      The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The U.S. Constitution is the supreme law of the land, and any statute, to be valid, must be In agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail. This is succinctly stated as follows:
      The General rule is that an unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of it's enactment and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.
      Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it.....
      A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the lend, it is superseded thereby.
      No one Is bound to obey an unconstitutional law and no courts are bound to enforce it.

      Strictly speaking, an unconstitutional statute is not a "law", and should not be called a "law", even if it is sustained by a court, for a finding that a statute or other official act is constitutional does not make it so, or confer any authority to anyone to enforce it.
      All citizens and legal residents of the United States, by their presence on the territory of the United States, are subject to the militia duty, the duty of the social compact that creates the society, which requires that each, alone and in concert with others, not only obey the Constitution and constitutional official acts, but help enforce them, if necessary, at the risk of one's life.
      Any unconstitutional act of an official will at least be a violation of the oath of that official to execute the duties of his office, and therefore grounds for his removal from office. No official immunity or privileges of rank or position survive the commission of unlawful acts. If it violates the rights of individuals, it is also likely to be a crime, and the militia duty obligates anyone aware of such a violation to investigate it, gather evidence for a prosecution, make an arrest, and if necessary, seek an indictment from a grand jury, and if one is obtained, prosecute the offender in a court of law.

It's insain they were told there trespassing and they opened a gate with a clear visible sign saying no trespassing 😮😢how can they get away with stuff like this where is the accountability at. I have no doubt in my mind that these cops are trained to ignore the law like this. And this is a common theme with cops in small country towns across the US. They have gotten away with violating rights for so long that they think it’s the norm. This is what no accountability for breaking the law creates.

      It would make sense to maintain accountability for L.E.O. and to remove Q.I. when it is acceptable to do so. The crux of the problem is corruption, and we need an inquiry that is either public or federal in order to hold L.E.O. responsible. When it is the responsibility of an agency to conduct its own investigation, it is obvious that the agency will never acknowledge to having done anything wrong or discover any fault.

    The deputy cannot determine trespassing without having already contacted the property owner. It is none of the deputy's business who is on the property absent a complaint from the owner.

      By the facial reactions of the supervisor that sergeant was wrong. That's why he asked to clarify what citation he was giving him. He figured the district attorney would throw it out and he'll deal with his sergeant later in private. But I was personally hoping he would've corrected him there in front of the family. But Hudson would of sued the sheriff department. This way eventually the $ would go to the family that deserved it. It was pick your poison day if you know what I mean. Hudson lost his job over it probably when the family decided to sue. But I have a feeling he had a authority complex. He was told twice how to handle it. Twice he disobeyed. It wouldn't surprise me he new the off duty female officer who called in the complaint. Hudson was cocky that day and he was the day he showed up in court with his fancy suit. Fight on!

      ​​@@sherylhumberger5417 They haven't sued yet, unfortunately you only sue after the charges are dropped or you're found not guilty because the civil case relies on the criminal proceeding. This is why you should never take a plea deal if you want to sue because it will be noted that you were in fact guilty of the crime (even if you weren't).
      This is exactly why they are pushing these bs charges because they know a lawsuit will be coming afterwards and want to try and avoid it for as long as possible or all together.
      It's an extremely corrupt circle.
      Lawyers can be expensive and if you're unlucky enough to get a public pretender they will pretty much pressure you into taking a bs plea deal to prevent you from suing.
      Hudson was most likely fired for another incident (considering the timing it's unlikely it was because of this incident). It takes a long time to get cops fired for misconduct with how crummy our justice system and policing is built.
      Cops like Hudson typically have multiple cases like this where they abuse their power so it's pretty common for them to be fired or forced to resign by the time the criminal or civil cases are over.
      They'll typically just find another department to work for though.
      This is why we need something like the brady list to bar cops like this from ever working in law enforcement ever again or any government position that holds authority.

They talk and talk and talk pushing to get and ID that will provide exactly zero information or evidence to support/further the "investigation". I wish that when they "get a call" they sit back and just observe if a crime is actually afoot vs immediately going in to make contact with somebody assuming that a crime occurred. Those callers sure have a ton of power if thats all it takes to get cops to detain and harass private citizens without any evidence that a crime actually occurred.

      The constitution gives states the power to govern themselves. This means that if something is legal on a federal level, that doesn't mean you can't get in trouble for it. Ultimately, federal law is the supreme law of the land, but would only take precedence if federal law enforcement is involved and federal and state law are in conflict. If you are violating a state's law, you will still face the music when dealing with state law enforcement. Federal ruling doesn't make you immune to state laws. It's funny how those who use the constitution to support their argument, seem to understand it the least.
      Also, again, you keep saying "arrested" for foul language. The guy was issued a citation as it's a class 3 misdemeanor. No one was arrested. If you don't know what "arrest" means, I certainly don't expect you to understand the constitution.@@JayOhBreezy

    Former deputy here, Hudson is a vindictive officer and hes pissed that the owner didn't want give him an ID, if he was in my department he would be fired and another officer would have been sent out to possibly de-escalate the situation and hopefully stop a lawsuit and the family has all the rights in the world to cuss Hudson out its called freedom of speech, also if shooting in the county isnt a crime then it doesn't constitute a crime so Hudson has no justification to be on his property.

      Innocence does not make you immune to investigation. You can't just shrug off the police when they are investigating reported gunshots. If an officer stops you because you match the description of a kidnapper, innocent or not, do you really think you can just ignore the police and walk away while they are detaining you for investigation? Absolutely not.
      If you ask me, these officers should have investigated deeper. Just because it's your property doesn't mean you can discharge firearms. The officer's should have ensured they are doing it safely. If they are firing toward homes or a roadway, then that's a major safety issue. The officers just let it go once they had proof of property ownership. They only got halfway through their investigation. The safety concern was still at hand.@@geoffwaters8786

    Fourth Amendment violation for entering the property without a warrant and then illegally arresting Rob's dad and seizing his wallet for ID, and also a Fifth Amendment violation for trying to force people to identify themselves without any reasonable suspicion of a crime. Hudson deserves to lose qualified immunity, to have his law enforcement certification revoked, and to be criminally charged.

      Maybe I suck at looking the laws up, but I couldn't identify any law stipulating distance from houses you can discharge a gun. Public places, accross roads, etc but nothing about residential. 1/4 mile in from the road & such a large property indicates their one argument is shakey AF.

I live in a rural area (on a 54,000 acre wildlife management area) and we cannot discharge a firearm within 200 feet of any road or atv trail, or within 200 yards of a dwelling that is not your own on your own property.
