  • Witness testimony continued today in a $200 million lawsuit against Johns Hopkins All Children’s Hospital that was featured in the Netflix documentary ‘Take Care of Maya’. In 2016, at just 10 years old, Maya Kowalski was admitted to Johns Hopkins All Children's Hospital for severe pain and was removed from the custody of her parents after staff accused them of "medical abuse." Her mother, Beata Kowalski, hung herself in her garage on Jan. 7, 2016, after going months without seeing her due to the medical abuse allegations, according to the family's attorney, Greg Anderson.

      Like you, I am a social worker and do not claim CB either! If a family took that social worker to our registered body I am sure they would be found guilty of professional misconduct.     Some nurses and doctors are a complete disgrace. Having multiple health issues myself, I’ve been treated poorly and with disregard numerous times. I understand that doctors’ and nurses’ job can be very hard, but if you are becoming mean, rude, and cold hearted, you should stop being a doctor or a nurse.

Maybe you’re thinking about working at a Private Hospital, because, honestly, we have been fighting to get a raise, and honestly, it’s been hard to get a few dollars more per hour.
      Luckily, my husband has a good paying job, but if l was alone, l would be living paycheck to paycheck.
      Did that before I meet my husband, but l honestly didn’t care. I love my job, and still look forward to going to work every morning or night.

      @@ON-le3hlTotally agree, going on 30 years as a Nurse, struggled ever month, paycheck to paycheck. Luckily, didn’t have any student loans to pay back, worked my butt off.🤣.
      Married, and luckily he had and still has a pretty good paying job in a Bank.
      Still look forward every morning or night going to work, but, have nurse’s struggling every month, and living paycheck to paycheck.

      My wife works and the hospital and yes, she can confirm that some nurses and doctors are incompetent. But mostly, the problem lies in the higher management. Lack of training, lack of compassion to their employees by cutting cost and not hiring THE RIGHT people and or not hiring at all leaving the hospital understaff ALL THE TIME. The hardworking and knows their job well gets overwhelmed and or burned out and the pay is extremely low to be doing the job they do. Even during covid when everyone else are at home keeping safe, they were busting their asses on line risking their lives and they got nothing from it at all while the rest are at home getting paid and or compensated. You can ask any nurse at any hospital, most of them will tell all the wrongdoing in a hospital.

      Absolutely agree! None of these people, from the disgusting Ms Bedy, to this bedside nurse, all should lose their jobs, their credentials, & be charged and held accountable. There’s absolutely nothing that will convince me that not 1, one, of these care givers with degrees, didn’t realize that there was something going on. Ms Bedy should be charged with Munshausen by Proxy as she seemed to be enjoying making this little girl and her families life a living hell.

      RN of 20 years here. I have witnessed such a downturn in the nurses through the years. They push these people through nursing programs as quickly as possible, too many of the students only there for the paycheck they hope to receive once they graduate.

    It’s really shitty to see a person lie to cover her ass and try to save her job. She needs her license revoked. She obviously lied when she said she didn’t hold her down and maya was not yelling no. Her body contortion indicates a fear response. As a therapist clothing cannot be removed from a child for the purpose of photographing without the presence of a parent, parental consent or a court order. She knows what she did was wrong. Thank God the Jury awarded this child compensation.

    all of the people involved in this at all children’s hospital should not only lose their job, but their license as well. it infuriates me that people go into a field like this and treat HUMAN BEINGS like scum. none of them even feel one ounce of guilt for what they put this family through and it ended in beata taking her own life and leaving this family broken forever.

    She doesn’t remember whether or not Maya was crying and upset and being exposed? Come on! I am a nurse and I most certainly would remember something like that! As a matter of fact, unless there were bruises and signs of physical abuse that was determined by physicians, I would not consent to this treatment by a social worker!

    Her body language, in general, indicates deception - chin thrusted forward, lots of eye blinks, appears very defensive. She appears to have a hard time understanding and answering questions. Lots of avoidance, lots of mouth grooming, lots of gestures, lots of discomfort shown, breathing rate increases. Mya was crying in the photo, lips turned down. Maya looked upset. I believe this rather dense nurse is lying.

    This date in question, if I'm hearing it correctly, was the first day she was assigned to care for Maya. And according to her sworn testimony 2 months ago, she agreed this was the first time she'd ever been asked to assist with taking photos of a patient. Even if she's in the wrong for going along with it, she damn well remembers the event. That entire event is outside any nurse's routine and I'm pretty sure most nurses would recall vivid details of something so unusual. The jurors are people like us. They're not buying it.

      I totally agree. I was an Optometrist Assistant. A mother asked us to hold down her kicking and screaming daughter to insert dilation drops. I remember everything about it ...8 or 9 yrs later. The uncomfortable feeling, the other office staff who helped me- even though we rarely worked together, his irritation after the child jumped up and shouted "that wasn't bad!", the mom and my relief, my laughter at said office staff for his reaction, and asking the Dr., beforehand, if I should comply with Mom's request. I remember everything bc it was the only time I've ever been asked to hold down a child.

