Jon Roland: Strictly speaking, an unconstitutional statute is not a "law", and should not be called a "law", even if it is sustained by a court, for a finding that a statute or other official act is constitutional does not make it so, or confer any authority to anyone to enforce it. All citizens and legal residents of the United States, by their presence on the territory of the United States, are subject to the militia duty, the duty of the social compact that creates the society, which requires that each, alone and in concert with others, not only obey the Constitution and constitutional official acts, but help enforce them, if necessary, at the risk of one's life. Any unconstitutional act of an official will at least be a violation of the oath of that official to execute the duties of his office, and therefore grounds for his removal from office. No official immunity or privileges of rank or position survive the commission of unlawful acts. If it violates the rights of individuals, it is also likely to be a crime, and the militia duty obligates anyone aware of such a violation to investigate it, gather evidence for a prosecution, make an arrest, and if necessary, seek an indictment from a grand jury, and if one is obtained, prosecute the offender in a court of law.
It's sad when the police can enforce laws they don't even know . We would be arrested if we went on private property and was asked to leave. It's insain they were told there trespassing and they opened a gate with a clear visible sign saying no trespassing 😮😢how can they get away with stuff like this where is the accountability at. We the people deserve better and cops do not run the world but the government let's them get away with sht like this.😢😢😢
I vaguely remember a female officer shooting a man on his own couch in his own apartment bc she thought she was in her apartment...and assumed he broke into her apartment.
He is a bully....doing this to be tyrants and annoy the family....disgusting to treat an American law abiding family this way ....SCOTLAND STANDS WITH THIS FAMILY.....these tyrant bully cops need to lose immunity....shame on them for allowing ego to abuse this family
@@kayetaylor5551The off-duty cop was an African America lady, who has been a victim of hate crimes, burned crosses and nooses in her yard by the Grand Wizards failing to trespass investigators.
Hudson has demonstrated that he is wildly unfit for law enforcement and should be barred from any kind of active duty when it comes to working in the field of law enforcement. This man is a tyrant and needs to be removed immediately!
It is absurd that police officers think just because they are officers. They have the right to just come on to anyone's property. As the Trespassers accuse you of Trespassing. and demand you to prove to them it's your property.. Make that make sense
@@King.David.219imagine the dude couldn’t be reached or was out of town. They’d have just arrested the older man. They need to prove he’s not allowed in the first place. Not the other way around. This asshole can reasonably infer they were telling the truth but wanted to play ego games with the people standing on their rights. He should be in jail.
He has the same mentality. In the other video he’s telling the son he doesn’t need a reason to stop someone and ask for ID. I have no doubt in my mind that these cops are trained to ignore the law like this. And this is a common theme with cops in small country towns across the US. They have gotten away with violating rights for so long that they think it’s the norm. This is what no accountability for breaking the law creates.
@@jesusoftheapes100% one of the worst police encounters I've ever seen this guy was a joke . Though I'm pretty sure it's not illegal to accidentally point a weapon at someone like in this scenario
Hudson should absolutely NOT have his job after this encounter. He violated the 1st, 4th, and 5th amendment rights of multiple citizens. He is a danger to the public !
This is exactly why we need to end qualified immunity and disband the FOP. These kinds of criminal cops need to be charged, jailed and their pensions should be forfeited to their victims.
Overturn terry v. Ohio. Wouldve stopped all this. That first stop was a terry stop. Terry opens the door for all this nonsense. Qualified immunity is not in a couple states and it changes npthing.
Holding L.E.O. accountable and stripping Q.I. when reasonable would make sense. the root is corruption, and we need public or federal investigation that can hold L.E.O. accountable. When an agency is responsible for investigating themselves, it is evidently never going to admit wrongdoing or find any fault.
It would make sense to maintain accountability for L.E.O. and to remove Q.I. when it is acceptable to do so. The crux of the problem is corruption, and we need an inquiry that is either public or federal in order to hold L.E.O. responsible. When it is the responsibility of an agency to conduct its own investigation, it is obvious that the agency will never acknowledge to having done anything wrong or discover any fault.
It's a liability for the police to question something they don't have to believe? I would think you would like the police to make sure someone claiming to own or have permission to be on your property that they would do the most to confirm what was said is the truth. I mean you can go on vacation have a person break into to your and claim they live there, and you wouldn't want the police to make sure thats the truth. Let me guess fuck the police, until you need their help then kiss their ass.

See, why do most people on these comments know this and these fools called deputies do not. They were wrong on an astounding number of points in these videos. Hate well earned.
