Certainly it should and likely will be raised as a court issue. However, the Constitution doesn't actually say he can't "RUN for office," just that he can't be seated, assuming it's _determined_ (by whom?) that he engaged in insurrection or aided those who did (another issue in itself).

in the senate you have 51 democrats to 49 republicans...for a totals of 100
.in the house you have 213 democrat's and 222 republicans for a total of 435
for 2/3 you would need 67 votes in the senate and 290 votes in the house

I would like to see it go all the way to a house vote. Perhaps President Trump will get a 2/3 vote. @@4NickAder Did you actually read article 14 section 3? I know that you didn't because it literally says, "But Congress may by a vote of two-thirds of each House, remove such disability." Meaning if you were disqualified per the insurrection clause of the Constitution, Congress can in fact, remove said disqualification by voting 2/3 of the house in favor of removing it. Please stop telling people that they are wrong factually like you know, when you don't and you're just are spouting things that sound like they ought to be a certain way. That's a really bad habit. Remember the entire insurrection clause was to prevent Confederate leadership from gaining back control over the south, but they did want to make it possible in case of some certain special case so they made it that Congress could actually allow it but only with a majority of 66% 2/3 or better. As the judicial path on insurrectional conduct is left to the people's resolve and the rule of law presumably remedied by Rico-stylized insurrection accountability corporatized is still insurrection. Amendment 14 Section 3.
If the resolve of the implementation of Amendment 14 Section 3 implicates those providing comfort from representing the people in current positions, recusals from judicary rulings are imperative to democracy as conspiratorial insurectional conduct has been documented by the January 6th committee.
Whether this helps or hurts Democrats, is irrelevant. We either enforce the Constitution, or we don't.

Some GOP members of Congress should be removed as well. The USA is built upon the constitution and any one who treads against it should not hold any office. Including those who tried to circumvent a duly elect president by it's people.
