  • The family of Maya Kowalski, the subject of Netflix’s “Take Care of Maya,” allege that a report of child abuse from Johns Hopkins All Children’s Hospital led to Beata Kowalski taking her own life. The Kowalski’s are suing doctors, the Department of Children and Families, and Johns Hopkins All Children’s Hospital for $200 million dollars in connection to Beata’s death. According to court documents, the child abuse case against Beata was pushed forward after Maya’s physician confirmed her condition, complex regional pain syndrome, was not the fault of her parents. During the time Beata was separated from Maya, she took her own life.

    This is the best judge I have ever seen,,,,,he is a true reflection of how Justice should be handled , Thanks to his wife and family for sharing him for 9 weeks in this trial

      I agree. He is so professional and treats the jury with the utmost respect. Although this part of the case has him ruffled, he handles himself very well.

    If the Hospital thought that the CRPS diagnosis wasn't real and the prescription was dangerous, why not report the doctors? Why the parents?

      And as this other comment says, a woman lost her life and a family lost a mother, a wife, and a lifetime filled with pain and regret based upon egos that all blamed the mom because she simply listened to a doctor in which I am sure she was desperate and scared for her daughter!

    I just saw the newspaper article in the Tampa Bay paper. It said the hospital was in the I.j. category. Not just the cardiac unit.

      I read the article and the 49 page government report with the findings - this is HUGE! The defense looks really shady misleading the judge about it today.

    I knew the defense was slimy, but I just thought that is how they are. Now withholding evidence and misleading the jury is, well, I have never seen anything like this. Wow!

    found the article. it states "All Children's had widespread problems with communication. "There was no evidence of any lines of communication or accountability" between risk ,anagement and "any of the 17 committees, councils, and departments"

In any case, i started telling my students that about books fifty years ago, and the book i had in mind at the time is a book called the Bible. Can't think why i'm bringing it up now, except just imagine if Palestinians and Israelis knew that Kynszch Didales has proven beyond any doubt that both of their precious books that they claim give them the right to live there are plagiarisms and revisions of fantastic fictions that are 37,000 years old, which all started with the number 29 - so they don't in reality have anything to fight about!       Yeah. There is always this possibility. But the longer it takes, the more difficult it is for the hospital to keep this out of the main stream media. They have to protect their reputation. Netflix is waiting for episode 2 🤣

      Most likely outcome. This trial means very little. If the Ks win and JHACH win an appeal, Anderson could petition for a loan for of the awarded amount. Only problem is that they will need to pay it back if it’s overturned. Netflix and book release are their insurance policy. The story of maya will fade away into the abyss and she will draw her desperate need for attention through social media. Anderson will then get on will trawling the streets for more victims to exploit. Same old same old 🤷‍♂️

    Take a drink every time Amanda Flores says “shopkins” to try and prove how well she knew Maya 😵‍💫
    This might have been the most scripted testimony yet, felt so rehearsed with key phrases we’ve heard over and over again and when she gave a response to a question she wasn’t prepped for you could immediately see her expression flatten like she was pondering if that was the right thing to say. And why did she keep fake smiling at such inappropriate times!!? Uuugh this woman’s chaotic and sporadic expressions are deeply unsettling…

      It's really really stressful testifying in court. People cope in different ways. Don't forget these people have had their nursing notes to refresh with and we've seen Shopkins mentioned a bit in those notes. Also not a lot of patients are there for 14 weeks, at least not kids like Maya who weren't gravely ill and could interact with others all day every day She'd have probably stood out.

    Hold on here a second!!! Medical people do NOT communicate by phone by mail by facebook once a patient is discharged....no matter how "close" you are to the patient. that is unethical! And NOPE we dont go to work on a day off to provide "condolences" to a patient losing a family member. Get real lawyer. OMG WHAT BS IS THIS?????

    6:44:35 I like this fella. I know he is a doctor but he testified he hasn’t practiced medicine as a OB/GYN in many years due to his own medical condition…he has however sat on hospital boards & committees and had more of a corporate role and responsibility.
    Out of all the ‘expert’ witnesses we’ve heard from, I found his testimony very credible. He clearly knows the ins and outs of large corporate institutions and has done his research. He articulates himself well in a manner that’s easy to follow.
    I feel like he’s earned his fee…unlike other ‘experts’ we’ve heard from in this case.
    Who knew he’d drop this bombshell on the last day of testimony though?! Is this a tactic??

      It proves nothing. There is no way the hospital left her alone for a length of time as all nursing notes were subpoenaed and were comprehensive and covered her whole admission. The defense didn't need to play anything.

