⏩ 50:30 How to deal with a bad C&P exam!
    * What is a C&P Exam? *
A C&P exam can be performed in-person, via telehealth, by providing Acceptable Clinical Evidence (ACE) or conducted at a VA Medical Center
If the Department of Veterans Affairs (VA) notifies a Veteran that they are scheduled to attend a C&P Examination, in accordance with 38 CFR 3.326, Veterans are obligated to attend.
A C&P exam will be performed by a VA or contracted private physician to evaluate the current severity of your disability.
►Tip #1. Attention to Detail - Understand What's In Your Medical Records
First, Veterans must do a thorough self-evaluation and have a clear understanding of the contents of their medical records. This is an essential first step.
Veterans may work with a VSO or designated representative to access their comprehensive medical record, or C-file, or they can file a Freedom of Information Act (FOIA) request to the VA Regional Office in your state and ask for a complete copy of their VA Claims File. A FOIA request is typically a much slower process.
►Tip #2. Mapping the Objectives of the C&P Exam - Review the DBQ for the Condition
C&P exams might focus on different conditions. Veterans should be aware of key details prior to any exam. Understanding the context of a medical condition is a powerful tool to have in the VA disability claim process. Veterans should also be aware of the rating schedule for the claimed condition.
Rating schedules are what will guide the evaluator. The schedule is a description of disabilities that result from every disease and injury that Veterans could have as a result from military service.
►Tip #3. Total Clarity - Tell the C&P Examiner the Frequency, Severity, and Duration of Your Symptoms
A Veteran attending a C&P exam should assume the exam begins as soon as they enter the office. Veterans need to be comfortable expressing themselves in detail. Being clear about the severity of conditions may seem counterintuitive. Being vulnerable with an examiner may feel uncomfortable, but it is necessary.
The evaluation will take personal statements from others, known as buddy letters into account. These statements from other service-members can help describe the triggering incident that led to the condition and/or the impact on a Veteran’s performance.
Veterans will only be asked and physically examined about the claimed condition. Examiners will not diagnose or treat any condition. They will also not accept additional medical evidence that is not already in a Veteran’s medical record.

My mother is 90 years old, U. S. Air Force. Served in the Korean War era, 1951-1953. She never applied for benefits or felt she could unless you were actually in the war. She now has a mild case of dementia and I told her we are going to applied and get benefits for home health. As I did my research, I requested copies of her medical records from her PCP and notice while she was in the military she had Scrofula (form of TB). Surgery was done and paid for by the military. She has a pacemaker, cornea transplant, high blood pressure, among a few other things. We have filed a claim and waiting for a response from compensation. She is so proud and honored to be Veteran, and to see her face light up every time she sees a U.S.A. Flag, is priceless. I want my mom to receive what’s due to her, for what she earned for serving our Country. Praying all goes well.

I separated from the U.S. Army in 2007. During service I was diagnosed with Depression with Suicidal Ideation twice by two separate doctors. I never spoke to the VA about this issue since I have been out. Conducted my C&P Exam today and they stated that my Depression that I am suffering is service connected. I cried so much throughout the exam because of all of the pain I have had over the years. I just hope the VA can really help the veterans who are suffering. Mental Health took its toll on my life and all of my relationships. Don't be afraid to speak the truth. I won't know the end results, but don't give up.

I went in yesterday for my C&P Exam and it went a whole lot better than my last. I think I talked too much off-topic on the last one. If I have multiple documented hearing tests while I was active duty with 3 years of at least quarterly monitoring, CT scan, periods of accommodation removing me from hazardous noise, will I need to see an outside doctor (audiologist) prior to submitting evidence to a C&P exam? I was Air Force 83-92, my job was (304X0) Wideband Communications Equipment Technician, mostly assigned to Combat Communications Groups. Very Loud equipment, generators, numerous tactical deployments in field conditions.

Have you helped anyone that has hyperuricemia, and suffers from painful flare ups similar to gout? My doctor keeps diagnosing it as a sprained ankle even after I describe to him that it occurs randomly without an injury. My last flare up occurred when I was standing in my kitchen. I’ve been referred to a podiatrist and neither my doctor or podiatrist have any idea what is causing my flare ups. I’ve been doing research to try an improve my condition naturally, because, I’m not sure if it’s a curse or blessing, I am allergic to vitamin M, Naproxen, Mobic, etc… the entire list of commonly prescribed meds given for inflammation, so I just have to tough thru the aches and pains. I have been avoiding talking about it for years, but I think a visit to the MH clinic might help to get it off my chest. It’s sad, I regret it, but I blow up due to the anger and frustration, and it gets ugly some days. Thanks for sharing your knowledge and experience with us.

@@ruizhou9612 When I hear people talk like you, most of the time it's folks that don't have a legitimate claim. If you did, twenty years is more than enough time to make it all the through the Veterans court of appeals several times. When you say that the VBA is responsible for Veteran suicide rates, that statement is beyond stupid. If a Vet committed suicide because of a mental health issue, that would fall to the VHA [Veterans Health Administration] to treat that problem. BTW ... most Veteran suicides are not by folks that were in combat. Studies have shown that is more likely a factor of the types of people that volunteer for the military. It's kind of like the fact that more tickets are written folks driving red cars. Is it the color of the car or is the behavior pattern of the type of people who pick red as their car color. Maybe it's time for to take responsibility for your own life and stop blaming other people for your problems.