    This child was assigned to this nurse from 7 AM to 7PM. There would be documentation of when the child left the floor , with whom , why and a consent form. The time the child left the floor and returned to the floor would/ should have been documented. If the child had not returned by the end of my shift I would have documented that, too. I can’t remember if she returned or not during during the time I was assigned to her doesn’t sit well with me. I am a RN with 38 years working with pediatric patients.

      I thought the exact same thing. I also would have documented the pictures being taken and by who and I definitely would have made sure that they had consent to take those pictures. I’m a NICU RN and we have to get consent to take a baby’s picture. I don’t like nurses that just follow orders without questioning them. I question every single order that I’m given.

    What’s so sad is that she herself had a family member (her brother) who needed much medical care, she even says that he’s the reason why she went into nursing, she says she was impressed with the wonderful care that her brother received. You would think she would know better…..

      She did fine. The photos are just to emotionally incense the jury, there is nothing wrong with taking photos when abuse is suspected before returning a child to care of her family. Her family wouldn't have had a problem with the photos if the hospital had not violated their trust in other ways making them angry and suspicious of everything. As her own dad says, Maya dresses like that normally because long pants aggravate her condition.

      I find that many nurses over the last 10 years have gone into it to make big money. Especially travel nurses. They make bank. I'm not a nurse, but an x-ray tech for almost 26 years. I can count on 2 hands the number of nurses I would feel comfortable taking care of me. That's it. So many just don't care about patients. They're going through the motions. Lot of eye rolling and ignoring call bells.

    The difference in the questioning between the defense and prosecution is absolutely astonishing, she was trained by the defense attorneys for the questions they would ask her so it all sounded like flowers and rainbows including her backstory credentials,
    Once the prosecution begins their cross examination she begins stammering and stuttering, mishearing things, asking to repeat the question when the questions become much less expected and the prosecuting attorney brings receipts to back it up

      Don't be emotionally manipulated. She may have been misled but she doesn't commit any serious violation. The patient wore those kind of clothes normally because of her condition, she wasn't "stripped for photos." And the nurse was acting on the information she was being given; that the patient was coming from an abusive family and therefore they needed before/after photos when returning her to the care of her uncle to confirm no abuse was taking place.

      I understand why she doesn't want to bite the hand that feeds her... I don't agree with it... My husband a doctor during the covid vaxx really didn't want anyone getting it but being he's at hospital that has a substantial reputation as a good teaching-hospital too he could definitely ruin his career speaking out against the vax. Just like when the swine flu vaxx was put out he immediately told me not to get it as no long-term data with peer reviewed studies are published and yet when the wine flu vaxx was released people were falling ill to it. Most of my medications I don't take unless it's been out on the market for at least 20 years - I prefer the 50 year mark as that's when the patent allows manufactures to make a generic.

      As a patient advocate, nurses routinely go against a patients' immediate desires or wishes and routinely take steps that make patients uncomfortable. I don't see anything particularly wrong with how this nurse behaved; her team suspected abuse or self-harm and they took before/after photos to confirm the condition. She wouldn't have been in a position to question the social worker or anyone else who were telling her that these conditions were suspected and taking photos is a considerably lesser harm to the patient compared to collecting no evidence and subsequently returning her to an abusive environment.

      sadly, as a nurse you don't want to put yourself on the wrong side of your profession and be black balled if you chose to move along your career... I don't agree with it but I can understand why she doesn't want to bite the hand that feeds her. My husband is a doctor and during the covid vaxx release he had to remain silent on him being against something that doesn't have any long-term data of a pharmaceutical released without proper testing (having a controlled group along with other case studies). If he spoke he probably wouldn't easily find any job and they years he put into his education and training.

    Her response to Mr. Anderson's question, at 21:06, baffles me... I feel like she heard "child having their clothes taken off for photos", panicked, short-circuited, and thought he was asking it in a way that accusing her of something. Which tells me that she does in fact remember all of it, and is focusing too hard on keeping her story straight for the Defense. I understand it can probably be nerve-wracking to be questioned up there, but... if what you are saying is supposedly true, and you did nothing wrong... it should not be this difficult.

I think the bigger issue is notes weren’t written accurately and she doesn’t want to admit to playing a part in any wrong doing. Either way, on the stand, she doesn’t look good to the profession, in my opinion.

    RNs don't take orders from Social Workers. If there isn't a doctor's order in the chart to support an intervention, we have to question the order and refuse it! This RN is just as culpable as the rest. Also, she doesn't seem to understand simple questions asked of her on the stand - she has a Master's degree?

    It is so frustrating that she was able to get away with blatant lying. As a hospital based nurse for 43 years, I may not have been able to recall everyday, routine procedures on every patient, but this picture taking was not routine. Yet she recalls very little. Or so she testified. Being a regular nurse on that unit she would have also have been aware of the issues with Maya’s family and medical history. I don’t care if she had never taken care of her previously, Maya’s issues would have generally been known. As such, one would think her memory would have been better. She is an absolute disgrace to nursing and has no business taking care of any patient in any setting. I only can hope her own daughter never needs a nurse to advocate for her and runs across the caliber nurse her own mother happens to be. She literally nauseated me.

