The issue with the rights is that HW has to agree to the sale (as Kev says), or be forced to sell by order of the Court during his lifetime. If he is willing (or if his estate is willing to sell once he has passed away), I'd happy donate a couple of hundred dollars to the cause for him to recover the rights.
Funny this showed up on TH-cam, I asked him the question. It was so cool meeting him and seeing just how down to earth he is. I hope the announcement of Dogma Remaster suggests he may have made some headway in getting the rights back.
Kevin Smith is such a legend and a great story teller. I think he and Sylvester Stallone have something in common here. Sylvester Stallone doesn't own Rocky because Producer Irwin Winkler bought the rights. Stallone is really pissed about it. Just like with Kevin he's in a situation where his pride and joy movie is not owned by a Studio but by an individual who won't give it up. Who are these jackasses and why is the industry still tolerating them?
You're right that they're similar in principle, but the difference is that the Rocky IP is still worth a fortune. They're still making movies that make hundreds of millions of dollars under the Rocky license. IF we assume that Stallone is offering fair market value for it, then maybe Smith's situation would be similar. Fair value would be a HUGE number because Rocky movies probably do well in streaming and will most likely be remade at some point in the future for potential billions in box office. So the Rocky IP is still staggeringly valuable and therefore a huge asset for Winkler, who is very near the end of his life. I'm sure he's plenty rich, but that license is a tremendous asset for his estate in terms of future earnings. He produced a lot of prestigious and lucrative films in his career, but those streaming residuals and redistribution payouts are small potatoes compared to Rocky's potential future. It's also a part of Winkler's legacy as a producer. The people that took a chance on that movie with Stallone as the lead ALL contributed to maybe the biggest underdog film of all time. Of course it's nowhere near as personal as it is to Stallone, but it's very meaningful to Winkler, too. Stallone is also an old man now and likewise thinking about his legacy and his family's financial future, but Winkler is in his nineties I think and despite a storied career he's most likely nowhere near Stallone in terms of wealth. That Rocky license could take care of his family for generations, and is rightfully his. I sympathize with Stallone's position. Of course it'd be great if he owned it, but that's the way the business works. He sold something to set himself up for a bright future in Hollywood, and that proved to be a worthwhile sacrifice. He became a colossal superstar on the back of that movie and made hundreds of millions of dollars. It was in no way a bad deal for him. Quite the contrary. What Winkler did is what producers do. They gamble on small films becoming big films, and the enormous successes are what earn them their reputations and money. Plenty of those gambles don't pay off and many lose money. He bought Rocky fair and square and was a big part of its initial success. Should he part with it now IF Stallone offered him a legit fair deal (which, again, would be HUGE money)? Sure, it would FEEL like the right thing to do, but his family would almost immediately lose a large chunk of that money in estate taxes. The most sound thing for his family to do financially is to wait until he passes before selling it, and maybe that's the plan. We have no way of knowing. What's going on with Dogma is entirely different in that way. Dogma earns no money as it is now. It's not available to stream for profit anywhere and is most likely not in current print for physical purchase. And if Smith bought it and made it available, it wouldn't be a huge earner for him. What he says about Weinstein is spot on -- he's holding the movie hostage just because he can. He has nothing to gain from it except whatever feeling he gets from saying no. I'd bet his beneficiaries will sell it when he dies, which shouldn't be long. Unless he puts something in his will that prevents it, which I wouldn't put past the prick.
I don't understand your annoyance. Someone buys something, be it a car, a house or music and film rights... once they buy it, it's theirs. Why should they sell it to anyone else? Buy a painting from a shop, it's yours. Later on, he artist becomes famous, and your painting is now worth millions. Does the shop have the right to claim it back? Just because you don't like the owner, if it's bought legally, it's tough luck.
@@another3997 Not the same thing at all. This is about copyright not ownership. To buy a franchise from under the creator and them do nothing with it is just a dick move. This is why The Fantastic Four had such trouble in movies because people were holding the rights with no intention of utilising them. It's like when supermarkets buy land just so no-one else can put a supermarket there. Or when a jealous Ex kills their former partner so no-one else can be with them. It's just controlling and spiteful. Why buy the rights to a movie and hold on to them when you're NEVER going to use them? Because you're a control freak. It's not even an Investment because No-one's making money on it.
Love a lot of Kevin's work, Dogma in particular. It does baffle me regarding the various bankruptcy types in usa, when despite compensation awards by a court, someone can hold on to assets like this.

I never thought I'd say this but thank goodness for Harvey Weinstein. Kevin Smith is an over rated hack, Dogma is his only good movie and we _definitely_ don't need a sequel. Especially when like half the cast are dead or washed up.
