    I just received my 100% VA disability rating back in October 2022. Permanent and total...
    God is so good 💯✊😊 and my VA disability lawyers weren't much help. I did most of the work and research myself. You really don't need any lawyers or organizations like this....especially at the Lower level

      Trey, I handled my claim without lawyers or an organization like this. Coincidentally I too in October 2022 got rated 100%. But we are in a separate category Trey. I would venture a guess that 95% of the Vets out there do need legal or other help in pursuing a VA disability claim. That's because most people are NOT capable of "doing the work and research" themselves.
      My supposition is somewhat evident when I visit my local VA med center. The Vets I see there look incapable of understanding their doctors' instructions, much less dealing with the complexities of the VA disability claims process and procedures.

      I just got my rating, no lawyer route as well. I know the VA can be heavy handed denying some people, but I think one of the reasons people believe they need lawyers is they hear about all the headaches people have getting state disability payments and either think the two are connected or the process is the same when, in reality it is different.

    I finally got my 100% P&T status. My suggestion is don't give up. What put me over the hump is getting my migraine raised from 0-50%. I filed a migraine as a secondary claim to Tinnitus. Thanks Reece for that tip that you gave me and file migraine as secondary to tinnitus and the VA finally accepted my supplemental claim after years of fighting.

      @@markevans6691 it has to meet certain criteria. On your initial letter concerning your migraine claim it should tell you that criteria.

    I’ve never asked for an increase. They took me to 100% T&P after 10 years of not getting better. well I'm still in awe of the fact that the relief grant I requested just arrived this morning, and I just received a $10 grand relief check from a charity organization

      @@mattallan434I am square business when comes to vets I know of two. They went along with a person they thought was faking, Back then they didn´t have the technology to check the back. Now they do 50 years later and I have pinched nerved 4-5 vertebrates. He rated and was just about to be discharged and they took pictures of him on the basketball court. The other may have been a dis-able vet telling on another. Found him putting up Xmas lights. Nothing to worry about VES will contact you after ten years if they need to see you. But either keep the same rating or give you more. You can work under some jobs for dis-able vets on military bases. Mostly mess duty. I have 100% but not covered for the Contaminated water at Lejeune

      @@johnmontgomery4923 Oh okay, so it sounds like it was more something they did back in the day because they simply didn't have the tech to see if someone was faking, so they sent someone out to investigate them. Is that right? And whats the deal about hanging up Christmas lights? Doesn't seem like an activity that would raise an eyebrow.

    It took me more than 40 years of being 'sick and tired.' Loss of hearing is what finally sent me to the VA. Once there 'shit happened.' I really can't explain it any other way. I had 'issues' I'd being struggling with for decades, but I never put 2 and 2 together. And that was pretty much by design. I wanted nothing to do with the government after having been a part of the government. But things came together over a couple of years and the next thing I know I'm at 60 percent. File a challenge and I was then at 80 percent. Another challenge and I found myself at 100 percent. Obviously I'm well passed 55 years of age, but I still worry these days that something I never knew I had coming to me will now be taken away. One of my many issues is being unable to believe in the permanence of anything positive. When things are good I'm anxious as a long-tailed cat in a room filled with rocking chairs.

      Make sure your dependent(s) are updated with the VA. If it's not, they WILL get their money. Just an FYI.

      Be at ease brother I've been terrified for the last 20 years. You got this. VA is so busy these days with burn pits and the wave of returning combat vets they are definitely not out looking to downgrade anyone.

    Not only am I 100% VA disabled, but appealed TDIU and won! Received $62,791.12 in back pay and received SMC K which pays me $432.00 monthly on top of my 100% pay. I feel like a socialist as I receive military retired pay and Social Security.

    Went VA Insider' with a 20% rating.. In less than 2 years, my rating is 100% P&T... If you have the 4 items as Brian mentioned VA Insider will take you farther than you are at.
    I was watching these vlogs for sometime and decided to go for it.
    A truly amazing company and network. My coach was Steve.
    The real amazing part of my venture with VA Insider was .. I was discharged in 1984.

