help the charged officials to get away with lapses/misconduct committed by them.Many cases fail before the Courts of Law just because of the defective framing of charge-sheets. Can new evidence be relied upon in the disagreement note by the disciplinary authority after completion of Inquiry proceedings which was not adduced during IO/PO stage? The new evidence was never part and parcel of the Charge Sheet. You are requested to provide your valuable opinion citing rule and the Supreme Court Order that whether the Disciplinary Authority can use new evidence after conclusion of IO’s report.