This movie was like a fever dream for the longest time..I even remember being little and replaying Jason Lee’s scenes over and over all because he was the voice of Syndrome lol
Anybody else made uncomfortable by the fact that if you put a goatee on Harvey Weinstein he'd look uncannily like Mister Brownstone from the Kevin Smith comic "Spider-Man/Black Cat: Evil That Men Do"?
@@thehellyousay It sure as hell wouldn't surprise me, but the truth is, I don't know. The story was first published between 2002 and 2006, and the Weinstein Company was listed as one of the production companies of record on the 2008 film "Zach and Mary Make a Porno" which was Smith's eighth collaboration with the Weinstein brothers. So, when Bob Weinstein's older brother Harvey is suddenly revealed to have been actively propositioning and/or raping women for the majority of the time that Smith had been working with him, I do look at a story like "Evil That Men Do" and wonder if Smith might have known more then he's admitting to publicly. I mean, according to Robert Rodriguez, Rose McGowan told him that she'd been sexually assaulted by Harvey, and that this was what drove him to hire her for the 2007 film "Grindhouse", so that Weinstein would be forced to pay her some kind of financial compensation under the guise of an actor's salary. And Smith and Rodriguez know each other, so accusations had been leveled at that point, just not legally. But who knows what he knew.
I can’t believe Kevin Smith has so little money after all this time and I can’t believe he doesn’t think dogma can make back millions of dollars on streaming or whatever
5:50 he hit the nail on the head without even realizing it. THAT is the reason harvey wont sell for any amount. Hes not holding out for more. He doesnt want to sell the asset because then the money would be paid to his victims. Not selling is just one more way he can hurt them.
I buy a lot of movies. Been buying a lot of movies for over 20 years. One of the few times I can specifically remember buying a specific movie is Dogma. 2-disc special edition, because the one guy working at the Sam Goody at the mall was so eager to sell it to me that while I was looking at it he sidled up next to me and handed me a coupon all "hey, you were gonna use this, right?" To this day it's one of the dvds I'll likely never get rid of, even if I find a blu ray copy of it somewhere. Maybe if this situation ever gets cleared up and there's a nice 4k release that has all the same features, but it'd take nothing less than that for me to part with my copy.
In June 2024, at a Smodcastle Theater screening of Clerks: The Animated Series, Kevin Smith announced that he had finally purchased Dogma from Weinstein. No details on a re-release were give, but Smith followed the claim saying he has written Dogma 2 and it will star Justin Bieber and Ralph Garman.
Dogma and WKRP are two of the best entertainment properties that ended up being permanently messed up by the business dealings behind the scenes. Very sad but Kevin is right not to pursue it further.
I have a feeling even without Harvey picking up Kevin's first movie.. we would still have found out about Kevin's talents.. movies, TV, even stand up, he would have made it

Crowd funding is a thing. How about contacting Harv's "lawyer" and asking what ARE the conditions of the release of Dogma. Then crowdfund that ransom. You can offer Executive Producer credits for the production of the Blu-ray or 4K release. Heck, you can do a small video shout-out to people who donate thousands or more and have that be an intro to the movie on the disc.
Dogma will always be one of my favorites. I don't keep up with anything Hollywood, I could really care less what's behind the curtain. I am here to be entertained. Saying that, I had no idea about the prisoner owning the movie. I just remember wondering why I never saw it on TV listed and also why was it so hard to get a better quality copy beyond DVD. I later found out why. Thankfully, I found a great copy that wasn't way out of reach.
I think he's underestimating how much Dogma could make back. It hasn't had a physical release in over 15 years. You give that a remaster with a full 4K release with collectors & steelbook editions and I'd be willing to bet it makes back $5M. Especially if you do that all leading up to a sequel with an eventual 2 film boxset.
I remember when the shooting script for Dogma got shotgunned all over the internet and I couldn't believe that pile of crap actually was given money to go into production

@@RiggsBF yeah luckily for people that want to see it this doesnt really impact it. digitally it survives, its just for the rights to make a sequel or to get a licensed dvd it is not quite as easy.
Well, there's one way we can do this. We take it back. Then Kevin can say, "see how much you already lost out, these cats are pirating it like crazy because you didn't want to go for the 500k."
Bro said ‘watch it on youtube,’ that’s inches away from yarrrr
@@gateauxq4604Inches my ass, that's literally yarrr
Thank you for posting this!!
Thankfully I still have my dvd of it. I’m impressed with his integrity in this and really hope he prevails in getting it back. One of my favorites.
Kevin Smith went from safe edgy to establishment schill. He has probably been on the island.