      Thanks for this comment I’m hoping to take my 50% to 100% hopefully mental health will bridge that gap for GAD what a hassle. Their rating system blows my mind. If I’m at 50% currently and GAD alone is a 70% claim alone you’d think that would be 100% easily, but the more I learn about this it’s not necessarily true. I may be lucky to get 80-90% we’ll see. 🙏

    God is good. After 22 years of 20 percent due to back pain and hand pain, I underwent 2 total hip replacements. Bingo. This vet got off his butt, put in claims for hips secondary to back, nerve issues-Radiculopathy bilateral…hands more severe, tinnitus (this is ringing-nothing to do with hearing loss…don’t fall for rater crap questions about hearing) plus sleep apnea, like I said earlier, “Bingo” code word for 100 %P&T. Yes, 6 months of heavy lifting and good medical evidence/ nexus and Bingo. God is so good.

    Finally got a 100 % after Non Hodgekin Lymphoma. After treatment the VA dropped me to 80%. I claimed a loss of a kidney 10 years ago, but was told " it's not on the list ", still waiting for increase under Pact- Act

    My husband is 84 years old and retired AF. Diagnosed with Parkinson’s Disease, Prostate Cancer, CHF, Hearing loss, Dementia , HBP all due to exposure to Agent Orange and Radiation. Currently 20% service connected and in consideration & review phase. Meanwhile while waiting for 100% approval has been hospitalized X2 and currently in a Skilled Nursing Facility for physical therapy. What are his chances of being approved and what happens if he passes away before a decision is made? Am requesting your book today. Thank you for your expertise.

      If a claimant dies before a claim decision is made, and there is a surviving spouse or dependent child, there may be back pay available to the surviving spouse or dependent child or to individuals or companies who paid for last costs.

    I’m at 100% Unemployable P&T but when I finally decided not to give up my fight with the VA (took 16 years). But didn’t realize my sleep apnea, heart murmur and Agent Orange exposure would increase the likelihood of winning my case. 🇺🇸

    I have Diabetes, Heart Disease and Prostate Cancer all resulting from exposure to Agent Orange resulting in 100% disability from the VA on March 13, 2002. I received a phone call to go to a VES doctor for a Prostate Cancer review. I asked what they are going to review and I was told, "To determine if the Prostate Cancer has improved". 🙄 On top of that, I was sent to the office of a Chiropractor for the review.

      @@mattallan434 Must be just 100% if they are checking for improvement. Which is a damn disgrace. Prostate cancer is a prime example of something that should be 100 P&T.

      @Dead Again cancers of any type are not P&T, once in remission your rating is based off residuals not the cancer.

    I went to prison a few years after I left the military. The lawyers we hired tried to use a PTSD defense. They got statements from family members saying how much I had changed and how I never left my room. They got doctors to confirm my hyperanxiety. Then 20 years passed and I was approaching homelessness, so I applied for disability, expecting maybe 30%. I didn't do any research or know what I was supposed to say. I just gave them everything from the court case and wrote a letter detailing everything I had experienced in Iraq. To my surprise, after only a month, they came back with a 100% P&T rating. So I took a different path than most. I'm still waiting for someone to say, "Whoops. We made a clerical error. Get back to work." To be honest, if that happened, I would likely just end it. It would be like in the movie 1408 (spoilers) where he thinks he got out of the nightmare, only to find himself right back in it.

    It was interesting, in my "Welcome to 100% Disability" packet (that's what I'm calling it), there was nothing sticking out in the materials saying I was rated "permanent and total" not in the info materials, nor decision. However, on the last page of the materials, in the "Decision" letter, or page 22 by paper count, it says: "Evidence we have used to grant permanent and total disability status . . ."
    And that's the way I learned I had been granted permanent and total disability status.

      I learned when I logged into the VA website and seen the I was moved up from 90% to 100%, a few days before the decision even came in the mail.

      @@truespirit Yes, on further investigation I immediately logged on to the VA website, unfortunately the website had yet to have the letters and information uploaded.
      About two weeks later the website finally had everything and I was able to download copies of the Decision letter, and various "Benefit Letters."