There was never a complaint of tresspassing. The deputies made that up all on their own. THEY are the compaintant. They need to be charged with violaton of rights.
The fact that he was humming a cocky little tune as he was mouthing off on the way out of the driveway shows people everything they need to know. This makes my blood boil, and it should have that effect on everyone. These two clowns and their supervisor deserve PRISON TIME.
By the facial reactions of the supervisor that sergeant was wrong. That's why he asked to clarify what citation he was giving him. He figured the district attorney would throw it out and he'll deal with his sergeant later in private. But I was personally hoping he would've corrected him there in front of the family. But Hudson would of sued the sheriff department. This way eventually the $ would go to the family that deserved it. It was pick your poison day if you know what I mean. Hudson lost his job over it probably when the family decided to sue. But I have a feeling he had a authority complex. He was told twice how to handle it. Twice he disobeyed. It wouldn't surprise me he new the off duty female officer who called in the complaint. Hudson was cocky that day and he was the day he showed up in court with his fancy suit. Fight on!
@@sherylhumberger5417 They haven't sued yet, unfortunately you only sue after the charges are dropped or you're found not guilty because the civil case relies on the criminal proceeding. This is why you should never take a plea deal if you want to sue because it will be noted that you were in fact guilty of the crime (even if you weren't). This is exactly why they are pushing these bs charges because they know a lawsuit will be coming afterwards and want to try and avoid it for as long as possible or all together. It's an extremely corrupt circle. Lawyers can be expensive and if you're unlucky enough to get a public pretender they will pretty much pressure you into taking a bs plea deal to prevent you from suing. Hudson was most likely fired for another incident (considering the timing it's unlikely it was because of this incident). It takes a long time to get cops fired for misconduct with how crummy our justice system and policing is built. Cops like Hudson typically have multiple cases like this where they abuse their power so it's pretty common for them to be fired or forced to resign by the time the criminal or civil cases are over. They'll typically just find another department to work for though. This is why we need something like the brady list to bar cops like this from ever working in law enforcement ever again or any government position that holds authority.
For a cop to detain for trespassing, they must have permission from the owner of the property to police the property... and only a fool would open themselves up to such liability.
The cops can't just go on private property and start IDing people to make sure they're not trespassing when there was no initial complaint from the property owner! How do they hear themselves and not feel like morons?!
Seen 1000's of vids like this and most of the cops don't listen. They all claim to be investigating but don't use their eyes and ears to gather information. They talk and talk and talk pushing to get and ID that will provide exactly zero information or evidence to support/further the "investigation". I wish that when they "get a call" they sit back and just observe if a crime is actually afoot vs immediately going in to make contact with somebody assuming that a crime occurred. Those callers sure have a ton of power if thats all it takes to get cops to detain and harass private citizens without any evidence that a crime actually occurred.
Seems every cop knows the different tricks to make it look like you are resisting or not just obeying their commands but very few of them know our rights. And even if they are found guilty of violating someone's rights there is no punishment and the tax payers pay the fines or settlements! Anyone else beside me tired of this!
These cops were ridiculous through and through. Hudson is a menace to society for his behavior. Being a cop doesn’t give you the ability to literally do anything you want. But in most cases, that’s how they are.
James freeman said it best. You are witnessing the documentary on the destruction of a humane society. These badged state sponsored buffoons have destroyed the fabric of society. Kind caring men and women have built up this country to be a safe place to raise kids. There is also something called Time place and Manor. Well, yes, we have the freedom to assemble and protest. There is a time a place and a manner in which we can do it. Meaning you can’t do it at two in the morning using a loudspeaker, you can’t do it in the middle of a busy intersection and obstruct traffic, and the mannor in which you do it such as if you are protesting against Some of the ridiculous laws they try to put in place on our second amendment rights doesn’t mean at the protest you can let a handgun off in the air. The constitution gives states the power to govern themselves. This means that if something is legal on a federal level, that doesn't mean you can't get in trouble for it. Ultimately, federal law is the supreme law of the land, but would only take precedence if federal law enforcement is involved and federal and state law are in conflict. If you are violating a state's law, you will still face the music when dealing with state law enforcement. Federal ruling doesn't make you immune to state laws. It's funny how those who use the constitution to support their argument, seem to understand it the least. Also, again, you keep saying "arrested" for foul language. The guy was issued a citation as it's a class 3 misdemeanor. No one was arrested. If you don't know what "arrest" means, I certainly don't expect you to understand the constitution.@@JayOhBreezy

Arrested for cursing and "destruction." Destruction of the English language? IGNORANCE AND EGO, very dangerous combo. Love it..."Watch for falling acorns!"