Whattttt????
Dogma is one of his best movies, that is why I bought the DVD.❤️❤️❤️
He got the rights back!!! Yes
Amazing .... thank you for sharing this.
Thank you for posting this. What a wonderful explanation and statement of his position. I truly hope he gets the rights back properly, one day.
Kevin Smith shouldn't be allowed to touch shit after the abomination he calls Masters Of The Universe.
DOGMA is my favorite movie of all time. It's CRIMINAL that the whole world can't access it 24/7 !!!!

Free to watch on TH-cam!
It's here
Thanks for posting this. Long time Kevin fan... looooooong time Ness fan. Peace
Everyone knew about Weinstein's behavior, including Smith. But they kept working with him regardless.
That leads to a bit of a conundrum regarding how involved HW was with every movie with a Mirimax label on it, since they were also a distribution company.
I could see that Smith, or Tarantino, being way more involved in all the casting and producing side of things, than a movie like Good Will Hunting.
Gervais nailed it at the Golden Globes - ' our next presenter starred in Netflix's Birdbox, a,movie where people survive by acting like they don't see a thing.... sort of like working for HW
Y’know, I keep participating in capitalist culture, knowing it’s killing the less privileged. I keep buying takeout in plastic and I’ve begun wearing makeup again, knowing the damage plastics and microplastics do to ALL living beings.
I can’t know KS’s level of awareness and justifications, but everybody’s just human, f’ing up like humans do.
Kevin is a national treasure. I'm really glad to see him doing what he loves.
Had the pleasure of meeting him at a con a couple years ago. I'm very happy to say that he is one of those celebs that is exactly who you hope they will be.
I need to find that pristine 4k TH-cam copy asap!
The Blu-Ray version is extremely rare. It's about $100.
@@leemires5315Haha lucky for me my mom bought one Without knowing what it is and then I inherited it because she doesn't buy much Blu-rays & has really no interest in them. So yeah I have DOGMA on Blu-Ray.
Drink up me hearties yo ho
@leemires5315 bought 2 disc special edition 4 months ago
Well being that you commented on TH-cam you're half way there! Just keep swimming...
I still got the SE on DVD
I've got the blu ray. Very happy to have made that impulse buy way back years ago when I worked for Best Buy
Same, I also have the blu ray. I didn't really think they would go OOP.
still have a well-used vhs that still works perfect. we just watched it again 2 nights ago
Dogma is up on TH-cam, the full movie.
I bought a dvd of Dogma at a yard sale for like $1.00 years ago, and I still have it. I rewatch it like once a year. LOVE that movie.
I saw the sequel to Jay and Silent Bob Strike Back… It’s probably for the best that Dogma doesn’t have a Dogma part 2.
I own one of the original DVD copies of Dogma. My wife and I have had people ask to borrow it over the years and we immediately say NO
I love that man.
I met him at the Clerks 3 premiere in San Diego. Fucking legend. The only celebrity I follow intently.
I saw him in St Louis at The Pageant when he was touring that Jay & Silent Bob Reboot. He told that story there too.
It’s a damn shame he can’t get his own movie back.
I copped 2 Blu-rays of Dogma @ a used record store a few years back.... No lie. I'll flip one in a heartbeat lol. They priced them @ 10-12 dollars @ the time...
This is some real raw stuff. Good form, Mr Smith. Good form.
And this is why piracy is sometimes moral.
How could this not fall squarely into the definition of an incarcerated felon being allowed to continually profit from his criminal enterprise..?
You think Dogma makes money?
Weinstein isn't profiting from it.
Owning a movie isn't a "criminal enterprise" 😂
Wow, I feel genuinely lucky to have found a used copy of Dogma at 2nd & Charles!
Kevin Smith is awesome. I love that he said “I would know and I need to look in the mirror every day”. So many people seem to be okay with shady crap as long as they can hide it. If you are a good person you can’t hide shady crap from yourself and that should be enough NOT to do shady shit.
One of my fave films ever. As much as I’d love to see a part 2 of Dogma Kevin has done the honourable thing by refusing to allow that criminal to be associated with the movie any further. Gotta love Kevin ! ❤
Kevin Smith and Rob Zombie should get together and make a very, very, very, very, very, very terrible movie together.
Kevin Smith is a fucking king🔥🔥🔥
Linda Fiorentino is the only memory i have of that film.
They all worked with him but nobody knew anything.
Riiiiiiiiiiiiiiiiight.
This is so sad. It's my favorite movie
Just wait until he gets offed in prison, then send the lawyer the $250k offer again.
Kev keeping it real as always. Love this man.