      VA benefit offices are all you need. Lots of lawyers chasing claims. You are wasting time and money using these guys.
      Also the online guys. Use the free resources provided to you. They are almost all disabled vets

    I believe a VA doctor can also complete a Nexxus or a DBQ… In fact, they’re supposed to help you… You can check out the VHA employee memorandum 1134… but however, that said there a lot of them will resist heavily … in spite of the fact that they are supposed to help you 🤦🏼‍♂️‼️
    how do you check to see if you have a permanent and/or total designation? I don’t see it online and I don’t see it on my code sheet….

    Please listen to Brian. I was at 20% when I started with VAClaimsInsider and am now 100% P&T (I"m over 55 so it became automatic). It all happened in just 12 months time. It can be a lot of work to get all the paperwork together but it's totally worth it. Follow their advice, use their tools, and just do it. I am a clinical social worker and worked daily with Soldiers and would always recommended VAClaimsInsider when they were having difficulties with the transition process to civilian life. I will be forever grateful for their services. Now that I'm retired I'd love to be a coach myself to help other veterans get the ratings they deserve.

    Honestly I didn’t even want to pursue what I should be getting because I’m scared of them doing anything to change or reduce my current 50% for other issues. 🙏
    These aren’t even including other secondary supplements I have either. Stressful process the VA is a hurry up and wait process, but what a blessing if it works out. Praying 🙏

      Apply for Perment Un-employable Disability with a VSO.. Mental Issues-PTSD VA. VBA-21 and get your doctor to fill out a PDQ. 21-0960C for that and other issues, They 3-14.

      yeah I learned that too...how are you at total 160%...when adding all the percentages...yet still be at a 90% rating overall???...but once it was explained...it's a percent of a percent that's left minus each claim's percent of the percentage left...crazy...but that's how they do it...just grateful to have anything these days in a world that keeps trying to take things away...funny how that works...God is good...and will always provide...regardless of those who try and do otherwise...smiles

    I had 40 percent for tinitus and PTSD. Now at 70 percent for chronic rhitus and chronic sinusitis both non allergenic and used evidence from my personal doctor. The sinusitis ans rhinitis gradually got worse after my deployment to Afghanistan. We had a diesel generator 10 feet from our tent. Also a 4 hole burnout burning shit every day and a burn pit. The VA attributed it to that

      Man I'm fighting for chronic sinusitis and chronic rhinitis but I've still been waiting for a decision 5 months now. I had to go to sick call in Iraq bc my top lip swelled up due to all the sand boogers and black smoke from burning things. I constantly was blowing my nose it got raw and infected. I got out in 2007 and still use Nasal spray to this day. Without it, I can't breathe

      @BAMA Fan USMC you need a diagnosis. If you were in Southwest Asia, sinusitis and chronic rhinitus are presumptive conditions, meaning automatic qualifiers for a rating.

    Why are there so many other pages that say that your rating *could* be reduced, even if you don't do anything? I'm 100% P&T, but I've been told I should do year exams at the VA to just have a paper trail (or a private doctor and upload visits to the VA).

      I have Private Doctors that I go to because I don’t really trust the competence of VA Doctors or how much they care. I don’t attend the annual VA appointments they set up for me. People told me that even though I am 100% Scheduler P&T the VA will lower my percentage because I don’t go to the VA for those Annual appointments. Does anyone know if that is true?

    As a Navy retiree at nearly 30 years I was broken over the years.
    The VA uses a book with specific dialogue between the physician and the VA raters.
    Physicians are not always familiar with the content of the book.
    VA raters are required to use the dialogue in the book and try to compare it to the what the physician states…..if the physician does not use the proper terminology you WILL be rated lower.

    The VA seems to be following their own rules in the last 5 years.
    The OIG now has the case and the potential abuse by VA raters not complying with VA requirements is being investigated I believe in favor of the veteran.
    Either the raters are not knowledgeable or are corrupt.

      Unfortunately what you are saying is true in some cases. With that being said, The VA does not intentionally deny claims. They’re following laws and regulations when reviewing your VA disability claim. Help them help you by submitting a strong claim with the appropriate medical evidence!

    the Permanent and total rating is confusing. meantime I have some STATIC injuries such as BI-LATERAL HEARING LOSS to the tune of 60% My ears are JACKED! 21 years Field Artillery.

