Age is not relevant regarding wearing a personal floatation device. Anyone who is not wearing an appropriate attire, for boating risks drowning after somehow ending up in the water. Not everyone is able, or knows how to swim, and if a passenger, or boat operator knows, and is able to swim then I think they would still be risking their own lives if they are not wearing a personal floatation device.
I think you asked an easy question. It is the captain who should be held responsible, for the child's safety, and mother's safety as well. However, safety is not an issue that many people take seriously as you can see on your video.

When crossing a bar or inlet nobody on the bow or in the cabin. Children under 12 have to wear life jackets. The skipper is fully responsible for all the people onboard and can face criminal charges.

It is extremely rare to see a person on a boat without a life jacket in South Africa, This applies to both inland (dams and lakes) and sea boating, and to both children and adults. If a Third World nation understands this, I'm not sure why Americans don't.

I checked prices, a good one can be had for about $100. That's for one that auto-inflates or manual inflates. A recharge kit is about $25. If that is too much to spend to keep your kid from drowning, the bulky old style are still available for less. That's like driving a car with a baby in your lap. Tragedy is coming sooner or later.
