons, you name it, and I would absolutely support using dogs for searches, just as soon as you get that dog on the stand and he can testify about what he smelled/found. Until then, it's just a "that was easy" button for getting around the 4th amendment.

It should be pointed out also, that several courts over the last two years have questioned the validity of using drug sniffing dogs at all, given that they can be commanded to alert even when drugs aren't present as a means of generating a reason to search a vehicle. Given that several cases have arisen as of late where this has happened and in at least one of them the arresting officer was fired and arrested himself for planting drugs after a dog sniff search "alerted" to drugs being present, it's highly likely that courts currently would be far more reluctant to rely upon the assertion the dog alerting was a valid basis to search a vehicle.

Sure, they can try and stick you with a drug test, but, as far as I know, testing positive for Thc in the bloodstream is not evidence for an "under the influence" charge. If Mr Love had got out of his car he would have been cuffed and possibly arrested on some made up charge, even beaten. Staying in his car may have been his best option, even if he legally obliged to exit his vehicle.
If he would have gotten out of the car he would have been cuffed and they ABSOLUTELY would have let the dog INSIDE THE CAR even though he DID NOT give consent.
The k9 officer was the most professional police man ever, he was calm, listing, and not at all threatening to the driver. We need more officers like that man. The other officers including Mr Jonny bravo needs to go back to school instead of worrying about his ego.

I’d like to point out the fact that the primary mode of investigating for most city police are traffic stops. The issue here, in my opinion, is a lack of training on BOTH sides….well said Audit.

An old coworker left to go to police academy, I ran into him later after he joined at the county sheriff's office. He told me he hated it, he said all they do is drive around profiling people. He told me he wasn't going to stay. That was 10 years ago and he's still there. He drank the cool aid.

Was the reliability of drug dogs and it found they had about 50/50 accuracy out of 10 stops they alerted 5 times when no drugs were present.
This is mostly due to positive reinforcement of praise when they do find something so the dog is eager to please his handler.

The attitude that cop had giving him a warning and even before then is crazy. I’m glad he didn’t escalate the situation with physical means but watching him roll his eyes like this was a bother to him is just bonkers.
There's an intersection near me with a mall on the left side that requires people make two left turns at lights to get into.
There is one small "No U-Turn" sign at the intersection.
3 cops hang out there (1 K9 unit) and pull over cars that make a U-Turn and immediately do a drug sniff of every car they pull over.
I know it's technically legal, but it definitely doesn't feel in the spirit of the law / freedom.

I always ask people to confess to having drugs when my dog does not alert for training purposes. I wonder how often that works.