    I believe a VA doctor can also complete a Nexxus or a DBQ… In fact, they’re supposed to help you… You can check out the VHA employee memorandum 1134… but however, that said there a lot of them will resist heavily … in spite of the fact that they are supposed to help you 🤦🏼‍♂️‼️

      ​@@User-tsf49kje3apsi , I recently went to see a VA rep to request a copy of my C&P exam(s) report(s). The VA rep completed a FOIA request very quickly by populating the required fields for me from his computer using my VA file info. He then had me sign it. He said that it could take as long as up to one year, but maybe sooner. It's my understanding that my c-files contain the whole 9 yards of all documents in my svc-connected claims, INCLUDING my C&P exam results/report. I also see that vets can request their c-files online (they estimate 10 to 12 weeks wait time). Will it hurt for me to request my c-files now that I'm aware that it may be more comprehensive than just the C&P exam(s) report(s)?

    Be careful asking for increases! I had 10% DA for SC Seborrhea, which is a lifelong skin condition that will never go away, but can only be managed. I have had several severe outbreaks in the last few years and decided to ask for 30% rating last year...big mistake! They sent me to a fly by night Doc to do the C&P exam, which he botched it, and claimed I was less than 5% body area affected in his report.
    Got a letter thinking I might be getting an increase. Nope. They were gonna take away my 10% b/c they said the C&P exam "showed improvement" and "affected less than 5% of the body", which was absurdly wrong. I had to spend time and effort fighting it, my VA doc didn't wanna get involved, but did eventually put in my medical file that I was "about 5%" and I ran with that, plus submitting a bunch of medical documentation about Seborrhea, along with photo evidence of my outbreaks, etc.
    Got my new decision letter last week and they said that "my condition had shown "some improvement" (which false), but "significant improvement in the condition has not been definitively established." and so my 10% rating "is continued" ... Having watched this video, I'm assuming this means my condition hasn't been determined to be "permanent" and I can probably expect to be hassled about this again within 5 years, esp if I file any new claims. Great.

      That’s why I’m set and happy with my rate. They’re static. I worked with a marine who had the same rating as me (90)….he kept trying for increases for his ptsd and got dropped to 70.

      Your mistake was going to the VA C&P exam. You DO NOT have to go to them. This group will send you to a Veteran friendly doctor to fill out your DBQ because that’s all that’s required is the DBQ.

    Great organization offering Veterans a road map and resources to understand the complex VA system and gives you your best chance at what you need to do and have for your best shot at getting service connections for your medical issues from service.
    Does everyone win? No because the VA will be fighting you in the process. Do a lot of Veterans prove and win their cases? Yes. Your best chance is a fully developed claim with overwhelming medical evidence to have your best chance and this company shows you the path and helps you connect the dots needed.
    VA puts several road blocks with a avalanche of paperwork and regulations in place. That with a complete roulette wheel of VA raters that most aren’t looking out for Veterans. VA Insider helps you level the playing field.

      @@VAClaimsInsider Willing to help. I told the VA I would not be examed by anyone that has not served. Most evaluators are doing internships. Most people I see here go to the VA. Hospitals will cover for free whatever is on your award letter. So you can go at any time or wait. Also, have Tri-Care.Example. If you have hypertension, that will cover a heart attack. Vets need to find a Boils down to registered VSO with a veteran organization. The rating is not lowered.VES will call you if they need to re-evaluate. In most cases, you get an upgrade. But do not voluntarily go.

    I have at least one STATIC disability that was rated at 60% combined plus I just hit 55 years of age so I don't know all the rules but I also have an osteoarthritic knee injury and a Bulging disc DDD and PTSD, Migraine headaches
    I use the V.A. for my health care almost exclusively so I am not sure about how to get PERMANENT AND TOTAL but I am working on it

    As the daughter of a veteran I am SICK of the VA! They don’t never know anything… and their treatments and dodging of the conditions kills me! All my life my dads old original dd214 paper stated AO contaminated… he was boots on the ground in Vietnam. Now they keep saying he doesn’t qualify.