The interview just went to how I get along with my kids, if I ever get disoriented when I am driving, how I get along with my grandchildren, if I argue with my wife, if I have drink, if I have nightmares. The Va left out / misfiled my VA / Medical University DRs Nexus Letter for my Lungs saying He believes more likely than NOT that my Lung issues / Sinus issues were caused by the Navy Diesel exhaust I was in for 3 years.
I / My VSO officer resubmitted it as NEW Evidence .
My Examiner today said she was going To Agree With My DRs Nexus Letter and agree that I should Get my requested Disability of Lung Disease.

Now? I just have to wait and see what the VA decides to Do with her Review?
It was a Sinus exam, the VA didn’t put the Lung exam in it this time, but mentioned it. The Nurse Practitioner / Vet Also said she would make reference to both that she agrees with DRs Nexus letter .
She said the VA may request another Lung C&P Exam . Thanks for yalls Help.

I began my Navy career in 1967. I got out of my second enlistment in 1975. During my hitch while in Japan I played football representing our base when I received a serious injury to my right knee. Both knees were beaten pretty good being a running back. I never thought about claiming injury now in 2023 but, as I’ve had both knees replaced and now feel I should. I have a record of the injury to the right knee and am just filing for the C&P utilizing the DAV for help. Have I waited too long? The whole process makes me feel overwhelmed. Any advice until I receive a response.

I tore my meniscus in my right knee while deployed During OIF in '03 and had surgery on that knee. My other knee now hurts and I'm always nervous because, I don't have to do more than stand up and walk and now my left knee gives out and I have to limp on both knees which is nerve wracking to say the least.
I am receiving disability for my right knee and a scar on right foot from a bunion surgery; wondered about filing for secondary for Left knee compensation.
Also, my left shoulder pops and grinds all the time. Left arm goes numb and feel like a pinched nerve or something to where I can't lift my arm. Also have slight constant ring in my head.
Just found this video and have no idea who to contact or where to go for exams, nexus, and things mention that are needed for claims.
After ETS I tried to go back to my same occupation I had prior to military service and had to quit and find another job, because climbing ladders was unsafe for me with knee problems.
Burn pits were disgusting duties btw.
Loud noise bangs give me anxiety (July 4th and New Years) are no longer an enjoyable time for me.
Please help get me going in the right direction for first steps to take.
    i served in the Army from '99 - '05

Actually it's the complete and total opposite for me, I keep seeing people getting more but they have less than me, not saying I deserve more, because I don't, I deserve nothing, I was just doing my job, nothing more, nothing less, but I will admit it is frustrating to see someone like a female RESERVE Coast Guardsman get labeled with PTSD because her son died, I came home from Iraq for R & R only to end up watching my dad die from cancer, I spent my birthday in his hospital room, he didn't even know I was there, Red Cross blew me off too after identifying myself when I tried to ask for an emergency leave extension, "I'm sorry but tonight is my first night and I don't know who to talk to, What? He's an Air Force Vet of 21 years? and they're transferring him to the VA in four days? (Which the county hospital never did, they just released him) OK, I have an idea, when you get to the VA why don't you ask someone there, they should be able to help you out better" To this day I detest the Red Cross and the USO. And that female, she praised everyone at the VA, Counselors, Social Workers, Psychologist, Psychiatrist, you know what I get, a roll of the eyes, a huff, and a whole bunch of "I don't knows"
Or how about the Soldier that was featured in our company's INTERNATIONAL newsletter, he had this full page story on him, and he had less than I did, he talked about enlisting because of September 11th, Well, me too, they listed off all his awards, and I was like, "I got that, I got that, I got that, oh look, he doesn't have that, he doesn't have that, and he doesn't have that" He gets a full page story. Or how the PAO who was labeled with PTSD, or even better, the Soldier who was diagnosed with PTSD because she manned a guard tower and a check point, no combat experience, just sitting in a guard tower gave her PTSD. There was a redecorating show I was watching, and they gave the female Soldier all brand new furniture, completely replaced everything, couch, tables, chairs, everything, and what did she do to get all of that, she jumped out of her vehicle at the start of a firefight and landed on her weapon, granted, she has to krap in a plastic bag for the rest of her life, but she's still in the Army. This one is marginal because he actually did get hit by an IED, he actually did have a TBI, but he claimed he was paralyzed from the waist down, and they gave him a free house, I say again, a FREE HOUSE, turns out he wasn't paralyzed after all, they had him on camera walking around his house, and they "didn't know if we're going to take back the house or not, we'll look into it"
And my FAVORITE OF ALL TIME, this is coming from the Voc Rehab Counselor I talked to back in 2008, but she told me about a client that she had that was 100% PTSD for, get this, two weeks in Basic Training, I SAY AGAIN, SHE WAS LABELED WITH 100% PTSD BECAUSE SHE WAS IN BASIC TRAINING FOR ONLY TWO WEEKS, she had a dog and everything, and me, what do I get? I can't even find anybody to listen to me, to help me, to be there for me, to talk for me, to support me, and that's even after telling people I've had multiple attempts, and still have a plan, just not a date, and you know what I hear? Crickets. I'm done. I give up.

Tom USAF, JAN 1966-May 1969. How do I get my medical records? The only thing I have is form 88 (Report of Medical Examination) upon discharge which states "Recurrent lumbo sacral strain, due to heavy lifting at South Ruislip AFB, England." I do not have the hospital records and the AFB and the 7520th U. S. Air Force hospital was close in 1972.

Don't know where to get my records and VA seems like they don't want to help me. I've could got a pension if I was willing to lie months after I got discharge, and I won't lie now. What do you think I should do. I got out of the Army Airborne on 1956. Thanks in advance.
