  • At the Ghazni Court of Appeal in eastern Afghanistan, an old man sentenced to death for murder pleads for his life. The 75-year-old admits to having killed a relative. Under the strict interpretation of Islamic sharia law ordered by the Taliban's supreme leader, he faces public execution -- with the sentence carried out by a relative of his victim. AFP had rare access to a court in Ghazni to see how sharia justice is being administered since the Taliban returned to power in August 2021.

      That is what happened in Malaysia too.
      Initially, these "compassionate", "human" and "love" lawyers hid behind a political faction from back.
      And when the faction win an election thus be a government, they executed their plan so fast that civilians couldn't react. With money from USA enough to lobby and energize both these lawyers' agenda and politicians.
      In Malaysia, the victims' families fought back. Thus our "mandatory penalty" were abolished instead of "total penalty".
      It was good at the surface but deep under, these "love-human-compassionate" lawyers have more power to dismissed a death penalty and turned previous death penalty judgement to a lifetime prison (30 - 40 years max). And thats what happen.
      In the meantime, the murderer could eat, sleep, breath without suffocate as these lawyers with their NGO will visit prison too to make sure it is in accordance to human right (my ass).
      Not to forget they, murderers, could have a dream and masturbate. And when out, they could just buy a girl service.
      So cheap human lives theses days.

      Sharia actually has strict requirements for providing acceptable proof as well. It is more direct. The punishments are severe and fast-tracked/immediate relative to Western ones. However, mercy is heavily emphasized on the part of all those involved, apart from the judges who must dispense the ruling of the law once a matter is set before them, they only consider the facts. There's no concept of going past a few days or weeks at the latest.

    Why there are questions against Islamic Shariya laws?? Same laws are in Tora and Bible. Punishment is necessary to keep the society in order. Take an example of Pakistan where there is no punishment, no justice and therefore rate of corruption is the highest.

    The difference between English Common Law and Shariah with respect to retributive justice is that under English Common Law a person found guilty of first degree murder has to be punished by state or forgiven by state. Under the Shariah as applied in Pakistan a person guilty of first degree murder has to be punished by state or he can also be forgiven by the legal heirs or deceased or matter can also be compromised with punishment of Diyat blood money, in Shariah applied by Taliban in Afghanistan the Taliban give an option to the legal heirs of the deceased to actually execute the guilty person under supervision or compromise or for give.
    Since 1800 we have been following in Pakistan English Common Law and since 1980s same has been coupled with Shariah and since introduction of Shariah there has been only one dacoit and murderer Mr. TAHIR Khan who was forgiven by mr. General Pervez Musharaf as President of Pakistan to please Mr. Tony Blair. If the narrator is talking about retributive justice to be an extreme form of Shariah than she is mistaken same doctrines exist in English Common Law, American Civil Law, Russian Criminal Code and Chinese Criminal Code. So BBC should get mature when reporting on Shariah.

      They intentionally used that interpretation. The literal meaning is "retaliation in kind". Eye for an eye is a great thing, but this phrase has become infamous among the westerners. Thus, it is a suitable description of Qisas for propaganda.

    Once a man was up in a tree plucking fruit when he slipped and fell to the ground. He fell on an An unfortunate bystander who was killed by the impact of the fall. The wife of the man who died demanded the dead penalty for the tree climber under the AN EYE FOR AN EYE CODE OF JUSTICE. The judge tried to reason with the widow that he had not intentionally murdered her husband and that it was an accident. But the lady was stubborn and demanded the tree climber’s death as was her right under muslim law. The judge thought long and hard and then gave his verdict. He sentenced the tree climber to death but he could only be killed in the same way that he had killed the widow’s husband. The only way he could be put to death was by the widow climbing up the same tree and falling on him just as he had slipped and fallen and killed the other man. Needless to say that the man was set free when the widow was unable to comply.

    It’s funny a lot of the commentators here forgot why we don’t use eye for a eye system of punishment anymore
    Hint: It leads to damage that can’t be done if the person is innocent, leads to cycles of retaliation and attack, can mess up innocent people who had nothing to do with the issue, can be more easily used to attack people who don’t like with compared to non eye for a eye systems….we also have famous quotes that even say eye for a eye is a horrible idea
