- Speech given by Senior Advocate Kapil Sibal at the People's Tribunal which was organised on the 6th of August 2022 at New Delhi on the "Judicial Rollback of Civil Liberties" by the Campaign for Judicial Accountability and Reforms (CJAR), People's Union for Civil Liberties (PUCL) and the National Alliance of People's movements (NAPM). The focus of the Tribunal was on the 2022 Supreme Court Judgments on the Gujarat riots (2002) and Chhattisgarh massacre of adivasis (2009).

But a forced entery in to property of masjid and it's records for 50 years to stay on removal of occupation is called proof of ownership!! I'm afraid that the Supreme Court may initiate contempt proceedings against Mr. Sibal for showing this level of courage and speaking the absolute truth about the present status of Indian Judiciary.

Well there are many instances where the Judiciary is showing itself to be incapable in carrying out it's duty.. the case on Electoral Bonds which is pending for several years is a decisive one for democratic manner of election, yet the SC said in 2019 that it was too close for the election year to take up and postponed it, pretty sure it'll say the same statement in 2024 as well, similarly cases on 'Pegasus' and Art 370, CAA/NRC, PMCares, etc all are languishing. Not to mention disdained use of UAPA laws and even recently the SC upheld the provisions carried out by ED, it overlooked the right against Self-incrimination [Art 20(3)], so violation Art 20(3) is not unconstitutional by the ED 😅 what a slap on justice and democracy 👍

Yes, I heard him speaking yesterday, and it was a great insight into whatever is happening inside our highest court. Now
It is very clear how the Gujarat roit was investigated, and how Modi got a clean chit from the SIT.
The very supreme court did not ask the obvious questions to the SIT. In this manner, the court offered a safe passage to people who would otherwise be in Jail.
No Faith In The Supreme Court Now.
All this fuming is because of SC's stand on ED's role. Our SC is in great shape. Compare to SC of US, UK. Look at the abortion judgement of US SC. What a digression and degeneration of the institution. Feel blessed that living in a developing country and have this standard of the judiciary. Look at other developing countries and you feel blessed to have institution like ours which runs with a fair degree of integrity and accountability.

From a layman perspective it's observed that SC is slow, lethargic, biased n untoward giving judgement/justice to not just crucial issues but ordinary ones also. That's why lacs of cases are lingering around in courts at all levels for decades together. This defeats the very purpose of the judiciary, faith of citizens in courts to get justice and then indirectly the progress/development of the country......