      Go to your local (state VA) for assistance. There should be one in every county. It is free, and they have access to previous VA claims in the past.

      If you're asking how long do you have to wait for a final decision on an appeal: The Veterans Benefits Administration usually takes 12 to 18 months to review appeals and decide whether to grant some or all of the appeal. When you request a review from a Veterans Law Judge at the Board of Veterans' Appeals, it could take 5 to 7 years for you to get a decision

      100% covers everything. 90% covers just what's on your claim. Put in for PERMENTLY UN-EMPLOYABLE DISABILITY for the other 10%

      The VA 20 year rule means if your rating has been in effect for 20 years or more, the VA cannot reduce it below the lowest rating it has held for the previous 20 years.

      To determine if you have P&T status, look at the VA decision letter you received from the VA. Some decision letters may display a checkmark for P&T status. Another indication of permanent status is if your letter informs you that no future exams are scheduled.

    So I had a surgery on my left hand that was done by a navy surgeon. Long story short the surgery didn’t go as planned and I lost feeling in the tips of my fingers, have very limited motion in my fingers, wrist, and pain that shoots from my wrist to my arm. Not to mention they removed the tendon in my middle finger. They didn’t give me anything for that and it causes me pain everyday and it limits what I can do for work. I want to file a claim on it but I’m scared they will lower my current rating which is 80%. Any advice on what I should do?

      There's always a chance that you could be re-evaluated for your connected conditions, and some conditions need to be re-evaluated every so often. However, seeing a decrease directly from filing another claim is unlikely, specially if your condition has gotten worse or hasn't improved.

      Next, click the radio button that says: “I’m filing a claim for a new condition or for a condition that’s gotten worse.”
      Before you submit your disability increase claim, make sure you’ve uploaded all supporting evidence necessary for the VA Rater to decide your claim.

My question is, if someone has a rating, can it be upgraded by the VA without filing for an increase? Since they can reduce it without asking us, I figured they can also increase it without asking/or having us apply for it. Never seen this happen, but curious.

      @@TronB58 They won't increase it without a C&P exam. Back in the day your VA doc could put the increase in or get you s/c (with your permission) but those days are long gone. Now VA docs see it as a conflict of interest to inform veterans the illnesses or injuries they have may be related to service.

      ¿Have you ever considered getting help from VA claims experts? We have a coaching program were we help educate and guide vets to effectively claim and get the rating they deserve.     I’m rated 100% P&T for mental health/alcoholism, etc… can my rating be lowered by the VA if I don’t make appointments and see doctors? And if I do make appointments, could they say I’m getting better and lower my rating. Or am I protected my P&T?

    20 years. That's how long it takes having a disability rating before it becomes permanent unless you are given a P&T tag prior to that 20 years.
    Even then, it isn't "permanent", as the VBA can reopen claims tagged P&T under certain criteria.

    I would recommend to anybody who needs to file any claim to go to your state's Dept of Veterans Affairs office, which should be located in every county across the country, or in a town.

      @thomastownsend2702 A VSOs job is to assist and guide you. They don't make determinations, can't make guarantees, and can't diagnose you, but they can assist with your paperwork and submit it for you. That's about it. So, I don't know how they can be shit. You, as the veteran, either meet the requirements for a rating or you don't. Pretty simple.

    I am at 90% and do not want to file an increase. My disabilities have kept me from being able to do certain things, including certain employment opportunities, as I always need medication to get by, yet I am not P&T. How can I change that status?     Not all of us can afford to go see a private Dr. to get a Diagnosis and a NEXUS. Then there are those of us that were Reservist and Active Duty would not treat us or enter in our medical records!

      A really well written personal statement and a concise log of pain and day to day difficulties go a long way. I got myself to 100% TDIU with housebound because I wrote basically a personal essay of what my worst days with migraines and insomnia looks like and I kept a consistent log of my sleep and every migraine using apps. I did this for about 6 months and used the PDFs from the apps and the statement for my final increase. I told every damn doc that I no longer drive. Hubby does all the food shopping and cooking (because between the pain and lack of sleep, I no longer use the stove due to nearly burning the house down). The best thing you can do is advocate for yourself and be the loudest squeakiest wheel. Good luck!