    The line of questioning about the EEG room has been so misleading. Plaintiff’s lawyer keeps referring to her being “taken DOWN to the surveillance room” as if it was some creepy dark surveillance room in the basement. Even the nurse today was so confused as to what he was talking about. I don’t think defense did a good job of attempting to clarify that until today. It was literally just a regular hospital room on the same floor right next to the nurses station but it happened to have extra equipment in it. And zero evidence of mistreatment came out from that video. I don’t believe for a single second she was allowed to defecate on herself. Even the video shows a nurse transferring her to a commode that’s like 1-2 feet from the bed exactly as you would expect. A commode would never be left touching a patients bed as if a patient would be allowed to just roll over and go whenever they wanted. When someone is wheelchair bound they’re most likely going to just pivot them onto a commode exactly like they did with her in the video. That whole line of questioning was extremely misleading and to me seems like they’re making up stories about abusive treatment in the hospital.

    I’m proud to say I’ve never fallen out or shouted at a work colleague in 43 yrs . I’m direct speaking but I use humour to get my point across usually . There’s always a way to make a point without arguing or hurting someone’s feelings

My mom was like that...guess that's why I could cope with high strung people and be quiet when others reach that peak. Keeping your cool is the best way to deescalate. i think her problem was someone else created a problem she had to deal with.

She's seventeen years old. She could have gotten up, motioned to him, and walked out of the courtroom to get a pain pill ( if that was really what she took). It's all for show people.

      The question is what part those pictures played into the actual clinical diagnosis. According to them it was ordered by a physician, then by CPS, later ordered by the physician but approved by CPS and put in M.K. record. I don't know & don't get the point of them.

    What bothers me about today's testimony was that the defense was trying to communicate to the jury the fact that Maya is fine now, no medical problems. BUT that is not the point; the point is how she was treated during the 3 -1/2 months that she was in the hospital back in 2015 and how it had a lingering effect on her life.

    Reading most of these comments leads me to believe MOST of you have never had a child in the hosp. For a lengthy stay if ever. Some of you probably don’t even have children. You have no ideal what it is like when you have no clue how to help your child day in and day out and every single person/ doctor wants to tell you something different, and because your super stressed and have no clue how to help or what the real issue is, no one wants to listen, you don’t know who to believe, then because you recite what the last doctor told you or did now all the sudden you the mom is the issue. Give me a dang break. All that Mother wanted was for her baby to be back to just being a kid again and to not be in pain. Yea she was a nurse and a good one from what I have seen, but this hosp. Had too many young fresh out of med school nurses throwing up red flags over BS, which In turn pushed this mom to the breaking point to which she sacrificed her own life so her daughter could come back home to be with her family. 😢❤😢❤😢❤

      My daughter died on the operating table. So yes I do know how it feels. After she died I wanted to be with her so badly but I had two sons that needed me. Only a very disturbed woman would do that. The hospital is not responsible for the "pain" Maya feels today and they are not responsible for Beata's death. These are some messed up folks

      How long ago and were you there under a DCF court order? If not then you can't compare. A child under a shelter order is something staff are alerted to & instructed to ensure the child's well being while a patient is supported.

    I would like to start by stating that I was 100% pro-planiff at the beginning of the planiff case. I started to have my doubts near the end and then evidence during additional testimony in the defense case, had began to change my position. I was still trying to keep an open-mind until today, as the last witness for the planiff rebuttal completed her testimony. It sealed my position to stand behind the defense.
    Miya testified concerning her HS Homecoming photos with her 4 things she wanted to touch on - item number 4, she told the jury that “the defense went as far as to look up my friends account to get that picture!”
    Which we have now witnessed in real time of the situation throughout this entire case, ‘if she says it, doesn’t make it true.’
    We have to rely on the evidence, not her interpretation of how she views the truth in her own mind.
    Hopefully, the jury picked up on this today and will rely on the evidence of truth in this case.

      Likewise, I was side maya at the start and didn’t watch the Netflix doco because I knew I was primed to empathise. . I’m a mum and I have a wonderful relationship with my daughter and it was hard for me not to fall in the trap of placing myself in their position. My opinion evolved as the trial went on as I listened to the evidence and the compelling arguments from commenters. I still felt sorry for maya but I don’t have any for her now. I questioned myself constantly. In the end, team kowalski took on the opportunity of a life time - 200M and people will sell their souls for that kind of money. Greed is at the heart of this trial but no amount of money will fill their empty souls. However, I do have a soft spot for Kyle, his pain and loss is the only one I believe.

      I agree and it was a mistake for Maya to testify specifically about the Homecoming pictures. I was a bit surprised. However, there are many problems with both sides in this case. But there won't be a $200M verdict.