It's none of that pig's business if anyone had permission to be on that property. The property owner never complained about trespassers. Badged bullies are always making up excuses to violently punish people who have done no harm.
What surprises me is that they volunteer to put themselves through this shit. Even if you DID commit a crime you have NO obligation to help them in an investigation. This man didn’t commit any crimes and is being treated like this… disgusting behavior by this police department.
The cop needs to be fired and arrested for trespassing. The guy called him like the guy asked, but that was not enough. Cop and the police department need to be sued.
So lets get this straight, two individuals ignored no trespassing signs, breaking through a gate and trespassing and then restrain and point guns at the lawful owners of the property?
Yeah fortunately for those two individuals VA doesn't have stand your ground or deadly force to protect property, otherwise they might have found themselves legally laid out should the owners have gone down that route. With how the USA is heading I think its a distinct possibility that sort of thing starts happening especially in rural areas where the cops are completely corrupt. Pray it doesn't happen, but these corrupt cops just keep pushing towards it.
Actually you do need a crime to stop him. Unlawful search & seizure. "Failure to cooperate"what law says he has to cooperate? Possibly trespassing, unlawful detainment He's not paid to think He's not paid to uphold the Constitution. He's being investigated for them "getting a call" A citation for "cursing/abusive language" whatever. Good luck with that one He has to write the citation because his ego demands it. Of course the sheriff's office withheld. Of course only the deputy showed up. But in civilian attire? Interesting
He showed up in plain clothes because apparently he doesn't work for them anymore. He said he was currently unemployed. Thats sounds fishey right there. If he didn't work for the agency why did he show up?
Seriously, what kind of charge is that?? Cursing/abusive language? So what? That CLEARLY violates your 1st amendment right. Freedom of speech. You can say literally whatever the hell you want. I hope those "citations" get dismissed. That's absolutely ludicrous. If that isn't a violation of your constitutional right, I don't know what is.
Even though he no longer works for SO he still is obligated to provide testimony. His employment status is irrelevant. As far as saying what ever you want, as long as you are not threatening the officer you're pretty much good to go. Personally, I would have told him to lick the sweat off my bleapen b@ll sac.
You were either and uneducated officer, or you are lying. No officer would need a warrant step onto a property to investigate a shots fired call. Dispatch: "Please state your emergency." Then we will send an officer out to the property." Also, 55 years serving as a deputy? Your profile says you are a retired railroad contractor and your profile image is that of a middle aged man. Doesn't add up, bud.
Innocence does not make you immune to investigation. You can't just shrug off the police when they are investigating reported gunshots. If an officer stops you because you match the description of a kidnapper, innocent or not, do you really think you can just ignore the police and walk away while they are detaining you for investigation? Absolutely not. If you ask me, these officers should have investigated deeper. Just because it's your property doesn't mean you can discharge firearms. The officer's should have ensured they are doing it safely. If they are firing toward homes or a roadway, then that's a major safety issue. The officers just let it go once they had proof of property ownership. They only got halfway through their investigation. The safety concern was still at hand.@@geoffwaters8786

Jon Roland:
Strictly speaking, an unconstitutional statute is not a "law", and should not be called a "law", even if it is sustained by a court, for a finding that a statute or other official act is constitutional does not make it so, or confer any authority to anyone to enforce it.

Holding L.E.O. accountable and stripping Q.I. when reasonable would make sense. the root is corruption, and we need public or federal investigation that can hold L.E.O. accountable. And how about you can't patrol until you pass a third grade civics test.
But this is how they like it. Us fighting our own cops never focusing on them you know who's

Call the Sussex internal affairs or the FBI to start an investigation tomorrow. That's what I'll be doing
Deplorable behavior from our hired public servants!!!
We need to defend ourselves!!!!!!
Cop had his ego hurt so much he had to go harrass the mans family, what a disgrace.
This could be the biggest settlement and a new case law definition in the US Supreme Court of Law. GOD bless
End qualified immunity and make cops buy private insurance.
OR PAY LAWSUITS, WON, FROM POLICE PENSION FUNDS, NOT BY LOCAL TAXPAYERS. ABOLISH QUALIFIED IMMUNITY, COPS ARE GETTING AWAY WITH MURDER, ASSAULT, BREECHES OF THE CONSTITUTION AND MORE !!
Rob should throw his name in and run for Sheriff in the next election, at least they would finally have someone in charge who knows and understands the Constitution and would be willing to teach his deputies and hold them accountable for violations
This would be amazing.
If there is a civil rights attorney out there watching this, please help these people!!