      Reservists and National Guard do not qualify except for issues that occurred while on active federal orders for at least 180 days, I believe.

    Question... The veteran is over 55 with a 90% rating that's not permanent, can his rating be reduce if he opens a new claim?

      There's always a chance that you could be re-evaluated for your connected conditions, and some conditions need to be re-evaluated every so often. However, seeing a decrease directly from filing another claim is unlikely.

      My marine buddy at work opened up a new claim for gulf war syndrome.He was at 60%. They reevaluated him for two of his other disabilities and lowered his rating to 40%. He is filing an appeal now.

      When you put in the claim, you open the can of worms. All rated conditions are subject to reevaluation whether or not the veteran is claiming an increase. My suggestion when I was a VSO was to put in for an increase for everything and make sure to only report your worst days at the C&P, after all, you don't want to be rated for your good days and you cannot arrange to have a bad day, so keep logs and make sure you can report all the aches, pains, down days, missed events, missed work and so on.

    So, I will be 57 May 2023, 100% temporary disabled since 2017, so I cannot be reduced and then request permanent total disability? I retired since 2017 and unable to work due to many reasons and have not worked since2018

      While you don’t really apply for P&T, there are some steps you can take to secure Permanent and Total Disability status. If you have a 100 percent VA disability rating and believe your level of impairment is reasonably certain to continue throughout your life, you can write a letter to your VA Regional Office requesting a permanent VA rating. With your letter, you should include medical evidence (like treatment records) showing that your medical condition cannot be expected to improve in the future. You may be able to obtain a VA permanent disability letter from your doctor as well, which highlights in their medical opinion, whether your disabilities are likely to improve in the future. You can also open a new claim inside eBenefits or VA.gov and type the disability of “Request for 100% Permanent and Total VA Disability” and upload medical evidence, buddy letters, and a letter from a doctor.

    What is the real difference between “Static” and “Permanent” ratings? Both are worded in a similar fashion stating you will be assigned a permanent evaluation without the need for RFE’s. How often are Static disabilities reevaluated if ever? Thanks in advance.

    How do they know if your awarded a higher rating from the VA after all of this isn’t that confidential and only sent to the veteran?

      VSOs, lawyers and these guys take a limited power of attorney using VA form 21-22, so they are cc'd on all your documents and get access to your c-file through VBMS and they continue to have that access until you revoke the POA, or sign a 21-22 with another agency.

      To determine if you have P&T status, look at the VA decision letter you received from the VA. Some decision letters may display a checkmark for P&T status. Another indication of permanent status is if your letter informs you that no future exams are scheduled.

      If you are P&T in state of Texas you will get a letter every year showing rating% amount monthly you will be payed and it will say P&T

      Alan I applied for TDIU using all my non-ptsd diagnosis. It seemed like every 18 months they wanted to reevaluate me thru mental health. and that was crazy stressful. What’s I found funny is that they never approved me for 100% with ptsd but once that was taken off it was approved cause that’s the most likely to improve since I was in an inpatient program at one point.     I don't get 100 percent but I did everything on my own, 70 percent VA , SSDI, workmans comp all on my own, yet my VA buddy told me to apply for "UN employ ability " so I did, it pay's you 100 percent and you get a card, perks all the perks, yet your really not 100 percent , I been getting paid 100 percent and can hit the state parks for free shop get gas, ect. Just wondering how long this will last,,, bet it is good for the young vets at least they can get paid 100 percent. Did you cover this?

    Question. I am 51 y/o and have a 80% overall rating. My rating was awarded to me in 2011. When I turn 55 y/o do I have to worry about being reevlauated or do I still have to worry until 2031? I am afraid of adding my sinuses, should I wait until I am over 55 y/o to put the claim in?

      There´s no age limit. In my case, other issues rose that could claim service related. 46 years I'm just claiming toxic poisoning at Camp Lejeune.

      Normally they award P&T if you reach 100% and all your Disabilities are STATIC. You can request your CODE SHEET to see which Disabilities are STATIC and which are not.
