    I am in Patrick County, Va. I was in the Army from 2/1998 to 2/2002.
    I am 60% disabled, but receive 100% with Unemployability.
    And I Believe I am Permanent & Total.
    Things are changing so much.

    I did four deployments as an 0331 Machine Gunner. It took me four and a half years and 7 rejected claims before I finally got 100% P&T. I didn't think it would ever happen. You definitely have to be persistent and not give up as tempting it is to throw in the towel I'm glad I didn't.

      Don't forget SSDI as an additional source of income that many disabled vets miss out on. Jimmy Carter required military to start paying in to Social Security to prevent indigent Military veterans trying to survive on mil disability retirement. It is a life changer. Don't get discouraged, go through the process. States routinely deny vets applying for SSDI, my denial gave the reason of "you have other sources of income". Ironically that is something they are not allowed to consider in their determination of disability. I went through three denials then sued for my benefits. It was a hands down win in court with previously having VA 100 percent P&T

    I think its great that you guys are helping Vets figure these things out. I had nobody in my corner whatsoever and it took me 13 years to get my rating. I think I'm 100 P and T but I'm unsure TBH. I know they screwed me with my CRSC backpay (only gave me 2 years worth) and probably other ways too.
    Vets need help with these things. As the VA said to me, "they are not there to help me with my claim". HRC literally said I was "lucky" to be getting 70% Army disability rating and to "stop complaining". Yeah...I'm lucky I broke my back and had my life ruined. Sure.
    The point is that for all the benefits available the govt doesnt want us to have them and actively fights to prevent us from getting them. The DAV was utterly useless and gave me no help at all. The county VA Rep tried to sabotage my CRSC claim. Help is often not help at all.
    All that said, a word of caution. I keep hearing you three say things like, "win the lottery", "holy grail", "top of your game" etc.
    Look, it seems really garrish to me to say stuff like that. We get these ratings because we were injured, sickened, or wounded in service. These arent prizes. Its compensation. I live in indescribable, permanent pain that will never go away. While my kids are going to college more or less free (its not actually free even with 100% tuition assist in our State) if I hadnt been injured and lost my career I'd be making a hell of a lot more money, retired and be onto a 2nd career making 6 figures easily because of what I was trained to do. That cant ever happen because of things the Army did that had terrible reprocussions for my health. I didnt win anything. These benefits simply are not prizes. I know you dont mean anything by it but treating them like prizes is why I think politicians do the same. They act as if we are lucky when we eventually get through this ridiculously difficult process and finally get the help we need.
    Thanks again for helping people. Wish I had known about you guys years ago. I won my case alone and thats the problem. I had to win in an adversarial process that should not be adversarial. I didnt do this to myself after-all. It happened serving our country. You'd think they'd help make it right. But they dont.

    • @VAClaimsInsider
      @VAClaimsInsider  ปีที่แล้ว

      We're glad to hear that you're getting the benefits you deserve but sorry to hear the process was difficult. You're definitely not alone in your frustration with the VA disability process.
      If you're wondering about your disability status, you can log in online to double check if you're 100% P&T or call the VA disability benefits hotline at 800-827-1000

    • @smokejaguarsix7757
      @smokejaguarsix7757 ปีที่แล้ว +2

      @@VAClaimsInsider so I just got an annual status letter and it says I'm 90% service connected VA. I was upgraded to 100% due to unemployability. However, it also says Permanent and Total due to service connected disabilities: YES. Is that any different than what you are discussing here?
      As a side, I was given 10c status by the Army (did not finish 20 years) and retired at 70%. So, even though the VA pays me at 100% rate they deduct it from my Army retired pay so I only get a few hundred from the Army. Its also tax-free though. I do get CRSC at 90%. When they paid me the CRSC they basically gave me only 2 years of back pay though. The Audit was ridiculous. Some months they owed me $700, some $200, some $1k and many nothing even though my pay didnt change and when I asked them why they told me it wasnt their job to explain and if I thought they were wrong I had to tell them why. It made no sense at all. I think they screwed me out of 3 or 4 years of CRSC back pay.

      If you're awarded VA permanent and total disability, your decision letter will likely have a P&T status box checked, but not always. The VA notifies you of P&T status in different ways depending on the regional office. Another sign is if your decision letter says you have zero medical exams scheduled

      If your disabilities have improved, your rating should be lowered.
      If your disabilities have stayed the same, your rating should stay the same.

    Navy vet here...i got out 2012. Did 14 years and last month right before my birthday i got 100% PT with one year back pay which was very nice! I got out with 30% and fought the VA for 10 years to finally get in the hundo club. I had over 80K student loans wiped out, pay no more property taxes on my home, got my handicap placid, got my I.D. retirement card, military star card to shop at exchanges online and the list goes on. If i can tell any veteran, dont give up, no means not yet, educate yourself and fight like a pitbull...lock on the Va and dont let go until u get what u want. Also dont miss exams and if u need to hire an attorney with a very good reputation in dealing with Mike Tyson aka Va

    How safe am I in keeping this rating?
    How often will the VA Re-Evaluate me?
    We do not have a VA Hospital/Facility in my region, all of my medical care is provided by Private Medical Specialist.
    My Injuries were well documented in my US Military Medical Records, however it took years to get the VA to even look at those records...

    I have been battling the VA system since 2013. I filed for Ischemic Heart disease at that point, but as a blue water sailor, agent orange diseases were not covered at that point. Finally, in January 2020, blue water sailors were awarded presumed agent orange exposure benefits. I was at 60% Ischemic heart disease, 30% hearing loss, and 10% tinnitus. Combined 80%.
    Now I finally was rated TDIU 100% P&T back to 2020. Plus special monthly compensation. Now the battle continues with the VA to get TDIU benefits back to 2013 when I first filed for Ischemic Heart disease.
    Thanks for your very informative video.

    My bane of my va disabilty existence, was probably my c & p exam. Now, my experience is back than was and my examiner even stated this, I was speaking too fast and she was having issues keeping up with what I was saying and the system keeping up with her. Which, prior to my finally meeting with my appeal hearing lawyer we discussed the c & p exam in great depth. It was discovered, my examiner vastly misquoted what I spoke about and also I wouldn't say twisted what I said but quoted in a way that misconstrued the facts. If you're going towards for your first c & p exam....I would stress speaking to them, slowly and keep the facts accurate but simple. Enough that your examiner and the va will have clear and accurate picture of you and your disability/disabilites.

    I was discharged from the Army with a severe lower back left hip injury. I tried getting a medical discharge to no avail. I got a 20% disability. Some years later I was taken to DAV and they got me 100 %
    Another thing I was in different hospitals for over a year. My medical records have nothing about me being paralyzed from the waist down for several weeks. Is there anything a can do?

      Hi James, thanks for reaching out. Were you wondering if there's a way to get that information on your medical records, or were you wondering if there's something you can do to get a certain benefit?
