    Hello and thanks for taking out time. I am an Iranian citizen but worked as a postdoctoral researcher in Turkey from August 2019- September 2022. Currently I am in USA and I am on J1 visa as a visiting scientist. Recently I have applied for Green card in USA and I am approved , but I found out that I am subject to 212e (2- year home residency). In my response letter, US department of state has mentioned that because I was in Turkey during doing my paper work for US visa (in September 2022), and moreover, Turkey is in my DS 2019 form and Turkey is in the skill list of USA then I need a No Objection letter from Turkish government to waive my 212e 2-year home residency. I have not received any financial support from Turkish government for coming to USA so I think I can ask for the No objection letter from Turkish embassy. Am I right? If yes, what documents should I submit for that and how it works to start the process?

      1. DS-2019
      2. Passport with a valid Visa
      3. Residental Address with prove like mail or bank statement's first page only indicates your curren address in the US
      4. A written letter from your side indicating the situation and requesting for relief.
      No Objection Waiver
      1. Complete a Form DS-3035 J-1 Visa Waiver Recommendation Application online or send it to the address specified on the U.S. Department of State web page. The preferred method for completing the DS-3035 is to submit it online, in which a case number is generated and assigned immediately. If you cannot complete the DS-3035 online, download the application, fill it in by hand and submit it. Applying for a waiver this way will take longer.
      2. Attach any documents you are instructed to enclose, such as two self-addressed, stamped, legal-size envelopes, copies of all previous Forms DS-2019, and a cashier's check or money order for the application fee payable to the U.S. Department of State.
      3. After you receive your case number, write the full case number on any document you submit as well as on the outside envelope of all future correspondence with the waiver division office. If you do not write the case number on all correspondence and on the outside of the envelope, the documents you submit will be returned to you.
      4. After you have received your case number, contact the embassy of your home country in Washington, D.C., and ask that a No Objection Waiver statement from your government be submitted directly by the embassy to the U.S. Department of State Waiver Review Division. Be sure to request that the embassy write your full case number on the “No Objection” statement and also on the outside of the envelope to be sent to the Waiver Review Division.
      5. Mail all the documents requested on the notice of your case number. You can monitor the status of your case by calling the recorded message line at: 202.663.1600 or 202.663.1225 or on the U.S. Department of State J-Waiver Division web site.
      6. At the conclusion of the review process, the Waiver Review Division will forward its recommendation to give you a waiver of 212(e) directly to the U.S. Citizenship and Immigration Services (USCIS) bureau, and you will receive a copy of that recommendation at the address listed on your data sheet.

    The information little bit incorrect here. I had this 2 years rule under J1 Visa but I changed my status to F1 visa without any issues. Of course this 2 years rule will not disappear and will be added automatically to your F1 Visa.

      The information is accurate. As I mentioned the 212 rule is stamped on the visa page but that doesn't mean it's now applied on you unless your country is in the skills list or being funded by other organizations. Also every country has different criteria most of them are the same.

      Hi, if it's written on your visa Page, then you better request a letter from DoS(department of state) for J1 advisory opinion so they can confirm if you're really subject to 2 year home country 212e rule or "Not Subject" it'll be the same process I did.
      By the way, if you're in Peru, have you finished your program in the us for 6 or 12 months J1 or just visiting back?

    I got a J1 Visa but never travelled to the usa because I was unavailable. If I’m selected for the DV Lottery, would the J1 rule stop me from being offered the visa?

      No, it'll not affect your lottery visa since both are different cases. So you're good.

    I'm on J1, which will end in July 2024, and the US government funded the program (Fulbright Scholarship). I searched my country on the skills list, and it's not added. Also, as I searched and read that it requires a no-objection letter, the embassy refused to do so for me. What do you think I should do in this case?

    I’m currently have the “subject to 212e” on my j1 visa. My visa is expired right now and currently going back home. Can I apply for the waiver even though I am in the Philippines? Thank you so much.