      I hope jury makes a decision based on evidence not sympathy. At the start plaintiff claimed JHACH starved Maya for 5 days. Later on it came out she was starved for 5 days prior to admittance to JHACH. It was Dr. Hannah who failed and sent his patient to JHACH. Based on evidence, JHACH was right. after release from hospital no ketamine, no flare ups to this date.

    Mayas and Jacks testimonies today were disingenuous and contradictory and Maya showed a vengeful attitude. They both shoe horned in excuses from baby books to my leg hurt. The nurses were lying on oath apparently. Not a good look and I do not believe the wise on the jury would have thought anything less.

    The defence trying to use Jack and Maya's depos against them, as if "I'm doing better now" erases everything that happened in 2016 is a joke. Chronic pain flares and remits. her doing better in 2019 is completely irrelevant and doesn't prove she was "faking" it in 2015-16. JH just. doesn't. get it.

    Too many inconsistencies from Maya and Father. Maya sounds rehearsed. She was 9 or 10 however she is recalling the events as if she read it in a book or someone told her what happened. Her words are similar to how the lawyer asked questions of the other witnesses. Not convinced. All this is supposedly based on a 9/10 year old childs memory, who was in excruciating pain.

      I don’t recall the planiffs calling a witness to confirm her claim of PTSD. Correct?
      I have PTSD and was hospitalized at a rehab facility following a traumatic event and then again years later following a trigger. PTSD changes your life immediately and forever. You learn to avoid certain situations that remind you of that trauma, in order to avoid a trigger.
      I’m really surprised that she’s there in court or listening to testimony that could trigger her PTSD. As she explains that has confined her.
      Today, was the first time that she displayed any discomfort of what was going on in court - and it was after her father’s testimony with the photos.

      Yeah and it was hardly "stripped" she removed one article of clothing, a t-shirt and did this herself despite later saying she was totally dependent on others to dress and undress her.     Maya is very well spoken. But, her testimony seems very rehearsed even dramatic. And I am left wondering how she remembers all these details that occured when she was age 10. I feel sad for her loss, but I just can’t buy the medical diagnosis and the “trauma” of being in shorts and a bra in the hospital. Working in a hospital, I have to say people are in robes with nothing on underneath. They tie in the back. This is normal in medical care. “Disrobing” “Stripped”. A little much.
    Sorry, testimony is a girl with an AMAZING memory and so rehearsed. She remembers everything but remembers NOTHING about cussing etc

    Christian nurse is lying about surveillance room. Committed to defending hospital and if hears wrongful actions, says “I don’t recall”.
    Not a credible witness.
    She DOES use nicknames “frequent flyer”. Very inexperienced & naive or just plain dishonest.

    Bottom line. The child is walking and thriving following a treatment plan similar to the hospital. And NO KETAMINE. She did not die without it as Dr. Kilpatrick predicted to the mother. A Board-certified hospital and board-certified employees, licensed social workers and investigators with all their experience and knowledge with children identified the problem with this child's treatments, followed protocol and put this child on the road to recovery or at least improve her quality of life without dependency on large doses of k. It took time for these professionals to access. The mother was interfering with that process. Authorities did what they had to do and IF sedating (which means putting to sleep) the child with large doses of K was the proper treatment it would have continued. Their observation included 24-hour video surveillance in order to see if what was being observed by those taking care of Maya was true and pictures of the patient's body in order to record, compare and observe and yes protect their record. My question is why the patient fight hard to prevent the pictures if she were not self-mutilating. She was wearing equivalent to a sports bra and shorts. More coverage than many other pictures and videos taken by others. With pictures both the hospital and social services could then decide the truth. Remember the father was giving conflicting information whether it be at the time of his interview and including other times. Beata should have waited, cooperated and given social services the time they needed to investigate and find it was safe to return Maya to her care. Why did she resist all help provided to her especially Dr. Teppa's referral to a mental health specialist. That doctor would have been tantamount in her pleading to take back Maya's treatment. Beata was not a medical doctor nor a specialist in CRPS treatment. She was an IV nurse working at a drug store. The question was and has been by Andersen to those who specialize in pain management, are you specialized in CRPS? Although Beata thought she was, she was not. 40 doctors' guys. 3 hospitals. Countless observations and treatment plans. And she chose doctors who were not board certified, could not accept insurance and one who practiced in Mexico of all places. Does she have CRPS? Many who specialize in the treatment of CRPS say no. However, it is a syndrome and not a disease. Diseases are ruled out and we are left with symptoms which are referred to as a syndrome. There are many. The last text on her phone " Retaliation". What did that mean?