Those 6 weeks of law enforcement training, on top of the three years of elementary school are really paying off.
I bet that pos HUDSON didn't even finish kindergarten with good results.
HE WAS THE SMARTEST ONE IN THE POLICE ACADEMY !!!
lmao facts
Fourth Amendment violation for entering the property without a warrant and then illegally arresting Rob's dad and seizing his wallet for ID, and also a Fifth Amendment violation for trying to force people to identify themselves without any reasonable suspicion of a crime. Hudson deserves to lose qualified immunity, to have his law enforcement certification revoked, and to be criminally charged.
1st amendmrnt violation for arresting the dad for cussing.
Maybe I suck at looking the laws up, but I couldn't identify any law stipulating distance from houses you can discharge a gun. Public places, accross roads, etc but nothing about residential. 1/4 mile in from the road & such a large property indicates their one argument is shakey AF.
5th amendment really wouldn't apply for the ID, that still falls under the 4th amendment. Now there was many violations including 1st, 4th, and 5th. But that's a bit off
@@hydrocarbon82most municipalities have ordinances concerning recreational/ hunting firearms uses within city limits and/or distance from roadways and dwellings. I live in a rural area (on a 54,000 acre wildlife management area) and we cannot discharge a firearm within 200 feet of any road or atv trail, or within 200 yards of a dwelling that is not your own on your own property.
maybe gunshots are considered exigent circumstances?
The “supervisor” let him write a ticket for cussing FOR CUSSING 🤬 WTH
The supervisor should be embarrassed for not stopping that when he had the chance, oh wait he's just as incompetent...
This really is unbelievable. How could anybody "back the blue" these days?
This is an absolute comedy. The ignorance of these cops is stunning.
It's not ignorance, it's abuse. These are narcissist psychopaths, they are deadly dangerous and need to be removed from public service.
Stupid too.
Fired deputy is the husband of the deputy who called it in to dispatch. See how that works?
It would be if it was fucking funny. This is not funny.
"Call and verify he gave you permission..."
Unless the property owner complained (or has a standing contract) the cop cannot confirm someone is not trespassing.
Not to mention calling wouldn’t prove shot. I can call anyone in my phone and make their contact title Rob.
@@CMTZ11 Which is exactly why Hudson, after getting him on the phone, "wELL i nEvEr SaW HiS iD EiThEr" a**hat
@@MrMaelstrom07 exactly. He doesn’t know what he’s doing. He tried to get them to comply with something small. Then changes to something bigger trying to bait them further. And then still try to unlawfully ID.
Praying these citizens get justice and these pigs are held accountable
There's only one solution
Me to but I highly doubt it they always get away with there bs
@@theworldisastage1984 and that solution happened to be the very thing they were on the property investigating…
You can argue with them, till you’re blue in the face if the supervisor doesn’t know the law, there’s no point let them take you to jail and sue them
This cop shouldn't be allowed to occupy any position of power - especially a police officer. Ignorance and arrogance are dangerous traits to have as a police officer. And this officer has both traits in spades.
No-one should occupy positions of power. Power corrupts.
Muzzleflashes him on his own property after arresting him and trespassing FOR NO CRIME!!! Bastards.
💯
Muzzle flash? Lmao.
What does that mean? I thought it was the flash of light after firing.
@@freddispaghetti No, it's a term used to describe pointing the muzzle of the weapon at anything other than something you intend to destroy, in this case, an innocent man's groin.
@@michaelmcginty2766 Thanks.
It is staggering that this cop can be this obtuse. Another petty, vindictive thug. Disgraceful.
demographics at play
@@ETT64 Using the word "demographics" is a cute way to disguise a racist heart. What about the "demographics" of the two other officers on the scene? They chose to do nothing as Hudson abused his power. And one of THEM was the "supervisor!" Surprised you didn't notice that. Perhaps your hood is on backwards.
@@Mallory-j5y Refreshing to see someone else calling out this BS.
@@92Jdmsupra God bless you for fighting against hate and ignorance.
There were two other "thugs" on the scene, and one of them was the supervisor. They did nothing to stop the injustice. In fact, they backed Hudson up. Why is everyone giving THEM a pass?
Please keep us updated. This entire incident is infuriating to watch.
I completely agree with the lawsuit. I hope the victims of these crimes are awarded a healthy compensation for the crimes committed in this video. These childish criminal cops belong in federal prison for the crimes they committed in this video. These are bad cops. Criminals shouldn't be enforcing the law.
I’m tired of paying lawsuits for these idiots.when I get fired for not knowing my damn job.
This crook went straight for the American Mans wallet and lied about the correct dollar amount of $50. Disgusting behaviour, should learn American law.