      You may not need to get a waiver. Just send the packet after filling the form to the advisory opinion department in DOS most likely they'll return the letter with "NOT SUBJECT" to 212E rule so then you may apply for the US again.

    1. You showed the email by the end of your video. Is that email from HR of your University. Did you ask them ? Could you please share with me where to ask and get this email.
    2. I am on a j1 212 E visa with 2 yrs rule apply. Working as a postdoc scholar in Ohio University. I came to the US in November 2023 and my vid will be expired in 1 November 2024. I wondered if I should apply soon? How long does it take for you? I have international travels before my visa expired and can I still apply for E 212 waiver?
    3. My country is Myanmar and the politic is terrible right now. And I think it’s not in skill list. Sorry, you explained a lot but I might have misunderstood. Is the link you share for applying for The waiver?

    Before you applied for advisory opinion you were subject of the 212 rules or you were not sure. I am short term scholar and I am subject but I would like to apply for advisory opinion since I have been here just for five months.

      Yes, I was sure that I wasn't subject to 212e but I still needed a letter of NOT SUBJECT so I can show to immigration for the change in adjustment of status. I had a 6 month visa only. I would highly recommend getting that letter through an advisory opinion.

      @@IvonitaRodriguez29 yes, it was on my passport US visa page written as "212e two years rule does apply polytechnic institute Virginia Tech" so my country name wasn't on skills list neither I was funded/sponsored by any government or educational or any individual entity, therefore I wasn't subject technically so that's how I received Not Subject to two year home residency rule.

      Hi, First of all, just go to the website below and check by applying for a J1 advisory opinion, follow the steps in the website it's an official US department of State government website and submit the required fields and documents and mail them and wait for their response most likely within a month or 2

      If you have money to stay some extra month(s) and you apply for an advisory opinion now, then you're eligible to stay without doing any job or study or apply for anything that requires your SSN or application for employment or aid ⛑️.

      The clear and short answer is Yes
      Details are, if you spent the J1 time period here with being funded by the US or outsider government or being paid for the tuition like stipend, then you must check with advisory opinion otherwise 99.99% they'll reject at US consulate or embassy

      Apply for waiver is the best option. Staying by saying isn't something should be saying BUT to pursue a better career you either apply for advisory or wait to apply for another internship then the rest is up to USCIS.

      Brother, you are supposed to wave only in 2 conditions whether both are applied or not will be finalized by the advisory opinion department in the US department of state. These 2 conditions could apply in funding or either home country name in skills list

    What does it mean .

      Because I was told in scholarship you will spend 2 years in home country so I was worried which job can give me this 2 year residency rule exemption?

      I have gone through all the documentation processes within the University, submitted my visa to the world bank as well (they sponsored me). They also didn't say anything at the time I sent my visa but clearly in the scholarship letter it was written subject to 2 year home country residency

    I'm not funded by Pakistani government

    But air ticket, health insurance, monthly stipend & course fee is being covered MashahAllah by JJWBGSP

      JJWBGSP stipend deraha hai, har cheez JJWBGSP NE HI COVER ki hai bus tuition fee 10% US University pay karai hai
      State Maryland hai but AAP state kyun pooch Rai hai , why does it matter? Give clear reason

      So i have that section 212 on my passport and my j1 will be ending soon 14 aug and i can stay here till 13 sep so is it possible to remove that section with in a month ? So that i can apply for student visa . I want to study here i dont want to go back .

      @@TRAVELWITHBHARAT0707 yes you can make it as it's possible to get within a month. Assuming you're from India and India's name is in the skills list BUT still it'll not affect your status as long as you're not being funded by India or US govt or from your institution.
      Quickly collect documents to apply for an advisory opinion from the US department of state DoS and they will do a scan on your program and everything possible then send you whether "Subject" or "Not Subject" letter. Then you can apply for F1/2 Visas.
      I applied 1.5 months earlier as well from my program ending.I got it in 29 days.