Love a lot of Kevin's work, Dogma in particular.
It does baffle me regarding the various bankruptcy types in usa, when despite compensation awards by a court, someone can hold on to assets like this.
Harvey is 77 years old and he won't get out of prison until 2043. There is no way he doesn't die in prison.
Based on his recent "creative" endevors, it's a good thing he can't ruin his old movies.
Glad I own the 2 disc special edition.
Can I borrow it
Kevin Smith is just amazing man, full of creativity,
We miss yall! Clerks 3 was sad AF homie
Who tf watches Clerks 3 especially after II? I didn't even know there was a 3. II was one of the worst things I've seen ever. I'd rather watch 2G1C.
Yeah, but that's life for some people. Some parts of life are a real dick punch. I'm going through that part right now, so I can relate to it. Funnily enough, I actually really like 3.
Edit: and then I re-watched 3.
If you don't like clerks 2 you stink
I never thought I'd say this but thank goodness for Harvey Weinstein. Kevin Smith is an over rated hack, Dogma is his only good movie and we _definitely_ don't need a sequel. Especially when like half the cast are dead or washed up.
This movie was like a fever dream for the longest time..I even remember being little and replaying Jason Lee’s scenes over and over all because he was the voice of Syndrome lol
I love Kevin!!! And I support his choices on this matter. Maybe it will eventually work out.
Let's hope Harvey gets shived in prison. Dogma was a great movie and I would love to see a sequel.
Kevin signed my blu ray copy of Dogma “Fuck Harvey Weinstein “. I treasure it
Only good thing, Weinstein has ever done.
Dogma doesn't need a fucking sequel.
Kevin Smith sucks shit with these Sequels.
Well thank god for harvey weinstein for preventing kevin smith from ruining Dogma by creating an unneccessary sequel likely staring his Daughter
Anybody else made uncomfortable by the fact that if you put a goatee on Harvey Weinstein he'd look uncannily like Mister Brownstone from the Kevin Smith comic "Spider-Man/Black Cat: Evil That Men Do"?
you don't suppose he's who the character is modeled after, do you?
From Silent Bob to Barely Audible Bob...Progress I suppose...
I can’t believe Kevin Smith has so little money after all this time and I can’t believe he doesn’t think dogma can make back millions of dollars on streaming or whatever
He's selling Dogma for Ramen Noodles and Honey Buns.
5:50 he hit the nail on the head without even realizing it. THAT is the reason harvey wont sell for any amount. Hes not holding out for more. He doesnt want to sell the asset because then the money would be paid to his victims. Not selling is just one more way he can hurt them.
Good he can't touch Dogma. It was the best movie he ever did
This doesn’t change the fact that he ruined He-Man.
Well, thanks to Harvey, at least one movie is never gonna be ruined by a sequel.
Kevin is the most integral man in Hollywood!
I am so glad I bought the deluxe 2-disk DVD way back in the mid 2000s. I heard physical copies cost a fortune, now.
And this is why I’m glad Dogma is so easy to find, in full, on YT. F**k Harvey! Watch the film on here!!! 😂
He's in jail. Give $5000 to a shot callers family, then offer $100,000 again
Dogma and WKRP are two of the best entertainment properties that ended up being permanently messed up by the business dealings behind the scenes. Very sad but Kevin is right not to pursue it further.
It's a shame, because Dogma is my all-time favorite Kevin Smith movie.
That woman yelling out who thinks he’s having a personal conversation with her.
I have a feeling even without Harvey picking up Kevin's first movie.. we would still have found out about Kevin's talents.. movies, TV, even stand up, he would have made it
we need more Kevin smith. masters of the universe was really good. I like how he stayed off the I hate starwars bandwagon. that makes him the only person on TV that agrees with me about it. that's weird.
“No one will ever know,” “but I will know,” has there been a time where Kevin Smith had some juicy gossip on anyone and didn’t talk about in front of a crowd. We would have found out.
“I won’t do it if he’s connected to it!” We know Kevin. Enough with the clapter.
That's gotta fucking suck knowing your best film is owned by a total monster.
Gotta suck knowing that when he needed the money he only had good things to say about him.
Im glad i own a copy of Dogma... People are selling them for ridiculous amounts
Cant be from Jersey and not Love Kevin Smith!
One reason why I kept quite a few DVDs
I love Kevin and i love that he didnt give into the d bag i hope one day he gets it back but am glad he stood up for what he believes in and what is right.
Loud Kevin is my favourite of Kevin’s characters right behind Silent Bob
It sucks. It's the first kevin smith movie i ever watched and i love it. Complete shame people are missing out on this