Yeah I noticed that. He planned on stealing anything over fifty dollars. I was glad the man spoke up and said he had more.
Unless I am missing something this should be a slam dunk. Ignoring a shut gate and a no trespassing sign should be a bright clear line. A good lawyer should have no trouble handling this.
Can you please do follow ups on these cases Lackluster!
This is an ABHORRENT display of the TYRANICAL state of the police force. absolute shame on both of these officers. SHAME. SHAME. SHAME. The sgt deserves to never own a badge or gun again. The bafoon newby deserves to be filling out paper work for the rest of his life.
BABOON OR BAFFOON...INTERCHANGABLE JUST CALL THE N WORD, NUMB NUTTS
This is the new America. If this upsets you just wait till Biden is re elected. Your Freedom will be gone.
He literally READ his rights to him saying he has the right to remain silent, and it still doesn't register LOL these cops are a JOKE
Sgt Hudson no longer works for the department. From what I gathered from the dispatcher he was fired.
As he should be
Doesn't mean he's isn't already working at another department. Just like how the Catholic church shuffled around their pedo priests
Did he lose his certifications? He doesn't need a badge or gun.
WITH THIS LEVEL OF STOOPIDITY I BELIEVE HE WAS PROMOTED TO THE HIGHEST LEVELS OF LAW ENFORCEMENT-- WHY WASTE THIS TALENT !!! ??
I’m sure he’s already working for another department
Hudson doesn't understand that he had to prove the person is trespassing. The suspect doesn't have to prove anything.
Judson is also unaware of Houston v. Hill for verbally abusing an officer is NOT a crime.
I bet Hudson can tell you what a #3 meal at Popeyes gets you, though.
And unless the PROPERTY OWNER expressly says this person is trespassing. Police can't trespass anyone from private property just because.
Even without the case law, we have a right to redress grievances, thats apart of the 1st amendment.
"I have the freedom of speech." "No you don't." WHAT!!!??!😮😂
💥💥💥All those officers need to be put on the "BRADY LIST!!!" Sorry you and your dad had to go through this crap. It's such a shame.
They should be in prison for 20 years.....
If this isn’t a retaliatory arrest, then what is?
It's funny that the tyrant said "this doesn't have to be this hard" arresting someone for trespassing when he is trespassing is so amazing
I like the way Hudson is screaming like a teenage girl and telling the land owner to calm down!! What a pathetic clown Hudson is
These things are not tyrants....
THEY ARE TREASONISTS....
@@johnmurphy5293 can't they be both?
The crazy part is that he doesn't have the ability to trespass someone off of private property. The property owner is the one who has to trespass them. This is pure blood boiling insanity from beginning to end. There are a dozen laws this cop broke and a dozen violations of this man's rights. I'm fuming!
@COTTFLIXdoesn’t take much brain power to be right, these dudes are traitors
Watch at 22.57 minutes in when the old Guy says "That's all you could get me for? Hudson's ego kicked right back in and he said "No Sir, I can give more if you LIKE!" Wow. Then the Supervisor cuts in and and takes charge, finally. Hudson just couldn't help himself, his ego had taken over. Scary!! We are not even safe on our own property from ego maniacs Cops 😮
And now our tax dollars will pay for the inevitable court costs and settlement! End qualified immunity now!
Yep excellent observation.
Tax dollars will still be paying for it without qualified immunity.
"I didn't know y'all was owners!"
After being told only a million times.
The $$$ should come out of the officer's pocket not the tax payer
I hope they sue them and that tyrant is sacked.
Officer Hudson is out of control! If he still has a job the whole department should be sued for millions.
The entire department is black. All racists. All hate whites.
This is just the beginning folks. Better wake up and start protecting yourselves and each other.
This is setting up for South Africa 2.0 in the States. Think I'm crazy? Check back in a handful of years
But really aren’t they all?😢
Sergeant and supervisor after 2 years of being an officer. Low in verbal skill. almost as if they promoted due to....
I would sue the living hell out of these boys officers they wouldn't have a job and then they would owe me money his truck driver's license out of wallets after being told no search or seizure from both of the gentleman is trespassing on their property they have already told him that they already landowners he has no rights to be there him being a police officer does not matter at that point
Why is it so impossible to expect honesty and integrity from American law enforcement?
Somewhere in this lawsuit should include these cops being fired for not knowing how to do their job
They are mentally unfit for public service.
That should be the main part after the millions.
If they would do that, there wouldn't be (M)any cops left, as none of them do know their job, they are LEOs that don't know the law, how crazy is that ?
