Regardless, even how the cop claims it happened wouldn't have been enough. Had he wrote that ticket, not only would he have gotten a tongue lashing from the judge, but opened himself up to a lawsuit in which he would've lost QI. As a former LEO, "officer safety " was dispelled once he padded him down for weapons. There's another officer on scene as your backup that has eyes on him while you're in your car looking up laws, writing tickets, chatting with your supervisor, etc...

They do not have the authority to conduct a pat down search for weapons simply for "officer safety"... In order to conduct a pat down, the must reasonably believe the individual is armed AND a threat to their safety or the safety of someone else. Also I would argue that once they have committed their pat down to satiate their concern for officer safety, they should no longer be allowed to claim that for the stop like the officer was when he was getting too close. The cop didn't pat him down until way after that anyway, and nothing you mentioned would lead a reasonable officer to believe that the individual was armed and dangerous. Also, it's not up to a lawyer to establish, articulate, or prove; it's up to the cop and any decent lawyer would drag that cop in a deposition or courtroom.

What’s incredibly infuriating is that, even if a stop or ticket or arrest is CLEARLY retaliatory, it’s justifiable if you’ve broken ANY law. So, if this auditor had in fact swerved, even a little bit, he wouldn’t have a retaliatory claim. However, based on the fact that this officer had no evidence and the auditor is so certain that his dashcam would prove otherwise, a ticket in this instance absolutely WOULD have been first amendment retaliation because they can’t prove that he violated a law, and he admitted to only writing him a ticket because of his speech.

In a just legal system, that officer would have to pay compensation to his victims from his own pocket. And he'd be liable for jail for his corrupt and tyrannical behaviour. But instead with have this 2 tier justice system, where the police get either no punishment, or the lightest of slaps on the wrist. Whereas Joe Public would get thrown in jail if they did the equivalent thing.

They do not have the authority to conduct a pat down search for weapons simply for "officer safety"... In order to conduct a pat down, the must reasonably believe the individual is armed AND a threat to their safety or the safety of someone else. I think any competant lawyer could justify the pat down in a courtroom. He got out of the car. Walked toward the officer. Did not stand where he was directed.

Also I would argue that once they have committed their pat down to satiate their concern for officer safety, they should no longer be allowed to claim that for the stop like the officer was when he was getting too close. The only way I would see that be valid coming back up after the pat down would be if a physical altercation actually arose. It's really just another by pass technique to skirt peoples rights.

The cop didn't pat him down until way after that anyway, and nothing you mentioned would lead a reasonable officer to believe that the individual was armed and dangerous. It's 2 things simultaneously, armed and dangerous, not one or the other or neither. Also, it's not up to a lawyer to establish, articulate, or prove; it's up to the cop and any decent lawyer would drag that cop in a deposition or courtroom.
@@mkirkman89 the language commonly used is reasonable suspicion or justifiable belief, but yea there has to be some fact that they can explain satisfactorily in a deposition or court. They think they can pat down anyone solely for the purpose of a weapons check, but it's not the case.

What’s incredibly infuriating is that, even if a stop or ticket or arrest is CLEARLY retaliatory, it’s justifiable if you’ve broken ANY law. So, if this auditor had in fact swerved, even a little bit, he wouldn’t have a retaliatory claim. However, based on the fact that this officer had no evidence and the auditor is so certain that his dashcam would prove otherwise, a ticket in this instance absolutely WOULD have been first amendment retaliation because they can’t prove that he violated a law, and he admitted to only writing him a ticket because of his speech.
Even though the crooked judges don't see it that way. They're tasked with being the cop's legal counsel and will rationalize the worst behavior.

"Now it's an officer safety thing." No it wasn't. It was an officer ego thing. That cop was determined to show that he was top dog in that interaction. He was drunk on power. And therefore a totally unsuitable person to be a police man. Because it's not about the law. It's about enforcing his personal wishes and feelings on the people he comes across.
In a just legal system, that officer would have to pay compensation to his victims from his own pocket. And he'd be liable for jail for his corrupt and tyrannical behaviour.
But instead with have this 2 tier justice system, where the police get either no punishment, or the lightest of slaps on the wrist. Whereas Joe Public would get thrown in jail if they did the equivalent thing.