      It is very possible that she was advised to reply “I do not recall” instead of replying with a definitive YES or NO. When I was in nursing school we were strongly advised, if ever called to the stand, to reply with “I do not recall” instead of NO. I can see the prosecutor ramping up with his questioning, trying to get her to admit that she was in the room for the pictures of Maya in the 2 different outfits. As he is ramping up, she is getting more uncomfortable and replying with “I do not recall” more often (as she was probably coached to do).

      This woman is an absolute disgrace to the field of nursing!!! I know that there are a ton of nurses just like this. This woman blatantly lied to save her ass because she knew what she was doing was wrong!! Nurses are supposed to be advocates for patients. The fact that this child was failed by EVERY single medical professional that she came into contact with at Johns Hopkins is beyond disturbing!!! I wish that attorney’s were not allowed to, “prep,” the witnesses or anyone taking the stand other than their respective clients. We would definitely get much more accurate answers.       ​@Batya-Grace because they are legally obligated to report to DHS if they suspect abuse or the doctor can lose their license. The aggressive treatment Maya has for her condition isn't recognized in the US, she had to go to Mexico to get that amount of ketamine.
      Now when it comes to experimental treatments like this perhaps there should be a law in place that if the parents understand the risks and consent to the treatment, then the doctor cannot interfere even if they disagree...but then it also wouldn't be the doctors responsibility if the patient were to die from the treatment. Then perhaps doctors wouldn't be incentivized to report abuse when a parent refuses or pushes a different treatment. Doctors are suppose to do no harm. If Maya died from the ketamine treatment, then the doctor would be blamed.
      The same thing with this nurse...she's lying because she was scared to lose her license. When it was DHS who requested the child abuse photos. It's CPS/DHS who is corrupt and steals children. The medical staff are just following protocol and acted based on the belief that Maya's mother had Muchensan by proxy and was overmedicating her child. Although I do think Maya should have been allowed to be transferred to another hospital, one which had a better grasp of CRPS because I don't think this hospital did. The fact is some hospitals are better with certain condition than others and specialize in different things.

    This "nurse" is awful. Just awful. I have been in the medical field for 20 years and I can remember, VIVIDLY, events that would have been traumatizing or upsetting for patients. As a Healthcare worker, you should have empathy for them. You feel what they feel. For her to continually deny remembering a patient's clear distress and her part in it, tells me that she is not paying enough attention to what is important, which is her patient! It's so frustrating to see this! Mistakes happen, but OWN IT! Do not continue to be a part of Maya and her family's suffering. She didn't stand up to the social worker then, but she can absolutely do something to make this is as right as it will ever be

      I've been on both sides. In the Medical field and as patient. 6 yrs I've been fighting ALL leukemia. I run into nurses even outside of the hospital. From my long stays they remember me very well and tell me stories about our time together. I remember many of my patients. It wasn't a normal situation with that child or her length of time there. It would stand out. I can remember patients from from my 1st years 30 yrs ago.

      I think all of the JHACH employees were terribly witnesses and their testimony was a wash for me. The constant attempts to evade answering any questions made me question whether they were threatened with retaliation if they actually answered a question.

      Omg, I just literally posted the same thing before reading your comment. X-ray tech for almost 26 years. Portables and O.R. so I get to know nurses all over the hospital. I said I can count on 2 hands the number of nurses I'd want taking care of me. The majority of them being over the age of 50. The younger nurses seem to just want to do their couple years and then be nurse manager. I'll never forget that travel nurses were making $150 an hour during COVID at my hospital.

      The documentary made me feel the same. It was hopeless. Maya would've been in there ages longer too had she not. The system would've dragged it out. Look at how long this outcome took. Our hospitals doesn’t have any off this crap, mothers and fathers are welcome any time to come and visit their kids. The things they do there would be so illegal in my country. I am appalled, what an absolutely shit health system you guys have there! To hear that medical kidnapping happens a lot- OMG! No just NO!

      This is NOT every hospital. But I am Canadian and I highly suggest our health care system (Ontario specifically)

      Ms. South Africa, this is not normal in America. This is something that should not have happened, and those nurses should be charged for child abuse and neglect. They were so horrible to this child and caused damage to this child's body. And drove the mother to suicide for declaring she was the abuser, when they were. Such things do not normally happen like this in a children's hospital in America. So glad this came out in the open.

      This is so rare most people never experience anything like this. Not ever. I don’t know anyone that has gone through this.
      In fact most times it’s the opposite. I see more kids being abused where the State won’t step in and help them.

      Come to Ireland we'll look after u it's free for all or at the very worst all medication you would meed in a month will not cost not more than 80_100 euros per, I fell so sad for the horrible systems you all have to put up, please don't take this the wrong I just wish yous had a better chance at health care it should be assessable for everyone❤
