    A MATTER OF RIGHT; EXCEPTION all person in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognizance as prescribed by law or this rule.
    (a) before or after conviction by the metropolitan trial court, municipal trial court, municipal trial court in cities, or municipal circuit trial court and.

Based of what i watch under Section 4 of rule 114, all persons in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognizance as prescribed by law or this Rule. When the time that you can bail, before or after conviction by the MetroTC, Municipal TC and in cities, or Municipal Circuit TC. Kapag ang kaso naman ay nasa Regional Trial Court everyone has right to Bail but not in all cases mostly after of conviction and the offense not punishable by death, reclusion perpetua or life imprisonment

    (a) to be presumed innocent until the contrary is proved beyond reasonable doubt.
    (b) to be informed of the nature and cause of the accusation against him.
    (c) to be present and defend in person and by counsel at every stage of the proceedings from arraignment to promulgation of the judgment.
    •Trial in Absentia
    •Appear without counsel
    (d) testify as a witness in his own behalf but subject to cross examination on matters covered by direct examination. His silence shall not in any manner prejudice him.     Good day po Atty I learn today is all about RULE 114 “Bail, a matter of right” All persons in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognize as prescribed by law or this Rule. Before and after conviction is only applicable to MTC, if the case is on RTC before only because the the accused presumed innocent but the offence should not punishable by death, reclusion perpetua, or life imprisonment such as the offence of murder.

    Under Section 4 of Rule 114 of the Rules of Court, all persons in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognizance as prescribed by law or this rule. (a) before or after conviction by the MTC, MTCC, or MCTC and (b) before conviction by the RTC of an offense not punishable by death, reclusion perpetua, or life imprisonment. I also learned that bail can be done when (a) before or after conviction by Metropolitan Trial Court, Municipal Trial Court in Cities, or Municipal Circuit Trial Court, and cannot be done when (b) before conviction by the Regional Trial Court of an offense not punishable by death, reclusion perpetua, or life imprisonment.

    * The granting of bail is usually considered to be an inherent right. However, there are certain circumstances where bail may be refused.     Rule 114 of Revised Rules of Criminal Procedure.
    Section 4. Bail, a matter of right; exception. - All persons in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognize as prescribed by law or this Rule.
    ✓Bail is our right in all cases because it is under in our constitution but there are exemptions.
    (a) before or after conviction by the Metropolitan Trial Court, Municipal Trial Court, Municipal Trial Court in Cities, or Municipal Circuit Trial Court, and
    ✓ You can post bail before and after your conviction, if you are in a lower level trial court or if you are in a lower court such as the MTC or Municipal Trial Court.
    (b) before conviction by the Regional Trial Court of an offense not punishable by death, reclusion perpetua, or life imprisonment
    ✓If the case is in the RTC, bail can be posted if the penalty in the case is not death penalty, reclusion perpetua or life imprisonment. And the accused must have bailed before he can be convicted.

    I've learned that the bail of matter of right under the rule 114 section 4 that everyone has the right to get their case release on bail specially when they are innocent. The bail is no longer eligible for bail in other cases.

    The General rule based on the Constitution with regards to Bail as a matter of Right, all person is entitled to bail from all cases filed before him. However, according to Sec. 4 of Rule 114. Bail, a matter of right; exception. - All persons in custody shall be admitted to bail as a matter of right, with sufficient sureties, or released on recognizance as prescribed by law or this Rule.
    a.Before or after conviction by the Metropolitan Trial Court, Municipal Trial Court, Municipal Trial Court in Cities, or Municipal Circuit Trial Court
    - Bail is a matter of right when before and after conviction if the case is in the first level courts. However, in cases such as Homicide, which in the jurisdiction of a Regional Trial Court, bail is a matter of right. But not all cases filed in RTC is eligible for bail.
    b. Before conviction by the Regional Trial Court of an offense not punishable by death, reclusion perpetua, or life imprisonment.
    - Filing for bail after conviction is not feasible. Under paragraph B, bail is only a matter of right before conviction as the accused is presumed innocent until proven guilty. However, if the punishment is reclusion perpetua, life imprisonment, or death, bail is not a matter of right even before conviction (e.g Murder). For cases such as Homicide which the punishment is only Reclusion temporal, bail is eligible.

What about po Kung Ang Isang convicted case nag fall under carnapping ( kc motocycle po Ang involved) napatunayang Hindi nakaw but Hindi naisauli sa oras kc cnanla at dna po natubos, pwd pa po ba ito mag bail. Naka file na po Ang apela sa Mla. At sa masbate RTC ito dininig. Sana po mapayuhan nyo ako atty.Maraming Salamat po.. More power po sa channel nyo na sadyang nakapagbbgay ng kaliwanagan patungkol sa ating batas. 👍👍👍☘️☘️☘️
