You’d be right. Gotham canonically is in New Jersey, and the death penalty isn’t a thing there.
It's not there because they probably keep rebooting the fucking DC universe. 😂
I mean they literally keep all villians in ONE prison when either they can A. Move them to a different location to be executed or make sure they don't all get lose in one spot where they can team up or B. have them in higher technology traps that would kill anyone if they try to escape

The way I view it, All Batman really needs to do is subdue him and the state can put that fucker down. Batman has his reasons for not killing but the state sure as hell doesn't. If the man consistently breaks out, is deemed as insane, and has shown no signs of changing his ways, the state should have put him down years ago. Or hell, why not one of the many police officers, victims, or other heroes gone out of their way to kill the bastard. Why must Batman be the one to dole out the punishment when there are so many other ways it could be done?
Although, the amount of times Batman has saved the joker from dying is pretty dumb. I personally prefer adaptations where Batman lets Joker kill himself due to the folly of his own actions

He removed his face and then disappeared for a number of years, before he left he set up his face in a place that would be easily seen by the people of Gotham, both of these things his severed face and his inactivity among Gotham together would make people including the bat family belive that the joker had been killed thus he was no longer a threat to anyone, after a few years when the bat family the people of Gotham and all the other criminals would have essentially forgotten about him he would the show up out of no where, this would catch every one by surprise and oft gaurd while also freaking then all the fk out as they have essentially all just randomly been jumped by a resurrected faceless phyco path who's been dead for the past 9 years

Everyone talks about Batman’s plot armor but no one ever mentions Joker’s plot armor. This dude escapes a maximum security insane asylum like it’s made of wet tissue paper.
I mean every major villain can break out of it.
The dude has had plot amour from the start. His first comic book appearance was meant to end with him dying from a huge fall, but somebody on staff saw this and said “Nah, we’re onto something here.”
They added some extra panels last minute showing the Joker had survived the fall and escaped.
Everyone does, escaping Arkham is easier than getting in

Yeah this was one of the worst comics I've read. Just so overboard in every way. I do think that it has some really cool artwork with the face removed, but it's beyond over the top with the actual story.

The batfam didn't have their faces removed, it was made to seem that way just before the bandages were removed, it was a psychological tactic joker used to mess with Batman's mind because he thrives on pushing Batman to the edge of insanity. Batman: I refuse to kill the joker because of my code even though I know he won't ever change and letting him live would be the death of many others.
My morale code over everyone else life, seems a fair trade.
Batman believes in rehabilitative justice. Most "comic fans" don't actually understand the world of Gotham and Batman, riddled with corruption from bottom to top with the only people trying to bring justice and balance to the city and its people being the Bat family and Commissioner Gordon. Having the criminal's go through the justice system and inevitably go to Arkham is the only option Bruce has since its not his place to kill them or detain them himself. His goal is for Gotham to have at least one person fighting to keep it from collapsing into lawless chaos and part of that is having faith in the institutions of justice and law even if they may fail because it at least resembles civilized society. Many of the criminals of Gotham are victims of the cities curse and its not Batman or anyone's place to punish them further than the suffering they already endure that forces them to criminality.

Rehabilitative justice may work for some, but it obviously never would for monsters like The Joker. If he is going to fight for Gotham to be safe, then that should include the willingness to put down the purest of evil. Regardless of what may have driven them to crime. Also, please explain why he goes out of his way to save The Joker from dying at the hands of others? It would not violate the no killing rule? Just admit it. All it is, is bad writing as an excuse to keep printing infinite copies. On top of that, it gets incredibly repetitive. I am not even asking for Batman to become like the Punisher or anything. Just for him to stop having the dumbest moral code possibly in all of comic books. We have seen it over and over and over again for decades upon decades now. The franchise is at its best when it puts a spin on it.

I font think you seem to understand how these comics work in an interconnected fashion or even the origins of these characters, which is okay, like I said most people who think of themselves as comic fans don't actually know a whole lot about said comics.
The Joker is a victim of his environment at the end of the day. He is the literal personification of the failures of Gotham and its systems, a regular Joe who fell victim to the failures of Gotham forcing him to criminality. He wasn't born evil, he isn't the literal embodiment of evil, that's Darkseid, he's the personification of Gothams chaos that Batman fights both physically and metaphorically. To kill the Joker would symbolize just giving up on Bruce's sense of justice and his faith in civil institutions. Killing Joker to relieve Gotham of the chaos would signify a greater compromising of his morals and beliefs, because if he's willing to just kill one person, a victim of the curse of Gotham, to try and put an end the the chaos and corruption of Gotham, why not take the easy way out and kill every other criminal extrajudicially? Doing so would mean he no longer has faith in civil institutions, and whatever Bruce will is the "correct" way to do things, meaning there really is no possible order in Gotham, just either chaos or the arbitrary whims of the tyrant Bruce becomes by losing faith in his belief that its unjust to kill the victim of a cruel and corrupt system just because their actions thereafter are harmful.
